III. The Agency has identified a set of comm<strong>on</strong> standard codes which it proposes<br />
being used in the new reporting framework (see Annex I). Do you think these<br />
standards are the relevant <strong>on</strong>es?<br />
While reaffirming that <strong>for</strong> derivative transacti<strong>on</strong>s full use of EMIR standards is<br />
necessary and expected, <strong>for</strong> the rest of c<strong>on</strong>tracts we suggest <str<strong>on</strong>g>ACER</str<strong>on</strong>g> to use<br />
standards and <strong>for</strong>mats widespread and used in trading practices, using in<br />
particular those standards and <strong>for</strong>mats which require the least operative burden<br />
<strong>for</strong> systems adaptati<strong>on</strong>.<br />
Yes, the ISO standard codes described there are in general suitable. We believe it is<br />
key that those standards are in line with the standards used <strong>for</strong> the reporting<br />
under EMIR.<br />
In additi<strong>on</strong> to the proposed codes, the LEI code should be c<strong>on</strong>sidered <strong>for</strong><br />
identificati<strong>on</strong> of market participants.<br />
IV. If a <strong>for</strong>mat is recognised by the Agency, what governance provisi<strong>on</strong>s should the<br />
Agency require to ensure the quality persists?<br />
Any <strong>for</strong>mat selected <strong>for</strong> trade reporting should be governed by the following<br />
principles:<br />
Any <strong>for</strong>mat changes required due to market developments or decided by data<br />
owners should be first coordinated with <str<strong>on</strong>g>ACER</str<strong>on</strong>g> and ESMA to avoid any double<br />
reporting/burden <strong>for</strong> market participants<br />
Sufficient lead times <strong>for</strong> setting changes live (at mi nimum 6 m<strong>on</strong>ths after<br />
<str<strong>on</strong>g>public</str<strong>on</strong>g>ati<strong>on</strong> of change). Also we believe that test plat<strong>for</strong>ms are extremely<br />
important and require some window of testing <strong>for</strong> market participants to<br />
assess their suitability.<br />
Market <str<strong>on</strong>g>c<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> phase to discuss proposed changes in advance of decisi<strong>on</strong>s<br />
E-Mail notificati<strong>on</strong> <strong>on</strong> proposed changes should be provided to market<br />
participants and other instituti<strong>on</strong>s(registrati<strong>on</strong> <strong>for</strong> mail notificati<strong>on</strong>)<br />
<strong>Standards</strong> to be used <strong>for</strong> reporting should be published including dates when they<br />
come into <strong>for</strong>ce and proposed changes via internet <strong>for</strong> download<br />
V. Do you have comments <strong>on</strong> these standards?<br />
As already menti<strong>on</strong>ed in previous questi<strong>on</strong>s, we believe it is key that standards and<br />
<strong>for</strong>mats used <strong>for</strong> REMIT reporting are fully in line with EMIR requirements. We<br />
urge ESMA and <str<strong>on</strong>g>ACER</str<strong>on</strong>g> to closely cooperate <strong>on</strong> this issue in order to avoid any<br />
double reporting or additi<strong>on</strong>al burden <strong>for</strong> market participants.<br />
