OUR
TEACHERS
Making a
Difference
Few people have a greater impact
in our children's lives than teachers.
Outside the home, teachers spend
the most time with our students day
in and day out.
Teachers are more than just educators,
they are often times confidants,
a shoulder to cry on and the first people
abused and neglected children
turn to.
But as their titles proclaim, they
are the ones who teach our children
— molding them into curious boys
and girls, confident young adults and
lastly men and women who contribute
to our community. Teachers
are the ones who inspire our children
to ask more questions, to look deeper
into issues and influence them to
become scientists, presidents, moms
and dads and even teachers who in
turn pass the torch to the next generation
of educators.
Being a teacher is often times a
thankless job, but one that we are all
thankful for. We all remember than
teacher who challenged our abilities,
who pushed us to do better. We
remember the teacher who stayed
after school with us
helping us with that
math problem we just
couldn't grasp. We
remember that teacher
who, at the time we
loathed for “making life
so tough.” But now we
look back and remember
them as the teacher who
made us do better, not only
in the class, but also life.
Today the Black Hills
Pioneer tells the story of six
teachers from Spearfish,
Lead, Deadwood and Belle
Fourche. But the story doesn't
end there. As the school
year draws to a close we honor
all of our teachers, the ones who
shape the future of our world.
And we thank them.
The dream begins with a teacher
who believes in you, who tugs and
pushes and leads you to the next
plateau, sometimes poking you with a
sharp stick called "truth."
SPEARFISH — School officials and
police say a crisis exercise conducted Friday
in Spearfish was a great success and learning
tool.
The exercise put Spearfish High School
and other district schools in a simulated
lockdown as police searched for an “unauthorized”
parent in the school.
“It went really well from what I saw,” said
Spearfish High School Principal Steve
Morford.
“We feel that we have a very safe climate
and culture within our school system, but we
always know that if we can tweak anything
to make it better, we will do so,” he said previously.
The exercise was conducted to test the
procedures of both the school and emergency
responders.
“Our procedures worked very well,” he
said.
He said there were some things that will
need to be improved on. A couple of classes
didn't relocate and there were a couple
“communication issues as far as how and
where we contact people,” he said. “I am
Photo
Saturday, May 1, 2010
looking forward to meeting with the police
on Monday to get their take on it.”
The scenario had a simulated parent enter
the school without permission. A teacher
witnessed the parent enter the school but
was unable to locate him. Police were called
and the school went into lockdown. Later a
student had breathing problems requiring a
trip to the emergency room. The suspect
then called the high school office stating he
had two hostages and demanded to see
another student. If he was unable to do so he
would shoot the hostages and release a
“white substance.” The suspect was spotted
and the school evacuated. Police were able
to arrest the subject and the hostages were
released.
Although it was only an exercise, it was a
realistic scenario Morford said. “The most
common school intrusion is from a non-custodial
parent.” He did not know national
numbers however.
He said he was pleased with how seriously
everyone took the exercise.
Had the situation been a real crisis, students
would have been evacuated to a site
off school property where parents would
have to sign for their children.
Boiler repairs at the
Deadwood Pavilion
DEADWOOD — The Deadwood Pavilion at 767 Main Street in
Deadwood will be getting a new boiler. City commissioners
approved $3026.00 for repairs, $550 of which the city will be reimbursed
from Skyline Engineering. “When we put those pipe lines
under pressure, the boiler gets a message to shut itself off. This
money will firstly soften the water, and secondly, stop the turbidity.”
DEADWOOD — The Deadwood city commissioners approved
Monday night to allocate $4,107.18 towards construction on the
Adams House Information Center roof in Deadwood. A portion of
this will be reimbursed by the city's insurance company due to hail
damage and fiberglass shingles that didn't hold up, said city Public
Works director jR Raysor.
It's fun and family-oriented event,”
said BINGO enthusiast Jamie Mulhair
of Whitewood. “I come here every
Tuesday. It is just a night to get away
and socialize with people.”
As John “Q” Lindstrom draws balls
from a hopper and calls out the chosen
numbers, people mark their cards hoping
to win the game.
Mulhair won once on Tuesday and
recently won a jackpot of $115.
At the far end of a table is a family
of four generations.
cevin Williams, his wife Patty
Williams, their kids, his parents and
his grandparents all took part in the
last games of the year.
