Direction pursuant to Section 34(1)(a) to List an Item on the State Heritage Register<br />
The Torin Building<br />
SHR No. 1796<br />
IN pursuance of section 34(1)(a) of the Heritage Act 1977, I, the Minister for Planning, having considered a recommendation<br />
of the Heritage Council of New South Wales, direct the Council to list the item of environmental heritage specifi ed in<br />
Schedule “A” on the State Heritage Register. This listing shall apply to the curtilage or site of the item, being the land<br />
described in Schedule “B”. The listing is subject to the exemptions from approval under section 57(2) of the Heritage Act<br />
1977, described in Schedule “C” and in addition to the standard exemptions.<br />

the Quarantine Areas except under the following<br />

(eg. oyster sticks, trays, baskets) used in any<br />
of the Quarantine Areas must be dried for 30<br />
days before use in any other NSW estuary.<br />
(b) oysters, oyster cultivation equipment and<br />
infrastructure may be relocated between the<br />
Quarantine Areas but only in accordance with<br />
the Oyster Shipment Log Book System for<br />
the Movement of Oysters, Oyster Cultivation<br />
Equipment and Infrastructure which is<br />
detailed below in Schedule 1.<br />
(c) oysters may be taken and culled in or adjacent<br />
to the Quarantine Areas or in accordance with<br />
a protocol approved by the Deputy Director-<br />
General, Agriculture, Biosecurity and Mine<br />
Safety.<br />
(iii) exclude sections 185 and 186 of the Fisheries<br />
Management Act 1994 with respect to oysters<br />
taken from the Quarantine Areas or any part of<br />
the Quarantine Areas in accordance with this<br />
order (but only in relation to the declared disease<br />
marteiliosis (QX disease).<br />
(iv) Require all holders of aquaculture permits within<br />
the Quarantine Areas to follow all directions of a<br />
fi sheries offi cer made under section 183(4) of the<br />
Act.<br />
SCHEDULE 1<br />
Oyster Shipment Logbook System for the Movement of<br />
Oysters, Oyster Cultivation Equipment and Infrastructure<br />
(1) All shipment of oysters, oyster cultivation equipment<br />
and infrastructure other than those within an estuary or<br />
those destined for direct sale for human consumption<br />
must be recorded in an Oyster Shipment Log Book prior<br />
to shipment.<br />

(2) Not less than 2 days prior to the shipment of a<br />
consignment of oysters, oyster cultivation equipment<br />
and infrastructure between estuaries, the shipping permit<br />
holder must contact the local District Fisheries Offi ce and<br />
identify the shipper, the nature of the shipment and its<br />
destination and the Oyster Shipment Log Book shipment<br />
permit number (top right hand corner of the shipment<br />
sheet).<br />
(3) Prior to the shipment of oysters, oyster cultivation<br />
equipment and infrastructure, the shipping permit<br />
holder must record on all four (4) quadruplicate copies<br />
of the Oyster Shipment Log Book sheets, details of<br />
the destination (including interstate), quantity (bag<br />
equivalents) and form (trays, sticks, etc) of oysters to<br />
be shipped.<br />
(4) For each shipment of oysters, oyster cultivation<br />
equipment and infrastructure, the completed original<br />
white copy (copy 1) of the Oyster Shipment Log Book<br />
sheets must accompany the shipment and be retained by<br />
the receiving permit holder.<br />
(5) The Oyster Shipment Log Book, or the original white<br />
copy (copy 1) of the Oyster Shipment Log Book that has<br />
accompanied a shipment, must be made available to a<br />
Fisheries Offi cer for inspection on demand.<br />
(6) The holder of an Oyster Shipment Log Book must at the<br />
end of each month in which a shipment has occurred,<br />
forward all blue copies (copy 3) for those shipments to<br />
NSW Department of Primary Industries Aquaculture<br />
Management at the address specifi ed below.<br />

the immediate vicinity of the water.<br />
Note: In addition to complying with the terms of this<br />
order, the taking of oysters or the movement of<br />
oyster cultivation equipment and/or infrastructure<br />
must comply with the terms of any fi shing closure<br />
made under section 8 and section 11 of the Fisheries<br />
Management Act 1994 including the fi shing closures<br />

