Incidental Harassment Authoriz<strong>at</strong>ion<br />

Lamont-Doherty Earth Observ<strong>at</strong>ory, Columbia University, P.O. Box 1000,61 Route 9W,<br />

Palisades, New York 10964-8000, is hereby authorized under section 101(a)(5)(D) of <strong>the</strong> <strong>Mar<strong>in</strong>e</strong><br />

Mammal Protection Act (MMPA) (16 U.S.C. 1371(a)(5)(D)) and 50 CFR 216.107, to harass<br />

small numbers of mar<strong>in</strong>e mammals <strong>in</strong>cidental to a mar<strong>in</strong>e geophysical survey conducted by <strong>the</strong><br />

RIV Marcus G. Langseth (Langseth) on <strong>the</strong> Sh<strong>at</strong>sky <strong>Rise</strong> <strong>in</strong> <strong>the</strong> Northwest Pacific Ocean July<br />

through September, <strong>2010</strong>:<br />

1. This Authoriz<strong>at</strong>ion is valid from July 19,<strong>2010</strong> through September 28,<strong>2010</strong>.<br />

2. This Authoriz<strong>at</strong>ion is valid only for specified activities associ<strong>at</strong>ed with <strong>the</strong> RIV Marcus G.<br />

Langseth's (Langseth) seismic oper<strong>at</strong>ions <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g specified geographic area:<br />

(a) The Sh<strong>at</strong>sky <strong>Rise</strong> area, loc<strong>at</strong>ed <strong>at</strong> 30 - 37 ON, 154 - 161°E <strong>in</strong> <strong>in</strong>tern<strong>at</strong>ional w<strong>at</strong>ers<br />

offshore from Japan, as specified <strong>in</strong> L-<strong>DEO</strong>'s Incidental Harassment Authoriz<strong>at</strong>ion<br />

applic<strong>at</strong>ion and Environmental Assessment.<br />

3. Species Authorized and Level of Takes<br />

(a) The <strong>in</strong>cidental tak<strong>in</strong>g of mar<strong>in</strong>e mammals, by Level B harassment only, is limited to <strong>the</strong><br />

follow<strong>in</strong>g species <strong>in</strong> <strong>the</strong> w<strong>at</strong>ers around <strong>the</strong> Sh<strong>at</strong>sky <strong>Rise</strong>:<br />

(i) Mysticetes - see Table 2 (<strong>at</strong>tached) for authorized species and take nurrlbers.<br />

(ii) Odontocetes - see Table 2 (<strong>at</strong>tached) for authorized species and take numbers.<br />

(iii) P<strong>in</strong>nipeds - see Table 2 (<strong>at</strong>tached) for authorized species and take numbers<br />

(iv) If any mar<strong>in</strong>e mammal species are encountered dur<strong>in</strong>g seismic activities th<strong>at</strong> are<br />

not listed <strong>in</strong> Table 2 (<strong>at</strong>tached) for authoriz<strong>in</strong>g tak<strong>in</strong>g and are likely to be exposed<br />

to sound pressure levels (SPLs) gre<strong>at</strong>er than or equal to 160 dB re 1 JlPa (rms),<br />

<strong>the</strong>n <strong>the</strong> Holder of this Authoriz<strong>at</strong>ion must alter speed or course, power-down or<br />

shut-down <strong>the</strong> airguns to avoid take.


(b) The tak<strong>in</strong>g by <strong>in</strong>jury (Level A harassment), serious <strong>in</strong>jury, or de<strong>at</strong>h of any of <strong>the</strong> species<br />

listed <strong>in</strong> 3(a) or <strong>the</strong> tak<strong>in</strong>g of any k<strong>in</strong>d of any o<strong>the</strong>r species of mar<strong>in</strong>e mammal is prohibited<br />

and may result <strong>in</strong> <strong>the</strong> modific<strong>at</strong>ion, suspension or revoc<strong>at</strong>ion of this Authoriz<strong>at</strong>ion.<br />

(c) The methods authorized for tak<strong>in</strong>g by Level B harassment is l<strong>in</strong>lited to <strong>the</strong> follow<strong>in</strong>g<br />

acoustic sources without an amendment to this Authoriz<strong>at</strong>ion:<br />

