Agent Oversight<br />

All MSBs stressed the importance of oversight of agents not <strong>on</strong>ly as critical <strong>to</strong> their<br />

BSA compliance resp<strong>on</strong>sibilities, but also as central <strong>to</strong> their business models. The<br />

MSBs noted that agent quality is critical <strong>to</strong> serving MSB cus<strong>to</strong>mers and <strong>to</strong> building<br />

and maintaining a reputati<strong>on</strong> for trust and reliability.<br />

While the foregoing premise applied universally, many MSBs noted different legal<br />

requirements for their agent relati<strong>on</strong>ships in different countries. For example,<br />

some countries may limit the ability <strong>to</strong> establish exclusive agent relati<strong>on</strong>ships, or<br />

might require different licensing resp<strong>on</strong>sibilities, such as m<strong>on</strong>ey transmissi<strong>on</strong> <strong>to</strong> be<br />

c<strong>on</strong>ducted through banks. Additi<strong>on</strong>ally, in some countries, the amount of publicly<br />

available informati<strong>on</strong>, coupled with privacy restricti<strong>on</strong>s, may impact the ability <strong>to</strong><br />

c<strong>on</strong>duct due diligence up<strong>on</strong> agents.<br />

Similar <strong>to</strong> the way many financial instituti<strong>on</strong>s approach certain <strong>on</strong>going cus<strong>to</strong>mer<br />

relati<strong>on</strong>ships, most MSBs view the initial evaluati<strong>on</strong> phase of new agents as the<br />

most critical in determining whether the relati<strong>on</strong>ship will work out and establishing<br />

baseline expectati<strong>on</strong>s for <strong>on</strong>going m<strong>on</strong>i<strong>to</strong>ring.<br />

In establishing agent relati<strong>on</strong>ships, <strong>on</strong>e MSB noted that it looks for partners that offer<br />

complementary products. There are three tiers of oversight for agents (including<br />

deposi<strong>to</strong>ry and n<strong>on</strong>-deposi<strong>to</strong>ry financial instituti<strong>on</strong> agents). The highest tier of<br />

oversight is an <strong>on</strong>-site visit <strong>to</strong> the headquarters office and includes a complete review<br />

of the AML compliance and training program, as well as a records review. The review<br />

takes 1-2 days and a report of findings and recommendati<strong>on</strong>s is developed for the agent.<br />

At the same MSB, the sec<strong>on</strong>d level of oversight is performed <strong>on</strong> MSB agent branches.<br />

The review includes a visit <strong>to</strong> the agent branches and interviews with employees <strong>to</strong><br />

determine employee knowledge and understanding of AML program requirements.<br />

A final level, which involves the least amount of oversight, is used for domestic<br />

financial instituti<strong>on</strong> agents selling the MSB’s products. This review includes a simple<br />

questi<strong>on</strong>naire that is sent <strong>to</strong> the agent <strong>to</strong> complete and is reviewed by the MSB.<br />

Another MSB applies due diligence <strong>to</strong> send locati<strong>on</strong>s and foreign corresp<strong>on</strong>dent/<br />

payout locati<strong>on</strong>s, including risk assessment, due diligence, training, agent reviews,<br />

and “stress tests.” The MSB has several agent reviewers and teleph<strong>on</strong>ic trainers. In<br />

2008, over 1,000 agent reviews were performed, as well as 2,000 agent trainings. The<br />

MSB also utilizes m<strong>on</strong>thly post-transacti<strong>on</strong>al analysis <strong>to</strong> identify agent locati<strong>on</strong>s that<br />

may be selected for reviews. Agent reviews are announced beforehand for various<br />

reas<strong>on</strong>s, including, for example, <strong>to</strong> ensure that the owner is present.<br />
