Public Hearing Comments<br />

July 21, 2005<br />

Apublic hearing was conducted on<br />

July 22, 2005 regarding the<br />

interpretation <strong>of</strong> House Bill1607,<br />

which becomes law on November 1, 2005.<br />

<strong>The</strong> topic <strong>of</strong> the meeting was whether or<br />

not some activities involved in photogrammetry<br />

or GIS mapping is included in the<br />

definition <strong>of</strong> the practice <strong>of</strong> land surveying.<br />

<strong>The</strong> approximately 70 people in attendance<br />

were representatives from the legislature, aerial photography companies, county<br />

assessors <strong>of</strong>fices, Conservation Commission, Corporation Commission, Department<br />

<strong>of</strong> Commerce, Tax Commission, Association <strong>of</strong> Regional Councils, ODOT,<br />

and utility companies to name a few. <strong>The</strong> Board appreciated the attendees active<br />

participation and their willingness to share information and their views on these<br />

topics.<br />

While it seems that if mappers were licensed, they would most logically<br />

fall under the definition <strong>of</strong> the practice <strong>of</strong> land surveying, there was not any majority<br />

agreement that it is necessary to license mappers. If the Board pursued<br />

registration <strong>of</strong> mappers, a revision to the law would be necessary to provide some<br />

amount <strong>of</strong> time to grandfather these mappers, along with a provision to practice<br />

only within their area <strong>of</strong> expertise.<br />

Another topic the Board is<br />

addressing is the change in<br />

the law in the definition <strong>of</strong><br />

the practice <strong>of</strong> land surveying, Section<br />

475.2(7)(a)(4) which states<br />

“subdivision <strong>of</strong> land parcels into<br />

smaller parcels and/or the preparation<br />

<strong>of</strong> the descriptions there<strong>of</strong>,”.<br />

A considerable amount <strong>of</strong><br />

discussion has occurred with regard<br />

to this new language. <strong>The</strong> practice <strong>of</strong><br />

writing legal descriptions for new<br />

parcels has been traditionally done by<br />

other pr<strong>of</strong>essions as well as by<br />

pr<strong>of</strong>essional land surveyors, and<br />

therefore also comes under the exceptions<br />

in Section 475.22. However, the<br />

Board currently plans to propose<br />

amended language in the statute, Section<br />

475.2(7)(a)(4), during the next legislative<br />

session to read “monumenting the<br />

subdivision <strong>of</strong> land parcels into smaller<br />

parcels and the preparation <strong>of</strong> the<br />

descriptions in connection therewith.”<br />

This is only proposed language<br />

and will need to go before the legislature<br />

before it will be enacted. However, in<br />

anticipation <strong>of</strong> this rewrite <strong>of</strong> the statute,<br />

Section 475.2(7)(a)(4) will not be<br />

enforced as currently written.<br />

License Expirations<br />

April 1, 2005 to July 31, 2005<br />

EXPIRATION/REVOCATION - Registrations may be revoked by the Board for non-payment <strong>of</strong> renewal<br />

fees. Registrants will be notified <strong>of</strong> revocation by certified mail. Typically this notification is mailed 10 days<br />

following expiration.<br />

RENEWALS - Each registration issued by the Board expires on the last day <strong>of</strong> the month in which renewal<br />

fees are due, and becomes invalid on that date unless paid. One notice <strong>of</strong> the renewal is sent by first class mail<br />

to the address <strong>of</strong> record in the board files. This in effect provides notice two months prior to revocation.<br />

REINSTATEMENT - Former registrants whose certificates have expired and were revoked for failure to<br />

pay renewal fees and desire to reinstate shall make application for reinstatement within 180 days after expiration<br />

and pay the prescribed renewal fee and penalty. After 180 days, a new application will be required, which<br />

shall be considered specifically by the Board, both from the standpoint <strong>of</strong> competency and <strong>of</strong> character.<br />

Marshal’s <strong>of</strong>fice are combining forces to advance<br />

the health, safety, and welfare <strong>of</strong> the public in the<br />

regulation <strong>of</strong> the pr<strong>of</strong>essions under the jurisdiction<br />