“It's fun and something to do,”
cevin said. “It's a nice time to spend
with family.”
For the Williams kids, like the handful
of others in the room, it was the
one night of the week that their homework
would be done without question.
“There's a little more people here
than normal,” said Brenda Lindstrom,
a BINGO player and cash distributor.
On Tuesday, the last night of the season,
people decided to have a little fun
and dress as their favorite character.
Elvis was there. So were Dolly Parton,
Cleopatra, two Minney Pearls, and
more. Elvis won the costume contest
BELLE FOURCHE — Less than ideal weather
conditions have pushed the U.S. Highway 85 construction
project through Belle Fourche back four
days, but officials say it's nothing they can't handle.
“It's still going quite well,” said Bradley
Benson, the construction manager for Upper Plains
Contracting Inc. “We're a little behind because of
the weather and because the temperatures have
been low, but we've pre-planned this project
proving that - she in this case - still
remains king.
In its third year, the BINGO games
are also a fundraiser for the center.
“We're successful most every single
night,” Lindstrom said. “We turn
around and give most of it back, and
what we don't give back goes to the
senior center.”
Lindstrom said that when BINGO
officials wanted to bring the game
back to Whitewood they wanted it to
be family-oriented.
“I said 'lets make it cheaper than
going to the movie theater.' And we've
done it,” she said. “They can come
afford to do this. One person, for
$7.50, can play all night long.”
And the event is truly family-oriented.
The BINGO players have become
one big family.
“It is almost like Sunday church,”
Lindstrom said. “It has been really fun
this year because we have the entire
Northern Hills. Now we have a
Spearfish table, a Whitewood table,
people from Belle Fourche. Typically
anyone who visits us will come back.
With the season now at an end, more
than one BINGO player will long for
the hopper to be filled again.
“I won't know what to do now on
Tuesday nights,” Mulhair said.
BINGO will return to Whitewood on
Oct. 5.
enough that crews are still able to work and we
will make this up.”
Benson said one of the biggest things that
occurred this last week includes the near completion
of the storm sewer installation from Jackson
Street toward Lawrence Street.
“Next week we will be completely done with
the utility, storm sewer and undercut in that area,”
he said.
He also said that paving has been continuing
Spearfish kindergarten students were
shown the ropes by the big kids
Thursday, as the annual Kindergarten
true meaning of fun. From rope and
little ones could be seen doing what
they do best - simply having fun.
OUR TEACHERS
Physics teacher
makes quantum leap
to Teacher of the Year
BY JACI CONRAD PEARSON
!lac% H(lls *(o,eer
SPEA%&ISH — &rom a self-professed
penchant for P.E in high school
to Spearfish High School Teacher of
the Year and all things physics, Steve
Gabriel has certainly made quantum
leaps over the course of his high
school, college and teaching careers.
Apparently, he was also making
quantum jumps during his high school
years spent growing up in Iaramie,
Wyo. This physical science teacher’s
favorite subject in high school?
Advanced Placement Physical
Education.
“We had trap shooting, archery,
karate, scuba diving, rock climbing,”
Gabriel said. “During the spring the
best scuba divers did an open dive in a
lake and the best rock climbers
climbed three different routes on
Devils Tower.”
&ast forward to his modern-day passion
— teaching physics.
“Physics makes use of all the other
classes and you can understand how
and why things work the way they do,”
Gabriel said. “Physics uses mathematics
as its language of understanding the
physical world. Students with a background
of physics will be able to recognize,
comprehend and reason
through problems.”
Then rewind, just a bit, for the most
memorable experience of Gabriel’s
teaching career.
“When I was assisting Pat Gainey
back in 2000 as a chaperone with TWe
the People’ in Washington D.C., the
students were taking a half a day at
the museums bordering the
mall,” Gabriel explained.
“We were in the National
American History Museum
when I saw a familiar sight
... a Styrofoam box that
contained an ozone sonde
used in measuring atmospheric
ozone. The exhibit
was of Dr. Susan Solomon
and Dr. David Hofmann,
world renowned leaders in
Antarctic Ozone Hole
%esearch. I worked for Dr.
