The Reorganization and Regular Meeting of the Board of Education of the <strong>Copiague</strong> Union Free<br />

School District, Town of Babylon, was held on July 12, 2012, in the Board of Education Conference<br />

Room.<br />

Meeting was called to order at 6:50 p.m. by Mary Ellen Ruppert, District Clerk, with the opening<br />

exercises and a moment of silent meditation.<br />

Mary Ellen Ruppert, District Clerk, administered the Oath of Office to re-elected Board Members<br />

Laura Gavey, Michael L. Greb and Henry Johnson.<br />

Roll call of Board Members by District Clerk. .<br />

Mrs. Ruppert called for nominations for President for the 2012-2013 School Year.<br />

Motion by Mrs. Fischer, seconded by Mrs. Gavey to nominate Michael Greb.<br />

There being no further nominations, Michael Greb elected President of the Board of Education of the<br />

<strong>Copiague</strong> Union Free School District for the 2012-2013 School Year.<br />

Vote: 7 Yes. Unanimously passed.<br />

Mrs. Ruppert administered the oath to Mr. Greb, who assumed Chairmanship of the meeting.<br />

Mr. Greb called for nominations for Vice President for the 2012-2013 School Year.<br />

Motion by Mrs. Natoli seconded by Mr. Newman to nominate Doris Fischer.<br />

There being no further nominations, Doris Fischer elected Vice President of the Board of Education<br />

for the 2012-2013 School Year.<br />

Vote: 7 Yes. Unanimously passed.<br />

Mr. Greb called for nominations for 2nd Vice President for the 2012-2013 School Year.<br />

Motion by Mrs. Fischer, seconded by Mrs. Gavey to nominate Rosemary Natoli.<br />

There being no further nominations, Rosemary Natoli elected Second Vice President for the 2012-<br />

2013 School Year.<br />

Vote: 7 Yes. Unanimously passed.<br />

Mrs. Ruppert administered the Oath of Office to the duly elected Vice President, Second Vice<br />

President and Charles A. Leunig, Superintendent of <strong>Schools</strong>.

Motion by Mrs. Fischer, seconded by Mrs. Gavey to appoint Mrs. Mary Ellen Ruppert District Clerk<br />

for the 2012-2013 school year.<br />

Vote: 7 Yes. Unanimously passed.<br />

Mr. Michael L. Greb, notary, administered the oath to District Clerk Mary Ellen Ruppert.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint Toni McIntosh District Treasurer for<br />

the year 2012-2013 at a stipend of $8,000.<br />

Vote: 7 Yes. Unanimously passed.<br />

Oath was administered to the District Treasurer Toni McIntosh on August 2, 2012 in the office of the<br />

District Clerk.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint the firm of Ingerman Smith, L.L.P.<br />

School Attorney (General Counsel and Labor Counsel) for the year 2012-2013; annual retainer<br />

$27,800; hourly rate for non-retainer services $200.00. And furthermore, authorizes the President of<br />

the Board of Education to sign a Letter of Engagement, dated July 1, 2012, with Ingerman Smith,<br />

L.L.P.<br />

Vote: 7 Yes. Unanimously passed.<br />

Motion by Mrs. Fischer, seconded by Mrs. Newman to appoint Cullen & Danowski, L.L.P. External<br />

Auditors for the year 2012-2013 at a fee of $46,000, as per Request for Proposal dated June 27, 2011<br />

(year 2 of 5).<br />

Vote: 7 Yes. Unanimously passed.<br />

Motion by Mrs. Fischer, seconded by Mrs. Newman to appoint R.S. Abrams & Co., L.L.P. Internal<br />

Auditors for the year 2012-2013 at a fee of $4,825 per month, not to exceed $57,900, as per Letter of<br />

Engagement dated May 21, 2012.<br />

Vote: 7 Yes. Unanimously passed.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint Michael Kearns Claims Auditor for the<br />

year 2012-2013 at a fee of $15,300 as per Letter of Engagement.<br />

Vote: 7 Yes. Unanimously passed.<br />

Oath was administered to the Claims Auditor Michael Kearns in the office of the District Clerk on<br />

