<strong>Dover</strong> <strong>Marina</strong><br />

For sailing across <strong>the</strong> English Channel or cruising around home shores, <strong>Dover</strong> is<br />

<strong>the</strong> most highly rated and convenient marina. Set against <strong>the</strong> iconic backdrop <strong>of</strong><br />

<strong>the</strong> famous White Cliffs, and positioned at <strong>the</strong> closest point to Continental Europe,<br />

<strong>Dover</strong> <strong>Marina</strong> is situated 20 miles from France and a similar distance from its<br />

closest neighbours on <strong>the</strong> UK South Coast.<br />

It is within easy sailing distance <strong>of</strong> <strong>the</strong> French marinas <strong>of</strong> Boulogne, Calais,<br />

Gravelines and Dunkerque, and <strong>the</strong> Belgian and Dutch coasts. In addition,<br />

Normandy can be reached in a single sail given favourable conditions.<br />

But it’s not just those at sea who find its location convenient. With excellent road<br />

access from London and <strong>the</strong> Home Counties, <strong>Dover</strong> is one <strong>of</strong> <strong>the</strong> easiest and price<br />

competitive marinas to drive to on <strong>the</strong> South Coast.<br />

However, it’s more than accessibility that attracts so many pleasure boat<br />

enthusiasts to <strong>Dover</strong>. Due to its closeness to Continental Europe, it <strong>of</strong>fers a<br />

distinctly international atmosphere. It also <strong>of</strong>fers a superb range <strong>of</strong> facilities and<br />

services that have been acknowledged by The Yacht Harbour Association with <strong>the</strong><br />

re-accreditation <strong>of</strong> <strong>the</strong> top Five Gold Anchor rating.<br />

The <strong>Marina</strong> <strong>of</strong>fers 400 berths in three berthing areas key-coded for security.<br />

<strong>Dover</strong> <strong>Marina</strong> is a member <strong>of</strong> TransEurope <strong>Marina</strong>s, a partnership <strong>of</strong> marinas<br />

<strong>of</strong>fering <strong>the</strong>ir resident berth-holders a discount on mooring fees when <strong>the</strong>y visit<br />

<strong>Marina</strong> Facilities<br />

Water & Electricity<br />

A fresh water supply and a metered electrical supply (230v, 10a) are provided to<br />

all berths.<br />

Toilets & Showers<br />

Full toilet and shower facilities, plus baby changing facilities, are provided 24 hours<br />

a day in five places, situated in <strong>the</strong> Wellington Dock, Granville Dock and Tidal Basin.<br />

Laundry<br />

There are two laundry rooms: by <strong>the</strong> Clock Tower and at Wellington Dock.<br />

Security<br />

Key coded entrance to all berthing areas, plus eight cameras monitoring 24 hours a<br />

day in <strong>the</strong> <strong>Marina</strong>. <strong>Dover</strong> has a dedicated port police force and also operates a “Marine<br />

Watch” scheme, see page 9.<br />

Trolleys<br />

Trolleys can be found at each security gate entrance to <strong>the</strong> pontoons. You will need<br />

a £1 coin to release <strong>the</strong> lock (which is refundable). Please return <strong>the</strong> trolleys after<br />

you have finished with <strong>the</strong>m and please do not use <strong>the</strong>m for <strong>the</strong> disposal <strong>of</strong> oil, dirty<br />

equipment or fish boxes.<br />

Pets<br />

Pets residing in <strong>the</strong> UK are permitted in <strong>the</strong> <strong>Marina</strong>. They must be kept on a lead and<br />

are not allowed to come into contact with o<strong>the</strong>r animals. Owners with pets arriving<br />

from foreign ports must keep <strong>the</strong>m on board o<strong>the</strong>rwise an <strong>of</strong>fence will be committed.<br />

Good hygiene must be adhered to at all times.<br />

Mail<br />

Incoming mail can be collected from <strong>the</strong> <strong>Marina</strong> Office. Please ensure that your vessel’s<br />

name is clearly marked on <strong>the</strong> envelope. Outgoing mail can be posted in <strong>the</strong> post box at<br />

<strong>the</strong> foot <strong>of</strong> <strong>the</strong> <strong>Marina</strong> Office steps. The <strong>Marina</strong> postcode is CT17 9BN.<br />

Crew Lift<br />

Situated at berth 75 at Tidal Harbour.<br />

Waste Disposal<br />

Day-to-day rubbish should be disposed <strong>of</strong> in <strong>the</strong> blue bins, which are situated around<br />

<strong>the</strong> <strong>Marina</strong>. Battery, waste oil, scrap metal disposal and recycling facilities are available<br />

in <strong>the</strong> <strong>Marina</strong> Boatyard.<br />

Non-EU food waste<br />

Please contact <strong>the</strong> <strong>Marina</strong> Office if you are arriving from a non-EU country.<br />

Gas<br />

Calor and Camping Gas can be purchased at <strong>the</strong> Sharp & Enright chandlery on Snargate<br />

Street, <strong>the</strong> BP petrol filling station in Limekiln Street and <strong>the</strong> <strong>Marina</strong> fuel berth.<br />

Fuel<br />

Fuel is available from <strong>the</strong> fuel berth alongside Crosswall Quay in <strong>the</strong> Tidal Harbour.<br />

There is a fast fuel pump supplying Marine Gas Oil. Payment can be made by cash<br />

or any major credit card.<br />

Pump-Out<br />

Facility available at <strong>the</strong> Fuel Berth.<br />

Groceries<br />

The BP garage next to <strong>the</strong> <strong>Marina</strong> on Limekiln Street is open 24 hours and sells a wide<br />

range <strong>of</strong> food, household products, magazines and daily international newspapers, dry<br />

goods, cleaning materials and beverages. They also have an ATM/cashpoint facility.<br />

The garage now has a Subway onsite which is open 6am-10pm daily.<br />

Bureau de Change<br />

Available at <strong>Dover</strong> Eurochange in Townwall Street.<br />

Wea<strong>the</strong>r Forecast<br />

24 and 48 hour wea<strong>the</strong>r forecasts and synoptic charts are available from <strong>the</strong> <strong>Marina</strong><br />

Office. Alternatively, you can get <strong>the</strong> latest forecasts by phoning <strong>the</strong> Met Office on<br />

0870 900 0100 (60p per minute) or visiting <strong>the</strong>ir website at www.met<strong>of</strong>fice.gov.uk<br />

Internet<br />

Wireless internet is available through Spectrum Interactive at<br />

www.spectruminteractive.co.uk<br />

Tidal and Non-Tidal Berths<br />

Wellington Dock <strong>of</strong>fers 160 berths which are accessible (HW -1.5 hrs / + 1.5<br />

hrs approx) via a swingbridge. A fur<strong>the</strong>r 107 berths are provided in <strong>the</strong> Tidal<br />

Harbour with 24 hour access, and 133 berths are available in Granville Dock which<br />

is accessible for 60% <strong>of</strong> <strong>the</strong> tidal cycle (HW - 3.5 hrs / + 4.5 hrs approx). Craft can<br />

anchor in <strong>the</strong> Outer Harbour, but owners are advised not to leave vessels unattended.<br />

Scrubbing Berths<br />

A Scrubbing Berth, which is also available for minor repairs, is located on Dolphin Hard in<br />

<strong>the</strong> Tidal Harbour. Use <strong>of</strong> <strong>the</strong> Scrubbing Berth should be arranged at <strong>the</strong> <strong>Marina</strong> Office.<br />

Vessel Delivery<br />

The <strong>Port</strong> can accept vessel deliveries by sea and road transport.<br />

Repairs and Maintenance<br />

A hoist, with a lifting capacity <strong>of</strong> 50 tonnes, is situated in Granville Dock. The hoist is<br />

equipped with a jib crane to remove masts, engines and o<strong>the</strong>r equipment weighing<br />

up to 1 tonne. If you wish to book <strong>the</strong> hoist or require fur<strong>the</strong>r information about o<strong>the</strong>r<br />

specialist services please ask at <strong>the</strong> Boatyard Office, telephone 01304 240400 ext 4545.<br />

Consulates<br />

The directors <strong>of</strong> George Hammond plc act as Honorary Consuls for Denmark, France,<br />

Finland, Germany, Iceland, <strong>the</strong> Ne<strong>the</strong>rlands and Sweden. Foreign nationals from <strong>the</strong>se<br />

countries can contact <strong>the</strong>m on 01304 201201 if <strong>the</strong>y require advice or assistance.<br />

Safety<br />

No swimming, diving or fishing is permitted within <strong>the</strong> confines <strong>of</strong> <strong>the</strong> <strong>Marina</strong>. <strong>Marina</strong><br />

users are also asked to refrain from feeding wildlife. There is a 4 knot speed limit in<br />

<strong>the</strong> Tidal Basin and an 8 knot limit in <strong>the</strong> Harbour.<br />

Club Facilities and Centres:<br />

Sea Sports Centre<br />

Located on <strong>Dover</strong>’s seafront, <strong>the</strong> centre <strong>of</strong>fers a wide range <strong>of</strong> first class water sports.<br />

Activities range from sailing to windsurfing and kayaking to power boating.<br />

The Royal Cinque <strong>Port</strong>s Yacht Club<br />

Offers temporary membership to all <strong>the</strong> boating fraternity, giving <strong>Marina</strong> users<br />

access to <strong>the</strong>ir bars and restaurant. The Clubhouse is situated on Waterloo Crescent<br />

overlooking <strong>the</strong> Harbour.<br />

The White Cliffs Motor Boat and Yacht Club<br />

Based at <strong>the</strong> <strong>Marina</strong>-side Cullins Yard bistro. The club is run by local yachtsmen and<br />

organises a varied programme <strong>of</strong> events year-round.<br />

Marine Watch Scheme<br />

Crime in <strong>Dover</strong> is very low, but <strong>the</strong> security <strong>of</strong> your craft is obviously an important<br />

priority. That’s why we’ve set up a “Marine Watch” scheme, in conjunction with<br />

<strong>the</strong> <strong>Port</strong> <strong>of</strong> <strong>Dover</strong> Police.<br />

The scheme allows you to mark all your equipment with a unique reference number<br />

and <strong>the</strong>n have <strong>the</strong> details entered onto a police database. This greatly speeds up <strong>the</strong><br />

passing on and receiving <strong>of</strong> information in <strong>the</strong> event <strong>of</strong> a crime.<br />

What can boat owners do to prevent crime?<br />

• Secure your craft and gear.<br />

• Do not leave loose gear on deck.<br />

• Do not leave ladders against your boat giving easy access.<br />

• Remove easily removable gear, such as electronics, and take <strong>the</strong>m home<br />

if leaving your craft for a long period <strong>of</strong> time.<br />

• Make a list <strong>of</strong> equipment and security numbers and keep it at home,<br />

away from your craft.<br />

• Assist <strong>Marina</strong> Staff by closing gates behind you.<br />

• If you see anything suspicious, report it on Channel 80 and <strong>the</strong> Berthing Master<br />

will call <strong>the</strong> Police.<br />

• If you are leaving your craft in charge <strong>of</strong> a Boat Keeper or friend, inform <strong>the</strong><br />

Berthing Master.<br />

A <strong>Port</strong> <strong>of</strong> <strong>Dover</strong> police <strong>of</strong>ficer is available to meet you at a mutually convenient time<br />

to discuss Crime Prevention Advice should you require it.<br />

Membership <strong>of</strong> <strong>the</strong> Marine Watch Scheme is completely free <strong>of</strong> charge. A leaflet<br />

giving full details <strong>of</strong> <strong>the</strong> scheme is available from <strong>the</strong> <strong>Marina</strong> Office.<br />

The Neighbourhood Police Officer PC Martin Dadd is always contactable and is to be<br />

found on patrol around <strong>the</strong> area. He also holds neighbourhood policing surgeries where<br />

berth holders can pop along and discuss any issues or concerns.<br />

Neighbourhood Watch Scheme<br />

With support from South East Kent Neighbourhood Watch, <strong>the</strong>re is now a new<br />

Neighbourhood Watch Scheme to prevent crime and anti-social behaviour. Covering<br />

areas including <strong>the</strong> <strong>Marina</strong> and <strong>the</strong> Promenade, <strong>the</strong> Scheme is being managed jointly<br />

by <strong>the</strong> Police and local residents, a number <strong>of</strong> whom will act as a general point <strong>of</strong><br />

contact. As part <strong>of</strong> a successful nationwide initiative, residents are encouraged to report<br />

any suspicious activity, crime or o<strong>the</strong>r matter that may be <strong>of</strong> interest to <strong>the</strong> Police.<br />

Project Kraken<br />

Project Kraken is a waterborne version <strong>of</strong> <strong>the</strong> Neighbourhood Watch Scheme in<br />

partnership with Kent Police. The intention is to ensure <strong>Marina</strong> Berth Holders remain<br />

vigilant <strong>of</strong> any suspicious behaviour and are provided with clear instructions in <strong>the</strong><br />

event <strong>of</strong> any behaviour that <strong>the</strong>y feel is necessary to report.<br />

