minimum applicable yard requirement for the zone in which the lot is located (see<br />

c) Notwithstanding anything else in this <strong>By</strong>-<strong>law</strong>, the minimum lot frontage for<br />

unserviced lots within an RR Zone may be reduced to one hundred twenty (120) feet<br />

and the minimum lot area reduced to one (1) acre where the following conditions are<br />

met:<br />

i) the original parcel of land contains a dwelling which was constructed on or<br />

before October 9, 1991; and,<br />

ii) the lot completely fronts on a street which was public on or before October 9,<br />

1991.<br />

d) Notwithstanding the Lot Frontage and Lot Area requirements of any zone, a lot<br />

containing a cemetery in existence on the effective date of this amendment may<br />

be subdivided and a development permit issued provided that:<br />

(i) the cemetery lot does not contain a dwelling and/or buildings other than<br />

(ii)<br />

accessory buildings or structures;<br />

where a cemetery lot does not abut a public street or highway or private<br />

road, a right-of-way or easement of access of a minimum width of twenty<br />

(20) feet, extending from the cemetery lot to its point of intersection with<br />

the public street or highway or private road shall be shown on the plan of<br />

subdivision;<br />

(iii) the easement or right of way appurtenant to the cemetery lot, shall be<br />

provided by the subdivider concurrently with the conveyance of the<br />

cemetery lot;<br />

(iv) notwithstanding the requirements of any zone, accessory buildings and<br />

structures permitted in conjunction with cemetery lots shall be subject to<br />

the provisions of Part 5, Section 28-29A of the this <strong>By</strong>-<strong>law</strong>;<br />

e) the remaining lands meet the requirements of the applicable zone. (NWCC-Dec<br />

18. Existing Buildings<br />

Where a building other than a building containing a non-conforming use has been erected on<br />

or before the effective date of this <strong>By</strong>-<strong>law</strong> on a lot having less than the minimum frontage or<br />

area, or having less than the minimum setback or side yard or rear yard required by this<br />
