The CONTRACTOR shall Monitor for Compliance that: (1) Placed<br />

<strong>Children</strong> are not exposed to second-h<strong>and</strong> smoke; (2) Placed <strong>Children</strong><br />

under eighteen (18) years <strong>of</strong> age are not permitted to use any tobacco<br />

products under any circumstances; <strong>and</strong> (3) Placed <strong>Children</strong> are not to<br />

drink any alcoholic beverages or use any narcotics or illegal substances<br />

under any circumstances. CONTRACTOR shall document failure <strong>of</strong> the<br />

Certified Foster Parent’s compliance with this section <strong>and</strong> take necessary<br />

corrective action to ensure compliance.<br />

1.2.5 Drivers’ Licenses, Vehicle Safety, <strong>and</strong> Vehicle Equipment<br />

The CONTRACTOR shall monitor <strong>and</strong> maintain the necessary records to<br />

meet the transportation requirements <strong>of</strong> California <strong>Department</strong> <strong>of</strong> Social<br />

Services Manual <strong>of</strong> Policy <strong>and</strong> Procedures, Title 22, Division 6, Chapter 1,<br />

Section 80<strong>07</strong>4 <strong>and</strong> Chapter 4, Section 83<strong>07</strong>4 as well as California Vehicle<br />

Code Sections 27360 <strong>and</strong> 27360.5. These requirements include the<br />

following: (1) drivers must be licensed for the type <strong>of</strong> vehicle operated;<br />

(2) the manufacturer’s rated seating capacity must not be exceeded;<br />

(3) vehicles used to transport Placed <strong>Children</strong> must be maintained in a<br />

safe operating condition; (4) infants must be secured in a car seat<br />

designed for infants; (5) children up to six years <strong>of</strong> age who weigh less<br />

than 60 pounds must be secured in a child passenger restraint system<br />

meeting applicable federal motor safety st<strong>and</strong>ards; <strong>and</strong> (6) children over<br />

six <strong>and</strong> less than sixteen years <strong>of</strong> age, <strong>and</strong> who weigh 60 pounds or more,<br />

must be secured in a child passenger restraint system or safety belt<br />

meeting applicable federal motor vehicle safety st<strong>and</strong>ards.<br />

1.2.6 Driving Records <strong>and</strong> Auto Liability Insurance <strong>of</strong> FFA Social Workers, Other<br />

FFA Staff, <strong>and</strong> Certified Foster Parents Who Use Their Vehicles to<br />

Transport Placed <strong>Children</strong><br />

The CONTRACTOR shall monitor <strong>and</strong> maintain records to verify that<br />

Certified Foster Parents or their designated drivers who transport the<br />

Placed <strong>Children</strong>: (1) have <strong>and</strong> maintain a valid California driver’s license<br />

with the California <strong>Department</strong> <strong>of</strong> Motor Vehicles; <strong>and</strong> (2) insure their<br />

vehicles, if used to transport the Placed <strong>Children</strong>, at or above the minimum<br />

bodily injury <strong>and</strong> property damage limits required by the State <strong>of</strong><br />

California.<br />

The CONTRACTOR shall also maintain for their social workers <strong>and</strong> other<br />

staffs that use their vehicles to transport children no less than $1,000,000<br />

non-owned auto liability coverage per accident in accordance with the<br />

Contract, Part I, Section 5.0 General Insurance Requirements, <strong>and</strong><br />

Section 6.0 Insurance Coverage Requirements.<br />