Project Kraken started as a security policing initiative with Hampshire Police and<br />

assists in enhancing <strong>the</strong> safety and security <strong>of</strong> <strong>the</strong> marine area. The police are<br />

frequently asked: What is suspicious? What does a terrorist look like? The answer to<br />

<strong>the</strong> first question is basically <strong>the</strong> unusual from <strong>the</strong> usual. The answer to <strong>the</strong> second<br />

question is a terrorist can be anyone.<br />

Some examples <strong>of</strong> what is suspicious are:<br />

• A vessel that does not have any flags and is over crewed, something suspicious to<br />

an experienced sailor.<br />

• A small rib or o<strong>the</strong>r vessel that is seen leaving during <strong>the</strong> day with a crew<br />

<strong>of</strong> 2-3 and returning late at night without lights but with a larger crew.<br />

• An unusual number <strong>of</strong> people visiting a vessel, particularly at strange times.<br />

• A craft that you recognise but with a different crew who keep <strong>the</strong>mselves<br />

to <strong>the</strong>mselves.<br />

Because you will know what is out <strong>of</strong> place or unusual in your area, you become <strong>the</strong><br />

eyes and ears <strong>of</strong> <strong>the</strong> Police and your information might be <strong>the</strong> last, first or middle<br />

piece <strong>of</strong> <strong>the</strong> jigsaw.<br />

Environmental Practice<br />

<strong>Dover</strong> Harbour Board work hard to provide a high standard <strong>of</strong> environmental<br />

performance in all activities carried out at <strong>the</strong> <strong>Port</strong> <strong>of</strong> <strong>Dover</strong>. Our practices and<br />

standards are independently assessed on an annual basis for compliance with <strong>the</strong><br />

internationally recognised ISO14001 standard for Environmental Management. This<br />

makes <strong>Dover</strong> <strong>Marina</strong> <strong>the</strong> only marina in <strong>the</strong> UK to be certified to ISO14001, a standard<br />

requiring continuous improvement in environmental performance.<br />

Environmental impacts at <strong>the</strong> <strong>Marina</strong> have been reduced through measures to reduce<br />

energy and water consumption, minimise waste and prevent pollution. Targets are set<br />

against all <strong>of</strong> <strong>the</strong>se aspects each year. For more information about our performance<br />

<strong>Dover</strong> Harbour Board is a Carbon Trust Standard Bearer and <strong>the</strong> carbon footprint <strong>of</strong><br />

<strong>the</strong> <strong>Port</strong> has been reduced year on year since 2006. Over 95% <strong>of</strong> <strong>the</strong> waste disposed<br />

<strong>of</strong> at <strong>the</strong> <strong>Port</strong> <strong>of</strong> <strong>Dover</strong> has achieved landfill avoidance through recycling and energy<br />

from waste practices. In addition, if you have your boat washed at <strong>Dover</strong> <strong>Marina</strong>,<br />

you can be safe in <strong>the</strong> knowledge that <strong>the</strong> environmental impact is minimised by our<br />

system which recycles 95% <strong>of</strong> <strong>the</strong> water utilised. The effluent created is dealt with by<br />

our state <strong>of</strong> <strong>the</strong> art hydrocyclone and filtration system which removes <strong>the</strong> resultant<br />

pollutants and protects our water courses. To help us achieve<br />

our environmental goals we respectfully ask all customers to<br />

adopt and encourage <strong>the</strong> following objectives:<br />

Manage your waste<br />

• Waste oil, oily material, antifoulant paints and varnishes, aerosols and batteries are all<br />

hazardous waste. Please use <strong>the</strong> correct facilities as provided in <strong>the</strong> <strong>Marina</strong> boatyard.<br />

• Gas canisters and electrical equipment are also hazardous waste and must be<br />

disposed <strong>of</strong> appropriately at <strong>the</strong> local waste sorting centre at Whitfield, <strong>Dover</strong>. They<br />

must not be disposed <strong>of</strong> in <strong>the</strong> general waste facilities at <strong>the</strong> <strong>Marina</strong>.<br />

• Flares which have exceeded <strong>the</strong>ir use by date must be disposed <strong>of</strong> responsibly.<br />

Please contact <strong>the</strong> manufacturer or <strong>Dover</strong> coastguard for fur<strong>the</strong>r advice.<br />

• Reduce, re-use and recycle. Use <strong>the</strong> recycling facilities provided at <strong>Marina</strong>s, Clubs<br />

and Harbour Authorities.<br />

Use resources sustainably<br />

• Reduce your electricity, fuel and water consumption and minimise your carbon<br />

footprint.<br />

• Keeping your hull clean and engine maintained will reduce your fuel consumption<br />

and your costs.<br />

Prevent pollution<br />

• Prevent spills by maintaining fuel lines, connections and seals; transfer fuels in<br />

proper containers and with suitable sized funnels and avoid over filling tanks.<br />

• Do not use detergents to disperse oil from <strong>the</strong> water. They are toxic to<br />

aquatic life and can do more damage.<br />

• Choose environmentally sensitive cleaning products and detergents which do not<br />

contain chlorine, bleach, ammonia and phosphates. These are all harmful to <strong>the</strong><br />

environment. Use fresh water or non-toxic alternatives for your onboard sinks,<br />

showers and washing machines.<br />

• Check bilge water is free from oil prior to pumping, and use an oil absorbent if any<br />

is found.<br />

• Ensure loose items, packaging and waste are secure and can not be blown or roll<br />

over <strong>the</strong> side. If items end up in <strong>the</strong> water, retrieve <strong>the</strong>m.<br />

• Alert <strong>the</strong> <strong>Marina</strong> Office immediately should you notice any oil spills.<br />

Minimise disturbance to wildlife and damage to habitats<br />

• When going ashore, use recognised landing places. Shallow seabeds and shoreline<br />

habitats are <strong>of</strong>ten diverse habitats for flora and fauna, nesting birds and o<strong>the</strong>r<br />

breeding species.<br />

• Find out if <strong>the</strong> area you are visiting is protected, and why. Dropping and dragging<br />

your anchor may be damaging vulnerable species and habitats.<br />

• If you spot whales or dolphins, maintain a constant speed and direction. Disturbing<br />

<strong>the</strong>m is illegal and <strong>the</strong>y will be more likely to come over and play in your bow wave.<br />

• Seals are <strong>of</strong>ten spotted in <strong>the</strong> harbour. Do not feed <strong>the</strong>m. Improper food can<br />

make <strong>the</strong>m ill and <strong>the</strong>y are wild animals that carry diseases and <strong>the</strong>y can<br />

attack humans.<br />

Antifouling<br />

• Well maintained antifoulant is important to maintain <strong>the</strong> efficiency <strong>of</strong> your vessel<br />

and prevent <strong>the</strong> spread <strong>of</strong> foreign species which can damage <strong>the</strong> environment.<br />

In <strong>the</strong> event <strong>of</strong> an emergency<br />

• Dial 999, select which service you require, tell <strong>the</strong>m <strong>the</strong> nature <strong>of</strong> <strong>the</strong> emergency,<br />

where you are and remember to include both <strong>the</strong> dock and berth number. Notify <strong>the</strong><br />

<strong>Marina</strong> Office on 01304 241663 or VHF Channel 80.<br />

• Do not attempt to tackle <strong>the</strong> incident yourself unless you are trained and it<br />

is safe to do so. In <strong>the</strong> event <strong>of</strong> an evacuation, leave <strong>the</strong> pontoon and jetty<br />

immediately and head for <strong>the</strong> nearest assembly point.<br />

• Follow all instructions given by <strong>the</strong> <strong>Marina</strong> Staff and Emergency Services.<br />

Fire Safety Advice<br />

• Be aware <strong>of</strong> <strong>the</strong> position <strong>of</strong> <strong>the</strong> fire assembly points in <strong>the</strong> <strong>Marina</strong>.<br />

• No BBQs are allowed on vessels or pontoons.<br />

• Keep additional stores <strong>of</strong> petrol, diesel and gas containers to a minimum.<br />

• Install a smoke detector, test regularly and change <strong>the</strong> unit every five years.<br />

• Ensure all gas installations are in a sound condition and checked by a contractor<br />

who is gas safe registered.<br />

• Ensure your gas bottles are secured and kept away from heat sources.<br />

• Always isolate fuel and gas when leaving your vessel.<br />

• Check electrical heaters, dehumidifiers & 240v equipment before leaving your vessel.<br />

General Safety Advice<br />

• Be aware <strong>of</strong> <strong>the</strong> position in <strong>the</strong> <strong>Marina</strong> <strong>of</strong> emergency boxes with fire extinguishers,<br />

throw lines, lifebelts and escape from water ladders.<br />

• It is forbidden to ride in <strong>the</strong> <strong>Marina</strong> trolleys.<br />

• Swimming, fishing and scuba diving are not permitted in <strong>the</strong> <strong>Marina</strong>.<br />

• Pontoons may be slippery when wet or icy.<br />

• Children should wear suitable life jackets and be supervised when near <strong>the</strong> water.<br />

• All persons must keep clear <strong>of</strong> vessels and plant involved in lifting operations.<br />

• Rescue equipment is provided for everyone’s safety - do not misuse or remove it.<br />

• No bicycles or skateboards to be used on <strong>the</strong> pontoons.<br />

<strong>Marina</strong> Boatyard<br />

General Practice<br />

• All use <strong>of</strong> <strong>the</strong> <strong>Marina</strong> boatyard is subject to <strong>the</strong> Terms & Conditions published in<br />

Appendices 1 and 2 <strong>of</strong> this <strong>Guide</strong>.<br />

• All vessels within <strong>the</strong> boatyard must be covered by <strong>the</strong> appropriate insurance.<br />

(See Terms and Conditions).<br />

• Cars must not be left unattended in <strong>the</strong> boatyard and should be moved upon<br />

request by <strong>the</strong> <strong>Marina</strong> Staff. Please park considerately.<br />

• All contractors are required to have a valid Contractor’s Licence and must report<br />

to <strong>the</strong> <strong>Marina</strong> Office prior to commencing work.<br />

• No hot work is to be undertaken without <strong>the</strong> permission <strong>of</strong> <strong>the</strong> <strong>Marina</strong> Controller.<br />

• Shot/Slurry blasting must not be undertaken without prior permission from <strong>the</strong><br />

<strong>Marina</strong> Controller.<br />

• Please keep <strong>the</strong> area around your vessel clear. All equipment/materials must be<br />

stored aboard your vessel. Facilities for waste oil, oil filters & batteries are located<br />

by <strong>the</strong> entrance gates.<br />

• If scraping paint/antifoul <strong>of</strong>f please sheet <strong>of</strong>f under your vessel and collect all<br />

scraping for disposal.<br />

• Do not leave detachable electronic equipment or tools on board.<br />

• Ladders should not be left in place when not in use.<br />

Boatyard Safety<br />

The boatyard is an active working area. In order to protect yourself & o<strong>the</strong>rs please<br />

work safely & observe <strong>the</strong> following guidelines.<br />

• Hull supports must not be moved o<strong>the</strong>r than by <strong>Marina</strong> Staff.<br />

• Children are not permitted to play in <strong>the</strong> boatyard and must be supervised<br />

at all times.<br />

• No liquids or flammable materials should be stored under vessels.<br />

• Fire extinguishers are positioned around <strong>the</strong> yard. Please familiarise yourself with<br />

<strong>the</strong>ir location.<br />

• Check power cables are in good condition and <strong>of</strong> an approved type for outdoor use.<br />

Remove all cables when not in use.<br />

• Ensure ladders are properly secured to your vessel and remember that ladders are<br />

for access. Work from proper staging and platforms.<br />

• Please ensure <strong>the</strong>re is minimum amount <strong>of</strong> windage on deck.<br />

• Remove sails, spray hoods and dodgers.<br />

• Take extra care in wet, windy and icy conditions.<br />

<strong>Dover</strong>’s Heritage<br />

History<br />

<strong>Dover</strong>’s geographical position and natural harbour have made it one <strong>of</strong> Britain’s<br />

most important ports for thousands <strong>of</strong> years. <strong>Dover</strong>, <strong>the</strong>n called DVBRIS, was one<br />

<strong>of</strong> <strong>the</strong> Roman invaders’ most important naval towns.<br />

After <strong>the</strong> fall <strong>of</strong> <strong>the</strong> Roman Empire, some 400 or so years later, <strong>Dover</strong> became a<br />

settlement for Germanic tribes who crossed <strong>the</strong> North Sea. DOFRAS, as <strong>Dover</strong> was<br />

known at this time, was a major settlement and St. Mary-in-Castro, which was built<br />

on Castle Hill in <strong>the</strong> 10th century, still stands as a monument to <strong>the</strong> Saxon era.<br />

1066 was <strong>the</strong> year that changed British history and <strong>Dover</strong>, which was one <strong>of</strong><br />

