Lakes (Tanks) of Karnataka<br />

Background:<br />

1. The Government of Karnataka c<strong>on</strong>firmed its <str<strong>on</strong>g>in</str<strong>on</strong>g>tent to c<strong>on</strong>serve <strong>lake</strong>s of Bangalore <str<strong>on</strong>g>by</str<strong>on</strong>g> accept<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> toto the<br />

f<str<strong>on</strong>g>in</str<strong>on</strong>g>d<str<strong>on</strong>g>in</str<strong>on</strong>g>gs of the Lakshman Rao Committee Report <strong>on</strong> “Preservati<strong>on</strong>, Restorati<strong>on</strong>, Or Otherwise of the Exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

Tanks <str<strong>on</strong>g>in</str<strong>on</strong>g> the Bangalore Metropolitan Area” per PWD GO No. 82 IMB 85 dated 11 February 1988. The order<br />

vests the resp<strong>on</strong>sibility for undertak<str<strong>on</strong>g>in</str<strong>on</strong>g>g the stated tasks primarily <strong>on</strong> the Karnataka Forest Department, and <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

some cases <strong>on</strong> the Bruhat Bengaluru Mahanagara Palike (BBMP) Bangalore Development Authority (BDA),<br />

Bangalore <strong>Water</strong> Supply and Sewerage Board (BWSSB) and the Karnataka State Tourism Development<br />

Corporati<strong>on</strong> (KSTDC), etc. For some years thereafter, there was energetic effort <strong>on</strong> the part of the Karnataka<br />

Forest Department to recover encroached <strong>lake</strong> lands and to restore many <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> and around Bangalore. The<br />

early part of last decade also witnessed the Dept. of Ecology and Envir<strong>on</strong>ment tak<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>itiative through the<br />

Indo Norwegian Envir<strong>on</strong>ment Programme (INEP) to <str<strong>on</strong>g>in</str<strong>on</strong>g>telligently rehabilitate Hebbal, Agara and Nagawara<br />

<strong>lake</strong>s. The rehabilitati<strong>on</strong> of Hebbal <strong>lake</strong> was c<strong>on</strong>sidered so impressive that n<strong>on</strong>e less than the Prime M<str<strong>on</strong>g>in</str<strong>on</strong>g>ister<br />

of Norway visited the water body to regard the good work d<strong>on</strong>e.<br />

2. These ga<str<strong>on</strong>g>in</str<strong>on</strong>g>s, however, were not c<strong>on</strong>solidated up<strong>on</strong> and <str<strong>on</strong>g>in</str<strong>on</strong>g> subsequent years the overall situati<strong>on</strong> of <strong>lake</strong>s has<br />

worsened. Most are be<str<strong>on</strong>g>in</str<strong>on</strong>g>g polluted and encroached <str<strong>on</strong>g>in</str<strong>on</strong>g> blatant disregard of the recommendati<strong>on</strong>s of the<br />

Lakshman Rao Committee and various orders of this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> and the Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> of <strong>India</strong>. Some<br />

that are rehabilitated <str<strong>on</strong>g>by</str<strong>on</strong>g> BBMP and BDA (Eg. Yediyur <strong>lake</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> Jayanagar) have been d<strong>on</strong>e purely from the<br />

standpo<str<strong>on</strong>g>in</str<strong>on</strong>g>t of civil eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer's visi<strong>on</strong> and understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g of what these <strong>lake</strong>s are meant to be -mere water<br />

stor<str<strong>on</strong>g>in</str<strong>on</strong>g>g aquifers. As a c<strong>on</strong>sequence the ecological functi<strong>on</strong>ality of such rehabilitated <strong>lake</strong>s has been<br />

disastrously <str<strong>on</strong>g>in</str<strong>on</strong>g>terfered with, or worse, destroyed. Thus requir<str<strong>on</strong>g>in</str<strong>on</strong>g>g, wholly unnecessarily, high ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance<br />

costs to keep the <strong>lake</strong> waters from turn<str<strong>on</strong>g>in</str<strong>on</strong>g>g eutrophic. Besides such eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer<str<strong>on</strong>g>in</str<strong>on</strong>g>g efforts have discarded various<br />

traditi<strong>on</strong>al and cultural rights that helped protect and c<strong>on</strong>serve <strong>lake</strong>s.<br />

3. Al<strong>on</strong>gside, many large <str<strong>on</strong>g>in</str<strong>on</strong>g>frastructure projects were be<str<strong>on</strong>g>in</str<strong>on</strong>g>g promoted that encroached, polluted and occupied<br />

<strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> and around Bangalore <str<strong>on</strong>g>in</str<strong>on</strong>g> total disregard to Judicial pr<strong>on</strong>ouncements and the law. A card<str<strong>on</strong>g>in</str<strong>on</strong>g>al example<br />

of such envir<strong>on</strong>mentally destructive and illegal practices, actively tolerated <str<strong>on</strong>g>by</str<strong>on</strong>g> the adm<str<strong>on</strong>g>in</str<strong>on</strong>g>istrati<strong>on</strong>, is the<br />

Bangalore Mysore Infrastructure Corridor Project (BMICP). Accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to evidence gathered from the<br />

Government's own rec2ords, this <strong>on</strong>e project al<strong>on</strong>e has already encroached and/or destroyed 9 tanks, of the<br />

23 tanks handed over illegally and questi<strong>on</strong>ably to this private corporati<strong>on</strong>. A table provid<str<strong>on</strong>g>in</str<strong>on</strong>g>g the details of<br />

these tanks currently <str<strong>on</strong>g>in</str<strong>on</strong>g> possessi<strong>on</strong> of M/s NICE is annexed at Annexure A.<br />

4. Such practices are <str<strong>on</strong>g>in</str<strong>on</strong>g> blatant disregard of this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g>'s <str<strong>on</strong>g>in</str<strong>on</strong>g>terim directi<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> a PIL that was <str<strong>on</strong>g>in</str<strong>on</strong>g>itiated <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

Padmashree Zafar Futehally and ors. vs. the State of Karnataka and ors (WP No. 31343/1995) aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st the<br />

encroachment and polluti<strong>on</strong> of <strong>lake</strong>s, and with a prayer to strictly enforce the recommendati<strong>on</strong>s of the<br />

