Public Hearing Comments
July 21, 2005
Apublic hearing was conducted on
July 22, 2005 regarding the
interpretation of House Bill1607,
which becomes law on November 1, 2005.
The topic of the meeting was whether or
not some activities involved in photogrammetry
or GIS mapping is included in the
definition of the practice of land surveying.
The approximately 70 people in attendance
were representatives from the legislature, aerial photography companies, county
assessors offices, Conservation Commission, Corporation Commission, Department
of Commerce, Tax Commission, Association of Regional Councils, ODOT,
and utility companies to name a few. The Board appreciated the attendees active
participation and their willingness to share information and their views on these
topics.
While it seems that if mappers were licensed, they would most logically
fall under the definition of the practice of land surveying, there was not any majority
agreement that it is necessary to license mappers. If the Board pursued
registration of mappers, a revision to the law would be necessary to provide some
amount of time to grandfather these mappers, along with a provision to practice
only within their area of expertise.

Another topic the Board is
addressing is the change in
the law in the definition of
the practice of land surveying, Section
475.2(7)(a)(4) which states
“subdivision of land parcels into
smaller parcels and/or the preparation
of the descriptions thereof,”.
A considerable amount of
discussion has occurred with regard
to this new language. The practice of
writing legal descriptions for new
parcels has been traditionally done by
other professions as well as by
professional land surveyors, and
therefore also comes under the exceptions
in Section 475.22. However, the
Board currently plans to propose
amended language in the statute, Section
475.2(7)(a)(4), during the next legislative
session to read “monumenting the
subdivision of land parcels into smaller
parcels and the preparation of the
descriptions in connection therewith.”
This is only proposed language
and will need to go before the legislature
before it will be enacted. However, in
anticipation of this rewrite of the statute,
Section 475.2(7)(a)(4) will not be
enforced as currently written.

License Expirations
April 1, 2005 to July 31, 2005
EXPIRATION/REVOCATION - Registrations may be revoked by the Board for non-payment of renewal
fees. Registrants will be notified of revocation by certified mail. Typically this notification is mailed 10 days
following expiration.
RENEWALS - Each registration issued by the Board expires on the last day of the month in which renewal
fees are due, and becomes invalid on that date unless paid. One notice of the renewal is sent by first class mail
to the address of record in the board files. This in effect provides notice two months prior to revocation.
REINSTATEMENT - Former registrants whose certificates have expired and were revoked for failure to
pay renewal fees and desire to reinstate shall make application for reinstatement within 180 days after expiration
and pay the prescribed renewal fee and penalty. After 180 days, a new application will be required, which
shall be considered specifically by the Board, both from the standpoint of competency and of character.

The Board of Governors of Licensed
Architects and Landscape Architects, the
State Board of Registration for Professional
Engineers and Land Surveyors, and the State Fire
Marshal’s office are combining forces to advance
the health, safety, and welfare of the public in the
regulation of the professions under the jurisdiction
of these boards, under the enforcement provided
by the State Fire Marshal’s office.
Meetings are being held and ideas are
being exchanged to determine how to improve the
communication between our agencies, which have
similar goals and missions, for the professionals we
regulate. The common objective is to ensure that
all buildings built in the state of Oklahoma comply
with the applicable statutes, rules, and building
codes, and are safe to utilize or occupy. In this
regard, we collectively decided that circulating
The Board’s Bulletin to all professional
engineers, land surveyors, architects and landscape
architects would be a good communication tool to
utilize. Therefore, for the first time The Board’s
Bulletin is being mailed to all of these
professionals. We welcome your comments and
suggestions as to how to make this publication a
more useful tool for you as professionals.
As the Executive Directors of the boards
regulating your professions, we also strongly
recommend that you familiarize yourself with not only
the statute and rules which regulate your profession,
but also any statutes or rules which regulate your
“sister” professions. Architects need to become
familiar with the engineering laws and engineers need
to become familiar with the architectural laws to
ensure that all state rules and regulations are followed.
One way that this board has chosen to use
The Board’s Bulletin in the past is to publish all
disciplinary activity of the Board. This involves
activities concerning licensed and unlicensed practice
of engineering and land surveying. Beginning with this
issue, The Board’s Bulletin will also contain all
disciplinary activity taken by the Architectural Board.
The Board’s Bulletin will also address any current
topics of interest, which may involve the regulation of
the practice of engineering, surveying, architecture
and/or landscape architecture. We will be soliciting
input from the State Fire Marshal’s office in this
communication as well.
So look for “The A/E Interchange” column
in each issue of The Board’s Bulletin to keep
abreast of what’s currently happening in your
professions.
Over 70 . . . . and Enjoying the Benefits!
If you are a registered professional engineer or land surveyor in the state of Oklahoma, one of the
benefits of being over 70 years of age is not being required to pay your $100 biennial renewal fee. This
waiver is for all registrants over the age of 70. An added exemption is reflected in the rules for continuing
education for professional engineers and land surveyors. IF you meet the requirement of not practicing your
profession for the prior 2 years, you may certify on your continuing education log form to this effect and
return the form to our office with your renewal form and you will not be required to obtain continuing
education. HOWEVER, if you are listed on a certificate of authorization as being in responsible charge of
the professional practices of a firm, you will NOT qualify for this exemption.

