About this <strong>for</strong>m<br />

Import<strong>an</strong>t – Please read this in<strong>for</strong>mation carefully be<strong>for</strong>e you<br />

complete your application. Once you have completed your<br />

application we strongly advise that you keep a copy <strong>for</strong> your<br />

records.<br />

What is <strong>an</strong> Australi<strong>an</strong> <strong>Declaratory</strong> <strong>visa</strong>?<br />

An Australi<strong>an</strong> <strong>Declaratory</strong> <strong>visa</strong> (ADV) is <strong>an</strong> entry authority that<br />

c<strong>an</strong> only be issued to Australi<strong>an</strong> citizens. The quickest <strong>an</strong>d most<br />

efficient evidence <strong>of</strong> Australi<strong>an</strong> citizenship <strong>for</strong> the purposes <strong>of</strong><br />

entry to Australia is a current Australi<strong>an</strong> passport.<br />

The ADV allows dual citizens to have their Australi<strong>an</strong> citizenship<br />

status linked to their <strong>for</strong>eign passport in limited circumst<strong>an</strong>ces.<br />

Generally there are 2 groups <strong>of</strong> people who are eligible <strong>for</strong> <strong>an</strong><br />

ADV:<br />

• <strong>an</strong> Australi<strong>an</strong> citizen child under 18 years <strong>of</strong> age; <strong>an</strong>d<br />

• adult Australi<strong>an</strong> citizens with compelling reasons to travel on<br />

a <strong>for</strong>eign passport on a regular basis.<br />

In some situations this could include adult Australi<strong>an</strong> citizens<br />

in <strong>an</strong> emergency situation that prevents them travelling on <strong>an</strong><br />

Australi<strong>an</strong> passport, such as where the normal arr<strong>an</strong>gements<br />

<strong>for</strong> the issue <strong>of</strong> <strong>an</strong> Australi<strong>an</strong> passport are not feasible.<br />

Validity <strong>of</strong> <strong>an</strong> ADV<br />

An ADV is valid <strong>for</strong> up to 5 years from its date <strong>of</strong> issue <strong>an</strong>d<br />

during its validity you c<strong>an</strong> make multiple journeys to <strong>an</strong>d from<br />

Australia.<br />

You must remain <strong>an</strong> Australi<strong>an</strong> citizen <strong>for</strong> the ADV to stay valid.<br />

Your ADV will cease to operate from the date you lose or<br />

renounce your Australi<strong>an</strong> citizenship. If you have lost or<br />

renounced your citizenship <strong>an</strong>d you w<strong>an</strong>t to return to Australia<br />

then you will need to apply <strong>for</strong> <strong>an</strong>d be gr<strong>an</strong>ted <strong>an</strong>other type <strong>of</strong><br />

<strong>visa</strong> under the Migration Act 1958.<br />

Parental consent<br />

If <strong>an</strong> ADV applic<strong>an</strong>t is under 18 years <strong>of</strong> age then you will<br />

also need to submit a full birth certificate <strong>an</strong>d evidence <strong>of</strong><br />

the consent <strong>of</strong> each parent or person holding their legal<br />

guardi<strong>an</strong>ship.<br />

Both parents must sign Part D <strong>of</strong> the ADV application <strong>for</strong>m or,<br />

where only one parent is able to sign, certified evidence <strong>of</strong> one<br />

<strong>of</strong> the following documents must be submitted:<br />

• a death certificate if one parent is dead;<br />

• a court order affecting the custody, guardi<strong>an</strong>ship or access <strong>of</strong><br />

a person in relation to a child.<br />

If special circumst<strong>an</strong>ces exist which prevent consent being<br />

given, please contact the <strong>Department</strong> <strong>of</strong> Immigration <strong>an</strong>d<br />

Border Protection (the department) in Australia or the<br />

Immigration <strong>of</strong>fice at <strong>an</strong> Australi<strong>an</strong> mission overseas be<strong>for</strong>e<br />

lodging your application.<br />

How to fill in this <strong>for</strong>m<br />

A separate ADV application <strong>for</strong>m must be submitted with each<br />