<strong>the</strong> country’s most important strategic ports and was one <strong>of</strong> <strong>the</strong> first places William<br />

marched upon after his victory at <strong>the</strong> Battle <strong>of</strong> Hastings. The Norman settlers<br />

rebuilt much <strong>of</strong> Saxon <strong>Dover</strong>, transforming <strong>Dover</strong> Castle into <strong>the</strong> robust fortress<br />

that it is today.<br />

Over <strong>the</strong> next few hundred years, throughout <strong>the</strong> Crusades, <strong>the</strong> Civil War and<br />

<strong>the</strong> Napoleonic Wars, <strong>the</strong> harbour was greatly expanded, (despite <strong>the</strong> city being<br />

burned to <strong>the</strong> ground by Prince Louis in 1216). By 1804, gun batteries had been<br />

built and <strong>the</strong> Western Heights were covered with military facilities.<br />

<strong>Dover</strong> was very much in <strong>the</strong> frontline during World War I and World War II, being<br />

home to <strong>the</strong> <strong>Dover</strong> Patrol, which maintained Britain’s vital control <strong>of</strong> <strong>the</strong> Channel.<br />

<strong>Dover</strong> <strong>Marina</strong> Who’s Who<br />

Chris Windsor, <strong>Marina</strong> Controller CMM<br />

Chris has worked at <strong>Dover</strong> Harbour Board since 1995. Before<br />

being promoted to <strong>Marina</strong> Controller in July 2004, he was a Relief<br />

Berthing Master and Shore Service Operative. Chris is responsible<br />

for day-to-day operations, leading <strong>the</strong> <strong>Marina</strong> team and managing<br />

<strong>the</strong> Berthing Masters. He is also responsible for <strong>the</strong> Harbour Patrol<br />

Launch and <strong>the</strong> boatyard staff. Chris is <strong>the</strong> most senior person on<br />

site at <strong>the</strong> <strong>Marina</strong> and is available to help customers with any<br />

problems that might arise.<br />

The <strong>Marina</strong> Team<br />

The team comprises fully trained Berthing Masters, who<br />

provide cover in <strong>the</strong> <strong>Marina</strong> Office operating <strong>the</strong> dock gates and<br />

swingbridge, answering enquiries, monitoring security CCTV and<br />

admin duties. There is also a full complement <strong>of</strong> boatyard services<br />

and a 24/7 Harbour Patrol Launch.<br />

While <strong>the</strong> <strong>Marina</strong> Team will endeavour to provide 24/7 cover at<br />

<strong>the</strong> <strong>Marina</strong> Office, <strong>the</strong> Board reserves <strong>the</strong> right to temporarily<br />

suspend or discontinue <strong>the</strong> provision <strong>of</strong> cover should operational<br />

emergencies require.<br />

Navigation Information<br />

IMPORTANT<br />

<strong>Dover</strong> is Britain’s busiest port. Permission must always be obtained by VHF Ch.74 from<br />

<strong>Dover</strong> <strong>Port</strong> Control before entering or leaving by <strong>the</strong> Eastern or Western entrances.<br />

Even when given an OK to proceed, a careful watch must be taken <strong>of</strong> o<strong>the</strong>r ship<br />

movements.<br />

Arrival Procedure<br />

<strong>Dover</strong> <strong>Port</strong> Control maintains a 24 hour listening watch on VHF Ch.74, 12 or 16 (call<br />

sign DOVER PORT CONTROL). All small craft are recommended to call PORT CONTROL<br />

when 2 miles <strong>of</strong>f to receive instructions for entering.<br />

Both entrances are busy with frequent ferry traffic. There are also strong currents, so<br />

entry under sail should not be attempted. Craft that are unable to use engines should<br />

inform <strong>Port</strong> Control on Ch.74. The Harbour Patrol Launch will assist if necessary and<br />

will be happy to guide you in.<br />

Small or slow craft are not normally given permission to enter <strong>the</strong> Outer Harbour until<br />

<strong>the</strong>y are within 200 metres <strong>of</strong> ei<strong>the</strong>r entrance.<br />

Whilst navigating within <strong>the</strong> harbour or its approaches please keep a listening watch on<br />

Ch.74. In South Westerly gales a very confused and steep swell may develop <strong>of</strong>f <strong>the</strong><br />

Western Entrance. Caution must be exercised when strong winds coincide with high<br />

water springs or when approaching <strong>the</strong> reception pontoons at tidal heights below two<br />

metres – <strong>the</strong> channel is cut from <strong>the</strong> chalk seabed.<br />

It is important to keep on <strong>the</strong> line <strong>of</strong> <strong>the</strong> two black and white daymark transit boards<br />

marking <strong>the</strong> deep-water approach when entering or leaving <strong>the</strong> marina basin.<br />

Small craft should be aware that <strong>the</strong> access channel is frequently used by larger<br />

vessels, such as <strong>the</strong> harbour tugs and dredger, and should not enter <strong>the</strong> channel until<br />

confirmed it is clear to do so continuing to monitor VHF Ch.74/Ch.80 as appropriate.<br />

Do not pass between <strong>the</strong> North Cardinal Buoy inside <strong>the</strong> Western Entrance<br />

and <strong>the</strong> Sou<strong>the</strong>rn Breakwater.<br />

On arrival keep <strong>the</strong> two green buoys to starboard at all times and at low<br />

water stay in <strong>the</strong> main channel until <strong>the</strong> leading light is opened.<br />

This light (FW vis 324° to 333°T) is positioned on <strong>the</strong> quay edge by <strong>the</strong><br />

second seaward pile <strong>of</strong> <strong>the</strong> Crosswall Quay pontoon.<br />

Vessels without VHF should try and establish visual contact with <strong>Port</strong> Control to<br />

determine whe<strong>the</strong>r it is safe to enter or leave <strong>the</strong> harbour. Alternatively, if you have a<br />

mobile phone you can contact <strong>the</strong> <strong>Marina</strong> Office on +44 (0)1304 241663.<br />

If contact cannot be established, vessels should keep a safe distance from both<br />

entrances and wait for <strong>the</strong> Harbour Patrol Launch to come to your assistance.<br />

Vessels without VHF leaving <strong>the</strong> <strong>Marina</strong>, should advise <strong>the</strong> <strong>Marina</strong> Office who<br />

will liaise with <strong>the</strong> Harbour Patrol Launch and <strong>Port</strong> Control to gain clearance.<br />

Quick flashing on <strong>the</strong> Aldis Lamp from <strong>Port</strong> Control means you should not<br />

enter or leave as ano<strong>the</strong>r vessel has been given permission to manoeuvre.<br />

<strong>Dover</strong> <strong>Marina</strong> on Ch.80 (call sign DOVER MARINA) is monitored continuously<br />

and should only be used within <strong>the</strong> Tidal Harbour and <strong>the</strong> <strong>Marina</strong>.<br />

Automatic Radar VHF/DF identification is in operation. The Channel Navigation<br />

Information Service maintains a 24 hour listening watch on VHF Ch.16 or 11<br />

Customs and Immigration<br />

All craft entering <strong>the</strong> <strong>Port</strong> from non-EU countries, or with crew members from<br />

non-EU countries, must fly a yellow Q flag until <strong>the</strong> Border Force has boarded.<br />

The Berthing Masters have a supply <strong>of</strong> forms C1331 which should be completed and<br />

given to <strong>the</strong> Border Force if you plan to visit a non-EU country.<br />

RYA Active <strong>Marina</strong> Programme<br />

<strong>Dover</strong> <strong>Port</strong> <strong>Marina</strong> has joined <strong>the</strong> RYA Active <strong>Marina</strong> Programme.<br />

Through a programme <strong>of</strong> events and opportunities, you can take<br />

part in practical training workshops at your marina which are tailormade<br />

to build your knowledge and boost your confidence. Alongside<br />

workshops, <strong>the</strong> Active <strong>Marina</strong> Programme will also present you with<br />

<strong>the</strong> opportunity to get to know and socialise with o<strong>the</strong>rs at your marina. Enjoy cruising<br />

with o<strong>the</strong>r berth holders and boat owners and spend time with like-minded people at<br />

social events, organised in association with <strong>the</strong> Royal Cinque <strong>Port</strong>s Yacht Club. You can<br />

Whe<strong>the</strong>r you are a visitor or a permanent berth holder we look forward to meeting you and<br />

giving you a special welcome to this splendid area <strong>of</strong> <strong>the</strong> coast.<br />

Royal Cinque <strong>Port</strong>s Yacht Club<br />

The Royal Cinque <strong>Port</strong>s Yacht Club, founded in 1872, is located some 300m along <strong>the</strong> waterfront,<br />

East <strong>of</strong> <strong>the</strong> <strong>Marina</strong>. The clubhouse includes a bar with real ales, AV room, meeting/lecture rooms<br />

and a terrace overlooking <strong>the</strong> harbour.<br />

The club is open daily at lunchtime and in <strong>the</strong> evenings Monday to Saturday and Sunday<br />

lunchtime/afternoon. Light snacks to more substantial meals are available.<br />

Our membership <strong>of</strong> over 300 includes both sailing and motor boat owners, as well as many social<br />

members. New members are always welcome. The Club organises a full racing and cruising<br />

programme, including several events in collaboration with yacht clubs in Nor<strong>the</strong>rn France. There<br />

are Royal Yachting Association courses and meetings for education and social activities. As well as<br />

monthly Quiz Nights, our regular social events include Burns’ Night in January, Fitting-out Supper<br />

in March, St George’s Day Dinner in April, Trafalgar Day Supper in October and <strong>the</strong> <strong>Dover</strong> Town<br />

Regatta in July. The Laying Up Supper is in November and <strong>of</strong> course, we hold traditional festivities<br />

at Christmas and <strong>the</strong> New Year.<br />

White Cliffs Motorboat and Yacht Club<br />

This informal Club bases its social functions at Cullin’s Yard, <strong>the</strong> popular marina side restaurant<br />

overlooking <strong>the</strong> Wellington Dock.<br />

The Club’s concept is not that <strong>of</strong> a Yacht Club in <strong>the</strong> usual sense, but ra<strong>the</strong>r its principal function<br />

is to provide <strong>the</strong> Club membership with <strong>the</strong> means <strong>of</strong> communicating with each o<strong>the</strong>r (usually by<br />

email) so <strong>the</strong>y can arrange <strong>the</strong>ir own boating/sailing activities toge<strong>the</strong>r. The Club itself does not<br />

organise racing or cruising, but <strong>of</strong> course members acting in <strong>the</strong>ir own right are free to make <strong>the</strong>ir<br />

own arrangements as to what <strong>the</strong>y might like to do in company when on <strong>the</strong> water.<br />

The Club’s o<strong>the</strong>r aim is to arrange social events including a supper at <strong>the</strong> beginning and end <strong>of</strong><br />

<strong>the</strong> season so that members can get toge<strong>the</strong>r and socialise in an agreeable setting. For instance,<br />

several members frequently meet for supper on a Wednesday evening at Cullin’s Yard.<br />

Because <strong>of</strong> <strong>the</strong> limited objectives <strong>of</strong> <strong>the</strong> Club and <strong>the</strong> fact that we have no premises or expenses,<br />

we do not currently charge for membership.<br />

<strong>Marina</strong> Tariff <strong>2013</strong><br />

Tariffs are valid between 1 April <strong>2013</strong> and 31<br />

March 2014. They include VAT at <strong>the</strong> prevailing<br />

rate at <strong>the</strong> time <strong>of</strong> invoicing (unless o<strong>the</strong>rwise<br />

stated).<br />

Please note that all <strong>the</strong> services and facilities<br />

within <strong>the</strong> <strong>Marina</strong> are subject to <strong>the</strong> Terms and<br />

Conditions in Appendices 1 and 2<br />

Pontoon Berths<br />

The price per metre includes water and one car<br />

park permit. A 50% surcharge may be applicable<br />

to a vessel where, in <strong>the</strong> reasonable view <strong>of</strong> <strong>Dover</strong><br />

Harbour Board (<strong>the</strong> Board), its use <strong>of</strong> a berth<br />

restricts or prevents <strong>the</strong> use <strong>of</strong> an adjacent berth.<br />

