In the Article 8.3 of REMIT, legislators clearly committed themselves to establish such<br />

rules: “Pers<strong>on</strong>s referred to in points (a) to (d) of paragraph 4 who have reported<br />

transacti<strong>on</strong>s in accordance with Directive 2004/39/EC or applicable Uni<strong>on</strong> legislati<strong>on</strong><br />

<strong>on</strong> derivative transacti<strong>on</strong>s, central counterparties and trade repositories shall not be<br />

subject to double reporting obligati<strong>on</strong>s relating to those transacti<strong>on</strong>s. Without<br />

prejudice to the first subparagraph of this paragraph, the implementing acts referred<br />

to in paragraph 2 may allow organised markets and trade matching or trade<br />

reporting systems to provide the Agency with records of wholesale energy<br />

transacti<strong>on</strong>s.<br />

This was a clear commitment from the legislators but <strong>on</strong>e cannot but notice that<br />

notwithstanding our repeated calls, we did not get yet any more clarity <strong>on</strong> this key<br />

issue. Once again, we call <strong>for</strong> a close cooperati<strong>on</strong> between the European Commissi<strong>on</strong>,<br />

<str<strong>on</strong>g>ACER</str<strong>on</strong>g> and ESMA to provide a high level of clarity <strong>for</strong> the market participants required<br />

to report.<br />

In this c<strong>on</strong>text, we would like to reiterate to <str<strong>on</strong>g>ACER</str<strong>on</strong>g> our str<strong>on</strong>g c<strong>on</strong>cern about double<br />

reporting between REMIT and other relevant financial legislati<strong>on</strong> (particularly EMIR).<br />

Trade repositories, <strong>on</strong>ce registered as RRMs, should be able to send to <str<strong>on</strong>g>ACER</str<strong>on</strong>g> all the<br />

necessary reportable in<strong>for</strong>mati<strong>on</strong>, including data and fields that are not required by<br />

EMIR, but should be reported under REMIT. Otherwise, double reporting would not be<br />

avoided, as, given a certain transacti<strong>on</strong>, market participants would be required to<br />

twice provide in<strong>for</strong>mati<strong>on</strong> <strong>on</strong> it: first, to the TR, under EMIR, and then to <str<strong>on</strong>g>ACER</str<strong>on</strong>g>,<br />

integrating the in<strong>for</strong>mati<strong>on</strong> already provided with additi<strong>on</strong>al fields.<br />

2. Sec<strong>on</strong>dly, we believe the Commissi<strong>on</strong> and <str<strong>on</strong>g>ACER</str<strong>on</strong>g> should further define resp<strong>on</strong>sibilities,<br />

particularly relevant in case of possible failure in delivering the data to <str<strong>on</strong>g>ACER</str<strong>on</strong>g> and/or<br />

the relevant NRA, where applicable, if the market participant opts to report through a<br />

RRM or a RIS. It should be <strong>for</strong> example expressly provided <strong>for</strong> that the compliance of a<br />

market participant with reporting obligati<strong>on</strong>s is c<strong>on</strong>sidered fulfilled when a c<strong>on</strong>tract<br />

exists between the market participant and the third party stating that the third party<br />

is in charge of reporting <strong>on</strong> behalf of the market participant. Once the market<br />

participant has provided timely all necessary data to the RRM or the RIS reporting <strong>on</strong><br />

its behalf, it should be explicitly released from any liability with respect to its<br />

reporting or <str<strong>on</strong>g>public</str<strong>on</strong>g>ati<strong>on</strong> obligati<strong>on</strong>s under REMIT. In any case, it should also be made<br />

clear that market participants <strong>on</strong> whose behalf data is reported remain owners of the<br />

data and must have access to the data, in order to be in a positi<strong>on</strong> to answer<br />

adequately any potential upcoming questi<strong>on</strong>s.<br />