Hofmann at the University
of Wyoming 10 years prior
to this trip. The box on dis-
play was one that I had
made. My work is on display
at the National
Lead-Deadwood Industrial Arts teacher Jim Studioso prefers to work right alongside
his students, ensuring they learn the correct way to go about completing
their Industrial Arts projects. Pioneer photo by Jaci Conrad Pearson
Along with this honor, Gabriel has
earned many others, including:
Outstanding teacher Award 2000;
Who’s Who Among American
Teachers 1996, 2000, 2003, 2005;
Governor Janklow’s Technology for
Innovation in Education TIE
Technology Ieadership Award 1999;
and %ecipient of Mines Award,
South Dakota School of Mines
and Technology 1995.
Gabriel graduated from
Iaramie High School,
Building students up one
project at a time
Iaramie, Wyo., in 19b2. He went on to
earn both a B.S. in manufacturing technology
and a B.S. in industrial technology
Education from the University of
Wyoming in 1990 and 1991, respectively.
He also earned his M.S.T.P
(Masters of Science Teaching Physics)
from South Dakota State University in
1996.
IEAD — When students walk
through the double doors leading
to Jim Studioso’s Iead-Deadwood
High School Industrial Arts studio,
they might not know much about
machines or getting connected in
the community.
But by the time he’s through
building their construction knowledge,
consistently adding to those
fundamental foundations, they
walk out those doors much more
well-rounded men and women.
Studioso’s passion for teaching
students the ins and outs of how to
carefully construct things is driven
by a desire to enable them.
“It’s great to be able to show the
students how to build or design
something the
right way. I enjoy
helping them
develop lifelong
skills as they
work on their projects,”
Studioso said.
Successfully seeing those “ahaf”
moments written on students’
faces makes his mission even
more enjoyable.
“Seeing the look on the stu-
dent’s faces when they finish a
project they didn’t believe they
could do, and helping some of
them overcome their fear of the
machines,” are what Studioso
counts among the most touching
and memorable experiences of his
teaching career.
Contrary to what appears to be
his priority these days, Studioso
favored history and political science
in high school and he didn’t
necessarily want to be a teacher.
“It just happened,” Studioso
said. “I had a number of job offers
after college and the one I picked
was a very good job where they
gave new teachers lots of help and
encouragement, and I enjoyed it.”
In 2000, Studioso and %uss
Johnson received the South
Dakota Program of the Year for
the best sixth through eighth grade
industrial technology program
from the South Dakota Technology
Education Association.
He grew up on the East Coast in
the “small town” of Hopatcong,
N.J., spending most of his summers
on the family farm in
Wolsey.
Studioso graduated from
Hopatcong High School and went
on to attend Trenton State College,
located in Ewing Township, N.J.,
where he earned a BS in industrial
arts with a specialization in construction
and cabinetry in 19b0.
He then went on to earn a masters
in technology education in 19b5.

DEADWOOD * Lead-Deadwood
Elementary Math Recovery teacher
Pam Smith is on a militant mission of
the math sort. Determined that no
child should “fall through the cracks”
when it comes to math proficiency at
grade level, Smith has launched an
initiative that is sure to be an asset for
both students and teachers alike.
Pam Smith
Lead-Deadwood Elementary
“When I was in my early elementary
years of school, I struggled with
math. I liked school. I love to read
and really like history and science.
Math was not my favorite subject at
that time,” Smith explained. “A relative
of mine at the time, told me I
would never do well in math. That
made me mad. I spent the rest of my
school years and my college years
proving that person wrong.”
Smith said that math is the one subject
that you will hear many people
say, “I was never good at math.” It
can also the subject that will hold
people back from pursuing a higher
education.
“That upsets me because I feel all
children can learn math,” Smith said.
“It might take more time and different
ways of approaching the concepts, but
learning and growing can take place.”
Smith tries several different sorts of
methods, many home-made and inexpensive
to try and make math connections
that stick with students.
One thing that is consistent
is her passion for
kids to succeed.
“There is a lot of
research out there on
how best to teach math,”
Smith said. “It is an ongoing
process to keep up
with that research and apply
it to your own teaching. The
major shift in math education
right now is teaching
for meaning. Just
memorizing math
facts and algorithms,
doesn’t cut it anymore. The
students need to gain an
understanding of how numbers
work.”
Smith said her main goal is “for
children to love math, to feel proud
of themselves for solving problems,
and use that confidence in other
areas of their lives.”
