Dear Ms. <strong>Everson</strong>:<br />

This letter is a follow-up to the Agency’s findings regarding the 90-day inspection<br />

conducted at your home on 06/26/<strong>2007</strong>. The purpose of this inspection was to<br />

determine compliance with applicable licensing statutes and administrative rules for<br />

Family Day Care Homes.<br />

A. Description of Facility<br />

Ms. <strong>Everson</strong> home is located on the Westside of Detroit near the intersection Seven<br />

Mile Rd. and Evergreen. The three-bedroom, one bath bungalow has adequate<br />

space for the capacity of six. The rooms approved for childcare use are the living<br />

room, dining room, family room and bedroom #1. The combined rooms measure<br />

approximately 450 square feet. The home has two remote, easily accessible exits.<br />

The outdoor play area is fenced and measures 400 square feet. Ms. <strong>Everson</strong> has a<br />

large Pit Bull chained in the rear of the yard. There is no barrier to protect daycare<br />

children from the animal. Ms. <strong>Everson</strong> has agreed to identify another location for<br />

her dog during daycare hours. He is not to have contact with any daycare<br />

child. The dog has dug large holes in the yard that Ms. <strong>Everson</strong> also agreed to have<br />

filled prior to children utilizing the space.<br />

Ms. <strong>Everson</strong> will operate her daycare family home 24 hours, Monday-Saturday.<br />

Daycare services will be provided to infants and children through 12 years of age.<br />

Meals and snacks will be provided by the home. She has chosen as her business<br />

name Maxine’s Heavenly Day Care.<br />

The facility has adequate and varied equipment for the requested capacity.<br />

There are no guns in the childcare family home. Transportation is not provided.<br />

Ms. <strong>Everson</strong> has completed CPR and First Aid.<br />

B. Rule/Statutory Violations<br />

The violations that were found are:<br />

R 400.1903<br />

Caregiver Responsibilities.<br />

(1) A caregiver shall be responsible for all of the following<br />

provisions:<br />

(f) Have a written and signed agreement with a responsible<br />

person who is 18 years of age or older to provide care and<br />

supervision for children during an emergency situation.<br />

Ms. <strong>Everson</strong> did not have a signed, written agreement with an adult to provide care<br />

and supervision in case of an emergency.<br />

R 400.1920<br />

Outdoor play area and equipment.<br />

(1) A child care home shall provide a clean, safe, and hazard<br />

free outdoor play area, on the premises or within a reasonable<br />

walking distance of the home.<br />

A large dog is chained in the outdoor play area and has dug excessively large holes<br />

making the outdoor play area unsafe for childcare use.<br />

R 400.1932<br />

Home maintenance and safety.<br />

(1) The structure, premises, and furnishings of a child care<br />

home shall be in good repair and maintained in a clean, safe,<br />

and comfortable condition.<br />

(2) All dangerous and hazardous materials or items shall be<br />

stored securely and out of the reach of children.<br />

(4) Three or more steps, or a total rise of 24 inches or more,<br />

shall require a handrail.<br />

On June 26, <strong>2007</strong>, cleaning products were easily accessible to daycare children.<br />

The family room steps have a rise of 24 inches but did not have a handrail.<br />

The furnace room was crowded with excess clothing, tools and furniture belonging to<br />

the landlord.<br />

R 400.1942<br />

Electrical service; maintenance.<br />

(1) The electrical service of a child care home shall be<br />

maintained in a safe condition. When warranted, an electrical<br />

inspection by an electrical inspecting authority may be required.<br />

The family room, bedroom 1 and the kitchen had electrical outlets easily accessible<br />

to daycare children.<br />

R 400.1945<br />

Fire; tornado; serious accident and injury plans.<br />

(1) A written plan for the care of children shall be established<br />

and posted for each of the following emergencies:<br />

(a) Fire evacuation.<br />

(b) Tornado watches and warnings.<br />

(c) Serious accident or injury.<br />

(d) Water emergencies, if applicable.<br />

Ms. <strong>Everson</strong> did not have written procedures for the care and evacuation of children<br />

in case of the emergencies for none of the plans noted above.<br />

Violations were identified at the time of the inspection.<br />

not be made in the specified time, it may be necessary to reevaluate the status of your<br />

certificate of registration.<br />

The Agency provides technical assistance to meet the licensing requirements and<br />

consultation to improve services.<br />