Requirements for Design Registration for Gas Detection<br />
and Monitoring Plant and Items<br />
I, ROBERT REGAN, Chief Inspector under the Coal Mine<br />
Health and Safety Act 2002 (the Act), pursuant to clause<br />
107(2)(ii) of the Occupational Health and Safety Regulation<br />
2001 (the Regulation), by this notice:<br />
1. Revoke the notice titled “Requirements for design<br />
registration for gas detection and monitoring plant<br />
and items” published in New South Wales <strong>Government</strong><br />
<strong>Gazette</strong> No. 24 of 2 February 2007, at pages 672-677,<br />
and<br />
2. Specify in the Schedule the standards that must be<br />
met for registration of a plant design for portable or<br />
hand-held plant or items used to determine or monitor<br />
the presence of gases for the purposes of the Act and<br />
used in underground mines at a coal workplace.<br />
In this notice, “items used to determine or monitor the<br />
presence of gases” include gas detection and monitoring<br />
equipment of fi xed installations, installations on mobile or<br />
transportable plant and within a mine, excluding tube bundle<br />
systems when the analyser is installed on the surface.<br />
SCHEDULE<br />
1. Design and Performance Requirements<br />
1.1 The following tests must be carried out prior to design<br />
registration. The design registration will only remain<br />
valid for gas detection and monitoring plant and items<br />
manufactured during a set period, typically fi ve (5)<br />
years, and where there is no change in the design,<br />
or change in the location or method of manufacture.<br />
Should the manufacture of design registered plant be<br />
required beyond the set registration period, a further<br />
application will be required and the application is to<br />
be accompanied with a further review of the plant<br />
with the currency of gazetted requirements and<br />
associated compliance standard.<br />
Note: Electrically powered gas detection and monitoring<br />
plant and items that are required for use in the<br />
hazardous zone must also be of a gazetted type under<br />
clause 19(1)(c) of the Coal Mine Health and Safety<br />
Regulation 2006 .<br />
1.2 Flammable gas detection and monitoring plant and<br />
items<br />
Only fl ammable gas detection and monitoring plant<br />
and items that conform to the following requirements<br />
in respect to construction and performance shall<br />
be considered suitable for design registration and<br />
permitted for use underground at a coal workplace.<br />
Flammable gas detection and monitoring plant<br />
must:<br />
(a) Conform to AS/NZS 60079.29.1:2008 Electrical<br />
apparatus for the detection and measurement of<br />
fl ammable gases Part 1: General requirements<br />
and test methods; and<br />
(b) Conform to the requirements of the following<br />
additional test criteria:<br />
(i) Poisons (additional to AS/NZS 60079.29.1<br />
clause 5.4.24.1)<br />