Lakshman Rao Committee report. In fact, Mr. Lakshman Rao was also a petiti<strong>on</strong>er <str<strong>on</strong>g>in</str<strong>on</strong>g> this PIL. While issu<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>terim directi<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> this PIL, still <str<strong>on</strong>g>in</str<strong>on</strong>g> force, this H<strong>on</strong>'ble <str<strong>on</strong>g>High</str<strong>on</strong>g> <str<strong>on</strong>g>Court</str<strong>on</strong>g> took <strong>on</strong> record allegati<strong>on</strong>s of the petiti<strong>on</strong>ers<br />

that: “there is large scale <str<strong>on</strong>g>in</str<strong>on</strong>g>discrim<str<strong>on</strong>g>in</str<strong>on</strong>g>ate grant and unauthorised occupati<strong>on</strong> of tank bed areas <str<strong>on</strong>g>in</str<strong>on</strong>g> and around<br />

Bangalore” there<str<strong>on</strong>g>by</str<strong>on</strong>g> seek<str<strong>on</strong>g>in</str<strong>on</strong>g>g “<str<strong>on</strong>g>in</str<strong>on</strong>g>terim directi<strong>on</strong> to the resp<strong>on</strong>dents for the protecti<strong>on</strong> of the tanks <strong>on</strong> the<br />

ground that any such grant of tank bed lands or encroachments are made, it will cause great <str<strong>on</strong>g>in</str<strong>on</strong>g>jury to the<br />

general public”. The directi<strong>on</strong> is clear and categorical that to protect <strong>lake</strong>s the State with specific regard to<br />

tanks is “not to make any grant or allotment of the lands situated <str<strong>on</strong>g>in</str<strong>on</strong>g> the Bangalore Metropolitan area until<br />

further orders”. (Emphasis added)<br />

5. In an extraord<str<strong>on</strong>g>in</str<strong>on</strong>g>ary and unprecedented effort <strong>on</strong> the part of the Karnataka State Legislature, a “Jo<str<strong>on</strong>g>in</str<strong>on</strong>g>t<br />

Legislature Committee <strong>on</strong> Encroachments <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore Urban District” was c<strong>on</strong>stituted under the<br />

chairmanship of then MLA Mr. A. T. Ramaswamy. An Interim Report – 1 of this Committee was submitted to<br />

the Legislature dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g February 2007. In regard to the neglect of <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> the Bangalore area, the Committee<br />

noted <str<strong>on</strong>g>in</str<strong>on</strong>g> this report its grave c<strong>on</strong>cern over the state of affairs as follows:<br />

“Almost all small and big tanks <str<strong>on</strong>g>in</str<strong>on</strong>g> the Bangalore Urban District have become sewage disposal tanks. Such<br />

tank bed encroachment is caused <str<strong>on</strong>g>by</str<strong>on</strong>g> two types of violati<strong>on</strong>s. Firstly, the local bodies namely, City<br />

Municipal Councils, Town Municipal Councils or the Bangalore Mahanagara Palike and Bangalore<br />

Development Authority, without enquir<str<strong>on</strong>g>in</str<strong>on</strong>g>g with Departments such as Revenue, Survey and<br />

Settlement and Lake Development Authority as to whether the build<str<strong>on</strong>g>in</str<strong>on</strong>g>gs encroach the tanks bed<br />

area, issue build<str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>structi<strong>on</strong> license, Commencement Certificate and Completi<strong>on</strong> Certificate. It is<br />

surpris<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the Bangalore Development Authority dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the period from 1963 to 1970 issued<br />

Commencement Certificates for the c<strong>on</strong>structi<strong>on</strong> of multi-storeyed build<str<strong>on</strong>g>in</str<strong>on</strong>g>gs u/s 15 of the Town and<br />

Country Plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g Act <str<strong>on</strong>g>by</str<strong>on</strong>g> collect<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Development Charges without enquir<str<strong>on</strong>g>in</str<strong>on</strong>g>g with Revenue<br />

Department or Survey and Settlement Department or refer to the City Survey Records regard<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

status of the lands <strong>on</strong> which apartment build<str<strong>on</strong>g>in</str<strong>on</strong>g>gs have come up encroach<str<strong>on</strong>g>in</str<strong>on</strong>g>g up<strong>on</strong> tanks beds..... The<br />

sec<strong>on</strong>d violati<strong>on</strong> is the polluti<strong>on</strong> of the <strong>lake</strong>s. The Karnataka Polluti<strong>on</strong> C<strong>on</strong>trol Board has not<br />

exercised its powers u/s 24 of the Act to punish those who pollute the tank bed <str<strong>on</strong>g>by</str<strong>on</strong>g> encroachment has<br />

allowed it to c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ue. There is provisi<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> the Act which requires every apartment to <str<strong>on</strong>g>in</str<strong>on</strong>g>stall a<br />

sewage treatment plant (STP <str<strong>on</strong>g>in</str<strong>on</strong>g> the build<str<strong>on</strong>g>in</str<strong>on</strong>g>g...... The Karnataka Polluti<strong>on</strong> C<strong>on</strong>trol Board has failed <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

tak<str<strong>on</strong>g>in</str<strong>on</strong>g>g acti<strong>on</strong> for polluti<strong>on</strong> c<strong>on</strong>trol giv<str<strong>on</strong>g>in</str<strong>on</strong>g>g excuses and a false reas<strong>on</strong> that <strong>on</strong>ly the Central Polluti<strong>on</strong><br />

C<strong>on</strong>trol Board is required to take acti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> respect of high rise build<str<strong>on</strong>g>in</str<strong>on</strong>g>gs.”<br />

In a subsequent submissi<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> way of Interim Report – II <strong>on</strong> 26 July 2007, the Committee noted as follows:<br />

“Accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the report of the Deputy C<strong>on</strong>servator of Forests, Bangalore Urban Divisi<strong>on</strong> dated 14-2-2007,<br />

there are about 48 tanks with a total tank bed area of 3,379 acres of which about 313 acres are under<br />

encroachment <str<strong>on</strong>g>by</str<strong>on</strong>g> 441 pers<strong>on</strong>s which has strangely g<strong>on</strong>e up to 553 encroachers as <strong>on</strong> 30-5-2007. A<br />

cursory exam<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> of the names and addresses of encroachers shows that these are not farmer<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> the neighbour<str<strong>on</strong>g>in</str<strong>on</strong>g>g areas who have encroached the tank bed but are mostly residents of different<br />

parts of the city who have encroached residential and commercial plots <str<strong>on</strong>g>in</str<strong>on</strong>g> the tanks bed. It is quite<br />

likely that some important and powerful pers<strong>on</strong>s have formed 'layout' <str<strong>on</strong>g>in</str<strong>on</strong>g> these tank beds and have<br />

sold to the city residents. The Forest Department has not even given the extent of encroachment <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

each pers<strong>on</strong> while giv<str<strong>on</strong>g>in</str<strong>on</strong>g>g the total area of encroachment as 312A 33G.”<br />