performing engineering services in the state of
Oklahoma on four projects without a certificate of
authorization to do so, Dant Clayton Corporation is
found Guilty and assessed an administrative
penalty of $2000. Richard Barrios, for aiding
assisting Dant Clayton Corporation in the unauthorized
practice of engineering in the state of Oklahoma is
found Guilty and assessed an administrative
penalty in the amount of $500.
In the Matter of Glenn Briggs & Associates, Inc.,
CA 544, and Glenn R. Briggs, P.E. 5749; Case
No. 04-61; Through Consent: Glenn Briggs &
Associates, Inc. and Glenn R. Briggs undertook to
provide consultation, evaluation, planning and design as
well as other engineering services for the Duke
Municipal Authority to design and get approval for the
addition of a total retention lagoon system to the
wastewater treatment facilities. For committing acts
which evidence attempts through commission or
omission to mislead any person or entity regarding the
services for this project, the firm and professional
engineer are each found Guilty of misconduct and
assessed an administrative penalty in the amount
of $5,000 each for a total of $10,000. Glenn R.
Briggs’ registration as Professional Engineer is
hereby Suspended for a term of one (1) year. As
a condition of reinstatement, Mr. Briggs is
ordered to complete Intermediate Studies in
Engineering Ethics offered by the College of
Engineering, Texas Tech University.

May 26-27, 2005
In the Matter of Edgar A. Stacy, III, PE 17977;
Case No. 05-11; Through Consent: For being
disciplined by the state of New Jersey for practicing
engineering with an expired certificate of registration,
Mr. Stacy is found Guilty and hereby Reprimanded.
In the Matter of Ronald A. Roberts, PE 17101;
Case No. 05-12; Through Consent: For being
disciplined by the state of New Jersey for practicing
engineering with an expired certificate of registration,
Mr. Roberts is found Guilty and hereby
Reprimanded.
In the Matter of Scott Lee Harvey; Case No. 05-
20; Through Consent: For offering engineering
services in the state of Oklahoma, deceiving his
employer by telling him he was a registered
professional engineer in Oklahoma and obtaining an
Oklahoma Professional Engineer’s seal, Mr. Harvey is
found Guilty and assessed an administrative
penalty of $1000.
July 21-22, 2005
In the Matter of Arnold Irwin, Jr.; Case No. 05-
18; Through Consent: For offering and practicing
surveying services on multiple projects in the state of
Oklahoma without a certificate of registration to do so,
Mr. Irwin is found Guilty and assessed an
administrative penalty in the amount of $3,750.
Mr. Irwin is ordered to cease and desist from the
practice of land surveying in the state of
Oklahoma until such time as he has been issued a
certificate of registration to do so.
In the Matter of Bonnie B. McInnish, PE 21852;
Through Consent: For offering and practicing
engineering in the state of Oklahoma on a project
without a certificate of registration to do so, Ms.
McInnish is found Guilty and assessed an
administrative penalty of $500.
In the Matter of E. C. Woodward Architect &
Associates, P.C., and Ernest C. Woodward;
Summary of Findings of Facts and Order: For
offering and practicing engineering without a certificate
of registration to do so on 5 projects in the state of
Oklahoma, Mr. Woodward is found Guilty and
assessed an administrative penalty of $5,000. For
offering and practicing engineering without a certificate
of registration to do so on 5 projects in the state of
Oklahoma, E. C. Woodward Architect & Associates,
P.C. is found Guilty and assessed an administrative
penalty in the amount of $5,000. Both
respondents are ordered to cease and desist from
the practice of engineering until such time as
they are duly registered to do so.

As stated in the “A/E Interchange” article of this newsletter – The Board’s Bulletin is now
printing disciplinary matters conducted by the Board of Governors of Licensed Architects and
Landscape Architects. The following are these enforcement activities from 2005 to date:
In the Matter of Monte Goucher and Goucher
& Associates, Inc.; Case No. 2004-206: Monte
Goucher is a registered professional engineer in the
state of Oklahoma. Goucher & Associates, Inc. is
a registered engineering firm in the state of
Oklahoma. Neither is authorized to offer or
provide architecture services in the state of
Oklahoma. For designing and preparing plans and
specifications for a church with an estimated cost
exceeding $200,000, the Board of Architects and
Landscape Architects finds that Mr. Goucher has
unlawfully practiced or offered to practice
architecture in the state of Oklahoma without a
license to do so. Mr. Goucher is hereby assessed a
civil penalty in the amount of $500.
In the Matter of Brett Biesemeyer; Case No.
2004-220: Brett Biesemeyer is a registered
professional engineer in the state of Oklahoma. Mr.
Biesemeyer is not authorized to offer or provide
architecture services in the state of Oklahoma. For
designing and preparing plans for a church which
exceeded $40,000 in cost, the Board of Licensed
Architects and Landscape Architects finds that Mr.
Biesemeyer has unlawfully practiced or offered to
practice architecture in the state of Oklahoma
without a license to do so. Mr. Biesemeyer is
hereby assessed a civil penalty in the amount of
$5000.
OLS EXAM PAK STUDY UNDERWAY
The Oklahoma Law & Surveying Examination (OLS) is an important part of the licensing process for
professional land surveyors in Oklahoma. Knowledge of the laws and procedures governing the
practice of land surveying in Oklahoma is essential to the goal of protection of the public. The profession
has undergone many changes in the last ten (10) years. Land Surveyors are being mailed a Professional
Activities and Knowledge Survey (PAKS) to collect information from the land surveying community to
ensure that the information being tested is current and relevant to the practice of land surveying in Oklahoma.
The success and validity of this effort depends upon the participation of professional land surveyors
in the state of Oklahoma.
Please take the time to complete the PAKS study and return it to our office by September 1, 2005.