(1) The apparatus shall be exposed to a<br />
volume fraction of 2% methane in air<br />
mixture containing a volume fraction<br />
of 50ppm hydrogen sulphide for 20<br />
minutes for continuous duty apparatus<br />
or 100 tests for spot reading apparatus.<br />
The following minimum acceptable<br />
performance requirements must be<br />
achieved:<br />
(A) For apparatus indicating zero to<br />
fi ve percent methane, the variation<br />
in indication from the standard test<br />
gas concentration shall not exceed<br />
a volume fraction ±0.2% methane.<br />
(B) For apparatus indicating zero to<br />
one hundred percent methane, the<br />
variation in indication from the<br />
standard test gas concentration shall<br />
not exceed a volume fraction ±0.3%<br />
methane.<br />
(ii) Effect of Other Gases (additional to AS/NZS<br />
60079.29.1 clause 5.4.24.2)<br />
(1) The apparatus shall be tested separately<br />
with the following gas mixtures:<br />
Carbon monoxide a volume fraction of standard test<br />
gas +<br />
a volume fraction 0.1% CO in air<br />
Nitric oxide a volume fraction of standard test<br />
gas +<br />
a volume fraction 25ppm NO in air<br />
Nitrogen dioxide a volume fraction of standard test<br />
gas +<br />
a volume fraction 10ppm NO in 2<br />
air<br />
(2) The standard test gas is as defi ned in AS/<br />
NZS 60079.29.1 clause 5.3.3.<br />
(3) The following minimum acceptable<br />
performance requirements must be<br />
achieved:<br />
(A) For apparatus indicating zero to<br />
fi ve percent methane, the variation<br />
in indication from the standard test<br />
gas concentration shall not exceed<br />
a volume fraction of:<br />
(i) ±0.1% methane for a test gas<br />
concentration less than or equal<br />
to 1% methane, or<br />
(ii) ±10% of test gas concentration<br />
or ±5% of the full scale<br />
measuring range whichever<br />
is the least for a test gas<br />

methane<br />
(B) For apparatus indicating zero to<br />
one hundred percent methane, the<br />

concentration less than or equal<br />
to 3% methane, or

vapours at toxic levels in respect to construction and<br />
performance shall be considered suitable for design<br />
registration and permitted for use underground at a<br />
coal workplace.<br />
1.4 Toxic gas detection and monitoring plant and items<br />
Only toxic gas detection and monitoring plant and<br />
items that conform to AS/NZS 4641:2007 Electrical<br />
apparatus for detection of oxygen and other gases and<br />
vapours at toxic levels in respect to construction and<br />
performance shall be considered suitable for design<br />
registration and permitted for use underground at a<br />
coal workplace.<br />
2. Testing Requirements<br />
2.1 All testing must be carried out by:<br />
(a) A laboratory in Australia that is accredited by<br />
the National Association of Testing Authorities<br />
Australia (NATA), or<br />
(b) An equivalent organisation acceptable to the<br />
Chief Inspector.<br />
3. Registration Assessment<br />
3.1 The following documents (or documents containing<br />
the following information) must be provided for<br />
assessment with the application under clause 107 of<br />
the Regulation for registration of plant design:<br />
(a) Testing certifi cate(s), accredited by NATA or by<br />
an otherwise acceptable equivalent, for each test<br />
design and performance criteria stipulated in 1.0<br />
above,<br />
(b) All supporting documentation specified in<br />
test certificate(s) that was used for product<br />
identifi cation and performance evaluation,<br />
(c) Apparatus operating instructions,<br />
(d) Apparatus life cycle (within the meaning of the<br />
Coal Mine Health and Safety Regulation 2006)<br />
maintenance instructions.<br />
(e) Where the plant is of a type as gazetted under<br />
clause 19(1)(c) of the Coal Mine Health and<br />
Safety Regulation 2006:<br />
(i) A copy of the Certifi cate of Conformity, or<br />
Approval,<br />
(ii) A copy of the test report(s) referenced in the<br />
Certifi cate of Conformity or approval, and<br />

The notice published in <strong>Government</strong> <strong>Gazette</strong> No 52 of<br />
20 March 2009 on page 1430 under the heading “Notice<br />
of Dedication of Land as Public Road at Mascot in the<br />
Botany Bay City Council area”, in respect of the<br />
dedication of Lot 1 Deposited Plan 347671, should not<br />
have been published. This erratum notice serves to<br />
advise that the abovementioned notice of dedication is<br />
invalid and accordingly the Commonwealth of Australia<br />
remains the owner of the title to the said Lot 1 pursuant<br />
to notice of acquisition published in Australian<br />
<strong>Government</strong> <strong>Gazette</strong> dated 18 March 1975.<br />

test stations in Australia, as required by clause 3.22.1<br />

exemption is subject to the conditions in Part A of<br />
Schedule 1.<br />
2. A Prescribed Tester is hereby exempted from clauses<br />