<str<strong>on</strong>g>High</str<strong>on</strong>g>light<str<strong>on</strong>g>in</str<strong>on</strong>g>g the commercial ga<str<strong>on</strong>g>in</str<strong>on</strong>g>s that can be made <str<strong>on</strong>g>by</str<strong>on</strong>g> so encroach<str<strong>on</strong>g>in</str<strong>on</strong>g>g tank lands, the Committee brought to the<br />

attenti<strong>on</strong> of the Legislature the case of Byrasandra tank with<str<strong>on</strong>g>in</str<strong>on</strong>g> the NIMHANS campus <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore,<br />

encroached <str<strong>on</strong>g>by</str<strong>on</strong>g> a builder, <strong>on</strong>e Mr. K. V. Shivakumar, <str<strong>on</strong>g>in</str<strong>on</strong>g> active collusi<strong>on</strong> with BBMP officials. About this exercise<br />

the Committee observes:<br />

“(t)he Government property thus toyed with and abetted <str<strong>on</strong>g>in</str<strong>on</strong>g> land-grabb<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>by</str<strong>on</strong>g> the BMPis 3A 26G i.e.,<br />

17,666 sq yards or 158,994 sq. ft. This NIMHANS land is situate <str<strong>on</strong>g>in</str<strong>on</strong>g> a central area of the city and each<br />

square foot will fetch not less than Rs. 8,000. The property is therefore worth Rs. 127 crores. It is this<br />

property the BMP officials have been help<str<strong>on</strong>g>in</str<strong>on</strong>g>g the builder-land grabber to possess illegally.” (Emphasis<br />

added.)<br />

6. Resp<strong>on</strong>d<str<strong>on</strong>g>in</str<strong>on</strong>g>g to this alarm<str<strong>on</strong>g>in</str<strong>on</strong>g>g situati<strong>on</strong>, this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> while f<str<strong>on</strong>g>in</str<strong>on</strong>g>ally rul<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> a PIL aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st <strong>lake</strong><br />

encroachment and polluti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> Krishna Bhat Vs. State of Karnataka and ors. (W.P. No. 1841/2006), reiterated<br />

its serious <str<strong>on</strong>g>in</str<strong>on</strong>g>tent to ensure <strong>lake</strong>s are protected and c<strong>on</strong>served as functi<strong>on</strong>al ecosystems and the comm<strong>on</strong>s<br />

with the State as custodian across Karnataka. The operative porti<strong>on</strong> of the directi<strong>on</strong> issued <str<strong>on</strong>g>by</str<strong>on</strong>g> this H<strong>on</strong>'ble<br />

<str<strong>on</strong>g>Court</str<strong>on</strong>g> <strong>on</strong> 17 September 2008 is as follows:<br />

“(i) The sewage or garbage will not be diverted to the <strong>lake</strong>s and tanks.<br />

(ii) The <strong>lake</strong> area as per the revenue records will be surveyed <str<strong>on</strong>g>by</str<strong>on</strong>g> the Revenue Department and would<br />

be fenced at the cost of the resp<strong>on</strong>dents.<br />

(iii) The Forest Department shall undertake plant<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the trees and sapl<str<strong>on</strong>g>in</str<strong>on</strong>g>gs after gett<str<strong>on</strong>g>in</str<strong>on</strong>g>g necessary<br />

technical op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> from the experts c<strong>on</strong>cerned.<br />

(iv) The Member Secretary of the State Legal Services Authority shall act as a co-ord<str<strong>on</strong>g>in</str<strong>on</strong>g>ator am<strong>on</strong>g all<br />

the resp<strong>on</strong>dents here<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g the revenue department and the forest department for both<br />

m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g the implementati<strong>on</strong> of the undertak<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the above resp<strong>on</strong>dents <str<strong>on</strong>g>in</str<strong>on</strong>g> implement<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />

execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g the work and the ecological and envir<strong>on</strong>mental c<strong>on</strong>diti<strong>on</strong> of the <strong>lake</strong>s.”<br />

Despite this directi<strong>on</strong>, and the active m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>by</str<strong>on</strong>g> this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g>, compliance with this order has been rather<br />

lax.<br />

7. The stated <str<strong>on</strong>g>in</str<strong>on</strong>g>tent of the Government of Karnataka <str<strong>on</strong>g>in</str<strong>on</strong>g> c<strong>on</strong>stitut<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Lake Development Authority (LDA) is to<br />

ensure comprehensive rehabilitati<strong>on</strong> of <strong>lake</strong>s of all municipalities <str<strong>on</strong>g>in</str<strong>on</strong>g> Karnataka. LDA sought to do this <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

almost entirely privatis<str<strong>on</strong>g>in</str<strong>on</strong>g>g the development, management and c<strong>on</strong>trol of <strong>lake</strong>s. LDA <str<strong>on</strong>g>in</str<strong>on</strong>g>itially signed four<br />

agreements hand<str<strong>on</strong>g>in</str<strong>on</strong>g>g over to various commercial entities <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore Hebbal <strong>lake</strong> (for Oberoi Hotel),<br />

Nagawara <strong>lake</strong> (for Lumb<str<strong>on</strong>g>in</str<strong>on</strong>g>i Developers), Vengaiahnakere (for Par C) and Agara <strong>lake</strong> (for Biota). LDA's <str<strong>on</strong>g>in</str<strong>on</strong>g>tent<br />

was to sign at least 30-40 such agreements and then spread this programme to <str<strong>on</strong>g>in</str<strong>on</strong>g>clude <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> other cities of<br />

Karnataka. This was based almost entirely <strong>on</strong> the unsubstantiated claim that the Government did not have<br />

resources to rehabilitate <strong>lake</strong>s <strong>on</strong> its own. The privatisati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g>itiative was widely criticised and campaigned<br />

aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st <str<strong>on</strong>g>by</str<strong>on</strong>g> hundreds of <str<strong>on</strong>g>in</str<strong>on</strong>g>dividuals and organisati<strong>on</strong>s and is now a subject matter of a PIL <str<strong>on</strong>g>in</str<strong>on</strong>g>itiated <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

Envir<strong>on</strong>ment Support Group and ors. Vs. State of Karnataka and ors. (WP. 817/2008). Issu<str<strong>on</strong>g>in</str<strong>on</strong>g>g an <str<strong>on</strong>g>in</str<strong>on</strong>g>terim order<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> this case, this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> rely<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> the c<strong>on</strong>sent of lease/licensee parties has been pleased to direct that<br />

“the Lake Development Authority shall not enter <str<strong>on</strong>g>in</str<strong>on</strong>g>to any fresh agreement with whomsoever and with<br />

reference to whatsover <strong>lake</strong> is c<strong>on</strong>cerned”. This H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> also directed the learned Government<br />