(i) a 36-Bolt airgun array th<strong>at</strong> may range <strong>in</strong> size from 40 to 360 cubic <strong>in</strong>ches (<strong>in</strong> 3 )<br />

with a total volume of approxim<strong>at</strong>ely 6,600 <strong>in</strong> 3 as an energy source;<br />

(ii) a multi-beam echosounder;<br />

(iii) a sub-bottom profiler; and<br />

(iv) <strong>the</strong> acoustic release transponder used to communic<strong>at</strong>e with <strong>the</strong> Ocean Bottom<br />

Seismometers (OBS).<br />

4. The tak<strong>in</strong>g of any mar<strong>in</strong>e mammal <strong>in</strong> a manner prohibited under this Authoriz<strong>at</strong>ion must be<br />

reported immedi<strong>at</strong>ely to <strong>the</strong> Office of Protected Resources, N<strong>at</strong>ional <strong>Mar<strong>in</strong>e</strong> Fisheries<br />

Service (NMFS), <strong>at</strong> 301-713-2289.<br />

5. The Holder of this Authoriz<strong>at</strong>ion is required to cooper<strong>at</strong>e with NMFS and any o<strong>the</strong>r Federal,<br />

st<strong>at</strong>e or local agency monitor<strong>in</strong>g <strong>the</strong> impacts of <strong>the</strong> activity on mar<strong>in</strong>e mammals.<br />

6. Mitig<strong>at</strong>ion and Monitor<strong>in</strong>g Requirements<br />

The Holder of this Authoriz<strong>at</strong>ion is required to implement <strong>the</strong> follow<strong>in</strong>g mitig<strong>at</strong>ion and<br />

monitor<strong>in</strong>g requirements when conduct<strong>in</strong>g <strong>the</strong> specified activities to achieve <strong>the</strong> least<br />

practicable adverse impact on affected mar<strong>in</strong>e mammal species or stocks:<br />

(a) Utilize two, NMFS-qualified, vessel-based Protected Species Visual Observers (PSVOs)<br />

(except dur<strong>in</strong>g meal times and restroom breaks, when <strong>at</strong> least one PSVO will be on w<strong>at</strong>ch) to<br />

visually w<strong>at</strong>ch for and monitor mar<strong>in</strong>e mammals near <strong>the</strong> seismic source vessel dur<strong>in</strong>g<br />

daytime airgun oper<strong>at</strong>ions (from civil twilight-dawn to civil twilight-dusk) and before and<br />

dur<strong>in</strong>g start-ups of airguns day or night. The Langseth's vessel crew will also assist <strong>in</strong><br />

detect<strong>in</strong>g mar<strong>in</strong>e mammals, when practicable. PSVOs will have access to reticle b<strong>in</strong>oculars<br />

(7x50 Fuj<strong>in</strong>on), big-eye b<strong>in</strong>oculars (25x150), and night vision devices. PSVO shifts will last<br />

no longer than 4 hours <strong>at</strong> a time. PSVOs will also make observ<strong>at</strong>ions dur<strong>in</strong>g daytime periods<br />

when <strong>the</strong> seismic system is not oper<strong>at</strong><strong>in</strong>g for comparison of animal abundance and behavior,<br />

when feasible.<br />

(b) PSVOs will conduct monitor<strong>in</strong>g while <strong>the</strong> airgun array and streamers are be<strong>in</strong>g deployed<br />

or recovered from <strong>the</strong> w<strong>at</strong>er.<br />

( c) Record <strong>the</strong> follow<strong>in</strong>g <strong>in</strong>fonn<strong>at</strong>ion when a mar<strong>in</strong>e mammal is sighted:<br />

(i) species, group size, age/size/sex c<strong>at</strong>egories (if deternl<strong>in</strong>able), behavior when first<br />

sighted and after <strong>in</strong>itial sight<strong>in</strong>g, head<strong>in</strong>g (if consistent), bear<strong>in</strong>g and distance<br />

from seismic vessel, sight<strong>in</strong>g cue, apparent reaction to <strong>the</strong> airguns or vessel (e.g.,<br />

none, avoidance, approach, parallel<strong>in</strong>g, etc., and <strong>in</strong>clud<strong>in</strong>g responses to ramp-up),<br />