4. Defi nitions<br />
In this Order:<br />
“Act” means the Occupational Health and Safety Act<br />
2000.<br />
“AS 2030” means Australian Standard AS 2030 – Gas<br />
Cylinders.<br />
”AS 2337” means Australian Standard AS 2337 – Gas<br />
Cylinder Test Stations.<br />
”Gas cylinder” has the same meaning as in the<br />
Regulation.<br />
“Gas cylinder test station” means a facility which<br />
performs inspection and testing of gas cylinders according<br />
to the requirements of AS 2337, and includes an integrated<br />
gas cylinder test station.

“Integrated gas cylinder test station” means a test station<br />
located within a gas cylinder manufacturing facility,<br />
which is also accredited to perform inspection of the<br />
manufacturing process.<br />
“MP 48” means the document of that title published by<br />
Standards Australia Limited from time to time.<br />
“Prescribed Tester” means a person who has received a<br />
certifi cate of conformity from AGA in relation to a gas<br />
cylinder test station that is located outside Australia and<br />
is operated by that person.<br />
“Prescribed User” means a person who:<br />
(a) hires or leases a gas cylinder to another person (within<br />
the meaning of clause 129 (b) of the Regulation),<br />
(b) owns a gas cylinder affecting public safety (within<br />
the meaning of clause 136 (9) of the Regulation, or<br />
(c) is an employer (within the meaning of clause 140<br />
(2) of the Regulation) who must ensure that a gas<br />
cylinder complies with AS 2030 Parts 1, 2 and 4 and<br />
is inspected and maintained as required by AS 2030<br />
Parts 1, 2 and 4.<br />
“Regulation” means the Occupational Health and Safety<br />
Regulation 2001.<br />
“WorkCover NSW” means the WorkCover Authority of<br />
New South Wales.<br />
5. Other laws not affected<br />
Nothing in this Order affects any other applicable<br />
requirement imposed by the Regulation, the Act or any<br />
other law in relation to the matters connected with this<br />
Order.<br />
6. Status of certain previous exemption orders<br />
For the avoidance of doubt, exemption orders 021/007<br />
and 005/08 are not affected by this Order.<br />
SCHEDULE 1<br />
Part A<br />
Conditions applicable to AGA and Prescribed Testers<br />
The exemption applying to AGA and a Prescribed Tester<br />
under this Order is subject to the following conditions:<br />
1. The design of a gas cylinder which is tested by the<br />
Prescribed Tester has been registered in accordance<br />
with clause 107 of the Regulation.<br />
2. The Prescribed Tester has received a current certifi cate<br />
of conformity granted by AGA.<br />
3. The Prescribed Tester’s identifi cation stamp mark has<br />
been advised to Standards Australia Limited for listing<br />
in the next publication of MP48.<br />
4. AGA must: (a) maintain a current register of all<br />
Prescribed Testers and (b) make available, on request,<br />
details contained in the register to a regulatory<br />
authority (including WorkCover NSW).<br />
5. The gas cylinders tested by a Prescribed Tester must<br />
be acceptable for sale in the country of manufacture<br />
as well as in Australia.<br />
6. Documentation, in the English language, required by<br />
AS 2030.1 must be available in Australia in relation<br />
to the gas cylinders tested by the Prescribed Tester.<br />
7. The Prescribed Tester must remain compliant with<br />
Appendix E of AS 2337.1.<br />

