o) O<strong>the</strong>r Circumstances<br />
i. where a work area identifies any o<strong>the</strong>r circumstances where employment is to be for a fixed period, <strong>the</strong>n,<br />
subject to a successful applicati<strong>on</strong> to <strong>the</strong> Director, Human Resources, you may be engaged for a fixed<br />
period(s) which will not exceed five (5) years.<br />
i.ii. any applicati<strong>on</strong> under this sub-clause will be accompanied by a written justificati<strong>on</strong> and will be subject to<br />
approval by <strong>the</strong> Director, Human Resources.<br />
2.2.2 Fur<strong>the</strong>r Employment<br />
a) Before your c<strong>on</strong>tract expires, <strong>the</strong> University will advise you <strong>of</strong> whe<strong>the</strong>r or not <strong>the</strong>re is a c<strong>on</strong>tinuing need for<br />
<strong>the</strong> positi<strong>on</strong>.<br />
b) Where <strong>the</strong> University advises you that <strong>the</strong>re is a c<strong>on</strong>tinuing need for <strong>the</strong> positi<strong>on</strong>, you will be given fur<strong>the</strong>r<br />
employment in <strong>the</strong> positi<strong>on</strong> provided that:<br />
i. you were employed in <strong>the</strong> relevant positi<strong>on</strong> through a competitive and merit-based selecti<strong>on</strong><br />
process; and<br />
ii. you have performed satisfactorily in that positi<strong>on</strong>.<br />
c) If you are currently employed <strong>on</strong> a fixed term c<strong>on</strong>tract that was made prior to this Agreement, your c<strong>on</strong>tract<br />
will not change. Any new c<strong>on</strong>tract must be made in accordance with this Agreement.<br />
2.2.3 Notice Periods<br />
Notwithstanding any entitlement available to you under your c<strong>on</strong>tract <strong>of</strong> employment, or under this Agreement <strong>on</strong><br />
account <strong>of</strong> your c<strong>on</strong>tinuous service, you will be entitled to <strong>the</strong> following notice period:<br />
a) If you are a fixed-term staff member, engaged <strong>on</strong> a fixed-term c<strong>on</strong>tract to work for <strong>the</strong> circumstances<br />
described in clause 72.32.1 (a), or clause 27.32.1 (c) <strong>of</strong> this Agreement, <strong>the</strong> University will provide you with<br />
its intenti<strong>on</strong> to renew, or not to renew, your employment with <strong>the</strong> University up<strong>on</strong> <strong>the</strong> expiry <strong>of</strong> your c<strong>on</strong>tract.<br />
Notice provided will be:<br />
Period <strong>of</strong><br />
C<strong>on</strong>tinuous Service<br />
Less than 3 years<br />
Period <strong>of</strong> Notice<br />
2 weeks<br />
3 Years or over 4 weeks<br />
If you are over <strong>the</strong> age <strong>of</strong> 45 years at <strong>the</strong> time <strong>the</strong> University gives you notice in accordance with this<br />
clause, and provided that you have at least two years c<strong>on</strong>tinuous service, you will be entitled to an<br />
additi<strong>on</strong>al week's notice.<br />
b) The University may at its opti<strong>on</strong> provide payment in lieu for all or part <strong>of</strong> <strong>the</strong> notice period.