Advocate to “ascerta<str<strong>on</strong>g>in</str<strong>on</strong>g> the view of the Government as to the future course of acti<strong>on</strong> for ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g the <strong>lake</strong>s<br />

and gardens <str<strong>on</strong>g>in</str<strong>on</strong>g> the city as well as <str<strong>on</strong>g>in</str<strong>on</strong>g> the State of Karnataka, and to avoid commercial activities so that the<br />

ecology and envir<strong>on</strong>ment of the <strong>lake</strong>s and gardens shall be ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g>ed and made available to the comm<strong>on</strong><br />

man”. Submitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g the State's positi<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> a statement filed before this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> <strong>on</strong> 21-01-2009, the<br />

Government of Karnataka submitted as follows: “(i)t is reiterated that the government, at this juncture, is<br />

not keen <str<strong>on</strong>g>in</str<strong>on</strong>g> leas<str<strong>on</strong>g>in</str<strong>on</strong>g>g out of the <strong>lake</strong>s/tanks, nor is it keen <str<strong>on</strong>g>in</str<strong>on</strong>g> extend<str<strong>on</strong>g>in</str<strong>on</strong>g>g the lease period”. This matter is<br />

await<str<strong>on</strong>g>in</str<strong>on</strong>g>g f<str<strong>on</strong>g>in</str<strong>on</strong>g>al arguments and disposal. In additi<strong>on</strong> to the aforementi<strong>on</strong>ed directi<strong>on</strong>s, this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> while<br />

deliberat<str<strong>on</strong>g>in</str<strong>on</strong>g>g various c<strong>on</strong>nected matters thought it fit and proper to seek the services of this H<strong>on</strong>'ble <str<strong>on</strong>g>High</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Court</str<strong>on</strong>g> Legal Services Committee to solicit all progressive views relat<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the l<strong>on</strong>g term restorati<strong>on</strong>,<br />

management and ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance of <strong>lake</strong>s and appo<str<strong>on</strong>g>in</str<strong>on</strong>g>ted a Committee of Secretaries of various Depts. to assist<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> this matter. (Emphasis added.)<br />

8. The H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has also been watch<str<strong>on</strong>g>in</str<strong>on</strong>g>g with anguish the terrible state of affairs <str<strong>on</strong>g>in</str<strong>on</strong>g> protect<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

<strong>lake</strong>s and other public comm<strong>on</strong>s across <strong>India</strong>. The H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has c<strong>on</strong>sistently held that <strong>lake</strong>s<br />

and such other comm<strong>on</strong>s must be protected for the benefit of current and future generati<strong>on</strong>s, to build water<br />

security for all and also <str<strong>on</strong>g>in</str<strong>on</strong>g> support<str<strong>on</strong>g>in</str<strong>on</strong>g>g traditi<strong>on</strong>al livelihoods and the c<strong>on</strong>servati<strong>on</strong> of biodiversity. To<br />

effectively ensure that statutory authorities take their resp<strong>on</strong>sibilities with all the seriousness that it deserves,<br />

the H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> has reaffirmed the importance of be<str<strong>on</strong>g>in</str<strong>on</strong>g>g guided with several card<str<strong>on</strong>g>in</str<strong>on</strong>g>al pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciples that have a<br />

str<strong>on</strong>g bear<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> build<str<strong>on</strong>g>in</str<strong>on</strong>g>g ecological security for humanity: the Public Trust Doctr<str<strong>on</strong>g>in</str<strong>on</strong>g>e, the Doctr<str<strong>on</strong>g>in</str<strong>on</strong>g>e of<br />

Intergenerati<strong>on</strong>al Equity, Polluter Pays Pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple and the Precauti<strong>on</strong>ary Pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple. Rely<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> these doctr<str<strong>on</strong>g>in</str<strong>on</strong>g>es,<br />

the H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> a most recent decisi<strong>on</strong> of 28 January 2011 <str<strong>on</strong>g>in</str<strong>on</strong>g> Jagpal S<str<strong>on</strong>g>in</str<strong>on</strong>g>gh and Ors. vs. State of Punjab<br />

and Ors. (Civil Appeal No. 1132/2011 @ SLP © No. 3109/2011, aris<str<strong>on</strong>g>in</str<strong>on</strong>g>g out of SLP (Civil) CC No. 19869 of<br />

2010), has laid down fundamentally the <str<strong>on</strong>g>in</str<strong>on</strong>g>terpretati<strong>on</strong> of law and practice with regard to management and<br />

c<strong>on</strong>servati<strong>on</strong> of <strong>lake</strong>s as public comm<strong>on</strong>s. Further, c<strong>on</strong>sider<str<strong>on</strong>g>in</str<strong>on</strong>g>g the task of protect<str<strong>on</strong>g>in</str<strong>on</strong>g>g such water bodies for<br />

the benefit of current and future generati<strong>on</strong>s, the H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has directed as follows:<br />

“Let a copy of this order be sent to all Chief Secretaries of all States and Uni<strong>on</strong> Territories <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>India</strong> who will<br />

ensure strict and prompt compliance of this order and submit compliance reports to this <str<strong>on</strong>g>Court</str<strong>on</strong>g> from<br />

time to time.” The <str<strong>on</strong>g>Court</str<strong>on</strong>g> clarify<str<strong>on</strong>g>in</str<strong>on</strong>g>g its <str<strong>on</strong>g>in</str<strong>on</strong>g>tent to ensure no derelicti<strong>on</strong> of its orders has further<br />

directed that the matter “...be listed before this <str<strong>on</strong>g>Court</str<strong>on</strong>g> from time to time (<strong>on</strong> dates fixed <str<strong>on</strong>g>by</str<strong>on</strong>g> us), so<br />

that we can m<strong>on</strong>itor implementati<strong>on</strong> of our directi<strong>on</strong>s here<str<strong>on</strong>g>in</str<strong>on</strong>g>. List aga<str<strong>on</strong>g>in</str<strong>on</strong>g> before us <strong>on</strong> 3.5.2011 <strong>on</strong><br />

which date all Chief Secretaries <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>India</strong> will submit their reports.”<br />