and behavioral pace; and<br />

(ii) time, loc<strong>at</strong>ion, head<strong>in</strong>g, speed, activity of <strong>the</strong> vessel (<strong>in</strong>clud<strong>in</strong>g number of airguns<br />

oper<strong>at</strong><strong>in</strong>g and whe<strong>the</strong>r <strong>in</strong> st<strong>at</strong>e of ramp-up or power-down), sea st<strong>at</strong>e, visibility,<br />

and sun glare; and<br />

(iii) <strong>the</strong> d<strong>at</strong>a listed under 6( c )(ii) will also be recorded <strong>at</strong> <strong>the</strong> start and end of each<br />

observ<strong>at</strong>ion w<strong>at</strong>ch and dur<strong>in</strong>g a w<strong>at</strong>ch whenever <strong>the</strong>re is a change <strong>in</strong> one or more<br />

of <strong>the</strong> variables.<br />

(d) Utilize <strong>the</strong> passive acoustic monitor<strong>in</strong>g (PAM) system, to <strong>the</strong> maximum extent<br />

practicable, to detect and allow some localiz<strong>at</strong>ion of mar<strong>in</strong>e mammals around <strong>the</strong> Langseth<br />

dur<strong>in</strong>g all airgun oper<strong>at</strong>ions and dur<strong>in</strong>g most periods when airguns are not oper<strong>at</strong><strong>in</strong>g. One<br />

PSVO and/or bioacoustician will monitor <strong>the</strong> PAM <strong>at</strong> all times <strong>in</strong> shifts no longer than 6<br />

hours. A bioacoustician shall design and set up <strong>the</strong> PAM system and be present to oper<strong>at</strong>e or<br />

oversee PAM, and available when technical issues occur dur<strong>in</strong>g <strong>the</strong> survey.<br />

(e) Do and record <strong>the</strong> follow<strong>in</strong>g when an animal is detected by <strong>the</strong> PAM:<br />

(i) notify <strong>the</strong> PSVO immedi<strong>at</strong>ely of a vocaliz<strong>in</strong>g mar<strong>in</strong>e mammal so a power-down<br />

or shut-down can be <strong>in</strong>iti<strong>at</strong>ed, if required;<br />

(ii) enter <strong>the</strong> <strong>in</strong>fonn<strong>at</strong>ion regard<strong>in</strong>g <strong>the</strong> vocaliz<strong>at</strong>ion <strong>in</strong>to a d<strong>at</strong>abase. The d<strong>at</strong>a to be<br />

entered <strong>in</strong>clude an acoustic encounter identific<strong>at</strong>ion number, whe<strong>the</strong>r it was<br />

l<strong>in</strong>ked with a visual sight<strong>in</strong>g, d<strong>at</strong>e, time when first and last heard and whenever<br />

any additional <strong>in</strong>fonn<strong>at</strong>ion was recorded, position, and w<strong>at</strong>er depth when first<br />

detected, bear<strong>in</strong>g if determ<strong>in</strong>able, species or species group (e.g., unidentified<br />

dolph<strong>in</strong>, spenn whale), types and n<strong>at</strong>ure of sounds heard (e.g., clicks, cont<strong>in</strong>uous,<br />

sporadic, whistles, creaks, burst pulses, strength of signal, etc.), and any o<strong>the</strong>r<br />

notable <strong>in</strong>fonn<strong>at</strong>ion.<br />

(f) Visually observe <strong>the</strong> entire extent of <strong>the</strong> exclusion zone (180 dB for cetaceans; see Table<br />

1 [<strong>at</strong>tached] for distances) us<strong>in</strong>g NMFS-qualified PSVOs, for <strong>at</strong> least 30 m<strong>in</strong>utes prior to<br />

start<strong>in</strong>g <strong>the</strong> airgun (day or night). If <strong>the</strong> PSVO f<strong>in</strong>ds a mar<strong>in</strong>e mammal with<strong>in</strong> <strong>the</strong> exclusion<br />

zone, L-<strong>DEO</strong> must delay <strong>the</strong> seismic survey until <strong>the</strong> mar<strong>in</strong>e mammal(s) has left <strong>the</strong> area. If<br />