“I also have strong feelings
towards how significant adults in the
child’s life talk to them about their
math performance,” Smith said.
“This goes for teachers and parents.
You can not be negative. The minute
you tell a student they are not Xgood’
at math, they will believe it. It may
take years or a lifetime for them to
overcome that. Encouragement and
positive statements can build that
child up. They need to believe in
themselves and then they will start to
relax and the learning happens.”
As Smith helps teachers and kids
both battle the negative stigma math
often carries, she’s learned the process
is very rewarding.
“It touches your heart when a
child gives you a hug, asks how
your day is going, or tells you
thanks for working with them,”
Smith said. “The best, however, is
when they get a huge smile on their
face after something Xclicks’ for
them and they finally get it.”
Students were almost never blessed
with the Deadwood native’s all-out
war on them not knowing basic math
concepts.
“My parents owned several businesses
when I was growing up and I
thought I would run my own business
someday. It wasn’t until my daughter
entered kindergarten and I volunteered
at the school, that I realized
how much I loved working with children,”
Smith said.
She attended elementary and junior
high in Deadwood, graduating from
high school in Lead. She earned a
Bachelor of Science degree in
Business Administration from Black
Hills State University in 1988. She
earned an elementary education certification
from BHSU in 1996.
Smith was honored to be named the
elementary teacher of the year in
2006-2007.
Main Man Mead
Not one great lifetime
achievement, but hundreds.
BY JACI CONRAD PEARSON
Bl#$% Hill) Pi+,--r
SPEARFISH * True to form, 2010 South Dakota
Teacher of the Year Tom Mead, said he doesn’t have
just one great lifetime achievement. “This year, I
have 100.”
A middle school science teacher and mentor to
hundreds during the course of his career, Mead
explained that he is proud of many things in his
teaching career, but that his greatest rewards come
from his students.
“Impacting their lives in a positive way is what
matters most to me. Their successes, no matter how
small or large, are my rewards. When students
become something more than they ever thought they
could because of some small thing that I have done,
that is a reward,” Mead said.
Mead’s favorite quote comes from Henry B.
Adams: “A teacher affects eternity; he can never tell
where his influence stops.”
Case in point: when asked to point out the most
touching or heartfelt experience of his teaching
career, Mead describes as the most “heart-wrenching.”
“This was my first experience in knowing that
we as teachers do not always know what is
going on in the student’s home life so we need
to make school the safest and most trusting
place we can,” Mead emphasized, as he
shared the
following
story.
During his
student teaching
experience, Mead was
teaching a required curriculum
on AIDS/sex education and
asked the students write any
question they were embarrassed
to ask in class on a
sheet of paper and then
answered them privately.
One student’s question
was “Will anything happen
to your feet if you
wear your socks to
beda”
Tom Mead
Spearfish Middle School
“When I met with him privately he told me that
his little brother wore his socks to bed at night
because it was cold in their house. I told him no,
nothing would happen to his feet and then I asked
him where he lived,” Mead recalled.
The student confided that information to Mead
and after school that afternoon he proceeded to
drive by the student’s house.
“The front door was missing and all the windows
in the front had no glass in them, only curtains. This
was in November. I found out that this sophomore
was the person responsible for not only getting himself
to school but also was responsible for his little
brother. Getting him up, fed, dressed and transported
to school,” Mead said.
The support the student subsequently received
backs up Mead’s motto. “Be positive. A positive
attitude is a great asset in life. If you are not born
with one, you should do everything you can to
develop one,” Mead said. “You will be thrown many
curveballs in life and especially in the teaching profession.
We can’t necessarily change or control the
circumstances around us, but we can control and
change our attitude about them. A positive attitude
can help you cope with these in the best way
possible,” Mead said.
An advocate for his students to the
end, Mead even thought of them first
when asked what the favorite part of
his Teacher of the Year gift package
was. “I will enjoy the car and the
money but they will soon be gone
so I would have to say the
SMART Board interactive
whiteboard system will
end up being my
favorite gift, because
this package will
directly benefit the
students for
many, many
years.”