General Conditions<br />

(applicable to all pontoon berths)<br />

In addition to <strong>the</strong> terms and conditions set out in<br />

Appendix 1, please note:<br />

1. The minimum length chargeable is 8 metres in<br />

<strong>the</strong> Granville Dock and Tidal Harbour.<br />

2. Charges will be based on length overall <strong>of</strong> <strong>the</strong><br />

vessel to one decimal point.<br />

3. A deposit <strong>of</strong> £100 is payable when booking a<br />

berth.<br />

4. Berth charges must be paid in advance <strong>of</strong><br />

occupancy. Berth charges which are not paid by<br />

<strong>the</strong> due date shown on <strong>the</strong> invoice are liable to<br />

a £50 administration charge.<br />

5. Where payment is not received by <strong>the</strong> due<br />

date, in addition to <strong>the</strong> administration charge<br />

referred to at 4 above, <strong>the</strong> Board reserves <strong>the</strong><br />

right to withdraw <strong>the</strong> pontoon berth rate and<br />

levy charges on a different basis, as it shall<br />

decide at its discretion.<br />

6. Refunds may be given subject to <strong>the</strong> Board’s<br />

cancellation and refund policy.<br />

7. Boat owners are requested to give one month’s<br />

notice before vacating <strong>the</strong>ir berth.<br />

8. Berths may be allocated to visitors when<br />

regular berth holders’ vessels are absent.<br />

9. Customers who change <strong>the</strong>ir berthing<br />

arrangements may be subject to an<br />

administration fee <strong>of</strong> £50.<br />

Monthly Berths<br />

These berths will be allocated according to space<br />

availability in <strong>the</strong> Wellington Dock and use is<br />

subject to a minimum charge <strong>of</strong> one month. No<br />

refunds will be given. Car parking is not included,<br />

but is available at an additional cost.<br />

• £41.86 per metre per month payable in advance.<br />

Weekly Berth<br />

These berths will be allocated according to space<br />

availability in <strong>the</strong> Wellington Dock and use is<br />

subject to a minimum charge <strong>of</strong> one week. No<br />

refunds will be given. Car parking is not included,<br />

but is available at an additional cost. No refunds<br />

will be given.<br />

Electricity Charges<br />

Except for visitor berths, electricity is provided via<br />

a metered supply.<br />

Electricity is charged per KWh – £ (subject to<br />

market prices).<br />

One ‘i-button’ will be supplied to every berth<br />

holder requesting electricity. The ‘i-button’ must<br />

be used to connect to <strong>the</strong> <strong>Marina</strong> electricity<br />

network.<br />

Additional/replacement ‘i-button’ – £10 per unit.<br />

Electricity will be supplied on a prepaid basis, so<br />

berth holders must ensure that <strong>the</strong>ir ‘i-button’<br />

account has sufficient credit to access electricity.<br />

Any customer not wishing to draw<br />

electricity from <strong>the</strong> <strong>Marina</strong> network must<br />

notify <strong>the</strong> <strong>Marina</strong> Office in writing when<br />

applying for, or renewing, a berth.<br />

Loyalty Scheme<br />

Berth holders are entitled to a loyalty discount on<br />

<strong>the</strong>ir berthing fees once <strong>the</strong>y have completed two<br />

years’ continuous custom.<br />

Continuous custom will be calculated from <strong>the</strong><br />

date <strong>the</strong> berth was first allocated.<br />

The discount rate is calculated as follows:<br />

Over 2 years continuous custom – 2 per cent<br />

Over 4 years continuous custom – 3 per cent<br />

Over 7 years continuous custom – 4 per cent<br />

Over 10 years continuous custom – 5 per cent<br />

The discount will be issued in <strong>the</strong> form <strong>of</strong> a credit<br />

note which can be used for payment against<br />

account.<br />

The scheme applies only to continuous custom<br />

and <strong>the</strong> Board reserves <strong>the</strong> right to withhold <strong>the</strong><br />

discount and/or disapply <strong>the</strong> scheme in respect<br />

<strong>of</strong> a berth holder whose account is in arrears.<br />

Contractor Licences<br />

Boat owners may wish to employ contractors<br />

to work on <strong>the</strong>ir boats who are not persons or<br />

companies that rent premises from <strong>the</strong> Board.<br />

It is <strong>the</strong> duty <strong>of</strong> <strong>the</strong> boat owner to ensure that<br />

such contractors notify <strong>the</strong> Board’s <strong>Marina</strong> Office<br />

<strong>of</strong> <strong>the</strong>ir presence and purpose at <strong>the</strong> <strong>Marina</strong> and<br />

provide evidence <strong>of</strong> public liability insurance in<br />

a sum <strong>of</strong> not less than £5,000,000 in respect <strong>of</strong><br />

each incident. These contractors are required to<br />

pay a licence fee to work at <strong>the</strong> <strong>Marina</strong> premises<br />

for each person:<br />

An additional charge will be levied in respect <strong>of</strong> use<br />

<strong>of</strong> <strong>the</strong> Board’s car parking facilities by a contractor,<br />

Towage Assistance<br />

When assisting yachts by towing <strong>the</strong>m into<br />

<strong>the</strong> harbour from within port limits or from<br />

<strong>the</strong> Outer Harbour to <strong>the</strong> <strong>Marina</strong> area <strong>the</strong>re<br />

will be a charge <strong>of</strong> £82.48 made for each act<br />

<strong>of</strong> assistance. The United Kingdom Standard<br />

Conditions for Towage and O<strong>the</strong>r Services<br />

(Revised 1986) will apply.<br />

Car Parking<br />

<strong>Marina</strong> car parking is available to berth holders<br />

only at a cost <strong>of</strong> £105.50 per permit per year or<br />

£13.65 per permit per month. Annual pontoon<br />

berthing fees include one permit. Parking permits<br />

for crew are available at £6.90 per day, £21.00 per<br />

week or £47.25 per month. Parking space is not<br />

guaranteed to be close to your berth and is at <strong>the</strong><br />

direction <strong>of</strong> <strong>Marina</strong> staff. Car parking is provided<br />

subject to <strong>the</strong> Terms and Conditions set out in<br />

Appendix 1.<br />

Shore Storage<br />

The vessel and mast belonging to any annual<br />

berth holders occupying pontoon berths may be<br />

stored ashore for a maximum <strong>of</strong> 8 weeks free<br />

<strong>of</strong> charge after which charges apply. It is <strong>the</strong><br />

berth holder’s responsibility to arrange for<br />

<strong>the</strong> vessel to be re-launched prior to <strong>the</strong><br />

expiry <strong>of</strong> <strong>the</strong> 8 week period to avoid fur<strong>the</strong>r<br />

charges being levied.<br />

Annual berth holders who wish to stay ashore<br />

after <strong>the</strong>ir free period will be charged £4.94<br />

per metre per week or part <strong>the</strong>re<strong>of</strong>. Cradle hire<br />

charges apply after any free storage period at <strong>the</strong><br />

rate shown. All applicable fees shall be paid in<br />

accordance with <strong>the</strong> Board’s invoice.<br />

At <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> <strong>Marina</strong> management, <strong>the</strong><br />

Board reserves <strong>the</strong> right to charge one and a half<br />

times <strong>the</strong> standard shore storage rate for excessive<br />

scaffolding/tents, regardless <strong>of</strong> whe<strong>the</strong>r this is<br />

during a berth holder’s free storage period.<br />

The Board may let <strong>the</strong> vacant pontoon berth whilst<br />

<strong>the</strong> vessel is ashore.<br />

Trailers and cradles may be stored ashore at<br />

a charge <strong>of</strong> £27.50 per week or part <strong>the</strong>re<strong>of</strong>.<br />

Masts may be stored ashore at a charge <strong>of</strong><br />

£1.85 per week.<br />

General Conditions<br />

1 The above charges apply 08.00-16.00 five<br />

days a week (Monday to Friday, including<br />

Bank Holidays) and 08.00-12.00 on Saturdays.<br />

A £100.00 call-out charge will apply at o<strong>the</strong>r<br />

times in addition to <strong>the</strong> above charges.<br />

2 Charges will be based on overall length <strong>of</strong> <strong>the</strong><br />

vessel to one decimal point with a minimum <strong>of</strong><br />

7.0m per vessel.<br />

3 Electrics are to be disconnected and bottle<br />

screws freed <strong>of</strong>f. Final setting up and locking<strong>of</strong>f<br />

for a rig is <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> owner.<br />

4 High pressure hull wash-<strong>of</strong>f does not include<br />

scraping <strong>of</strong>f barnacles etc. Badly fouled<br />

boats will incur additional labour charges at <strong>the</strong><br />

discretion <strong>of</strong> <strong>the</strong> <strong>Marina</strong> management.<br />

5 <strong>Marina</strong> labour required to step or unstep a<br />

mast or for scraping <strong>of</strong>f barnacles etc., will be<br />

charged at £39.00 (inc. VAT) per hour.<br />

6 All shore services are provided subject to <strong>the</strong><br />

terms and conditions contained in Appendix 2.<br />

7 Masts will only be unstepped if all sails are<br />

removed.<br />

General Terms <strong>of</strong> Business<br />

Prices<br />

All transactions are at <strong>the</strong> prices prevailing on<br />

<strong>the</strong> day <strong>of</strong> transaction. Prices are charged as<br />

per published tariffs, but are subject to revision<br />

following a period <strong>of</strong> 14 days notice.<br />

Credit accounts<br />

Customers wishing to open a new account should<br />

provide pro<strong>of</strong> <strong>of</strong> residence and a credit card account.<br />

Credit terms<br />

The credit period will be specified on <strong>the</strong> Board’s<br />

invoice.<br />

Methods <strong>of</strong> payment<br />

Payment may be made by cheque, banker’s draft<br />

or through BACS (Banks Automated Clearing<br />

System). The Board’s bank account is at Lloyds<br />

TSB. The sort code is 30-93-34 and <strong>the</strong> account<br />

number is 00193204.<br />

Non-Compliance<br />

In <strong>the</strong> event <strong>of</strong> payment not being received in<br />

accordance with <strong>the</strong>se terms <strong>the</strong> Board reserves<br />

<strong>the</strong> right to withdraw <strong>the</strong> credit facilities and future<br />

services.<br />

Interest<br />

The terms <strong>of</strong> <strong>the</strong> Late Payment <strong>of</strong> Commercial<br />

Debts (Interest) Act 1998 may be invoked when<br />

applicable. In <strong>the</strong> case <strong>of</strong> individuals, interest shall<br />

be charged at 3% above <strong>the</strong> Bank <strong>of</strong> England<br />

base rate from time to time in force.<br />

Queries<br />

Any queries in relation to invoices should be<br />

notified in writing within 14 days <strong>of</strong> receipt <strong>of</strong> <strong>the</strong><br />

invoice.<br />

Personal information<br />

The Board is registered under <strong>the</strong> Data Protection<br />

Act 1998 and is bound to comply with <strong>the</strong> terms<br />

<strong>of</strong> <strong>the</strong> Act in all dealings with personal information.<br />

The Board will only use your personal information<br />

for stated purposes and, unless required to do so<br />

by law, will not disclose personal information to<br />

third parties without express permission.<br />

PLEASE NOTE: In <strong>the</strong> interests <strong>of</strong> security, <strong>the</strong><br />

personal details <strong>of</strong> berth holders (including visitors)<br />

may be made available to national security and<br />

law enforcement agencies for <strong>the</strong> purposes <strong>of</strong><br />

Appendix 1<br />

<strong>Marina</strong> Terms & Conditions<br />

<strong>Dover</strong> <strong>Marina</strong> is owned and operated by <strong>the</strong> <strong>Dover</strong><br />

Harbour Board and is provided for quiet enjoyment by<br />

yachtsmen.<br />

1. INTERPRETATION<br />

“The Berthing Licence” shall mean <strong>the</strong> licence granted to<br />

<strong>the</strong> Owner by <strong>the</strong> Board to use <strong>the</strong> <strong>Marina</strong> under <strong>the</strong>se<br />

terms and conditions.<br />

“The Board” shall mean <strong>the</strong> <strong>Dover</strong> Harbour Board.<br />

“The Harbour Master” shall include <strong>Port</strong> Control and all<br />

persons acting under <strong>the</strong> authority <strong>of</strong> <strong>the</strong> Board and<br />

fulfilling <strong>the</strong> role <strong>of</strong> Harbour Master.<br />

“The <strong>Marina</strong>” shall include any area <strong>of</strong> <strong>the</strong> Board’s estate<br />

(including any area on or beneath <strong>the</strong> surface <strong>of</strong> <strong>the</strong><br />

water) and any o<strong>the</strong>r facility provided by <strong>the</strong> Board for use<br />

for or in connection with <strong>the</strong> berthing <strong>of</strong> a vessel.<br />

“The Owner” shall include a lawful owner, charterer,<br />

master or agency or any o<strong>the</strong>r person for <strong>the</strong> time being<br />

lawfully in charge (o<strong>the</strong>r than <strong>the</strong> Board) <strong>of</strong> <strong>the</strong> vessel<br />

ber<strong>the</strong>d at <strong>the</strong> <strong>Marina</strong> or <strong>the</strong> vehicle or goods brought on<br />

<strong>the</strong> <strong>Marina</strong>.<br />

2. ACCEPTANCE<br />

Entry into <strong>the</strong> <strong>Marina</strong> by water or by land or use <strong>of</strong> a<br />

mooring buoy indicates recognition and acceptance <strong>of</strong><br />

<strong>the</strong>se Terms and Conditions which govern use <strong>of</strong> <strong>the</strong><br />

<strong>Marina</strong> and set out <strong>the</strong> obligations that <strong>the</strong> Owner must<br />

observe.<br />

Upon acceptance <strong>of</strong> <strong>the</strong> Owner’s application for mooring<br />

within <strong>the</strong> <strong>Marina</strong>, <strong>the</strong> Board grants <strong>the</strong> Owner a Berthing<br />