This order of the H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has a direct bear<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> the current cause of acti<strong>on</strong> relat<str<strong>on</strong>g>in</str<strong>on</strong>g>g to develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g a<br />

management plan for the protecti<strong>on</strong> and c<strong>on</strong>servati<strong>on</strong> of <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> Karnataka, and thus the order is extensively<br />

excerpted here. In dismiss<str<strong>on</strong>g>in</str<strong>on</strong>g>g the appeal of Jagpal S<str<strong>on</strong>g>in</str<strong>on</strong>g>gh who encroached a village p<strong>on</strong>d, the H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> directs as<br />

follows:<br />

“13. We f<str<strong>on</strong>g>in</str<strong>on</strong>g>d no merit <str<strong>on</strong>g>in</str<strong>on</strong>g> this appeal. The appellants here<str<strong>on</strong>g>in</str<strong>on</strong>g> were trespassers who illegally encroached <strong>on</strong><br />

to the Gram Panchayat land <str<strong>on</strong>g>by</str<strong>on</strong>g> us<str<strong>on</strong>g>in</str<strong>on</strong>g>g muscle power/m<strong>on</strong>ey power and <str<strong>on</strong>g>in</str<strong>on</strong>g> collusi<strong>on</strong> with the officials<br />

and even with the Gram Panchayat. We are of the op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> that such k<str<strong>on</strong>g>in</str<strong>on</strong>g>d of blatant illegalities must<br />

not be c<strong>on</strong>d<strong>on</strong>ed. Even if the appellants have built houses <strong>on</strong> the land <str<strong>on</strong>g>in</str<strong>on</strong>g> questi<strong>on</strong> they must be<br />

ordered to remove their c<strong>on</strong>structi<strong>on</strong>s, and possessi<strong>on</strong> of the land <str<strong>on</strong>g>in</str<strong>on</strong>g> questi<strong>on</strong> must be handed back<br />

to the Gram Panchayat. Regulariz<str<strong>on</strong>g>in</str<strong>on</strong>g>g such illegalities must not be permitted because it is Gram Sabha<br />

land which must be kept for the comm<strong>on</strong> use of villagers of the village. The letter dated 26.9.2007 of<br />

the Government of Punjab permitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g regularizati<strong>on</strong> of possessi<strong>on</strong> of these unauthorized occupants<br />

is not valid. We are of the op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> that such letters are wholly illegal and without jurisdicti<strong>on</strong>. In our<br />

op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> such illegalities cannot be regularized. We cannot allow the comm<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g>terest of the<br />

villagers to suffer merely because the unauthorized occupati<strong>on</strong> has subsisted for many years.”<br />

(Emphasis added)<br />

The H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> illustrates the c<strong>on</strong>sistency <str<strong>on</strong>g>by</str<strong>on</strong>g> which such illegalities have been dealt with <str<strong>on</strong>g>by</str<strong>on</strong>g> cit<str<strong>on</strong>g>in</str<strong>on</strong>g>g various<br />

earlier orders and categorically describes the extremely rare situati<strong>on</strong>s when encroachments of <strong>lake</strong> lands can<br />

be c<strong>on</strong>d<strong>on</strong>ed, and that too <strong>on</strong>ly <strong>on</strong> humanistic terms to correct age-old social <str<strong>on</strong>g>in</str<strong>on</strong>g>justices:<br />

“14. In M.I. Builders (P) Ltd. vs. Radhey Shyam Sahu, 1999(6) SCC 464 the Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> ordered<br />

restorati<strong>on</strong> of a park after demoliti<strong>on</strong> of a shopp<str<strong>on</strong>g>in</str<strong>on</strong>g>g complex c<strong>on</strong>structed at the cost of over Rs.100<br />

crores. In Friends Col<strong>on</strong>y Development Committee vs. State of Orissa, 2004 8) SCC 733 this <str<strong>on</strong>g>Court</str<strong>on</strong>g><br />

held that even where the law permits compound<str<strong>on</strong>g>in</str<strong>on</strong>g>g of unsancti<strong>on</strong>ed c<strong>on</strong>structi<strong>on</strong>s, such<br />

compound<str<strong>on</strong>g>in</str<strong>on</strong>g>g should <strong>on</strong>ly be <str<strong>on</strong>g>by</str<strong>on</strong>g> way of an excepti<strong>on</strong>. In our op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> this decisi<strong>on</strong> will apply with even<br />

greater force <str<strong>on</strong>g>in</str<strong>on</strong>g> cases of encroachment of village comm<strong>on</strong> land. Ord<str<strong>on</strong>g>in</str<strong>on</strong>g>arily, compound<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> such<br />

cases should <strong>on</strong>ly be allowed where the land has been leased to landless labourers or members of<br />

Scheduled Castes/Scheduled Tribes, or the land is actually be<str<strong>on</strong>g>in</str<strong>on</strong>g>g used for a public purpose of the<br />

village e.g. runn<str<strong>on</strong>g>in</str<strong>on</strong>g>g a school for the villagers, or a dispensary for them”. (Emphasis added)<br />

Recognis<str<strong>on</strong>g>in</str<strong>on</strong>g>g the illegal practices engaged <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>by</str<strong>on</strong>g> several State Governments <str<strong>on</strong>g>in</str<strong>on</strong>g> assist<str<strong>on</strong>g>in</str<strong>on</strong>g>g encroachers of comm<strong>on</strong> lands<br />

aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st the law, the H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has ruled as follows:<br />

“15. In many states Government orders have been issued <str<strong>on</strong>g>by</str<strong>on</strong>g> the State Government permitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g allotment<br />

of Gram Sabha land to private pers<strong>on</strong>s and commercial enterprises <strong>on</strong> payment of some m<strong>on</strong>ey. In<br />

our op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> all such Government orders are illegal, and should be ignored.”<br />

9. Dwell<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> ancestral wisdom <str<strong>on</strong>g>in</str<strong>on</strong>g> build<str<strong>on</strong>g>in</str<strong>on</strong>g>g water security for a country dependent <strong>on</strong> n<strong>on</strong>-perennial rivers and<br />

the m<strong>on</strong>so<strong>on</strong>s, the H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> states as follows:<br />

“17. In this c<strong>on</strong>necti<strong>on</strong> we wish to say that our ancestors were not fools. They knew that <str<strong>on</strong>g>in</str<strong>on</strong>g> certa<str<strong>on</strong>g>in</str<strong>on</strong>g> years<br />

there may be droughts or water shortages for some other reas<strong>on</strong>, and water was also required for<br />

cattle to dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k and bathe <str<strong>on</strong>g>in</str<strong>on</strong>g> etc. Hence they built a p<strong>on</strong>d attached to every village, a tank attached to<br />

every temple, etc. These were their traditi<strong>on</strong>al ra<str<strong>on</strong>g>in</str<strong>on</strong>g> water harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g methods, which served them for<br />

thousands of years.<br />

18. Over the last few decades, however, most of these p<strong>on</strong>ds <str<strong>on</strong>g>in</str<strong>on</strong>g> our country have been filled with<br />

earth and built up<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> greedy people, thus destroy<str<strong>on</strong>g>in</str<strong>on</strong>g>g their orig<str<strong>on</strong>g>in</str<strong>on</strong>g>al character. This has c<strong>on</strong>tributed<br />

to the water shortages <str<strong>on</strong>g>in</str<strong>on</strong>g> the country.<br />

