76-3-611. Review of final plat.<br />
(1) The governing body shall examine each final subdivision plat and shall approve the<br />
plat only if:<br />
(a) it conforms to the conditions of approval set forth on the preliminary plat and to<br />
the terms of this chapter and regulations adopted pursuant to this chapter; and<br />
(b) the county treasurer has certified that all real property taxes and special<br />
assessments assessed and levied on the land to be subdivided have been paid.<br />
(2) (a) The governing body may require that final subdivision plats and certificates of<br />
survey be reviewed for errors and omissions in calculation or drafting by an<br />
examining land surveyor before recording with the county clerk and recorder.<br />
When the survey data shown on the plat or certificate of survey meets the<br />
conditions pursuant to this chapter, the examining land surveyor shall certify the<br />
compliance in a printed or stamped certificate on the plat or certificate of survey.<br />
The certificate must be signed by the surveyor.<br />
(b) A land surveyor may not act as an examining land surveyor in regard to a plat or<br />
certificate of survey in which the surveyor has a financial or personal interest.<br />
76-3-612. Abstract of title required for review process.<br />
(1) The subdivider shall submit with the final plat a certificate of a title abstracter<br />
showing the names of the owners of record of the land to be subdivided and the<br />
names of lienholders or claimants of record against the land and the written consent to<br />
the subdivision by the owners of the land, if other than the subdivider, and any<br />
lienholders or claimants of record against the land.<br />
(2) The governing body may provide for the review of the abstract or certificate of title<br />
of the land in question by the county attorney where the land lies in an unincorporated<br />
area or by the city or town attorney when the land lies within the limits of a city or<br />
town.<br />
76-3-613. Index of plats to be kept by county clerk and recorder.<br />
(1) The county clerk and recorder shall maintain an index of all recorded subdivision<br />
plats and certificates of survey.<br />
(2) This index shall list plats and certificates of survey by the quarter section, section,<br />
township, and range in which the platted or surveyed land lies and shall list the<br />
recording or filing numbers of all plats depicting lands lying within each quarter<br />
section. Each quarter section list shall be definitive to the exclusion of all other<br />
quarter sections. The index shall also list the names of all subdivision plats in<br />
alphabetical order and the place where filed.<br />