<strong>the</strong> PSVO sees a mar<strong>in</strong>e mammal th<strong>at</strong> surfaces, <strong>the</strong>n dives below <strong>the</strong> surface, <strong>the</strong> observer<br />

shall wait 30 m<strong>in</strong>utes. If <strong>the</strong> PSVO sees no mar<strong>in</strong>e mammals dur<strong>in</strong>g th<strong>at</strong> time, <strong>the</strong>y should<br />

assume th<strong>at</strong> <strong>the</strong> animal has moved beyond <strong>the</strong> exclusion zone. If for any reason <strong>the</strong> entire<br />

radius cannot be seen for <strong>the</strong> entire 30 m<strong>in</strong>utes (m<strong>in</strong>) (i.e., rough seas, fog, darkness), or if<br />

mar<strong>in</strong>e mammals are near, approach<strong>in</strong>g, or <strong>in</strong> <strong>the</strong> exclusion zone, <strong>the</strong> airguns may not be<br />

started up. If one airgun is already runn<strong>in</strong>g <strong>at</strong> a source level of <strong>at</strong> least 180 dB, L-<strong>DEO</strong> may<br />

start <strong>the</strong> second gun without observ<strong>in</strong>g <strong>the</strong> entire exclusion zone for 30 m<strong>in</strong> prior, provided<br />

no mar<strong>in</strong>e mamnlals are known to be near <strong>the</strong> exclusion zone (<strong>in</strong> accordance with condition<br />

6(h) below).<br />

(g) Establish a 180-dB exclusion zone for mar<strong>in</strong>e mamnlals before <strong>the</strong> 4-str<strong>in</strong>g airgun array<br />

(6,600 <strong>in</strong> 3 ) is <strong>in</strong> oper<strong>at</strong>ion; and a 180-dB exclusion zone before a s<strong>in</strong>gle airgun (40 <strong>in</strong> 3 ) is <strong>in</strong><br />

oper<strong>at</strong>ion, respectively. See Table 1 (<strong>at</strong>tached) for distances and safety radii.<br />

(h) Implement a "ranlp-up" procedure when start<strong>in</strong>g up <strong>at</strong> <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g of seismic<br />

oper<strong>at</strong>ions or anytime after <strong>the</strong> entire array has been shutdown for more than 8 m<strong>in</strong>, which<br />

means start <strong>the</strong> smallest gun first and add airguns <strong>in</strong> a sequence such th<strong>at</strong> <strong>the</strong> source level of<br />

<strong>the</strong> array will <strong>in</strong>crease <strong>in</strong> steps not exceed<strong>in</strong>g approxim<strong>at</strong>ely 6 dB per 5-m<strong>in</strong>ute period.<br />

Dur<strong>in</strong>g ramp-up, <strong>the</strong> PSVOs will monitor <strong>the</strong> exclusion zone, and if mar<strong>in</strong>e mammals are<br />

sighted, a course/speed alter<strong>at</strong>ion, power-down, or shut-down will be implemented as though<br />

<strong>the</strong> full array were oper<strong>at</strong>ional. Therefore, <strong>in</strong>iti<strong>at</strong>ion of ramp-up procedures from shut-down<br />

requires th<strong>at</strong> <strong>the</strong> PSVOs be able to view <strong>the</strong> full exclusion zone as described <strong>in</strong> 6(f) (above).<br />

(i) Alter speed or course dur<strong>in</strong>g seismic oper<strong>at</strong>ions if a mar<strong>in</strong>e mammal, based on its<br />

position and rel<strong>at</strong>ive motion, appears likely to enter <strong>the</strong> relevant exclusion zone. If speed or<br />

course alter<strong>at</strong>ion is not safe or practicable, or if after alter<strong>at</strong>ion <strong>the</strong> mar<strong>in</strong>e mammal still<br />

appears likely to enter <strong>the</strong> exclusion zone, fur<strong>the</strong>r mitig<strong>at</strong>ion measures, such as power-down<br />

or shut-down, will be taken.<br />

U) P ower-down or shut-down <strong>the</strong> airgun(s) if a mar<strong>in</strong>e mammal is detected with<strong>in</strong>,<br />

approaches, or enters <strong>the</strong> relevant exclusion zone (as def<strong>in</strong>ed <strong>in</strong> Table 1, <strong>at</strong>tached). A shutdown<br />

means all oper<strong>at</strong><strong>in</strong>g airguns are shut-down. A power-down means reduc<strong>in</strong>g <strong>the</strong><br />

number of oper<strong>at</strong><strong>in</strong>g airguns to a s<strong>in</strong>gle oper<strong>at</strong><strong>in</strong>g 40 <strong>in</strong> 3 airgun, which reduces <strong>the</strong> exclusion<br />

zone to <strong>the</strong> degree th<strong>at</strong> <strong>the</strong> animal(s) is outside of it.<br />

