any independent evidence that they intended that said property be<br />

characterized as the titled-spouse's separate property?<br />

~ Does Fam. Code §852's <strong>re</strong>qui<strong>re</strong>ment <strong>of</strong> a writing to change<br />

character apply to property acqui<strong>re</strong>d during marriage?<br />

~ If the asset was acqui<strong>re</strong>d from a third party, is the spouse who<br />

benefitted from the transaction subject to the interspousal fiduciary<br />

duty?<br />