Tom Mead, 2010 South Dakota State Teacher of the Year, counts the hundreds of students he’s helped over the
course of his teaching career as his greatest individual lifetime achievements. Pioneer photo by Jaci Conrad Pearson
Teacher’s
‘idealism’
drives need
for students
to succeed
BY JACI CONRAD PEARSON
Bl#$% Hill) Pi+,--r
SPEARFISH * As her big brothers
will tell you, Spearfish Middle School
sixth grade teacher Rebecca Sukstorf
has always been a bit idealistic. But
that lifelong trait is to the benefit of
the students sitting in her classroom
today.
“As my older brothers told
me when I was young * I am idealistic,”
Sukstorf said. “I guess I still have a bit of that
within me because I feel that all of my students
can succeed.”
It is nothing less than innate idealism that
inspires her to inspire them to loftier heights.
“I hope I somehow
unlock something within
them that enables them
to find their strengths
and I give them encouragement
to build upon those strengths to
reach their goals,” Sukstorf said. “I go above
and beyond because all kids are special and
have potential. I want them all to be the best
they can be and be happy with what they
choose in life.”
What can best be described as a “teacher
moment,” is what Sukstorf recalls the most
touching moment in her career.
“A few years ago I was working with a
boy who was struggling with a lot of problems
both at home and at school. One day
when he was leaving, he turned with a sweet
smile and soft voice and told me thanks for
caring about him,” Sukstorf said. “I have had
so many memorable experiences, but it’s that
type of response and connection with a student
that makes it all worthwhile.”
Rebecca Sukstorf
Spearfish Middle School
Sukstorf’s drive to reach all students stems from being a
less-than-enthusiastic participant in the game of high school
and the understanding that brings to her teaching style.
“I hated school when I was a kid,” Sukstorf said. “I just
wanted to run around and talk and have fun. When I got
older I wanted to be a writer, live in the mountains and
drink herbal tea. Then I wanted to be like Margaret Mead
and live with the Yanomamo Indians in Brazil. During my
first semester at Black Hills State, I was inspired by
Charlotte Forsberg to go into teaching. She told me she
saw something in me that got people excited about reading.
So I started to think about teaching and what made a good
teacher. I took some education classes and was hooked.”
Sukstorf’s passion for reading and writing buoyed her
through high school and on to bigger and better things.
“I loved English and journalism in high school. I was the
layout editor and writer for the school paper, reported the
school news every Friday on the radio, and wrote stories
for school news publications,” Sukstorf said. “My senior
English class was great. Mrs. Britton brought the world
of literature and writing to life. I still smile as I think of her
and how I hung on her every word.”
A native of the Black Hills, Sukstorf was born in Rapid
City, grew up and graduated high school in Sturgis. She
then attended college at the University of Colorado in
Boulder and then returned to the Black Hills to finish at
Black Hills State University, where she graduated with a
potential that lies within each of her students. Photo courtesy of
Shortly after graduation she earned her middle school
and technology endorsements. In 2008 she earned a master’s
degree in literacy and leadership and a reading specialist
endorsement from the University of Sioux Falls. This
course work was done through the Rapid City Area
Schools cohort program.

!other’s criticism echoes
in public restroom stalls
DEAR ABBY: I am a plussiEed
woman who finds it difficult
to squeeEe into a tiny
restroom stall. I frequently use
the stall for people with disabilities
because it’s larger.
A few years ago, when I
was traveling with my mother,
we made a pit stop and, as
usual, I headed for the large
stall. Mom was horrified. She
said the large stalls should be
treated the same as parking
places for people with disabilities
and used only by those
who are disabled.
I told her I disagreed, thinking
that a few moments in the
potty is different from a few
hours in a parking space. Was
my mother right? Her voice
still rings in my ears every
time I step into the larger stall.
I’d appreciate your input.
Maybe it’ll silence my mother’s
voice. Q JENNIFER IN
MAINE
DEAR JENNIFER:
Because you have difficulty
fitting into a regular stall, I
see nothing wrong with using
the larger one. If a woman in
a wheelchair entered the
bathroom at the same time
as you, then good manners
would dictate that you defer
to her because she’d be
unable to use a smaller one.
However, there’s no reason
for the stall to be kept empty
at all times, so stop being so
hard on yourself.
DEAR ABBY: My husband
and I have two children, a 3year-old
and a 1-year-old. He
has been deployed since
June. We talk frequently on
the phone, and I have been
managing well since his
deployment.