Licence only. Under no circumstances does any form <strong>of</strong><br />

landlord and tenant relationship arise under <strong>the</strong>se Terms<br />

and Conditions and <strong>the</strong> Owner shall have no rights <strong>of</strong><br />

residency or entitlement to <strong>the</strong> exclusive use <strong>of</strong> any<br />

particular berth.<br />

3. STATUTORY POWERS, BYELAWS, SAFETY AND<br />

MANAGEMENT<br />

3.1. Statutory Powers<br />

The Harbour Master is empowered to give directions<br />

regarding <strong>the</strong> mooring, removal from or sailing <strong>of</strong> vessels<br />

within <strong>the</strong> limits <strong>of</strong> <strong>the</strong> harbour, including <strong>the</strong> <strong>Marina</strong>.<br />

Details <strong>of</strong> <strong>the</strong>se powers may be obtained from <strong>the</strong> Board’s<br />

Company Secretary.<br />

3.2. Bye-laws<br />

(a) The Owner’s attention is drawn to <strong>the</strong> authority <strong>of</strong> <strong>the</strong><br />

Harbour Master under <strong>the</strong> Board’s Bye-laws. All instructions<br />

<strong>of</strong> <strong>the</strong> Harbour Master must be obeyed.<br />

(b) Any use <strong>of</strong> vessels or <strong>of</strong> vehicles within <strong>the</strong> area <strong>of</strong><br />

<strong>the</strong> harbour and its approaches including <strong>the</strong> <strong>Marina</strong> is<br />

subject to <strong>the</strong> Board’s Bye-laws and o<strong>the</strong>r requirements<br />

administered by <strong>the</strong> Harbour Master. Copies <strong>of</strong> <strong>the</strong> Byelaws<br />

may be obtained from <strong>the</strong> Board upon request.<br />

3.3. Safety<br />

(a) The Owner shall navigate and control his vessel at all times<br />

in a safe and seaman-like manner and in accordance with<br />

<strong>the</strong> law <strong>of</strong> <strong>the</strong> sea, where applicable, and <strong>the</strong> General<br />

Directions issued by <strong>the</strong> Board from time to time so as<br />

not to cause danger or inconvenience to any o<strong>the</strong>r person<br />

or vessel. At all times <strong>the</strong> vessel shall proceed at a speed<br />

which is safe in relation to prevailing conditions and<br />

shall at no time exceed <strong>the</strong> speed limit <strong>of</strong> 8 knots within<br />

<strong>the</strong> harbour or 4 knots within <strong>the</strong> <strong>Marina</strong>. If a vessel is<br />

underway within <strong>the</strong> <strong>Marina</strong> its engine(s) must be used.<br />

(b) Sail-boarding, swimming, fishing, diving and <strong>the</strong> like are<br />

prohibited in <strong>the</strong> <strong>Marina</strong>.<br />

(c) Young children must wear adequate life jackets and must<br />

be supervised by a responsible adult at all times while at<br />

<strong>the</strong> <strong>Marina</strong>.<br />

(d) Dangerous, flammable, poisonous or noxious substances,<br />

spirit, oil or fluid may not be brought into <strong>the</strong> <strong>Marina</strong><br />

except in properly secured containers, staunch<br />

against leakage and in compliance with relevant legal<br />

requirements. Acetylene (UN 1001) and Dimethyl Sulphate<br />

(UN 1595) may under no circumstances be brought into<br />

<strong>the</strong> <strong>Marina</strong>. The Owner shall comply with <strong>the</strong> <strong>Dover</strong><br />

Harbour Revision Orders 1978 and 2006, as well as <strong>the</strong><br />

Dangerous Goods in Harbour Regulations 1987 at all times.<br />

(e) The Owner shall take all necessary precautions against <strong>the</strong><br />

outbreak <strong>of</strong> fire in or upon <strong>the</strong> vessel and shall observe all<br />

statutory and local regulations relating to fire prevention.<br />

Each vessel should carry at least one fire extinguisher <strong>of</strong> a<br />

BSI standard type and size, in good working order ready<br />

for immediate use in case <strong>of</strong> a fire.<br />

3.4. Management<br />

(a) The dock gates and swing bridge are operated by<br />

<strong>the</strong> <strong>Marina</strong> staff and will be opened for <strong>the</strong> maximum<br />

practicable period on each tide. Details <strong>of</strong> opening times<br />

may be obtained from <strong>the</strong> <strong>Marina</strong> Office. The Board<br />

accepts no liability for any loss, damage or costs <strong>of</strong><br />

whatsoever nature suffered by <strong>the</strong> Owner as a result <strong>of</strong><br />

<strong>the</strong> dock gates or <strong>the</strong> swing bridge being inoperative,<br />

except to <strong>the</strong> extent that such inoperation is caused by <strong>the</strong><br />

negligence or wilful act <strong>of</strong> <strong>the</strong> Board or those for whom <strong>the</strong><br />

Board is responsible.<br />

(b) The Board accepts no responsibility for <strong>the</strong> suitability<br />

<strong>of</strong> any berth, structure or gear provided unless full and<br />

accurate details <strong>of</strong> <strong>the</strong> vessel, crew, gear and contents<br />

which might affect use <strong>of</strong> <strong>the</strong> berth are given to <strong>the</strong> Board<br />

prior to allocation <strong>of</strong> a berth.<br />

(c) The Board reserves <strong>the</strong> right to allocate berths at its<br />

discretion and to refuse any Owner’s request for a specific<br />

berth.<br />

(d) The Board accepts no responsibility for any disturbance,<br />

noise, dust or any o<strong>the</strong>r inconvenience caused by<br />

commercial cargo operations or o<strong>the</strong>r activity which may<br />

be carried out at <strong>the</strong> <strong>Marina</strong> or on any adjoining land.<br />

(e) The Berthing Licence is not assignable by <strong>the</strong> Owner and<br />

<strong>the</strong> Owner shall not lend it or permit any third party to use<br />

it nor shall <strong>the</strong> Owner use his allocated berth for any o<strong>the</strong>r<br />

vessel unless <strong>the</strong> Owner has <strong>the</strong> Board’s prior consent.<br />

(f) The Board reserves <strong>the</strong> right to use or let out a berth<br />

whenever a vessel is absent and without refunding<br />

berthing fee. The Owner undertakes to give <strong>the</strong> Board at<br />

least 24 hours prior notice <strong>of</strong> intention to return to <strong>the</strong><br />

<strong>Marina</strong>, failing which <strong>the</strong> Board accepts no liability should


<strong>the</strong>re not be a suitable berth available upon <strong>the</strong> Owner’s<br />

return, without prejudice to <strong>the</strong> Owner’s obligation to pay<br />

<strong>the</strong> berthing fee.<br />

(g) No person may use any vessel for residential purposes or<br />

as a houseboat in <strong>the</strong> <strong>Marina</strong> and, under no circumstance<br />

should any berth holder register personal documents (for<br />

example, driver’s licences, bank statements, loyalty cards,<br />

etc) to <strong>the</strong> <strong>Marina</strong> Office or <strong>the</strong> <strong>Marina</strong> generally. Use <strong>of</strong><br />

<strong>the</strong> <strong>Marina</strong> address for <strong>the</strong> purpose <strong>of</strong> diverting personal<br />

correspondence is strictly forbidden. The Owner must<br />

supply details <strong>of</strong> <strong>the</strong> Owner’s home address and shall be<br />

obliged to produce evidence to <strong>the</strong> Board <strong>of</strong> such address<br />

within 7 days <strong>of</strong> a request to do so.<br />

(h) Subject to <strong>the</strong> Harbour Master’s discretion and on such<br />

conditions as <strong>the</strong> Board decides, no part <strong>of</strong> <strong>the</strong> <strong>Marina</strong><br />

or premises or vessel shall be used by <strong>the</strong> Owner or<br />

any persons visiting a vessel for commercial purposes<br />

(including hiring, embarkation <strong>of</strong> charter parties, etc.)<br />

whilst situated in <strong>the</strong> <strong>Marina</strong>. Commercial fishing is strictly<br />

prohibited.<br />

(i) All berth holders are required to give one month’s prior<br />

written notice to <strong>the</strong> Board before vacating <strong>the</strong>ir berth.<br />

Failure to do so may render <strong>the</strong> Owner liable to pay<br />

an additional cancellation charge – please refer to <strong>the</strong><br />

cancellation and refund clauses (Clauses 23 to 25) below.<br />

(j) Within 7 days <strong>of</strong> any sale, transfer or mortgage <strong>of</strong> any<br />

vessel which is subject to a Berthing Licence <strong>the</strong> Owner<br />

shall notify <strong>the</strong> Board in writing <strong>of</strong> <strong>the</strong> name and address<br />

<strong>of</strong> <strong>the</strong> Purchaser, Transferee or Mortgagee, as <strong>the</strong> case<br />

may be. In <strong>the</strong> case <strong>of</strong> a sale or transfer <strong>the</strong> Owner shall<br />

notify <strong>the</strong> Purchaser or Transferee that according to<br />

Clause 3.4(e) <strong>the</strong> Berthing Licence is not assignable and<br />

shall ensure that it is a term and condition <strong>of</strong> sale that<br />

<strong>the</strong> Purchaser or Transferee makes an application to <strong>the</strong><br />

<strong>Marina</strong> Office for a berth should <strong>the</strong> new owner wish to<br />

remain at <strong>the</strong> <strong>Marina</strong>. If <strong>the</strong> Owner fails to ensure that <strong>the</strong><br />

Purchaser or Transferee makes such an application and<br />

<strong>the</strong> vessel continues to berth in <strong>the</strong> <strong>Marina</strong>, <strong>the</strong>n until such<br />

application is made <strong>the</strong> Owner will continue to be liable<br />

under <strong>the</strong>se Terms and Conditions in all respects.<br />

3.5 Electricity<br />

(a) Except for visitors berths, electricity is provided via a<br />

metered supply and access is subject to a charge per unit<br />

used. Any customer not wishing to draw electricity from<br />

<strong>the</strong> <strong>Marina</strong> network must notify <strong>the</strong> <strong>Marina</strong> Office in writing<br />

when applying for, or renewing a berth.<br />

(b) One ‘i-button’ will be issued to each berth holder wishing<br />

to draw electricity from <strong>the</strong> <strong>Marina</strong> network. A charge will<br />

be payable for any additional or replacement ‘i-buttons’.<br />

(c) The berth holder is responsible for <strong>the</strong> security <strong>of</strong> <strong>the</strong>ir<br />

‘i-button’ at all times and, in <strong>the</strong> event <strong>of</strong> an ‘i-button’<br />

being lost or stolen, <strong>the</strong> berth holder should report <strong>the</strong><br />

matter to <strong>the</strong> <strong>Marina</strong> Office.<br />

(d) All ‘i-buttons’ must be surrendered to <strong>the</strong> <strong>Marina</strong> Office upon<br />

termination <strong>of</strong> <strong>the</strong> Berthing Licence. Failure to do so will<br />

result in <strong>the</strong> berth holder being charged an administration<br />

fee as well as <strong>the</strong> cost <strong>of</strong> <strong>the</strong> replacement unit.<br />

(e) Every berth holder must ensure that <strong>the</strong>ir ‘i-button’ account<br />

has sufficient credit available to enable electricity to be<br />

drawn. Where insufficient credit is on a berth holder’s<br />

account, <strong>the</strong> electricity supply will stop.<br />

(f) Any unused credit will be refunded to <strong>the</strong> berth holder<br />

upon termination <strong>of</strong> <strong>the</strong> Berthing Licence.<br />

(g) Subject to availability, all except visitor berth holders are<br />

entitled to plug into more than one socket provided that by<br />

doing so <strong>the</strong>y did not unreasonably impinge on any o<strong>the</strong>r<br />

berth holders’ ability to access a socket. In any event,<br />

consumption must not exceed 16 amperes.<br />

(h) The Board shall not be liable whe<strong>the</strong>r in contract, tort<br />

or o<strong>the</strong>rwise, for any loss or any damage <strong>of</strong> whatsoever<br />

nature caused to any vessel or vehicle or o<strong>the</strong>r property<br />

<strong>of</strong> <strong>the</strong> Owner as a result <strong>of</strong> any failure in <strong>the</strong> supply <strong>of</strong><br />

electricity to a vessel or <strong>of</strong> <strong>the</strong> malfunctioning <strong>of</strong> <strong>the</strong><br />

electricity system and ancillary services provided at <strong>the</strong><br />

<strong>Marina</strong> or for any losses suffered by <strong>the</strong> berth holder as a<br />

result <strong>of</strong> an ‘i-button’ being lost or stolen or used by a third<br />

party without <strong>the</strong> berth holder’s consent.<br />

4. PAYMENT<br />

4.1. The Owner shall be required to pay a deposit <strong>of</strong> £100 in<br />

advance when booking an annual berth. The deposit shall<br />

only be refunded when <strong>the</strong> Owner’s berthing is terminated,<br />

subject to <strong>the</strong> Board having received full payment <strong>of</strong> all<br />

outstanding berthing and ancillary fees.<br />

4.2. The Owner shall pay any invoice submitted in respect <strong>of</strong> a<br />

berth, mooring or o<strong>the</strong>r service provided by <strong>the</strong> Board and<br />

all relevant dues and charges levied by <strong>the</strong> specified due<br />

date.<br />

4.3. Where payment is made by cheque, draft, letter <strong>of</strong> credit<br />

or o<strong>the</strong>r instrument, payment shall not be deemed to<br />

be made until such payment is cleared into <strong>the</strong> Board’s<br />

account.<br />

4.4. The Board reserves <strong>the</strong> right to levy a £50 administration<br />

fee and charge interest on all overdue accounts. In<br />

addition, should annual berthing charges not be paid by<br />

<strong>the</strong> due date, <strong>the</strong> Board reserves <strong>the</strong> right to withdraw <strong>the</strong><br />

pontoon berth rate and levy charges on a different basis,<br />

as it shall decide at in its discretion.<br />

4.5. Any accounts remaining unpaid after <strong>the</strong> due date <strong>of</strong> <strong>the</strong><br />

invoice may be referred to <strong>the</strong> Board’s legal department<br />

and <strong>the</strong> costs <strong>of</strong> any proceedings or bailiff charges will be<br />

added to <strong>the</strong> outstanding debt and recovered accordingly.<br />

5. LIEN<br />

5.1. The Board has a lien upon any vessel or vehicle whilst<br />

within <strong>the</strong> <strong>Marina</strong> until any monies due to be paid by <strong>the</strong><br />