August 3, 2012.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint Margaret Ryan, Chief Faculty Auditor,<br />

for the year 2012-2013..<br />

Vote: 7 yes. Unanimously passed.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint Principals – Joseph Agosta, Jeanette<br />

Altruda, Cynthia Florio, Michael Kelly and Andrew Lagnado, Chief Faculty Counselors, for the year<br />

2012-2013.<br />

Vote: 7 yes. Unanimously passed.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to appoint Peter Michaelson, Purchasing Agent,<br />

for the year 2012-2013.<br />

Motion by Mrs. Fischer, seconded by Mr. Newman to approve the rate for mileage reimbursement at<br />

.50 cents per mile for the year 2012-2013.<br />

with other districts in Nassau/Suffolk Counties in the joint bidding of the commodities<br />

11. Motion by Mrs. Natoli, seconded by Mr. Newman to approve the following resolution supporting<br />

the opposition from the educational community regarding the Special Education Bill:<br />

RESOLUTION<br />

WHEREAS, a last minute legislative effort has resulted in passage of a bill<br />

that would heap new financial and administrative burdens on our school<br />

districts by requiring Committees on Special Education to take a student’s<br />

home life and cultural environment into account when making special<br />

education placements and require reimbursement within 30 days of tuition<br />

payments made by parents for unapproved placements.<br />

And WHEREAS, the bill may well violate federal IDEA requirements<br />

and according to the Poughkeepsie Journal, “leave local school districts<br />

exposed to a myriad of lawsuits and soaring special educational costs.”<br />

And WHEREAS, this legislation came without sufficient time for due<br />

consideration, leaving schools blindsided with new costs after their budgets<br />

were decimated to stay under the tax cap.<br />

And WHEREAS, the legislation leaves districts with high ethnic and<br />

religious populations subject to outlandish parental demands, jeopardizing<br />

funds budgeted for other special education students and the general education<br />

population of the district; ignoring the fact that under the tax cap, unexpected<br />

funds must be taken from existing programs and services, hurting other<br />

students.<br />

And WHEREAS, there are better ways to make sure that parents don’t<br />

wait too long for reimbursement when it’s found to be warranted, streamlining<br />

how placement challenges are settled and being culturally sensitive when<br />

making placements. Allowing parents to demand private school placement<br />

when an appropriate public school programs exists is detrimental to other<br />

students and the taxpaying communities that support our schools.

And WHEREAS, if the State of New York believes this is appropriate,<br />

it needs to provide the funding from its larger tax base and not expect local<br />

taxpayers to pay for a program that is not based on education concerns.<br />

And WHEREAS, the bill is legally flawed, as Committees on Special<br />

Education do not have the authority to reimburse parents for private,<br />

unapproved placements with 30 days as required under the bill. They may<br />

only do so only when directed by a hearing officer.<br />

And WHEREAS, this amounts to New York State’s first voucher<br />

program and one for only the wealthy, as only wealthy parents can afford to<br />

pay private, non-approved tuition payments and wait for reimbursement.<br />

And WHEREAS, this is a voucher program intended to segregate our<br />

children. New York State has always been a leader in integrating all of our<br />

children, irrespective of race, culture or special needs. Now, we are not only<br />

allowing a return to segregation, we are encouraging it by paying wealthy<br />

parents to use high cost, private services based on culture and not the<br />

appropriate educational services needed by the student to separate student,<br />

depriving them of the advantages of a shared social experience.<br />

THEREFORE, be it RESOLVED that the Board of Education Calls on<br />

Governor Andrew Cuomo to veto this onerous and inappropriate legislation.<br />

12. Motion by Mr. Newman, seconded by Mrs. Natoli to approve the following resolution regarding<br />

the Settlement Agreement between the <strong>Copiague</strong> School District and AT&T:<br />

RESOLUTION<br />

BE IT RESOLVED, that the Board herewith authorizes the Board<br />

President to execute a Release and Settlement Agreement between the<br />

Board and AT&T Corp. in which AT&T will issue a credit to the<br />

School District and the District will make a payment to AT&T<br />

regarding disputed charges. The Board has previously reviewed said<br />

Release and Settlement and herewith authorizes its approval.<br />