8. AGA must continue to be permitted by a recognized<br />
body (within the meaning of AS 2337.1) to grant<br />
certificates of conformity to gas cylinder test<br />
stations.<br />
Part B<br />
Conditions applicable to Prescribed Users<br />
The exemption applying to a Prescribed User under this<br />
Order is subject to the condition that the Prescribed User<br />
ensures that any gas cylinder to which the exemption applies<br />
bears an identifi cation stamp mark which indicates that the<br />
gas cylinder has been tested by a Prescribed Tester.<br />
PRACTICE NOTE DC (CIVIL) NO. 7<br />
Court Approval of Settlements<br />
THIS Practice Note applies to actions commenced in the<br />
Sydney Registry of the Court only.<br />
1. In general, applications for approval under the Civil<br />
Procedure Act will be listed for hearing on Fridays.<br />
However alternative arrangements will be made for urgent<br />
applications or where there are special circumstances.<br />
2. A party may list a matter for approval either by fi ling<br />
copies of the proposed Terms of Settlement and the<br />
relevant Affi davit(s) in the Registry or by contacting the<br />
List Offi ce.<br />
3. Where an approval is listed by contacting the List Offi ce,<br />
the parties are required to fi le all Affi davit evidence upon<br />
which they will rely at the hearing at least three (3) clear<br />
working days prior to the listing of the application before<br />
the Court.<br />
4. A matter should not be listed unless the application will<br />
be ready to proceed. If the plaintiff’s disability requires<br />
orders to be made by the Supreme Court or Guardianship<br />
Board, application for orders should, wherever possible,<br />
be made prior to the matter being listed.<br />
5. Unless there are exceptional circumstances, the plaintiff<br />
and the tutor will be required to attend at the hearing of<br />
the application.<br />
6. The Affi davit evidence should, where relevant, include<br />
the following matters:<br />
A. Whether the settlement reflects a compromise<br />
on liability and if so, copies of any relevant<br />
documents;<br />
B. Up to date medical report/s dealing with all relevant<br />
medical issues;<br />
C. A statement by the tutor as to the plaintiff’s current<br />
disabilities, if any;<br />
D. A statement of the net amount to be invested on behalf<br />
of the plaintiff or which will be payable in accordance<br />
with a Court order, which should include all accounts<br />
(including legal costs and claims by the tutor or family<br />
members for reimbursement), both paid and unpaid;<br />
E. Details of the past out-of-pocket expenses both paid<br />
and unpaid;<br />
F. Details of any other deductions to be made from the<br />
settlement e.g. Centrelink;<br />
G. A statement by the tutor to the effect that the amount<br />
allowed for past out-of-pocket expenses in the<br />
settlement includes all accounts, both paid and unpaid,<br />
of which the tutor is aware having made all relevant<br />
enquiries;

H. A current Medicare Notice of Charge or Clearance;<br />
I. An acknowledgement by the tutor that the settlement<br />
is fi nal.<br />
7. A copy of counsel’s advice or in its absence the advice of<br />
the solicitor with carriage of the matter, dealing with both<br />
the question of liability and the consideration of each of<br />
the applicable heads of damage in the proceedings should<br />
generally be provided for the assistance of the presiding<br />
Judge considering approval of the settlement three (3)<br />
clear working days prior to the listing of the application<br />
before the Court. Such advice may be provided to the<br />
Court in a sealed envelope and will be returned.<br />
8. In cases where an undertaking is required from a legal<br />
representative in relation to either the payment of out of<br />
pocket expenses or the reimbursement of payments made,<br />
the undertaking should, unless the court otherwise orders,<br />
be in the following form:<br />