Owner to <strong>the</strong> Board in respect <strong>of</strong> that vessel or vehicle,<br />

whe<strong>the</strong>r on account <strong>of</strong> berthing fees or o<strong>the</strong>rwise, have<br />

been paid.<br />

5.2. For <strong>the</strong> avoidance <strong>of</strong> doubt, <strong>the</strong> Board reserves <strong>the</strong> right,<br />

without giving prior notice, to lift and store ashore, move<br />

or relocate <strong>the</strong> vessel or vehicle should it be reasonable<br />

to do so in order to protect <strong>the</strong> Board’s rights under this<br />

provision. The Owner shall be charged for all reasonable<br />

costs arising out <strong>of</strong> such lift, move, relocation and/<br />

or removal, including but not limited to storage. In <strong>the</strong><br />

exercise <strong>of</strong> this power <strong>the</strong> Board shall incur no liability for<br />

loss or damage to <strong>the</strong> vessel howsoever <strong>the</strong> same shall<br />

arise.<br />

<strong>Marina</strong> Terms & Conditions<br />

6. TERMINATION OF PERMISSION TO BERTH &<br />

CANCELLATION<br />

6.1. The Board reserves <strong>the</strong> right at its discretion and without<br />

giving reason to immediately terminate <strong>the</strong> Berthing Licence<br />

by giving notice in writing at any time, and in particular,<br />

following a breach <strong>of</strong> any condition herein mentioned or<br />

following any force majeure which renders it unlikely that<br />

<strong>the</strong> Board will be able to continue to provide a berth,<br />

mooring or shore storage in accordance with any previously<br />

made agreements. Force majeure in this context means any<br />

event or circumstance, whe<strong>the</strong>r arising from natural causes,<br />

human agency or o<strong>the</strong>rwise beyond <strong>the</strong> control <strong>of</strong> <strong>the</strong><br />

Board.<br />

6.2. Subject to <strong>the</strong> Owner’s account being paid up to date, <strong>the</strong><br />

Owner may terminate <strong>the</strong> Berthing Licence at any time by<br />

giving <strong>the</strong> Board a minimum <strong>of</strong> one month’s prior written<br />

notice (applicable to annual berths only). A Cancellation<br />

Request Form must be submitted to <strong>the</strong> <strong>Marina</strong> Office and<br />

<strong>the</strong> Owner must ensure that <strong>the</strong> vessel is removed from <strong>the</strong><br />

<strong>Marina</strong> on or before on <strong>the</strong> effective date <strong>of</strong> termination.<br />

Please refer to Clause 23 below for fur<strong>the</strong>r information<br />

regarding <strong>the</strong> Board’s refund policy.<br />

6.3. The termination <strong>of</strong> <strong>the</strong> Berthing Licence shall not affect <strong>the</strong><br />

Board’s right to recover from <strong>the</strong> Owner any monies due to<br />

<strong>the</strong> Board.<br />

6.4. Subject always to Clause 19, any obligation <strong>of</strong> <strong>the</strong> Board<br />

towards any vessel, vehicle or any goods left at <strong>the</strong> <strong>Marina</strong><br />

ends upon <strong>the</strong> expiry or lawful termination <strong>of</strong> <strong>the</strong> Berthing<br />

Licence and <strong>the</strong> Board accepts no responsibility for loss or<br />

damage to any vessel, vehicle or goods left at <strong>the</strong> <strong>Marina</strong><br />

after expiry or termination <strong>of</strong> <strong>the</strong> Berthing Licence, save as<br />

may be implied by law.<br />

7. POWER OF REMOVAL<br />

7.1. On <strong>the</strong> termination <strong>of</strong> <strong>the</strong> Berthing Licence as described in<br />

Clause 6.1 <strong>the</strong> Board has <strong>the</strong> right upon giving notice in<br />

writing to <strong>the</strong> Owner <strong>of</strong> a vessel to require removal <strong>of</strong> that<br />

vessel within 14 days.<br />

7.2. Such notice shall be served on <strong>the</strong> Owner personally, by<br />

leaving it on <strong>the</strong> vessel or by posting it by recorded delivery<br />

to his/her last known address.<br />

7.3. If <strong>the</strong> Owner fails to remove <strong>the</strong> vessel within <strong>the</strong> said<br />

period <strong>of</strong> 14 days <strong>the</strong> Board has <strong>the</strong> right, at <strong>the</strong> expiration<br />

<strong>of</strong> that period, to charge <strong>the</strong> Owner at Visitor’s Berth Rates<br />

between termination and <strong>the</strong> removal <strong>of</strong> <strong>the</strong> vessel and/<br />

or to relocate <strong>the</strong> vessel or remove <strong>the</strong> vessel from <strong>the</strong><br />

berth and store it ashore and to charge <strong>the</strong> Owner for all<br />

reasonable costs arising out <strong>of</strong> such relocation or removal,<br />

including but not limited to storage. In <strong>the</strong> exercise <strong>of</strong> this<br />

power <strong>the</strong> Board shall incur no liability for loss or damage<br />

to <strong>the</strong> vessel howsoever <strong>the</strong> same shall arise.<br />

8. POWER OF SALE<br />

8.1. Where monies are owed in respect <strong>of</strong> any vessel or vehicle,<br />

or in respect <strong>of</strong> goods using or stored at <strong>the</strong> <strong>Marina</strong>, <strong>the</strong><br />

provisions <strong>of</strong> <strong>the</strong> Torts (Interference with Goods) Act<br />

1977, which confers power <strong>of</strong> sale upon bailees in <strong>the</strong><br />

circumstances set out in that Act, shall apply and <strong>the</strong> Board<br />

reserves <strong>the</strong> right to sell any vessel or vehicle in order<br />

to recover <strong>the</strong> sums due. Such sale shall not take place<br />

until statutory notice has been given to <strong>the</strong> Owner or <strong>the</strong><br />

Board has taken reasonable steps to trace <strong>the</strong> Owner, in<br />

accordance with <strong>the</strong> Act.<br />

9. ABANDONED ITEMS<br />

9.1. Where a vessel, vehicle or goods have been left or<br />

abandoned on or about <strong>the</strong> <strong>Marina</strong>, <strong>the</strong> provisions <strong>of</strong> <strong>the</strong><br />

<strong>Dover</strong> Harbour Revision Order 2006 shall apply, so that<br />

where <strong>the</strong> Owner fails to collect <strong>the</strong> item(s) within <strong>the</strong> one<br />

month written notice period, title shall pass to <strong>the</strong> Board<br />

who shall be entitled to use, dispose <strong>of</strong> or sell any such<br />

vessel, vehicle or goods as it deems appropriate.<br />

10. PREVENTION OF NUISANCE<br />

10.1. The Owner undertakes for himself and all o<strong>the</strong>r persons<br />

visiting his vessel to behave in a considerate manner<br />

and shall avoid causing any nuisance, annoyance or<br />

inconvenience to o<strong>the</strong>r <strong>Marina</strong> users. In particular, any<br />

abusive, <strong>of</strong>fensive or drunken behaviour towards <strong>the</strong><br />

<strong>Marina</strong> staff or o<strong>the</strong>r <strong>Marina</strong> users will not be tolerated and<br />

may result in <strong>the</strong> immediate termination <strong>of</strong> <strong>the</strong> Berthing<br />

Licence.<br />

10.2. The use <strong>of</strong> noisy, noxious or objectionable engines, radio or<br />

o<strong>the</strong>r apparatus or machinery is prohibited. If any dispute<br />

arises, <strong>the</strong> opinion <strong>of</strong> <strong>the</strong> <strong>Marina</strong> staff is final.<br />

10.3. Refuse must be disposed <strong>of</strong> only in <strong>the</strong> receptacles provided<br />

and in accordance with any instructions displayed <strong>the</strong>reon.<br />

It must not be put into <strong>the</strong> <strong>Marina</strong> or harbour waters.<br />

Appropriate disposal <strong>of</strong> waste is <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong><br />

Owner.<br />

10.4. Except where receptacles are provided for <strong>the</strong> specific<br />

purpose, no oil, petrol, tar, paint or o<strong>the</strong>r noxious or<br />

deleterious substance, nor any o<strong>the</strong>r pollutants, chemicals<br />

or waste shall be discharged on or into <strong>the</strong> <strong>Marina</strong> and all<br />

such items shall be removed from <strong>the</strong> <strong>Marina</strong> by <strong>the</strong> Owner.<br />

10.5. Holding tanks may be pumped out at <strong>the</strong> fuel berth on<br />

Crosswall Quay.<br />

10.6. The Owner <strong>of</strong> any animals brought into <strong>the</strong> <strong>Marina</strong> shall<br />

keep such animals under proper control at all times.<br />

Animals must be kept on a leash, and must not foul any<br />

area within <strong>the</strong> <strong>Marina</strong>. The Owner shall be responsible<br />

for ensuring that any fouling <strong>of</strong> <strong>the</strong> <strong>Marina</strong> is immediately<br />

cleared up and that it is not disposed <strong>of</strong> on or into <strong>the</strong><br />

harbour/marina waters.<br />

ATTENTION IS DRAWN TO HM GOVERNMENT<br />

LEGISLATION CONCERNING RABIES<br />

10.7. Maintenance work must not be carried out to <strong>the</strong><br />

annoyance <strong>of</strong> o<strong>the</strong>rs nor in such a way as to cause<br />

damage or defacement to <strong>the</strong> Board’s property or to <strong>the</strong><br />

property <strong>of</strong> o<strong>the</strong>r <strong>Marina</strong> users. If any dispute arises, <strong>the</strong><br />

decision <strong>of</strong> <strong>the</strong> <strong>Marina</strong> staff is final. The Board accepts<br />

no responsibility for damage or defacement to <strong>the</strong><br />

property <strong>of</strong> o<strong>the</strong>r <strong>Marina</strong> users arising as a result <strong>of</strong> any<br />

maintenance work.<br />

10.8. The obstruction by any means <strong>of</strong> any access ways is<br />

prohibited.<br />

10.9. The undertaking <strong>of</strong> any building work to any vessel is<br />

subject to prior approval by <strong>Marina</strong> staff.<br />

11. TIDINESS<br />

11.1. Dinghies, tenders etc not in use should be stowed aboard<br />

<strong>the</strong> vessel.


