Dear Ms. Everson:
This letter is a follow-up to the Agency’s findings regarding the 90-day inspection
conducted at your home on 06/26/2007. The purpose of this inspection was to
determine compliance with applicable licensing statutes and administrative rules for
Family Day Care Homes.
A. Description of Facility
Ms. Everson home is located on the Westside of Detroit near the intersection Seven
Mile Rd. and Evergreen. The three-bedroom, one bath bungalow has adequate
space for the capacity of six. The rooms approved for childcare use are the living
room, dining room, family room and bedroom #1. The combined rooms measure
approximately 450 square feet. The home has two remote, easily accessible exits.
The outdoor play area is fenced and measures 400 square feet. Ms. Everson has a
large Pit Bull chained in the rear of the yard. There is no barrier to protect daycare
children from the animal. Ms. Everson has agreed to identify another location for
her dog during daycare hours. He is not to have contact with any daycare
child. The dog has dug large holes in the yard that Ms. Everson also agreed to have
filled prior to children utilizing the space.
Ms. Everson will operate her daycare family home 24 hours, Monday-Saturday.
Daycare services will be provided to infants and children through 12 years of age.
Meals and snacks will be provided by the home. She has chosen as her business
name Maxine’s Heavenly Day Care.
The facility has adequate and varied equipment for the requested capacity.
There are no guns in the childcare family home. Transportation is not provided.

Ms. Everson has completed CPR and First Aid.
B. Rule/Statutory Violations
The violations that were found are:
R 400.1903
Caregiver Responsibilities.
(1) A caregiver shall be responsible for all of the following
provisions:
(f) Have a written and signed agreement with a responsible
person who is 18 years of age or older to provide care and
supervision for children during an emergency situation.
Ms. Everson did not have a signed, written agreement with an adult to provide care
and supervision in case of an emergency.
R 400.1920
Outdoor play area and equipment.
(1) A child care home shall provide a clean, safe, and hazard
free outdoor play area, on the premises or within a reasonable
walking distance of the home.
A large dog is chained in the outdoor play area and has dug excessively large holes
making the outdoor play area unsafe for childcare use.
R 400.1932
Home maintenance and safety.
(1) The structure, premises, and furnishings of a child care
home shall be in good repair and maintained in a clean, safe,
and comfortable condition.
(2) All dangerous and hazardous materials or items shall be
stored securely and out of the reach of children.
(4) Three or more steps, or a total rise of 24 inches or more,
shall require a handrail.
On June 26, 2007, cleaning products were easily accessible to daycare children.
The family room steps have a rise of 24 inches but did not have a handrail.
The furnace room was crowded with excess clothing, tools and furniture belonging to
the landlord.

Electrical service; maintenance.
(1) The electrical service of a child care home shall be
maintained in a safe condition. When warranted, an electrical
inspection by an electrical inspecting authority may be required.
The family room, bedroom 1 and the kitchen had electrical outlets easily accessible
to daycare children.
R 400.1945
Fire; tornado; serious accident and injury plans.
(1) A written plan for the care of children shall be established
and posted for each of the following emergencies:
(a) Fire evacuation.
(b) Tornado watches and warnings.
(c) Serious accident or injury.
(d) Water emergencies, if applicable.
Ms. Everson did not have written procedures for the care and evacuation of children
in case of the emergencies for none of the plans noted above.

The Agency provides technical assistance to meet the licensing requirements and
consultation to improve services.