19. Also, many p<strong>on</strong>ds are aucti<strong>on</strong>ed off at throw away prices to bus<str<strong>on</strong>g>in</str<strong>on</strong>g>essmen for fisheries <str<strong>on</strong>g>in</str<strong>on</strong>g> collusi<strong>on</strong><br />

with authorities/Gram Panchayat officials, and even this m<strong>on</strong>ey collected from these so called<br />

aucti<strong>on</strong>s are not used for the comm<strong>on</strong> benefit of the villagers but misappropriated <str<strong>on</strong>g>by</str<strong>on</strong>g> certa<str<strong>on</strong>g>in</str<strong>on</strong>g><br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>dividuals. The time has come when these malpractices must stop.” (Emphasis added.)<br />

10. On the basis of such reas<strong>on</strong><str<strong>on</strong>g>in</str<strong>on</strong>g>g, and <str<strong>on</strong>g>in</str<strong>on</strong>g> an extraord<str<strong>on</strong>g>in</str<strong>on</strong>g>ary effort to curtail the ru<str<strong>on</strong>g>in</str<strong>on</strong>g> of our water-bodies and thus<br />

water security, the H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> issued a directi<strong>on</strong> to all States and Uni<strong>on</strong> Territories to come up with a<br />

scheme to protect and c<strong>on</strong>serve these resources for the benefit of all and also the future generati<strong>on</strong>s:<br />

“22. Before part<str<strong>on</strong>g>in</str<strong>on</strong>g>g with this case we give directi<strong>on</strong>s to all the State Governments <str<strong>on</strong>g>in</str<strong>on</strong>g> the country that they<br />

should prepare schemes for evicti<strong>on</strong> of illegal/unauthorized occupants of Gram Sabha/Gram<br />

Panchayat/Poramboke/Shamlat land and these must be restored to the Gram Sabha/Gram Panchayat<br />

for the comm<strong>on</strong> use of villagers of the village. For this purpose the Chief Secretaries of all State<br />

Governments/Uni<strong>on</strong> Territories <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>India</strong> are directed to do the needful, tak<str<strong>on</strong>g>in</str<strong>on</strong>g>g the help of other senior<br />

officers of the Governments. The said scheme should provide for the speedy evicti<strong>on</strong> of such illegal<br />

occupant, after giv<str<strong>on</strong>g>in</str<strong>on</strong>g>g him a show cause notice and a brief hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g. L<strong>on</strong>g durati<strong>on</strong> of such illegal<br />

occupati<strong>on</strong> or huge expenditure <str<strong>on</strong>g>in</str<strong>on</strong>g> mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>structi<strong>on</strong>s there<strong>on</strong> or political c<strong>on</strong>necti<strong>on</strong>s must not<br />

e treated as a justificati<strong>on</strong> for c<strong>on</strong>d<strong>on</strong><str<strong>on</strong>g>in</str<strong>on</strong>g>g this illegal act or for regulariz<str<strong>on</strong>g>in</str<strong>on</strong>g>g the illegal possessi<strong>on</strong>.<br />

Regularizati<strong>on</strong> should <strong>on</strong>ly be permitted <str<strong>on</strong>g>in</str<strong>on</strong>g> excepti<strong>on</strong>al cases e.g. where lease has been granted<br />

under some Government notificati<strong>on</strong> to landless labourers or members of Scheduled<br />

Castes/Scheduled Tribes, or where there is already a school, dispensary or other public utility <strong>on</strong><br />

the land.” (Emphasis added.)<br />

11. Resp<strong>on</strong>d<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the precarious situati<strong>on</strong> nati<strong>on</strong>-wide with ever <str<strong>on</strong>g>in</str<strong>on</strong>g>creas<str<strong>on</strong>g>in</str<strong>on</strong>g>g threats and disturbances to <strong>lake</strong>s as<br />

wetland ecosystems, the Uni<strong>on</strong> M<str<strong>on</strong>g>in</str<strong>on</strong>g>istry of Envir<strong>on</strong>ment and Forests (MoEF) has enacted the Wetland<br />

(C<strong>on</strong>servati<strong>on</strong> and Management) Rules, 2010 under the Envir<strong>on</strong>ment Protecti<strong>on</strong> Act, 1986, a copy of which is<br />

annexed at Annexure B. The Preamble expla<str<strong>on</strong>g>in</str<strong>on</strong>g>s the purpose and <str<strong>on</strong>g>in</str<strong>on</strong>g>tent of these Rules, and are excerpted<br />

here to highlight the emerg<str<strong>on</strong>g>in</str<strong>on</strong>g>g standards for wetland protecti<strong>on</strong> and rehabilitati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>India</strong>:<br />

“Whereas the wetlands, vital parts of the hydrological cycle, are highly productive, support excepti<strong>on</strong>ally<br />

large biological diversity and provide a wide range of ecosystem services, such as waste assimilati<strong>on</strong>,<br />

water purificati<strong>on</strong>, flood mitigati<strong>on</strong>, erosi<strong>on</strong> c<strong>on</strong>trol, ground water recharge, micro-climate<br />

regulati<strong>on</strong>, aesthetic enhancement of the landscape while simultaneously support<str<strong>on</strong>g>in</str<strong>on</strong>g>g many<br />

significant recreati<strong>on</strong>al, social and cultural activities, besides be<str<strong>on</strong>g>in</str<strong>on</strong>g>g a part of cultural heritage;<br />

And Whereas many wetlands are seriously threatened <str<strong>on</strong>g>by</str<strong>on</strong>g> reclamati<strong>on</strong> through dra<str<strong>on</strong>g>in</str<strong>on</strong>g>age and landfill,<br />

polluti<strong>on</strong> (discharge of domestic and <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrial effluents, disposal of solid wastes), hydrological<br />

alterati<strong>on</strong>s (water withdrawal and <str<strong>on</strong>g>in</str<strong>on</strong>g>flow changes) and over-exploitati<strong>on</strong> of their natural resources<br />

result<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> loss of biodiversity and disrupti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> goods and services provided <str<strong>on</strong>g>by</str<strong>on</strong>g> wetlands;<br />