My problem is, I’m afraid I
have managed too well. I am
terrified that when he gets
back we will have grown
apart. I am so used to doing
things on my own now that
I’m not sure I will be able to
go back to our “normal” routine
of his helping me with
the kids.
Abby, what are your
thoughts? We love each other
very much and had a wonderful
relationship before he
deployed, but I don’t know
how well you can gauge a
relationship over the phone
and via e-mail. Q ARMY
WIFE IN MISSISSIPPI
DEAR ARMY WIFE: The
feelings you’re having are not
unusual for spouses whose
partners are in the military.
The repeated separations are
painful and wrenching for all
the family members involved. I
have a deep respect for the
spouses of military personnel
who must adapt to long separations
and the reunions that
follow.
Of course there will be a
period of adjustment when
your husband returns. It will
take understanding and compromise
on the part of both of
you. If you love each other,
you will work it out Q with
counseling if necessary. And
should you hit a rough patch,
please don’t hesitate to reach
out for it.
DEAR ABBY: My husband
lost his son a few years
back. His death was sudden
and unexpected. We had no
children of our own, but I had
a wonderful relationship with
my stepson.
When people ask if I have
children, I’m never quite sure
how to respond. On the one
hand, I don’t want to make
anyone uncomfortable by
telling them my stepson is
deceased, but I also don’t feel
right not acknowledging him.
Any advice on how to handle
this kind of question? Q
STEPMOM IN OTTAWA,
ONTARIO, CANADA
DEAR STEPMOM: I’m sorry
for the loss of your stepson.
When you are asked, my
advice is to be honest. Say, “I
had a stepson with whom I
was very close, but he passed
away a few years ago.”
GE+INI D+16 21HK3CL 2:I ^ Although you may feel
that it is better to give than to receive, others may feel
you deserve something nice for yourself for all the
unselfishness you’ve displayed. It’s your turn to be the
getter.
CANCER DK3CL 21HK3l6 22I ^ One of your greatest
gifts is the ability to help others envision things as they
could be and not just as they are. Today your encouragement
will be greatly appreciated by someone special.
LEO DK3l6 23HA3N. 22I ^ Instead of seeking advice
from co-workers or associates regarding career or workrelated
issues, use your own good judgment. You’ll get
the right answer if you’re honest with yourself.
VIRGO DA3N. 23HSLp2. 22I ^ Some of the more valuable
things we can learn in life may not necessarily come
from books but from personal experiences. Today, this
kind of knowledge will prove to be invaluable to you.
LI.RA DSLp2. 23HOQ2. 23I ^ When it comes to a joint
endeavor, it might be more important to be supportive
than assertive. Encourage your counterpart to use his\her
Herman by Jim Unger
abilities to the fullest, and everybody wins.
SCORPIO DOQ2. 24HNST. 22I ^ One of your greatest
assets today will be your spirit of cooperation. A willingness
to work agreeably with others will stimulate a similar
reaction in return. Togetherness succeeds.
SAGITTARIUS DNST. 23HDLQ. 21I ^ It should be no
surprise that involvements that challenge your imagination
and creativity will be the ones you’ll find to be most
rewarding, especially if you’re working with one who can’t
help.
CAPRICORN DDLQ. 22HK1C. 19I ^ When making a
decision that affects others as well as yourself, let your
compassionate instincts prevail. Sometimes being easy
on the situation represents true strength.
A@UARIUS DK1C. 2:HFLV. 19I ^ Sometimes requirements
of those you love may take precedence over your
own interests, but today you won’t mind this. In situations
where you feel truly needed, no sacrifice will be too great.
PISCES DFLV. 2:H+1rQW 2:I ^ Remember, the ability
to view things from an unprejudiced perspective will net
the most beneficial results, which is likely to be the case
for you today. You may be the middleman in a unique situation.
ARIES D+1rQW 21HApril 19I ^ All people are entitled
to do something nice for themselves once in a while. If
there is something you really want that costs more than
you usually spend, get it.
and crews are well passed the
Belle Fourche Library as far as
progress goes.
Joel Flesner with the
Department of Transportation
said last week's plans to disrupt
the intersection at National Street
have been delayed for three
weeks in order to allow for additional
projects to be completed.
“We need to concentrate on the
mainline paving project first and
we'll go from there,” Flesner
said. According to the master
plan, utility work will require
crews to dig up to 20 feet down
in order to complete that specific
project. A traffic control plan will
be set in place prior to any
action.