(k) Follow<strong>in</strong>g a power-down, if <strong>the</strong> mar<strong>in</strong>e mammal approaches <strong>the</strong> smaller design<strong>at</strong>ed<br />

exclusion zone, <strong>the</strong> airguns must <strong>the</strong>n be completely shut-down. Airgun activity will not<br />

resume until <strong>the</strong> PSVO has visually observed <strong>the</strong> mar<strong>in</strong>e mammal(s) exit<strong>in</strong>g <strong>the</strong> exclusion<br />

zone and is not likely to return, or has not been seen with<strong>in</strong> <strong>the</strong> exclusion zone for 15 m<strong>in</strong> for<br />

species with shorter dive dur<strong>at</strong>ions (small odontocetes) or 30 m<strong>in</strong> for species with longer dive<br />

dur<strong>at</strong>ions (mysticetes and large odontocetes, <strong>in</strong>clud<strong>in</strong>g spenn, pygmy spenn, dwarf spenn,<br />

killer, and beaked whales).<br />

(1) Follow<strong>in</strong>g a power-down or shut-down and subsequent animal departure, airgun<br />

oper<strong>at</strong>ions may resume follow<strong>in</strong>g ramp-up procedures described <strong>in</strong> 6(h).<br />

(m) <strong>Mar<strong>in</strong>e</strong> geophysical surveys may cont<strong>in</strong>ue <strong>in</strong>to night and low-light hours if such<br />

segment(s) of <strong>the</strong> survey is <strong>in</strong>iti<strong>at</strong>ed when <strong>the</strong> entire relevant exclusion zones are visible and<br />

can be effectively monitored.<br />

(n) No <strong>in</strong>iti<strong>at</strong>ion of airgun array oper<strong>at</strong>ions is pennitted from a shut-down position <strong>at</strong> night or<br />

dur<strong>in</strong>g low-light hours (such as <strong>in</strong> dense fog or heavy ra<strong>in</strong>) when <strong>the</strong> entire relevant exclusion<br />

zone cannot be effectively monitored by <strong>the</strong> PSVOs on duty. '<br />

(0) If a North Pacific right whale (Eubalaena japonica) is visually sighted, <strong>the</strong> airgun array<br />

will be shut-down regardless of <strong>the</strong> distance of <strong>the</strong> animal(s) to <strong>the</strong> sound source. The array<br />

will not resume fir<strong>in</strong>g until 30 m<strong>in</strong> after <strong>the</strong> last documented whale visual sight<strong>in</strong>g.<br />

(P) To <strong>the</strong> maximum extent practicable, schedule seismic oper<strong>at</strong>ions (i.e., shoot<strong>in</strong>g airguns)<br />

dur<strong>in</strong>g daylight hours and OBS oper<strong>at</strong>ions (i.e., deploy/retrieve) to nighttime hours.<br />

7. Report<strong>in</strong>g Requirements<br />

The Holder of this Authoriz<strong>at</strong>ion is required to:<br />

(a) Submit a draft report on all activities and monitor<strong>in</strong>g results to <strong>the</strong> Office of Protected<br />

Resources, NMFS, with<strong>in</strong> 90 days of <strong>the</strong> completion of <strong>the</strong> Langseth's Sh<strong>at</strong>sky <strong>Rise</strong><br />

cruise. This report must conta<strong>in</strong> and summarize <strong>the</strong> follow<strong>in</strong>g <strong>in</strong>fonn<strong>at</strong>ion:<br />

(i) D<strong>at</strong>es, times, loc<strong>at</strong>ions, head<strong>in</strong>g, speed, we<strong>at</strong>her, sea conditions (<strong>in</strong>clud<strong>in</strong>g<br />

Beaufort sea st<strong>at</strong>e and w<strong>in</strong>d force), and associ<strong>at</strong>ed activities dur<strong>in</strong>g all seismic<br />

oper<strong>at</strong>ions and mar<strong>in</strong>e mammal sight<strong>in</strong>gs;<br />