received pursuant to this settlement, other than for legal<br />

Early Return of Subpoenas<br />
THIS Practice Note supersedes and replaces the previous<br />
Practices Notes referable to early return of subpoenas.<br />
1. INTRODUCTION<br />
1.1 The issuing of subpoenas and the inspection of<br />
documents is vital to the proper preparation of cases.<br />
The Court provides a system for the early production<br />
of documents so that parties can meet the standards<br />
imposed by Practice Notes.<br />
1.2 The power to deal with subpoenas is delegated to the<br />
registrar by a direction under section 13 of the Civil<br />
Procedure Act 2005.<br />
2. SYSTEM FOR EARLY RETURN OF SUBPOENAS<br />
2.1 The Court aims to allocate a return date within 6<br />
weeks of the issue of a subpoena for production.<br />
2.2 The Court has adopted the following system for the<br />
early return of subpoenas and access to documents to<br />
give effect to the powers in rule 33.9 of the Uniform<br />
Civil Procedure Rules 2005:<br />
(a) The issuing party will obtain a return date from<br />
the registry and endorse it on the subpoena. In<br />
Sydney, the return date will be on a Monday at<br />
11am before the registrar.<br />

(b) The issuing party must attach to the service copies<br />
of the subpoena a notice in the form specifi ed in<br />
the Practice Note. The issuing party is required to<br />
endorse a proposed access order and the producer<br />
is required to complete the attached declaration<br />
as to whether the material produced is copied<br />
material, original material or a mix of copied<br />
and original material. Unless an alternative<br />
order is sought the proposed access order will<br />
be “Plaintiff to have fi rst access for 7 days;<br />
thereafter, in the absence of further application,<br />
access to all parties.” Where a different proposed<br />
access order is sought the issuing party must<br />
state his or her reasons in the notice. If there is<br />
a dispute over the proposed access, the parties<br />
must appear on the return date.<br />
(c) The issuing party must serve a copy of the<br />
subpoena and notice on all other parties who have<br />
an address for service within 7 days of issue. If<br />
the return date is less than 2 weeks away, the copy<br />
and notice must be served within 24 hours.<br />
(d) The issuing party must appear on the return date<br />
if it has not notifi ed all parties of the issue of the<br />
subpoena. All other parties must attend on the<br />
return date unless the issuing party has obtained<br />
consent to mention the matter for all parties. The<br />
Court may make costs orders against parties who<br />
have not complied with the rules and this practice<br />
note.<br />
(e) Any party or the producer, may object to the<br />
issuing party about the proposed access order.<br />
The issuing party must notify all other parties<br />
of the objection. Parties who wish to contest the<br />
proposed access order must appear on the return<br />
date and argue the question before the registrar.<br />
(f) If there is No. appearance on the return date, the<br />
Court will generally make the proposed access<br />
order. There is No. need for the parties to appear<br />
on the return date if all parties consent to the<br />
order sought.<br />
(g) If the subpoena has not been served, the issuing<br />
party should appear on the return date and ask<br />
the registrar for a new return date.<br />
(h) If documents have not been produced, any party<br />
may obtain a further return date from the registry.<br />
That party must inform all other parties of the<br />
new return date.<br />
3. ACCESS TO DOCUMENTS<br />
3.1 When the proposed access order takes effect, parties<br />
may inspect documents in the registry in accordance<br />
with that order. The other parties may inspect the<br />
documents produced as soon as the fi rst access order<br />
has expired.<br />
3.2 Practitioners should be aware that, if the party with<br />
fi rst access does not inspect documents in accordance<br />
with the proposed access order, other parties may<br />
inspect privileged documents and the privilege may<br />
be lost.<br />
3.3 The Court has broad discretionary powers under rule<br />
33.8 of the Uniform Civil Procedure Rules 2005 with<br />
respect to access to and copying of documents.<br />