<strong>for</strong>eign passport.<br />

• Complete this <strong>for</strong>m in English using BLOCK LETTERS.<br />

• You must <strong>an</strong>swer all questions (including that <strong>of</strong> a current<br />

residential address).<br />

• If a question is not applicable then write ‘N/A’.<br />

• If you need more space to <strong>an</strong>swer the questions, attach the<br />

additional in<strong>for</strong>mation signed <strong>an</strong>d dated.<br />

How to apply<br />

Make sure you sign the <strong>for</strong>m <strong>an</strong>d have all the documents<br />

required.<br />

If your documents are not in English you should arr<strong>an</strong>ge <strong>for</strong><br />

them to be tr<strong>an</strong>slated into English by <strong>an</strong> accredited NAATI<br />

tr<strong>an</strong>slator. If you provide photocopies <strong>of</strong> original documents,<br />

they must be certified as true copies by <strong>an</strong> authorised person.<br />

Authorised people include a magistrate, Justice <strong>of</strong> the Peace,<br />

Commissioner <strong>of</strong> Declarations, Commissioner <strong>of</strong> Affidavits,<br />

solicitor, registered medical practitioner, b<strong>an</strong>k m<strong>an</strong>ager or a<br />

State or Public Service <strong>of</strong>ficer with at least 5 years service.<br />

If you are outside Australia, lodge your application at <strong>an</strong><br />

Australi<strong>an</strong> mission.<br />

If you are in Australia, you must lodge your application in<br />

Australia by post or by courier direct to the Australi<strong>an</strong><br />

<strong>Declaratory</strong> Visa Centre (NSW). Contact details are available<br />

from the department’s website<br />

Integrity <strong>of</strong> application<br />

The department is committed to maintaining the integrity <strong>of</strong><br />

the <strong>visa</strong> <strong>an</strong>d citizenship programs. Please be aware that if you<br />

provide us with fraudulent documents or claims, this may result<br />

in processing delays <strong>an</strong>d possibly your application being refused.<br />

Documents you must provide<br />

When you lodge <strong>an</strong> ADV application <strong>for</strong>m, you must submit a<br />

valid <strong>for</strong>eign passport. You will need to provide evidence <strong>of</strong>:<br />

• your identity <strong>an</strong>d date <strong>of</strong> birth (by me<strong>an</strong>s <strong>of</strong> a full birth<br />

certificate or current passport); <strong>an</strong>d<br />

• your Australi<strong>an</strong> citizenship; <strong>an</strong>d<br />

• <strong>an</strong>y legal ch<strong>an</strong>ge <strong>of</strong> name, if applicable; <strong>an</strong>d<br />

• <strong>an</strong>y other nationalities you may hold (citizenship certificates,<br />

passports etc.).<br />

If you are in <strong>an</strong> emergency or compelling situation, then you<br />

must also include in your application a written statement that<br />

explains your circumst<strong>an</strong>ces.<br />

You will also be asked to provide supporting documentation to<br />

subst<strong>an</strong>tiate your claims.<br />

Supporting documents<br />

All documents not in English must be accomp<strong>an</strong>ied by a<br />

certified English tr<strong>an</strong>slation by <strong>an</strong> accredited NAATI tr<strong>an</strong>slator.<br />

In submitting evidence, where original documents are<br />

photocopied or reproduced each page must be stamped or<br />

authorised by <strong>an</strong> <strong>of</strong>ficial as being a true copy <strong>of</strong> the original.<br />

In Australia, certification is provided by a Justice <strong>of</strong> the Peace,<br />

a Commissioner <strong>for</strong> Declarations or by a person be<strong>for</strong>e whom<br />

a statutory declaration may be made. In your country the<br />

relev<strong>an</strong>t <strong>of</strong>ficial may be a person or agency whose similar<br />

authority is recognised by the law.<br />

Charges<br />

Payment must accomp<strong>an</strong>y each ADV application <strong>for</strong>m <strong>an</strong>d is<br />

not refunded if the application is unsuccessful.<br />

If members <strong>of</strong> your family unit are on the same <strong>for</strong>eign passport<br />

then lodge a single application <strong>for</strong>m <strong>an</strong>d pay only one<br />

application charge.<br />

Fees may be subject to adjustment at <strong>an</strong>y time. Visa <strong>Application</strong><br />

Charges may be subject to adjustment on 1 July each year. This<br />

may increase the cost <strong>of</strong> a <strong>visa</strong>.<br />

nearest <strong>of</strong>fice <strong>of</strong> the department.<br />

Method <strong>of</strong> payment<br />

In Australia<br />

To make a payment, please pay by credit card, debit card, b<strong>an</strong>k<br />

cheque or money order made payable to the <strong>Department</strong> <strong>of</strong><br />