And whereas <strong>India</strong> is a signatory to the Ramsar C<strong>on</strong>venti<strong>on</strong> for the c<strong>on</strong>servati<strong>on</strong> and wise use of<br />

wetlands, which <str<strong>on</strong>g>in</str<strong>on</strong>g>cludes <str<strong>on</strong>g>in</str<strong>on</strong>g> its ambit a wide variety of habitats, such as rivers and <strong>lake</strong>s, coastal<br />

lago<strong>on</strong>s, mangroves, peatlands, coral reefs, and numerous man-made wetlands, such as p<strong>on</strong>ds, farm<br />

p<strong>on</strong>ds, irrigated agricultural lands, sacred groves, salt pans, reservoirs, gravel pits, sewage farms, and<br />

canals;<br />

And whereas the Central Government has identified certa<str<strong>on</strong>g>in</str<strong>on</strong>g> wetlands for c<strong>on</strong>servati<strong>on</strong> and<br />

management under its c<strong>on</strong>servati<strong>on</strong> programme and provides f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial and technical assistance to<br />

the State Governments and Uni<strong>on</strong> territory Adm<str<strong>on</strong>g>in</str<strong>on</strong>g>istrati<strong>on</strong>s for various c<strong>on</strong>servati<strong>on</strong> activities<br />

through approval of the Management Acti<strong>on</strong> Plans;<br />

And whereas the Nati<strong>on</strong>al Envir<strong>on</strong>ment Policy, 2006 recognises the ecological services provided <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

wetlands and emphasizes the need to set up a regulatory mechanism c<strong>on</strong>sistent with the Ramsar<br />

C<strong>on</strong>venti<strong>on</strong> to ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> the ecological character of the identified wetlands and develop a nati<strong>on</strong>al<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>ventory of such wetlands;”<br />

The restricti<strong>on</strong>s imposed under these rules are as follows:<br />

“The follow<str<strong>on</strong>g>in</str<strong>on</strong>g>g activities with<str<strong>on</strong>g>in</str<strong>on</strong>g> the wetlands shall be prohibite, namely:-<br />

(i) reclamati<strong>on</strong> of wetlands;<br />

(ii) sett<str<strong>on</strong>g>in</str<strong>on</strong>g>g up of new <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries and expansi<strong>on</strong> of exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries;<br />

(iii) manufacture of handl<str<strong>on</strong>g>in</str<strong>on</strong>g>g or storage or disposal of hazardous substances covered under the<br />

Manufacture, Storage and Import of Hazardous Chemical Rules, 1989 notified vide S.O. Number 966<br />

(E) dated the 27 th November, 1989 or the Rules for Manufacture, Use, Import, Export and Storage of<br />

Hazardous Micro-organisms/Genetically eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eered organisms or cells notified vide GSR number<br />

1037 (E) dated the 5 th December, 1989 or the Hazardous Wastes (Management, Handl<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and<br />

Transboundary Movement) Rules, 2008 notified vide S.O. Number 2265 (E), dated the 24 th<br />

September, 2008;<br />

(iv) solid waste dump<str<strong>on</strong>g>in</str<strong>on</strong>g>g: provided the exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g practices, if any, existed before the commencement of<br />

these rules shall be phased out with<str<strong>on</strong>g>in</str<strong>on</strong>g> a period not exceed<str<strong>on</strong>g>in</str<strong>on</strong>g>g six m<strong>on</strong>ths from the date of<br />

commencement of these rules;<br />

(v) discharge of untreated wastes and effluents from <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries, cities or towns and other human<br />

settlements: provided that the practices, if any, existed before the commencement of these rules<br />

shall be phased out with<str<strong>on</strong>g>in</str<strong>on</strong>g> a period not exceed<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong>e year from the date of commencement of<br />

these rules;<br />

(vi) any c<strong>on</strong>structi<strong>on</strong> of a permanent nature except for boat jetties with<str<strong>on</strong>g>in</str<strong>on</strong>g> fifty metres from the mean<br />

high flood level observed <str<strong>on</strong>g>in</str<strong>on</strong>g> the past ten years calculated from the date of commencement of these<br />

rules.<br />

(vii) any other activity likely to have an adverse impact <strong>on</strong> the ecosystem of the wetland to be<br />

specified <str<strong>on</strong>g>in</str<strong>on</strong>g> writ<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>by</str<strong>on</strong>g> the Authority c<strong>on</strong>stituted <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with these rules.”<br />

12. Keep<str<strong>on</strong>g>in</str<strong>on</strong>g>g the above <str<strong>on</strong>g>in</str<strong>on</strong>g> view, the follow<str<strong>on</strong>g>in</str<strong>on</strong>g>g steps are proposed for the c<strong>on</strong>servati<strong>on</strong> and protecti<strong>on</strong> of <strong>lake</strong>s as<br />

functi<strong>on</strong>al ecosystems, cultural and livelihood supportive spaces and as public comm<strong>on</strong>s.<br />

Immediate Efforts Needed to Protect, C<strong>on</strong>serve and Rehabilitate Lakes:<br />

13. Identify<str<strong>on</strong>g>in</str<strong>on</strong>g>g spatial spread of <strong>lake</strong>s and determ<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g extent of encroachment: Based <strong>on</strong> a review of the<br />

Revenue Map, matched to appropriate scale with the 1973 Survey of <strong>India</strong> toposheets, and ovelay<str<strong>on</strong>g>in</str<strong>on</strong>g>g these<br />

with time series maps publicly accessible <str<strong>on</strong>g>in</str<strong>on</strong>g> Google Earth imageries, and also compar<str<strong>on</strong>g>in</str<strong>on</strong>g>g these with the Land<br />

Use Plans (such as Comprehensive Development Plan of Bangalore) as and where available, it is extremely<br />

critical to first and foremost demarcate the legal boundaries of the <strong>lake</strong>. Once this is achieved, the next<br />

important task is to undertake field verificati<strong>on</strong> to identify and enumerate the nature and extent of<br />

encroachments – keep<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> view the guidel<str<strong>on</strong>g>in</str<strong>on</strong>g>es issued <str<strong>on</strong>g>in</str<strong>on</strong>g> the rul<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> Jagpal<br />

S<str<strong>on</strong>g>in</str<strong>on</strong>g>gh. Such mapp<str<strong>on</strong>g>in</str<strong>on</strong>g>g and assessment efforts do not need any high end technological or m<strong>on</strong>etary support,<br />

and can easily encourage the <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement of local bodies, educati<strong>on</strong>al <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>s, volunteers, etc. The<br />

Karnataka State Remote Sens<str<strong>on</strong>g>in</str<strong>on</strong>g>g Agency has already built a satellite imagery base map of the entire State<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g various layered details. Such public <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> can be extensively utilised <str<strong>on</strong>g>in</str<strong>on</strong>g> this purpose without<br />

any additi<strong>on</strong>al cost or effort.<br />

14. Removal of encroachments: Once the extent of the <strong>lake</strong>s have been identified, acti<strong>on</strong> must be <str<strong>on</strong>g>in</str<strong>on</strong>g>itiated<br />

through the relevant agencies for removal of such encroachments. Where communities who are poor have<br />

encroached water bodies, they must be humanely rehabilitated, wherever possible, <str<strong>on</strong>g>in</str<strong>on</strong>g> neighbour<str<strong>on</strong>g>in</str<strong>on</strong>g>g public<br />

lands <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with Rehabilitati<strong>on</strong> norms and policies, <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with the Jagpal S<str<strong>on</strong>g>in</str<strong>on</strong>g>gh rul<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the<br />