(ii) Species, number, loc<strong>at</strong>ion, distance from <strong>the</strong> vessel, and behavior of any mar<strong>in</strong>e<br />

mammals, as well as associ<strong>at</strong>ed seismic activity (number of power-downs and<br />

shut-downs), observed throughout all monitor<strong>in</strong>g activities.<br />

(iii) An estim<strong>at</strong>e of <strong>the</strong> number (by species) of mar<strong>in</strong>e mammals th<strong>at</strong>: (A) are known<br />

to have been exposed to <strong>the</strong> seismic activity (based on visual observ<strong>at</strong>ion) <strong>at</strong><br />

received levels gre<strong>at</strong>er than or equal to 160 dB re 1 J.lPa (nns) and/or 180 dB re 1<br />

J.lPa (nns) with a discussion of any specific behaviors those <strong>in</strong>dividuals exhibited;<br />

and (B) may have been exposed (based on model<strong>in</strong>g results) to <strong>the</strong> seismic<br />

activity <strong>at</strong> received levels gre<strong>at</strong>er than or equal to 160 dB re 1 J.lPa (nns) and/or<br />

180 dB re 1 J.lPa (nns) with a discussion of <strong>the</strong> n<strong>at</strong>ure of <strong>the</strong> probable<br />

consequences of th<strong>at</strong> exposure on <strong>the</strong> <strong>in</strong>dividuals th<strong>at</strong> have been exposed.<br />

(iv) A description of <strong>the</strong> implement<strong>at</strong>ion and effectiveness of <strong>the</strong>: (A) tenns and<br />

conditions of <strong>the</strong> Biological Op<strong>in</strong>ion's Incidental Take St<strong>at</strong>ement (ITS)<br />

(<strong>at</strong>tached); and (B) mitig<strong>at</strong>ion measures of <strong>the</strong> Incidental Harassment<br />

Authoriz<strong>at</strong>ion. For <strong>the</strong> Biological Op<strong>in</strong>ion, <strong>the</strong> report will conf<strong>in</strong>n <strong>the</strong><br />

<strong>in</strong>lplenlent<strong>at</strong>ion of each Tenn and Condition, as well as any conserv<strong>at</strong>ion<br />

recommend<strong>at</strong>ions, and describe <strong>the</strong>ir effectiveness, for m<strong>in</strong>imiz<strong>in</strong>g <strong>the</strong> adverse<br />

effects of <strong>the</strong> action on listed mar<strong>in</strong>e mammals.<br />

(b) Submit a f<strong>in</strong>al report to <strong>the</strong> Chief, Pennits, Conserv<strong>at</strong>ion, and Educ<strong>at</strong>ion Division, Office<br />

of Protected Resources, NMFS, with<strong>in</strong> 30 days after receiv<strong>in</strong>g comments from NMFS on <strong>the</strong><br />

draft report. IfNMFS decides th<strong>at</strong> <strong>the</strong> draft report needs no comments, <strong>the</strong> draft report will<br />

be considered to be <strong>the</strong> f<strong>in</strong>al report.<br />

Authoriz<strong>at</strong>ion occurs, such as an <strong>in</strong>jury, serious <strong>in</strong>jury or mortality, and are judged to result<br />

from <strong>the</strong>se activities, L-<strong>DEO</strong> will immedi<strong>at</strong>ely report <strong>the</strong> <strong>in</strong>cident to <strong>the</strong> Chief of <strong>the</strong> Permits,<br />

Conserv<strong>at</strong>ion, and Educ<strong>at</strong>ion Division, Office of Protected Resources, NMFS, <strong>at</strong> 301-713-<br />

2289. L-<strong>DEO</strong> will postpone <strong>the</strong> research activities until NMFS is able to review <strong>the</strong><br />

circumstances of <strong>the</strong> take. NMFS will work with L-<strong>DEO</strong> to determ<strong>in</strong>e whe<strong>the</strong>r modific<strong>at</strong>ions<br />