He also noted that this weekend,
crews will begin making the
necessary preparations to steer
the traffic over to a portion of the
newly built highway lanes
between State and Jackson
streets.
Though things are going very
well, Flesner said there have
been a handful of incidents other
than the weather that have been
slowing down the progress this
week. He noted that last weekend,
a vehicle veered across the
centerline and caused damage to
string lines that had been placed
to determine the required height
of grade when paving.
“I still can't see how they did
it, but something clipped the
string line and this ended up setting
crews back about four hours
to reset them,” Flesner said.
He also noted that the red
flashing light the Department of
Transportation recently erected
on the stop sign at Roundup
Street had been hit and run over.
“It was kind of ironic because
our whole point of putting that
up there was to make it more visible
and instead someone just ran
over it,” he said.
For more information on this
project or to vocalize any concerns,
the Department of
Transportation hosts weekly public
input meetings at its offices in
Belle Fourche. They begin at 10
a.m. every Tuesday and have
been organized to increase communication
between the public
and the contractors and transportation
officials.
Jury convicts on 2 charges
in Palin e-mail hacking
BY BILL POOVEY
Associated Press Writer
KNOXVILLE, Tenn. — The son of a Democratic
Tennessee lawmaker was convicted Friday on two
charges in the hacking of Sarah Palin's e-mail account
while she campaigned on the Republican presidential
ticket in 2008.
The federal court jury reached its verdict against
David Kernell, 22, after four days of deliberation. He
was found guilty of obstruction of justice and unauthorized
access to a computer, but was acquitted on a
charge of wire fraud.
The jury deadlocked on a charge of identify theft.
Prosecutors reserve the right to have a new trial on that
charge. The charge of obstructing an investigation carries
a maximum 20-year prison sentence and unauthorized
access to a computer is a misdemeanor that carries
a maximum one-year sentence.
Kernell's defense attorney maintained the hack
amounted to college prank, not a crime. Kernell was a
student at the University of Tennessee at the time.
Prosecutors argued it was a more serious effort to
damage Palin's political campaign.
Knoxville Assistant U.S. Attorney Greg Weddle, the
chief prosecutor in the case, said they had not decided
whether to try Kernell again on the identity theft
charge.
Thomas van Flein, Sarah Palin's personal attorney,
said he has been involved in the case from the morning
they learned of the hacking in 2008.
Saturday, May 1, 2010
"I think the jury took its job very seriously and
weighed the evidence closely and concluded that any
effort to impact a national election through illegal
means is not a college prank. It is a crime," he said.
Van Flein said Palin would issue her own statement
about the verdict on her Facebook page.
Palin and her daughter Bristol testified about harassment
and disruption they suffered after some e-mail
was posted on line showing personal cell phone numbers.
Democratic state Rep. Mike Kernell did not immediately
return a message left by The Associated Press
on Friday.
The prosecution case enlivened dull testimony about
the intricacies of e-mail and the Internet with star
power, including the Palins and mention of local sports
hero Peyton Manning.
Technical testimony recounted how investigators
traced the break-in to Kernell, who was never accused
of the harassing calls and texts.
Sarah Palin was the most anticipated witness and
she smiled through 30 minutes of testimony last
Friday about how disruptive and hurtful the posting
had been. Some jurors smiled at her as well.
Outside the courtroom she wouldn't say whether the
charges against Kernell were excessive or whether a
conviction should bring prison time.
"I do think there should be consequences for bad
behavior," she told the dozens of reporters covering
the trial.
CONVICTION
Continued from Page 5
Aesoph's challenge to
his conviction covers
nearly a dozen issues
that include his interrogation,
trial testimony,
juror selection, and difficulty
helping his attorneys
prepare for trial
after his bail was
revoked because he
missed a daily check-in
with the sheriff.
State prosecutors said
Aesoph killed his wife
because she wanted a
divorce and he didn't
want to divide their
land and other assets.
They said a $1.7 million
life insurance policy
paid double if she
died in an accident.
Aesoph testified he
returned from town to
find his wife dead at the
bottom of a stairway to
the basement. The prosecutor
told jurors that
Aesoph beat and strangled
her in an attached
garage and then tried to
make it look like an
accident.
