Planning Awareness Week!<br />

In 2008 the National<br />

Association of Estate<br />

Planners & Councils<br />

(NAEPC), in conjunction<br />

with Rep. Mike Thompson<br />

(D-CA) and 49 of his colleagues,<br />

co-sponsored and<br />

helped pass H. Res. 1499,<br />

which declared the third<br />

week in October National<br />

Estate Planning Awareness<br />

Week.<br />

This means that in 2012,<br />

National Estate Planning<br />

Awareness Week falls on Oct.<br />

15 through Oct. 21.<br />

Did you know:<br />

<strong>The</strong> majority of<br />

Americans over 65 are totally<br />

dependent on their Social<br />

Security checks. With proper<br />

knowledge and planning,<br />

future generations can have a<br />

more secure retirement.<br />

It is estimated that over<br />

120 million Americans do not<br />

have an up-to-date estate<br />

plan to protect themselves<br />

and their families, making<br />

estate planning one of the<br />

most overlooked areas of personal<br />

financial management.<br />

With advance planning,<br />

issues such as guardianship<br />

of children, managing bill<br />

paying and assets in the<br />

event of sickness or disability,<br />

care of a special needs child,<br />

long-term care needs, and<br />

distribution of retirement<br />

assets can all be handled<br />

with sensitivity and care, a<br />

reasonable cost.<br />

<strong>The</strong> majority of<br />

Americans lack the ability to<br />

adequately plan for their<br />

retirement. This can be<br />

changed immediately with<br />

knowledge and the right<br />

planning tools, such as living<br />

trusts, pourover wills,<br />

advance health care directives<br />

and irrevocable life<br />

insurance trusts (ILITs).<br />

Many people mistakenly<br />

believe that since they aren’t<br />

“rich” they do not need to do<br />

any financial and estate planning.<br />

Estate planning is not<br />

just for the wealthy and is<br />

important for everyone. This<br />

attitude can be financially<br />

harmful in the long-run and<br />

can be avoided with proactive<br />

action.<br />

You care deeply about<br />

your family and you want to<br />

ensure the assets you have<br />

worked so hard for will go to<br />

them when you die.<br />

How much of your estate<br />

will go to taxes and attorneys?<br />

How much will be left<br />

for your heirs?<br />

Your estate plan determines<br />

the answers to these<br />

questions. <strong>The</strong>refore, it is<br />

imperative that you take the<br />

time to consider which<br />

estate-planning options, such<br />

as living trusts, are available<br />

and which are best for your<br />

particular circumstances.<br />

<strong>The</strong> living trust may also<br />

be called a revocable living<br />

trust, inter vivos (Latin for<br />

“while living”) trust, A-B<br />

trust, or the double trust system.<br />

It is named the “living<br />

trust” because it is in effect<br />

during your lifetime and<br />

enables you to observe and<br />

control the trust, giving you<br />

the opportunity to alter or<br />

amend any provisions.<br />

This type of control is<br />

not possible with a will or an<br />

irrevocable trust. Remember<br />

that the living trust is a creature<br />

that is entirely dependent<br />

upon the words within it.<br />

Thus, it needs to be carefully<br />

drafted to contain the<br />

things you want and which<br />

are appropriate to you.<br />

Having a living trust<br />

means that, since all your<br />

assets are inside the trust,<br />

you do not hold title to anything.<br />

Since you have nothing<br />

in title in your own name,<br />

there is nothing to probate<br />

upon your death.<br />