<strong>in</strong> <strong>the</strong> activities are appropri<strong>at</strong>e and necessary, and notified <strong>the</strong> permit holder th<strong>at</strong> <strong>the</strong>y may<br />

resume sound source oper<strong>at</strong>ions.<br />

9. In <strong>the</strong> event th<strong>at</strong> L-<strong>DEO</strong> discovers an <strong>in</strong>jured or dead mar<strong>in</strong>e mammal th<strong>at</strong> are judged to not<br />

have resulted from <strong>the</strong>se activities, L-<strong>DEO</strong> will contact and report <strong>the</strong> <strong>in</strong>cident to <strong>the</strong> Chief of<br />

<strong>the</strong> Permits, Conserv<strong>at</strong>ion, and Educ<strong>at</strong>ion Division, Office of Protected Resources, NMFS, <strong>at</strong><br />

301-713-2289 with<strong>in</strong> 24 hours of <strong>the</strong> discovery.<br />

10. L-<strong>DEO</strong> is required to comply with <strong>the</strong> Terms and Conditions of <strong>the</strong> Incidental Take<br />

St<strong>at</strong>ement (ITS) correspond<strong>in</strong>g to NMFS' Biological Op<strong>in</strong>ion issued to both NSF and<br />

NMFS' Office of Protected Resources (<strong>at</strong>tached).<br />

11. A copy of this Authoriz<strong>at</strong>ion and <strong>the</strong> ITS must be <strong>in</strong> <strong>the</strong> possession of all contractors and<br />

whales, as well as green, hawksbill, le<strong>at</strong>herback, loggerhead, and olive ridley sea turtles; <strong>the</strong><br />

Environmental basel<strong>in</strong>e for <strong>the</strong> action area; <strong>the</strong> anticip<strong>at</strong>ed effects of <strong>the</strong> proposed activities; and<br />

<strong>the</strong> Cumul<strong>at</strong>ive effects, it is <strong>the</strong> NMFS' Op<strong>in</strong>ion th<strong>at</strong> <strong>the</strong> actions (NSF's fund<strong>in</strong>g of and <strong>the</strong><br />

Pennits Division's issuance of an IHA for seismic surveys over <strong>the</strong> Sh<strong>at</strong>sky <strong>Rise</strong>) are not likely<br />

to jeopardize <strong>the</strong> cont<strong>in</strong>ued existence of <strong>the</strong>se species. Similarly, it is <strong>the</strong> NMFS' Op<strong>in</strong>ion th<strong>at</strong><br />

<strong>the</strong> issuance of an IHA by <strong>the</strong> NMFS' Pennits Division for harassment th<strong>at</strong> would occur<br />

<strong>in</strong>cidental to <strong>the</strong> proposed action is not likely to jeopardize <strong>the</strong> cont<strong>in</strong>ued existence of <strong>the</strong>se<br />

species. No critical habit<strong>at</strong> co-occurs with<strong>in</strong> <strong>the</strong> action area and thus <strong>the</strong> proposed action would<br />

have no effect on critical habit<strong>at</strong>.<br />

Incidental take st<strong>at</strong>ement<br />

Section 9 of <strong>the</strong> ESA and federal regu1<strong>at</strong>ion pursuant to Section 4( d) of <strong>the</strong> ESA prohibit <strong>the</strong><br />

"take" of endangered and thre<strong>at</strong>ened species, respectively, without special exemption. "Take" is<br />

def<strong>in</strong>ed as to harass, hann, pursue, hunt, shoot, wound, kill, trap, capture or collect, or to <strong>at</strong>tempt<br />

to engage <strong>in</strong> any such conduct. Harm is fur<strong>the</strong>r def<strong>in</strong>ed by <strong>the</strong> NMFS as an act which actually<br />

kills or <strong>in</strong>jures wildlife, which may <strong>in</strong>clude significant habit<strong>at</strong> modific<strong>at</strong>ion or degrad<strong>at</strong>ion<br />

which actually kills or <strong>in</strong>jures fish or wildlife by significantly impair<strong>in</strong>g essential behavioral<br />

p<strong>at</strong>terns, <strong>in</strong>clud<strong>in</strong>g breed<strong>in</strong>g, feed<strong>in</strong>g, or shelter<strong>in</strong>g. Incidental take is def<strong>in</strong>ed as take th<strong>at</strong> is<br />