Immigration <strong>an</strong>d Border Protection. Debit card <strong>an</strong>d credit card<br />

are the preferred methods <strong>of</strong> payment.<br />

Outside Australia<br />

Be<strong>for</strong>e making a payment outside Australia, please check with the<br />

Australi<strong>an</strong> Government <strong>of</strong>fice where you intend to lodge your<br />

application as to what methods <strong>of</strong> payment <strong>an</strong>d currencies they<br />

c<strong>an</strong> accept <strong>an</strong>d to whom the payment should be made payable.<br />

About the in<strong>for</strong>mation you give<br />

The details you provide will only be used by the department<br />

<strong>for</strong> the purpose <strong>for</strong> which you have provided them, unless there<br />

is a legal obligation or necessity to use them <strong>for</strong> <strong>an</strong>other purpose<br />

or you have consented to their use <strong>for</strong> <strong>an</strong>other purpose. Your<br />

contact in<strong>for</strong>mation will not be added to <strong>an</strong>y mailing list.<br />

The collection, access, storage, use <strong>an</strong>d disclosure by the<br />

department <strong>of</strong> the in<strong>for</strong>mation you provide is governed by the<br />

Options <strong>for</strong> receiving written communications<br />

If you do not appoint a migration agent/exempt person you<br />

may still authorise <strong>an</strong>other person, in writing, to receive written<br />

communications on your behalf. This person is called the<br />

authorised recipient.<br />

Authorised recipient in<strong>for</strong>mation<br />

All written communication about your application will be sent to<br />

your authorised recipient, unless you indicate that you wish to<br />

have health <strong>an</strong>d/or character in<strong>for</strong>mation sent directly to you.<br />

The department will communicate with the most recently<br />

appointed authorised recipient as you may only appoint one<br />

authorised recipient at <strong>an</strong>y time <strong>for</strong> a particular application.<br />

You will be taken to have received <strong>an</strong>y documents sent to that<br />

person as if they had been sent to you.<br />

To appoint <strong>an</strong> authorised recipient you should complete:<br />

• Part G – Options <strong>for</strong> receiving written communications; <strong>an</strong>d<br />

• <strong>for</strong>m 956A Appointment or withdrawal <strong>of</strong> <strong>an</strong> authorised<br />

recipient.<br />

Note: Migration agents/exempt persons do not need to<br />

complete <strong>for</strong>m 956A.<br />

Consent to communicate electronically<br />

The department may use a r<strong>an</strong>ge <strong>of</strong> me<strong>an</strong>s to communicate<br />

with you. However, electronic me<strong>an</strong>s such as fax or e-mail will<br />

only be used if you indicate your agreement to receiving<br />

communication in this way.<br />

To process your application the department may need to<br />

communicate with you about sensitive in<strong>for</strong>mation, <strong>for</strong> example,<br />

health, police checks, fin<strong>an</strong>cial viability <strong>an</strong>d personal<br />

relationships. Electronic communications, unless adequately<br />

encrypted, are not secure <strong>an</strong>d may be viewed by others or<br />

interfered with.<br />

If you agree to the department communicating with you by<br />

electronic me<strong>an</strong>s, the details you provide will only be used by<br />

the department <strong>for</strong> the purpose <strong>for</strong> which you have provided<br />

them, unless there is a legal obligation or necessity to use them<br />

<strong>for</strong> <strong>an</strong>other purpose, or you have consented to use <strong>for</strong> <strong>an</strong>other<br />

purpose. They will not be added to <strong>an</strong>y mailing list.<br />

The Australi<strong>an</strong> Government accepts no responsibility <strong>for</strong> the<br />

security or integrity <strong>of</strong> <strong>an</strong>y in<strong>for</strong>mation sent to the department<br />

over the internet or by other electronic me<strong>an</strong>s.<br />

If you authorise <strong>an</strong>other person to receive documents on your<br />

behalf <strong>an</strong>d they wish to be contacted electronically, their<br />

signature is required on <strong>for</strong>m 956 or 956A to indicate their<br />

consent to this <strong>for</strong>m <strong>of</strong> communication.<br />

Note: Electronic communication is the fastest me<strong>an</strong>s <strong>of</strong><br />

communication available <strong>an</strong>d the department prefers to<br />

communicate electronically because this results in faster<br />
