B. Rule/Statutory Violations<br />

The violations that were found are:<br />

R 400.1903<br />

Caregiver Responsibilities.<br />

(1) A caregiver shall be responsible for all of the following<br />

provisions:<br />

(f) Have a written and signed agreement with a responsible<br />

person who is 18 years of age or older to provide care and<br />

supervision for children during an emergency situation.<br />

Ms. <strong>Everson</strong> did not have a signed, written agreement with an adult to provide care<br />

and supervision in case of an emergency.<br />

R 400.1920<br />

Outdoor play area and equipment.<br />

(1) A child care home shall provide a clean, safe, and hazard<br />

free outdoor play area, on the premises or within a reasonable<br />

walking distance of the home.<br />

A large dog is chained in the outdoor play area and has dug excessively large holes<br />

making the outdoor play area unsafe for childcare use.<br />

R 400.1932<br />

Home maintenance and safety.<br />

(1) The structure, premises, and furnishings of a child care<br />

home shall be in good repair and maintained in a clean, safe,<br />

and comfortable condition.<br />

(2) All dangerous and hazardous materials or items shall be<br />

stored securely and out of the reach of children.<br />

(4) Three or more steps, or a total rise of 24 inches or more,<br />

shall require a handrail.<br />

On June 26, <strong>2007</strong>, cleaning products were easily accessible to daycare children.<br />

The family room steps have a rise of 24 inches but did not have a handrail.<br />

The furnace room was crowded with excess clothing, tools and furniture belonging to<br />

the landlord.<br />