<strong>in</strong>cidental to, and not <strong>the</strong> purpose of, <strong>the</strong> carry<strong>in</strong>g out of an o<strong>the</strong>rwise lawful activity. Under <strong>the</strong><br />

tenns of Sections 7(b)(4) and 7(0)(2), tak<strong>in</strong>g th<strong>at</strong> is <strong>in</strong>cidental and not <strong>in</strong>tended as part of <strong>the</strong><br />

agency action is not considered to be prohibited tak<strong>in</strong>g under <strong>the</strong> ESA provided th<strong>at</strong> such tak<strong>in</strong>g<br />

is <strong>in</strong> compliance with <strong>the</strong> tenns and conditions of this Incidental Take St<strong>at</strong>ement.<br />

The measures described below are nondiscretionary, and must be undertaken by <strong>the</strong> NSF and <strong>the</strong><br />

Pennits Division so th<strong>at</strong> <strong>the</strong>y become b<strong>in</strong>d<strong>in</strong>g conditions for L-<strong>DEO</strong> for <strong>the</strong> exemption <strong>in</strong> Section<br />

7(0)(2) to apply. Section 7(b)(4) of <strong>the</strong> ESA requires th<strong>at</strong> when a proposed agency action is<br />

found to be consistent with Section 7(a)(2) of <strong>the</strong> ESA and <strong>the</strong> proposed action may <strong>in</strong>cidentally<br />

take <strong>in</strong>dividuals of listed species, <strong>the</strong> NMFS will issue a st<strong>at</strong>ement th<strong>at</strong> specifies <strong>the</strong> impact of<br />

any <strong>in</strong>cidental tak<strong>in</strong>g of endangered or thre<strong>at</strong>ened species. To m<strong>in</strong>imize such impacts,<br />

reasonable and prudent measures and tenn and conditions to implement <strong>the</strong> measures, must be<br />

provided. Only <strong>in</strong>cidental take result<strong>in</strong>g from <strong>the</strong> agency actions and any specified reasonable<br />

and prudent measures and tenns and conditions identified <strong>in</strong> <strong>the</strong> <strong>in</strong>cidental take st<strong>at</strong>ement are<br />

exempt from <strong>the</strong> tak<strong>in</strong>g prohibition of Section 9(a), pursuant to Section 7(0) of <strong>the</strong> ESA.<br />

Section 7(b)(4)(C) of <strong>the</strong> ESA specifies th<strong>at</strong> <strong>in</strong> order to provide an <strong>in</strong>cidental take st<strong>at</strong>ement for<br />

an endangered or thre<strong>at</strong>ened species of mar<strong>in</strong>e mammal, <strong>the</strong> tak<strong>in</strong>g must be authorized under<br />

Section 101(a)(5) of <strong>the</strong> MMPA. One of <strong>the</strong> federal actions considered <strong>in</strong> this Op<strong>in</strong>ion is <strong>the</strong><br />

Pennits Division's proposed authoriz<strong>at</strong>ion of <strong>the</strong> <strong>in</strong>cidental tak<strong>in</strong>g of f<strong>in</strong>, blue, sei, humpback,<br />

North Pacific right, and spenn whales pursuant to Section 101(a)(5)(D) of <strong>the</strong> MMPA. With this<br />

authoriz<strong>at</strong>ion, <strong>the</strong> <strong>in</strong>cidental take of listed whales is exempt from <strong>the</strong> tak<strong>in</strong>g prohibition of<br />

Section 9(a), pursuant to Section 7(0) of <strong>the</strong> ESA.<br />

Amount or extent of take<br />

The NMFS anticip<strong>at</strong>es <strong>the</strong> proposed seismic survey <strong>in</strong> <strong>the</strong> Pacific Ocean over <strong>the</strong> Sh<strong>at</strong>sky <strong>Rise</strong><br />

might result <strong>in</strong> <strong>the</strong> <strong>in</strong>cidental take of listed species. The proposed action is expected to take 9<br />

blue (10 exposures), 16 f<strong>in</strong> (17 exposures), 37 sei (40 exposures), 10 humpback (11 exposures),<br />

1 North Pacific right (1 exposure), and 22 spenn whales (24 exposures) by expos<strong>in</strong>g <strong>in</strong>dividuals<br />

to received seismic sound levels gre<strong>at</strong>er than 160 dB re 1 JlPa by harassment. These estim<strong>at</strong>es<br />