PRACTICE NOTE SC Eq 7 – Family Provision<br />
Commencement<br />
1. This Practice Note commences on 1 June 2009.<br />
Application<br />
2. This Practice Note applies to all applications under the Family Provision Act 1982<br />
or Chapter 3 of the Succession Act 2006.<br />
Definitions<br />
3. In this Practice Note:<br />
CPA means the Civil Procedure Act 2005<br />
Family provision application means an application under the Family Provision<br />
Act 1982 or Chapter 3 of the Succession Act 2006<br />
Online hearing means a hearing conducted pursuant to s 71 of the Civil<br />
Procedure Act 2005 and Part 3.9 of the Uniform Civil Procedure Rules 2005 and<br />
in accordance with Practice Note SC Gen 12<br />
UCPR means the Uniform Civil Procedure Rules 2005.<br />
Plaintiff’s documents<br />
4. The plaintiff must serve the following documents with the Summons:<br />
• An affidavit adapted from the form in Annexure 1 to this Practice Note<br />
• Notice of eligible persons<br />
• Draft consent orders for the first return date of the Summons that:<br />
o Set out a timetable for the future conduct of the proceedings including<br />
the service of affidavits and the disclosure of any documents<br />
o Refer the proceedings to mediation at the conclusion of that timetable.<br />
5. If a limitation period is about to expire and proceedings are being commenced to<br />
preserve rights, the plaintiff must serve the following documents with the<br />
Summons:<br />
• An affidavit setting out the reasons why the service of evidence should be<br />
deferred<br />
• Draft consent orders for the first return date that set out a timetable for the<br />
future conduct of the proceedings.<br />

Mediation<br />
8. Unless ordered otherwise, all proceedings involving Family provision applications<br />
must be mediated.<br />

17. Any application for interim provision or expedition must be by a notice of motion<br />
filed as soon as the circumstances warranting such an application are known.<br />
Proof of certain matters<br />
18. Unless the court orders otherwise, or notice is given that strict proof is necessary,<br />
parties may give evidence as follows:<br />
• A kerbside appraisal by a real estate agent of any property;<br />
• Internet or other media advertisements of the asking price of real estate;<br />
• The plaintiff’s or beneficiary’s best estimate of costs or expenses of items the<br />

• The plaintiff’s or beneficiary’s best estimate of costs or expenses of any<br />
renovation or refurbishment of property the plaintiff or beneficiary wishes to<br />

• A description by the plaintiff or beneficiary of any medical condition of which it<br />
is alleged the plaintiff or beneficiary is suffering.<br />
19. Practice Note SC Eq 5 – Expert evidence in the Equity Division applies with any<br />
necessary adaptations, if expert evidence is to be called.<br />
Consent Orders finalising proceedings<br />
20. Consent Orders finalising proceedings must include provisions that the parties<br />
agree that:<br />
• The application was made within time<br />
• The plaintiff is an eligible person<br />
• The plaintiff has served a notice identifying all other eligible persons on the<br />
administrator at the time of serving the summons<br />
• The administrator has filed a copy of the affidavit required by SCR Schedule J<br />
• The administrator has served notices of the plaintiff's claim on any person<br />
who, in the administrator's opinion, may be an eligible person<br />
• The administrator has filed a notice of appearance.<br />
21. Consent orders requiring the approval of an associate judge will be referred to<br />
the duty associate judge on a Friday.<br />
Listing for hearing<br />
22. If the proceedings fail to settle at mediation, the Registrar will set the proceedings<br />
down for hearing and make the Usual Order for Hearing in Annexure 4 to this<br />

Costs<br />
23. If any affidavits include irrelevant material, the court may order that the party<br />

USUAL ORDER FOR MEDIATION<br />
1. The executor or administrator of the deceased estate must file and serve an<br />
updated affidavit listing the estate’s assets and an up to date valuation of those<br />
assets by no later than 6 working days prior to the mediation.<br />
2. All other parties must file and serve a statement listing the parties’ assets and up<br />
to date valuation of those assets by no later than 6 working days prior to the<br />
mediation.<br />
3. Not less than 3 working days prior to the mediation, the plaintiff is to deliver a<br />
bundle of documents to the Mediator containing:<br />
3.1 copies of all affidavits served in the proceedings;<br />
3.2 copies of any other documents relied on by the plaintiff;<br />
3.3 the statement containing up to date valuations of the plaintiff’s assets;<br />
3.4 the statement as to the plaintiff’s estimated costs to the date of mediation.<br />