<strong>of</strong> these boards, under the enforcement provided<br />

by the <strong>State</strong> Fire Marshal’s <strong>of</strong>fice.<br />

Meetings are being held and ideas are<br />

being exchanged to determine how to improve the<br />

communication between our agencies, which have<br />

similar goals and missions, for the pr<strong>of</strong>essionals we<br />

regulate. <strong>The</strong> common objective is to ensure that<br />

all buildings built in the state <strong>of</strong> <strong>Oklahoma</strong> comply<br />

with the applicable statutes, rules, and building<br />

codes, and are safe to utilize or occupy. In this<br />

regard, we collectively decided that circulating<br />

<strong>The</strong> Board’s <strong>Bulletin</strong> to all pr<strong>of</strong>essional<br />

engineers, land surveyors, architects and landscape<br />

architects would be a good communication tool to<br />

utilize. <strong>The</strong>refore, for the first time <strong>The</strong> Board’s<br />

<strong>Bulletin</strong> is being mailed to all <strong>of</strong> these<br />

pr<strong>of</strong>essionals. We welcome your comments and<br />

suggestions as to how to make this publication a<br />

more useful tool for you as pr<strong>of</strong>essionals.<br />

As the Executive Directors <strong>of</strong> the boards<br />

regulating your pr<strong>of</strong>essions, we also strongly<br />

recommend that you familiarize yourself with not only<br />

the statute and rules which regulate your pr<strong>of</strong>ession,<br />

but also any statutes or rules which regulate your<br />

“sister” pr<strong>of</strong>essions. Architects need to become<br />

familiar with the engineering laws and engineers need<br />

to become familiar with the architectural laws to<br />

ensure that all state rules and regulations are followed.<br />

One way that this board has chosen to use<br />

<strong>The</strong> Board’s <strong>Bulletin</strong> in the past is to publish all<br />

disciplinary activity <strong>of</strong> the Board. This involves<br />

activities concerning licensed and unlicensed practice<br />

<strong>of</strong> engineering and land surveying. Beginning with this<br />

issue, <strong>The</strong> Board’s <strong>Bulletin</strong> will also contain all<br />

disciplinary activity taken by the Architectural Board.<br />

<strong>The</strong> Board’s <strong>Bulletin</strong> will also address any current<br />

topics <strong>of</strong> interest, which may involve the regulation <strong>of</strong><br />

the practice <strong>of</strong> engineering, surveying, architecture<br />

and/or landscape architecture. We will be soliciting<br />

input from the <strong>State</strong> Fire Marshal’s <strong>of</strong>fice in this<br />

communication as well.<br />

So look for “<strong>The</strong> A/E Interchange” column<br />

in each issue <strong>of</strong> <strong>The</strong> Board’s <strong>Bulletin</strong> to keep<br />

abreast <strong>of</strong> what’s currently happening in your<br />

pr<strong>of</strong>essions.<br />

Over 70 . . . . and Enjoying the Benefits!<br />

If you are a registered pr<strong>of</strong>essional engineer or land surveyor in the state <strong>of</strong> <strong>Oklahoma</strong>, one <strong>of</strong> the<br />

benefits <strong>of</strong> being over 70 years <strong>of</strong> age is not being required to pay your $100 biennial renewal fee. This<br />

waiver is for all registrants over the age <strong>of</strong> 70. An added exemption is reflected in the rules for continuing<br />

education for pr<strong>of</strong>essional engineers and land surveyors. IF you meet the requirement <strong>of</strong> not practicing your<br />

pr<strong>of</strong>ession for the prior 2 years, you may certify on your continuing education log form to this effect and<br />

return the form to our <strong>of</strong>fice with your renewal form and you will not be required to obtain continuing<br />

education. HOWEVER, if you are listed on a certificate <strong>of</strong> authorization as being in responsible charge <strong>of</strong><br />

the pr<strong>of</strong>essional practices <strong>of</strong> a firm, you will NOT qualify for this exemption.<br />