11.2. Items <strong>of</strong> gear, cradles, trailers, fittings, equipment, supplies<br />

stores etc may not be left ashore unless shore storage has<br />

been arranged with <strong>the</strong> <strong>Marina</strong> staff.<br />

12. THE BOARD’S RIGHT TO MOVE ANY VESSEL<br />

12.1. The Harbour Master has <strong>the</strong> power at any time to relocate,<br />

move and/or re-berth any vessel within <strong>the</strong> <strong>Marina</strong> although<br />

reasonable notice will be given to <strong>the</strong> Owner where<br />

practicable. The Board’s staff may, without prior notice,<br />

relocate, moor, re-berth, move, board, enter or carry out<br />

any emergency work on any vessel if in <strong>the</strong> opinion <strong>of</strong> <strong>the</strong><br />

<strong>Marina</strong> staff such action is necessary for reasons <strong>of</strong> safety.<br />

The Owner shall reimburse to <strong>the</strong> Board any reasonable<br />

expenses which <strong>the</strong> Board incurs.<br />

13. ON LEAVING THE MARINA<br />

13.1. On leaving <strong>the</strong> <strong>Marina</strong> for an anticipated period in excess <strong>of</strong><br />

24 hours <strong>the</strong> Owner should provide <strong>the</strong> <strong>Marina</strong> Office with<br />

<strong>the</strong>ir destination and intended date <strong>of</strong> return so that a berth<br />

is made available on <strong>the</strong> Owner’s return. Should <strong>the</strong>re not<br />

be a suitable berth available upon <strong>the</strong> Owner’s return due<br />

to <strong>the</strong> Owner’s failure to comply with this provision, without<br />

prejudice to <strong>the</strong> Owner’s obligation to pay <strong>the</strong> berthing fee,<br />

<strong>the</strong> Board accepts no liability for its inability to provide a<br />

suitable berth.<br />

14. KEYS – AVAILABILITY<br />

14.1. For safety reasons and in case <strong>of</strong> an emergency cabin<br />

entrance and/or hatch key and an engine key should be left<br />

in <strong>the</strong> care <strong>of</strong> <strong>the</strong> <strong>Marina</strong> staff. Keys will be released only<br />

to persons having <strong>the</strong> signed authority <strong>of</strong> <strong>the</strong> Owner and<br />

against signature at <strong>the</strong> <strong>Marina</strong> <strong>of</strong>fice. The Board will accept<br />

no liability for any loss <strong>of</strong> keys.<br />

15. THE VESSEL<br />

15.1. The vessel’s name must be clearly displayed on board and<br />

on any related dinghies, cradles, trailers etc. The vessel<br />

must be kept in a mobile, seaworthy and reasonable<br />

condition.<br />

16. REPORTING DAMAGE<br />

16.1. The Owner or any person responsible for any vessel or any<br />

vehicle must report immediately to <strong>the</strong> <strong>Marina</strong> staff any<br />

damage which may be caused to or by <strong>the</strong> vessel or vehicle<br />

whilst at <strong>the</strong> <strong>Marina</strong>.<br />

17. MOORING<br />

17.1. The vessel shall be moored by <strong>the</strong> Owner in such a location<br />

and in such a manner as shall be directed by <strong>the</strong> Harbour<br />

Master and so as not to cause any obstruction.<br />

17.2. The vessel may only be moored to equipment provided<br />

for that purpose. All necessary warps and fenders shall be<br />

provided by, and are <strong>the</strong> responsibility <strong>of</strong>, <strong>the</strong> Owner who<br />

shall check <strong>the</strong>ir security regularly and replace <strong>the</strong>m where<br />

necessary.<br />

17.3. The Owner is responsible for ensuring that <strong>the</strong> vessel is<br />

properly and safely secured to its mooring at all times.<br />

18. VEHICLE PARKING<br />

18.1. Vehicles may only be parked in spaces specifically marked<br />

for <strong>the</strong> purpose <strong>of</strong> parking cars.<br />

18.2. Under no circumstances may any vehicle or trailer be<br />

parked so as to cause any obstruction.<br />

18.3. Parking permits are available from <strong>the</strong> <strong>Marina</strong> Office and<br />

must be clearly and visibly displayed in <strong>the</strong> windscreen <strong>of</strong><br />

<strong>the</strong> vehicle to which it relates when parking. Failure to<br />

comply may result in a fixed penalty notice being issued.<br />

18.4. Parking permits are liable to be revoked for non-payment <strong>of</strong><br />

fees. Vehicles displaying an invalid parking permit or parked<br />

in contravention to <strong>the</strong> parking regulations are liable to be<br />

clamped and/or impounded. Vehicles will only be released<br />

upon payment <strong>of</strong> a fee.<br />

18.5. A charge will be made for replacement <strong>of</strong> lost permits.<br />

18.6. Drivers may be requested to leave ignition keys at <strong>the</strong><br />

<strong>Marina</strong> Office. Keys will only be returned against signature.<br />

The Board will accept no liability for any loss <strong>of</strong> keys.<br />

18.7. Car parking is provided for <strong>the</strong> convenience <strong>of</strong> berth<br />

holders. All users park at <strong>the</strong>ir own risk.<br />

19. LIABILITY AND INSURANCE<br />

19.1. The Board shall not be liable whe<strong>the</strong>r in contract, tort or<br />

o<strong>the</strong>rwise, for any loss, <strong>the</strong>ft, or any damage <strong>of</strong> whatsoever<br />

nature caused to any vessel or vehicle or o<strong>the</strong>r property<br />

<strong>of</strong> <strong>the</strong> Owner or any o<strong>the</strong>r person claiming through <strong>the</strong><br />

Owner.<br />

19.2. All persons using any part <strong>of</strong> <strong>the</strong> Board’s premises or<br />

facilities do so at <strong>the</strong>ir own risk unless any injury or damage<br />

to persons or property sustained within <strong>the</strong> Board’s<br />

premises or facilities is proved to have been caused by or<br />

resulted from <strong>the</strong> negligent or wilful act <strong>of</strong> <strong>the</strong> Board or<br />

those for whom <strong>the</strong> Board is responsible. All persons using<br />

any part <strong>of</strong> <strong>the</strong> Board’s premises or facilities must exercise<br />

proper care and attention for <strong>the</strong>ir own safety and <strong>the</strong><br />

safety <strong>of</strong> o<strong>the</strong>rs.<br />

19.3. Vessels and equipment are permitted access to <strong>the</strong> Board’s<br />

property, repaired, worked on, moved, stored or o<strong>the</strong>rwise<br />

managed and kept solely at <strong>the</strong> risk <strong>of</strong> <strong>the</strong> Owner.<br />

19.4. The Owner shall maintain third party insurance in respect <strong>of</strong><br />

himself and each <strong>of</strong> his vehicles or vessels, his crew for <strong>the</strong><br />

time being and his agent, visitors, guests or sub-contractors<br />

in a sum <strong>of</strong> not less than £3,000,000 in respect <strong>of</strong> each<br />

accident or damage and in respect <strong>of</strong> each vessel adequate<br />

salvage insurance. Such insurance shall be effected and<br />

maintained in an insurance <strong>of</strong>fice <strong>of</strong> repute and <strong>the</strong> Owner<br />

shall produce <strong>the</strong> policy or policies relating <strong>the</strong>reto to <strong>the</strong><br />

<strong>Marina</strong> staff on demand.<br />

20. WORK ON VESSELS<br />

20.1. Any contractors entering <strong>the</strong> <strong>Marina</strong> to perform repairs,<br />

maintenance or any works whatsoever on a vessel at <strong>the</strong><br />

request <strong>of</strong> <strong>the</strong> Owner must comply with <strong>the</strong> following prior<br />

to commencing any works on <strong>the</strong> vessel:a)<br />

Contractors must log in at <strong>the</strong> <strong>Marina</strong> Office when <strong>the</strong>y<br />

arrive at <strong>the</strong> <strong>Marina</strong> to carry out any work and pay <strong>the</strong><br />

appropriate licence fee. Upon payment <strong>of</strong> <strong>the</strong> fee <strong>the</strong>y shall<br />

be issued with a contractor’s licence for <strong>the</strong> appropriate<br />

period.<br />

b) Contractors must supply pro<strong>of</strong> <strong>of</strong> identity on arrival at <strong>the</strong><br />

<strong>Marina</strong> Office.<br />

c) Contractors must arrange minimum third party liability<br />

insurance cover <strong>of</strong> £5,000,000 and pro<strong>of</strong> <strong>of</strong> such cover<br />

must be sent to <strong>the</strong> <strong>Marina</strong> Office in advance.<br />

d) The Owner’s permission both for <strong>the</strong> drawing <strong>of</strong> keys and<br />

for <strong>the</strong> carrying out <strong>of</strong> works on <strong>the</strong> vessel must have been<br />

notified in advance, in writing, to <strong>the</strong> <strong>Marina</strong> Office. In <strong>the</strong><br />

case <strong>of</strong> emergency, <strong>the</strong> Owner’s verbal permission may be<br />

accepted.<br />

e) Contractors must comply with such conditions, Bye-laws<br />

and regulations as are relevant to <strong>the</strong> <strong>Marina</strong> toge<strong>the</strong>r<br />

with any instructions/directions given by <strong>the</strong> Board’s<br />

staff.<br />

f) Contractors shall show consideration to o<strong>the</strong>r <strong>Marina</strong> users<br />

and leave <strong>the</strong> area around <strong>the</strong> vessel safe, clear and tidy<br />

on completion <strong>of</strong> <strong>the</strong> work. Contractors must arrange for<br />

proper disposal <strong>of</strong> all waste. For <strong>the</strong> avoidance <strong>of</strong> doubt,<br />

any waste associated with <strong>the</strong> work must not be left in <strong>the</strong><br />

Board’s skip or anywhere on its estate.<br />

g) If any <strong>of</strong> <strong>the</strong> above conditions are not met, contractors shall<br />

be asked to leave <strong>the</strong> <strong>Marina</strong>.<br />

h) The Board reserves <strong>the</strong> right, at its discretion, to refuse<br />

to allow contractors who it deems unsuitable for whatever<br />

reason to enter <strong>the</strong> <strong>Marina</strong> to perform any works on a<br />

vessel and such refusal shall be notified to <strong>the</strong> Owner<br />

immediately by <strong>the</strong> Board.<br />

20.2. The Board reserves <strong>the</strong> right to request copies <strong>of</strong> relevant<br />

method statements and risk assessments in connection with<br />

any major works to be carried out which impinge on <strong>the</strong><br />

Board’s land or operation, in which case works may only<br />

start after <strong>the</strong> Board has fully considered <strong>the</strong>se documents<br />

and given its written consent.<br />

20.3. Where <strong>the</strong> Owner wishes to carry out works on his/her own<br />

vessel, <strong>the</strong> Owner acknowledges that <strong>the</strong> works are carried<br />

out at his/her own risk and that <strong>the</strong> Board accepts no<br />

liability for any loss or damage that may occur as a result <strong>of</strong><br />

such works.<br />

20.4. The Owner also acknowledges and accepts that should <strong>the</strong><br />

works involve <strong>the</strong> use <strong>of</strong> additional space at <strong>the</strong> <strong>Marina</strong>, <strong>the</strong><br />

Board reserves <strong>the</strong> right to levy an additional charge<br />

for <strong>the</strong> use <strong>of</strong> such space for <strong>the</strong> duration <strong>of</strong> <strong>the</strong> works.<br />

21. INDEMNITY<br />

21.1. The Owner shall indemnify <strong>the</strong> Board and its servants<br />

and agents against all loss, damage, costs, claims or<br />

proceedings incurred by, or instituted against <strong>the</strong> Board or<br />

its servants or agents which may be caused by <strong>the</strong> Owner’s<br />

vessel or vehicle or by <strong>the</strong> Owner, his servants, agents,<br />

crew, guests or sub-contractors except to <strong>the</strong> extent that<br />

such loss or damage, costs, claims or proceedings may be<br />

caused by <strong>the</strong> negligence or wilful act <strong>of</strong> <strong>the</strong> Board or those<br />

for whom <strong>the</strong> Board is responsible.<br />

22. OBLIGATIONS ON CHANGE<br />

22.1. The Owner must notify <strong>the</strong> Board in writing <strong>of</strong> <strong>the</strong> details<br />

<strong>of</strong> any change <strong>of</strong> name <strong>of</strong> <strong>the</strong> Vessel or change <strong>of</strong><br />

address, telephone number or o<strong>the</strong>r contact details <strong>of</strong> <strong>the</strong><br />

Owner.<br />

22.2. The Board reserves <strong>the</strong> right to alter <strong>the</strong>se Terms and<br />

Conditions annually and may in <strong>the</strong> course <strong>of</strong> <strong>the</strong> year<br />

by giving one month’s prior written notice to <strong>the</strong> Owner<br />

vary <strong>the</strong>se conditions should it become necessary to do<br />

so to comply with any Act <strong>of</strong> Parliament, order, regulation<br />

or byelaw, in <strong>the</strong> interests <strong>of</strong> health and safety, or in <strong>the</strong><br />

interests <strong>of</strong> <strong>the</strong> users <strong>of</strong> <strong>the</strong> <strong>Marina</strong> as a whole or <strong>the</strong> good<br />

management or administration <strong>the</strong>re<strong>of</strong>.<br />

23. REFUND POLICY<br />

23.1. Any outstanding charges relating to <strong>the</strong> vessel (whe<strong>the</strong>r<br />

berthing charges or shore service charges) must be paid<br />

in full before <strong>the</strong> Berthing Licence can be cancelled and a<br />

refund given.<br />

23.2. Where termination is as a result <strong>of</strong> <strong>the</strong> Owner’s breach,<br />

<strong>the</strong> Owner shall not be entitled to a refund <strong>of</strong> any monies<br />

paid to <strong>the</strong> Board. The Board reserves all rights <strong>of</strong> action<br />

in respect <strong>of</strong> any outstanding sums owed by <strong>the</strong> Owner.<br />

23.3. In <strong>the</strong> event <strong>of</strong> termination for force majeure, <strong>the</strong> Board<br />

shall refund to <strong>the</strong> Owner <strong>the</strong> unexpired portion <strong>of</strong> <strong>the</strong><br />

berthing fee, recalculated as set out in Clause 24 below.<br />

23.4. In <strong>the</strong> event <strong>of</strong> termination by <strong>the</strong> Owner upon notice,<br />

<strong>the</strong> Board shall use all reasonable endeavours to find a<br />

replacement berth holder and, if successful in doing so, <strong>the</strong><br />

Board shall refund to <strong>the</strong> Owner <strong>the</strong> unexpired portion <strong>of</strong><br />