assisting Dant Clayton Corporation in the unauthorized<br />

practice <strong>of</strong> engineering in the state <strong>of</strong> <strong>Oklahoma</strong> is<br />

found Guilty and assessed an administrative<br />

penalty in the amount <strong>of</strong> $500.<br />

In the Matter <strong>of</strong> Glenn Briggs & Associates, Inc.,<br />

CA 544, and Glenn R. Briggs, P.E. 5749; Case<br />

No. 04-61; Through Consent: Glenn Briggs &<br />

Associates, Inc. and Glenn R. Briggs undertook to<br />

provide consultation, evaluation, planning and design as<br />

well as other engineering services for the Duke<br />

Municipal Authority to design and get approval for the<br />

addition <strong>of</strong> a total retention lagoon system to the<br />

wastewater treatment facilities. For committing acts<br />

which evidence attempts through commission or<br />

omission to mislead any person or entity regarding the<br />

services for this project, the firm and pr<strong>of</strong>essional<br />

engineer are each found Guilty <strong>of</strong> misconduct and<br />

assessed an administrative penalty in the amount<br />

<strong>of</strong> $5,000 each for a total <strong>of</strong> $10,000. Glenn R.<br />

Briggs’ registration as Pr<strong>of</strong>essional Engineer is<br />

hereby Suspended for a term <strong>of</strong> one (1) year. As<br />

a condition <strong>of</strong> reinstatement, Mr. Briggs is<br />

ordered to complete Intermediate Studies in<br />

Engineering Ethics <strong>of</strong>fered by the College <strong>of</strong><br />

Engineering, Texas Tech University.<br />

Mr. Stacy is found Guilty and hereby Reprimanded.<br />

In the Matter <strong>of</strong> Ronald A. Roberts, PE 17101;<br />

Case No. 05-12; Through Consent: For being<br />

disciplined by the state <strong>of</strong> New Jersey for practicing<br />

engineering with an expired certificate <strong>of</strong> registration,<br />

Mr. Roberts is found Guilty and hereby<br />

In the Matter <strong>of</strong> Scott Lee Harvey; Case No. 05-<br />

20; Through Consent: For <strong>of</strong>fering engineering<br />

services in the state <strong>of</strong> <strong>Oklahoma</strong>, deceiving his<br />

employer by telling him he was a registered<br />

pr<strong>of</strong>essional engineer in <strong>Oklahoma</strong> and obtaining an<br />

<strong>Oklahoma</strong> Pr<strong>of</strong>essional Engineer’s seal, Mr. Harvey is<br />

found Guilty and assessed an administrative<br />

penalty <strong>of</strong> $1000.<br />

July 21-22, 2005<br />

In the Matter <strong>of</strong> Arnold Irwin, Jr.; Case No. 05-<br />

18; Through Consent: For <strong>of</strong>fering and practicing<br />

surveying services on multiple projects in the state <strong>of</strong><br />

<strong>Oklahoma</strong> without a certificate <strong>of</strong> registration to do so,<br />

Mr. Irwin is found Guilty and assessed an<br />

administrative penalty in the amount <strong>of</strong> $3,750.<br />

Mr. Irwin is ordered to cease and desist from the<br />

practice <strong>of</strong> land surveying in the state <strong>of</strong><br />

<strong>Oklahoma</strong> until such time as he has been issued a<br />

certificate <strong>of</strong> registration to do so.<br />

In the Matter <strong>of</strong> Bonnie B. McInnish, PE 21852;<br />

Through Consent: For <strong>of</strong>fering and practicing<br />

engineering in the state <strong>of</strong> <strong>Oklahoma</strong> on a project<br />

without a certificate <strong>of</strong> registration to do so, Ms.<br />

McInnish is found Guilty and assessed an<br />

<strong>Oklahoma</strong>, Mr. Woodward is found Guilty and<br />

assessed an administrative penalty <strong>of</strong> $5,000. For<br />

<strong>of</strong>fering and practicing engineering without a certificate<br />

<strong>of</strong> registration to do so on 5 projects in the state <strong>of</strong><br />