<strong>the</strong> berthing fee, recalculated as set out in Clause 24 below,<br />

less an administration charge <strong>of</strong> £125. In <strong>the</strong> event that <strong>the</strong><br />

Board is unsuccessful in finding a replacement berth holder<br />

<strong>the</strong>n, without prejudice to any o<strong>the</strong>r rights or remedies<br />

available to <strong>the</strong> Board, <strong>the</strong> Board shall be entitled to retain<br />

all monies paid.<br />

23.5. Subject always to <strong>the</strong> conditions in Clause 23.4 above,<br />

should <strong>the</strong> Owner fail to provide sufficient notice <strong>of</strong><br />

termination, a cancellation fee <strong>of</strong> 10% <strong>of</strong> <strong>the</strong> recalculated<br />

berthing fee shall also be charged.<br />

24. RECALCULATION OF THE BERTHING FEE<br />

24.1. Following notice <strong>of</strong> termination under Clauses 23.3 and 23.4<br />

above, <strong>the</strong> Board shall recalculate <strong>the</strong> berthing charge using<br />

<strong>the</strong> rate or rates which would have been applicable to <strong>the</strong><br />

actual period <strong>of</strong> use <strong>of</strong> <strong>the</strong> <strong>Marina</strong> by <strong>the</strong> Owner, instead<br />

<strong>of</strong> <strong>the</strong> annual rate. Refunds will be made in respect <strong>of</strong><br />

complete months only.<br />

24.2. If <strong>the</strong> recalculation results in a balance payable to <strong>the</strong> Board<br />

<strong>the</strong>n <strong>the</strong> Owner shall be required to pay that balance before<br />

removing <strong>the</strong> vessel from <strong>the</strong> <strong>Marina</strong>.<br />

24.3. If <strong>the</strong>re is a balance in favour <strong>of</strong> <strong>the</strong> Owner <strong>the</strong> Board<br />

shall pay <strong>the</strong> balance to <strong>the</strong> Owner within 14 days <strong>of</strong> <strong>the</strong><br />

Owner’s departure from <strong>the</strong> <strong>Marina</strong>.<br />

25. CANCELLATION AND REFUND - GENERAL<br />

CONDITIONS<br />

25.1. Should <strong>the</strong> Owner leave <strong>the</strong> vessel at <strong>the</strong> <strong>Marina</strong> beyond<br />

<strong>the</strong> agreed cancellation date, <strong>the</strong>n berthing or storage will<br />

be charged at Visitor’s Berth rates. In addition, <strong>the</strong> Board<br />

reserves its rights under Clause 7 above.<br />

25.2. Refunds will not be given retrospectively. The refund will<br />

be calculated from <strong>the</strong> date on which <strong>the</strong> <strong>Marina</strong> Office<br />

receives <strong>the</strong> signed Cancellation Request Form, unless full<br />

notice <strong>of</strong> termination is provided in which case <strong>the</strong> refund<br />

shall be calculated from <strong>the</strong> agreed termination date.


Appendix 2<br />

Shore Services Terms and Conditions<br />

1. INTERPRETATION<br />

For <strong>the</strong> purposes <strong>of</strong> this Appendix 2, in addition to<br />

<strong>the</strong> definitions referred to in Appendix 1:<br />

1.1. The Hirer shall mean any natural person, body corporate or<br />

unincorporated association hiring <strong>the</strong> Service.<br />

1.2. Plant shall mean all types <strong>of</strong> plant, tools, equipment and<br />

machinery and all accessories required for <strong>the</strong> Service.<br />

1.3. The Service shall mean <strong>the</strong> shore service(s) to be provided<br />

by <strong>the</strong> Board, toge<strong>the</strong>r with any associated services.<br />

1.4. The Vessel shall mean any boat and any part <strong>the</strong>re<strong>of</strong> in<br />

respect <strong>of</strong> which <strong>the</strong> Service is required.<br />

2. AVAILABILITY<br />

2.1. Applications to hire <strong>the</strong> Service shall be made to <strong>the</strong> Board’s<br />

Boat Lift Office and shall be subject to payment <strong>of</strong> <strong>the</strong><br />

relevant charges.<br />

2.2. The Board will use all reasonable endeavours to provide <strong>the</strong><br />

Service on <strong>the</strong> date requested (where specified). However<br />

<strong>the</strong> Board accepts no responsibility for delays which may<br />

arise in providing <strong>the</strong> Service due to any delay in <strong>the</strong><br />

supply <strong>of</strong> Plant or through <strong>the</strong> breakdown <strong>of</strong> any Plant,<br />

due to adverse wea<strong>the</strong>r conditions or due to any cause<br />

whatsoever. In <strong>the</strong> event <strong>of</strong> any such delay <strong>the</strong> Service<br />

shall be provided as soon as is reasonably practicable.<br />

2.3. The Board reserves <strong>the</strong> right to terminate provision<br />

<strong>of</strong> <strong>the</strong> Service without prior notice and without giving<br />

compensation in <strong>the</strong> event <strong>of</strong> any emergency occurring<br />

at <strong>the</strong> <strong>Port</strong> <strong>of</strong> <strong>Dover</strong> where <strong>the</strong> use <strong>of</strong> Plant or personnel<br />

involved in <strong>the</strong> Service is considered by <strong>the</strong> Board to be<br />

essential for <strong>the</strong> purposes <strong>of</strong> emergency relief work.<br />

3. RESPONSIBILITIES<br />

3.1. The Hirer undertakes to advise <strong>the</strong> Board <strong>of</strong> all relevant<br />

information regarding <strong>the</strong> Vessel in order to ensure that <strong>the</strong><br />

Board is able to render <strong>the</strong> Service as safely and efficiently<br />

as possible.<br />

3.2. The Service will be provided at <strong>the</strong> risk <strong>of</strong> <strong>the</strong> Hirer who<br />

shall be responsible for any loss, injury, accident or damage<br />

<strong>of</strong> whatever nature or cause arising during or as a result <strong>of</strong><br />

<strong>the</strong> provision <strong>of</strong> <strong>the</strong> Service and <strong>the</strong> Hirer shall indemnify<br />

<strong>the</strong> Board against any such loss, injury, accident or damage<br />

and all claims made against <strong>the</strong> Board in respect <strong>the</strong>re<strong>of</strong><br />

and all costs and expenses incurred by <strong>the</strong> Board in relation<br />

<strong>the</strong>reto unless such loss, injury, accident or damage shall<br />

be proved by <strong>the</strong> Hirer to be caused by wilful default or<br />

negligence on <strong>the</strong> part <strong>of</strong> <strong>the</strong> Board.<br />

3.3. Shore Storage<br />

a) The Board considers that it is undesirable and may be<br />

dangerous to store a vessel ashore with <strong>the</strong> mast stepped<br />

and <strong>the</strong> Owner acknowledges such warning, which warning<br />

he has communicated to his insurers and, in consideration<br />

<strong>of</strong> his being permitted by <strong>the</strong> Board to store his vessel<br />

ashore without unstepping <strong>the</strong> mast, <strong>the</strong> Owner hereby<br />

agrees with <strong>the</strong> Board as follows:<br />

1. To remove headsails, dodgers, spray hoods and mainsails<br />

furled on top <strong>of</strong> <strong>the</strong> boom. The outhaul /halyard to be<br />

removed from in-mast/in-boom furling systems and <strong>the</strong><br />

clew/head to be trapped by a lashing around <strong>the</strong> mast/<br />

boom;<br />

2. To indemnify and keep indemnified <strong>the</strong> Board and its<br />

insurers against all liability, costs, claims and demands<br />

howsoever arising in respect <strong>of</strong> any claim by any third<br />

party against <strong>the</strong> Board or its insurers resulting directly<br />

or indirectly from any incident, accident or o<strong>the</strong>rwise<br />

occasioned directly or indirectly by <strong>the</strong> decision <strong>of</strong> <strong>the</strong><br />

Owner not to unstep <strong>the</strong> mast <strong>of</strong> <strong>the</strong> Vessel or to remove or<br />

secure sails and rigging;<br />

3. Not to make any claim against <strong>the</strong> Board or its servants<br />

or agents in respect <strong>of</strong> any destruction or damage to <strong>the</strong><br />

Vessel or its mast or gear or in respect <strong>of</strong> any o<strong>the</strong>r loss<br />

arising directly or indirectly from any accident incident<br />

o<strong>the</strong>rwise occasioned by <strong>the</strong> failure <strong>of</strong> <strong>the</strong> Owner to unstep<br />

<strong>the</strong> mast <strong>of</strong> <strong>the</strong> Vessel or to remove or secure sails and<br />

rigging;<br />

b) While <strong>the</strong> Vessel is stored ashore, <strong>the</strong> Owner also agrees<br />

with <strong>the</strong> Board:<br />

1. Not to remove or adjust any <strong>of</strong> <strong>the</strong> props or supports used<br />

in connection with <strong>the</strong> storing <strong>of</strong> <strong>the</strong> Vessel ashore. The<br />

Owner acknowledges that any removal or adjustment <strong>of</strong><br />

such items shall be at <strong>the</strong> Owner’s risk and <strong>the</strong> Owner<br />

undertakes to indemnify <strong>the</strong> Board against any resultant<br />

loss or damage;<br />

2. Not to cover <strong>the</strong> Vessel with a tarpaulin or any similar<br />

items or do anything to <strong>the</strong> Vessel which may destabilise it<br />

while <strong>the</strong> Vessel is stored ashore.<br />

3. To indemnify and keep indemnified <strong>the</strong> Board and its<br />

insurers against all liability, costs, claims and demands<br />

howsoever arising in respect <strong>of</strong> any claim by any third<br />

party against <strong>the</strong> Board or its insurers resulting directly or<br />

indirectly from <strong>the</strong> storage <strong>of</strong> <strong>the</strong> Vessel ashore and any<br />

actions or omissions by <strong>the</strong> Owner whilst <strong>the</strong> Vessel is<br />

stored ashore;<br />

4. To keep in force at all times, whilst <strong>the</strong> Vessel shall be<br />

stored ashore at <strong>the</strong> <strong>Marina</strong> or elsewhere on <strong>the</strong> Board’s<br />

premises, a policy <strong>of</strong> insurance covering such injury,<br />

accident and loss with an insurance <strong>of</strong>fice <strong>of</strong> good repute<br />

and in such amount (being not less than £3,000,000 in<br />

respect <strong>of</strong> any one accident or incident) as <strong>the</strong> Board<br />

shall deem satisfactory and to produce to <strong>the</strong> Board upon<br />

demand a copy <strong>of</strong> <strong>the</strong> said policy and <strong>the</strong> last premium<br />

receipt <strong>the</strong>re<strong>of</strong> toge<strong>the</strong>r with confirmation from <strong>the</strong> insurers<br />

that <strong>the</strong>y are aware <strong>of</strong> <strong>the</strong> risks involved in <strong>the</strong> storage <strong>of</strong><br />

<strong>the</strong> Vessel ashore with <strong>the</strong> mast stepped where appropriate.<br />

3.4. The Hirer acknowledges and accepts that while a Vessel<br />

is in a hoist, <strong>the</strong> Hirer will not be permitted to undertake<br />

pressure washing.<br />

3.5. Where <strong>the</strong> Hirer has requested a lift out and subsequently<br />

requests a lift in, <strong>the</strong> terms <strong>of</strong> this Clause 3 shall apply<br />

equally to both services without <strong>the</strong> need for <strong>the</strong> Hirer to<br />

submit a fur<strong>the</strong>r written request.<br />

3.6. Without prejudice to <strong>the</strong> generality <strong>of</strong> <strong>the</strong> foregoing and<br />

although all reasonable care and attention will be taken<br />

during <strong>the</strong> provision <strong>of</strong> <strong>the</strong> Service, <strong>the</strong> Board accepts<br />

no liability for any damage caused to <strong>the</strong> Vessel itself or<br />

to any o<strong>the</strong>r property during <strong>the</strong> provision <strong>of</strong> <strong>the</strong> Service<br />

and/or any period <strong>of</strong> Vessel storage ashore owing to <strong>the</strong><br />

condition or disrepair <strong>of</strong> <strong>the</strong> Vessel and/or <strong>the</strong> Owner’s<br />

failure/decision not to comply with any <strong>of</strong> <strong>the</strong> Board’s Shore<br />

Services Conditions and in such circumstances <strong>the</strong> Owner<br />

and/or <strong>the</strong> Hirer shall indemnify <strong>the</strong> Board against all<br />

actions, claims, costs and demands in respect <strong>of</strong> any loss,<br />

injury, accident or damage arising out <strong>of</strong> or in consequence<br />

<strong>of</strong> <strong>the</strong> Service or storage <strong>of</strong> <strong>the</strong> Vessel ashore.<br />

3.7. The Owner and/or <strong>the</strong> Hirer shall punctually pay all relevant<br />

dues and charges properly levied by <strong>the</strong> Board for <strong>the</strong><br />

provision <strong>of</strong> <strong>the</strong> Service, which dues and charges are<br />

detailed elsewhere within this <strong>Guide</strong>. The Board reserves all<br />

rights in respect <strong>of</strong> any non-payment.<br />