<strong>Oklahoma</strong>, E. C. Woodward Architect & Associates,<br />

P.C. is found Guilty and assessed an administrative<br />

penalty in the amount <strong>of</strong> $5,000. Both<br />

respondents are ordered to cease and desist from<br />

the practice <strong>of</strong> engineering until such time as<br />

they are duly registered to do so.<br />

As stated in the “A/E Interchange” article <strong>of</strong> this newsletter – <strong>The</strong> Board’s <strong>Bulletin</strong> is now<br />

printing disciplinary matters conducted by the Board <strong>of</strong> Governors <strong>of</strong> Licensed Architects and<br />

Landscape Architects. <strong>The</strong> following are these enforcement activities from 2005 to date:<br />

In the Matter <strong>of</strong> Monte Goucher and Goucher<br />

& Associates, Inc.; Case No. 2004-206: Monte<br />

Goucher is a registered pr<strong>of</strong>essional engineer in the<br />

state <strong>of</strong> <strong>Oklahoma</strong>. Goucher & Associates, Inc. is<br />

a registered engineering firm in the state <strong>of</strong><br />

<strong>Oklahoma</strong>. Neither is authorized to <strong>of</strong>fer or<br />

provide architecture services in the state <strong>of</strong><br />

<strong>Oklahoma</strong>. For designing and preparing plans and<br />

specifications for a church with an estimated cost<br />

exceeding $200,000, the Board <strong>of</strong> Architects and<br />

Landscape Architects finds that Mr. Goucher has<br />

unlawfully practiced or <strong>of</strong>fered to practice<br />

architecture in the state <strong>of</strong> <strong>Oklahoma</strong> without a<br />

license to do so. Mr. Goucher is hereby assessed a<br />

civil penalty in the amount <strong>of</strong> $500.<br />

In the Matter <strong>of</strong> Brett Biesemeyer; Case No.<br />

2004-220: Brett Biesemeyer is a registered<br />

pr<strong>of</strong>essional engineer in the state <strong>of</strong> <strong>Oklahoma</strong>. Mr.<br />

Biesemeyer is not authorized to <strong>of</strong>fer or provide<br />

architecture services in the state <strong>of</strong> <strong>Oklahoma</strong>. For<br />

designing and preparing plans for a church which<br />

exceeded $40,000 in cost, the Board <strong>of</strong> Licensed<br />

Architects and Landscape Architects finds that Mr.<br />

Biesemeyer has unlawfully practiced or <strong>of</strong>fered to<br />

practice architecture in the state <strong>of</strong> <strong>Oklahoma</strong><br />

without a license to do so. Mr. Biesemeyer is<br />

hereby assessed a civil penalty in the amount <strong>of</strong><br />

$5000.<br />

OLS EXAM PAK STUDY UNDERWAY<br />

<strong>The</strong> <strong>Oklahoma</strong> Law & Surveying Examination (OLS) is an important part <strong>of</strong> the licensing process for<br />

pr<strong>of</strong>essional land surveyors in <strong>Oklahoma</strong>. Knowledge <strong>of</strong> the laws and procedures governing the<br />

practice <strong>of</strong> land surveying in <strong>Oklahoma</strong> is essential to the goal <strong>of</strong> protection <strong>of</strong> the public. <strong>The</strong> pr<strong>of</strong>ession<br />

has undergone many changes in the last ten (10) years. Land Surveyors are being mailed a Pr<strong>of</strong>essional<br />

Activities and Knowledge Survey (PAKS) to collect information from the land surveying community to<br />

ensure that the information being tested is current and relevant to the practice <strong>of</strong> land surveying in <strong>Oklahoma</strong>.<br />

<strong>The</strong> success and validity <strong>of</strong> this effort depends upon the participation <strong>of</strong> pr<strong>of</strong>essional land surveyors<br />

in the state <strong>of</strong> <strong>Oklahoma</strong>.<br />

Please take the time to complete the PAKS study and return it to our <strong>of</strong>fice by September 1, 2005.<br />