H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g>. In case the encroachments are <str<strong>on</strong>g>by</str<strong>on</strong>g> landed class, realtors, bus<str<strong>on</strong>g>in</str<strong>on</strong>g>ess units/companies,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>frastructure projects and such other n<strong>on</strong>-poor and n<strong>on</strong>-socially disenfranchised communities, strict legal<br />

acti<strong>on</strong> must be taken for their evicti<strong>on</strong> and recovery of the <strong>lake</strong> lands for the benefit of current and future<br />

generati<strong>on</strong>s. In additi<strong>on</strong>, such encroachers must be severely penalised. The m<strong>on</strong>ies recovered, if any, from<br />

such recovery acti<strong>on</strong>s, must be set aside for exclusive use of rehabilitati<strong>on</strong> of <strong>lake</strong>s.<br />

15. Live fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g of Lakes as a permanent protecti<strong>on</strong> measure: The immediate next acti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> heavily populated<br />

and densely built urban areas should be to fix appropriate pillars for mark<str<strong>on</strong>g>in</str<strong>on</strong>g>g the boundaries. A suitable<br />

approach could be to adopt a livse fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g approach as directed <str<strong>on</strong>g>by</str<strong>on</strong>g> this H<strong>on</strong>'ble <str<strong>on</strong>g>Court</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> the Krishna Bhat case<br />

– thus sav<str<strong>on</strong>g>in</str<strong>on</strong>g>g hundreds of crores of public m<strong>on</strong>ey from needless c<strong>on</strong>structi<strong>on</strong> of st<strong>on</strong>e walls. (Live fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g can<br />

be <str<strong>on</strong>g>in</str<strong>on</strong>g>telligently and aesthetically developed to serve as a biodiversity z<strong>on</strong>e and as a source of nutriti<strong>on</strong> and<br />

m<str<strong>on</strong>g>in</str<strong>on</strong>g>or forest produce to local communities – an age old practice can thus be revived). In extreme cases where<br />

encroachment is widespread and aggressive, fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>by</str<strong>on</strong>g> barbed wire or cha<str<strong>on</strong>g>in</str<strong>on</strong>g> l<str<strong>on</strong>g>in</str<strong>on</strong>g>ks, <str<strong>on</strong>g>in</str<strong>on</strong>g> additi<strong>on</strong> to live fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />

may be adopted. The potential tree and shrub species for such live fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g are provided <str<strong>on</strong>g>in</str<strong>on</strong>g> Annexure C.<br />

16. Strengthen<str<strong>on</strong>g>in</str<strong>on</strong>g>g of Lake Bunds: Most <strong>lake</strong>s were protected as l<strong>on</strong>g as the bunds were secure. Due to<br />

encroachment and poor ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance, many <strong>lake</strong> bunds are <str<strong>on</strong>g>in</str<strong>on</strong>g> poor shape and thus result <str<strong>on</strong>g>in</str<strong>on</strong>g> the waterbodies<br />

los<str<strong>on</strong>g>in</str<strong>on</strong>g>g water hold<str<strong>on</strong>g>in</str<strong>on</strong>g>g capacity and becom<str<strong>on</strong>g>in</str<strong>on</strong>g>g dry very so<strong>on</strong>. This enables encroachments of various sorts. To<br />

prevent the loss of water hold<str<strong>on</strong>g>in</str<strong>on</strong>g>g capacity, it is critical that the bunds of all <strong>lake</strong>s must be strengthened <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

appropriate st<strong>on</strong>e pitch<str<strong>on</strong>g>in</str<strong>on</strong>g>g (not c<strong>on</strong>crete l<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g) both <strong>on</strong> the <strong>lake</strong> side and also towards to the Atchkat<br />

(downstream flood pla<str<strong>on</strong>g>in</str<strong>on</strong>g>s, normally cultivated). In the <strong>lake</strong> side of the bund, sparse plant<str<strong>on</strong>g>in</str<strong>on</strong>g>g of Pandanus<br />

odorotisema (abundantly available <str<strong>on</strong>g>in</str<strong>on</strong>g> Ranganathittu) may be undertaken, as it stabilises the bund. On the<br />

Atchkat side, P<strong>on</strong>gamia p<str<strong>on</strong>g>in</str<strong>on</strong>g>nata or Acacia nilotica may be planted <str<strong>on</strong>g>in</str<strong>on</strong>g> a s<str<strong>on</strong>g>in</str<strong>on</strong>g>gle row half way down the bund to<br />

provide for a shady walk<str<strong>on</strong>g>in</str<strong>on</strong>g>g path that also attracts <str<strong>on</strong>g>in</str<strong>on</strong>g>sects and birds. A typical plant<str<strong>on</strong>g>in</str<strong>on</strong>g>g plan for strengthen<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

the <strong>lake</strong> bund is illustrated <str<strong>on</strong>g>in</str<strong>on</strong>g> Annexure D.<br />

17. Desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g: Most <strong>lake</strong>s have been silted up due to poor ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance of <strong>lake</strong>s and their watersheds. It is<br />

extremely important to ensure that appropriate desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g of <strong>lake</strong>s is undertaken to improve the water hold<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

and recharg<str<strong>on</strong>g>in</str<strong>on</strong>g>g capacities of <strong>lake</strong>s. This should be d<strong>on</strong>e <str<strong>on</strong>g>by</str<strong>on</strong>g> ensur<str<strong>on</strong>g>in</str<strong>on</strong>g>g that desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g is undertaken extremely<br />

sensitively so as not to adversely affect the appropriate structure of the <strong>lake</strong>, as <str<strong>on</strong>g>in</str<strong>on</strong>g>dicated <str<strong>on</strong>g>in</str<strong>on</strong>g> Annexure E. The<br />

extent of desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g should be decided based <strong>on</strong> the spatial spread and the depth of the <strong>lake</strong> near the bund.<br />

The ratio of desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g should be such that the base of the <strong>lake</strong> should not exceed more than a metre below the<br />

lowest po<str<strong>on</strong>g>in</str<strong>on</strong>g>t near the bund. The desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g should be graded <str<strong>on</strong>g>in</str<strong>on</strong>g> a manner that is gradually slop<str<strong>on</strong>g>in</str<strong>on</strong>g>g from the<br />

foreshore all around towards the bund. There should not be any deep trenches or surprise pits (such as those<br />

caused <str<strong>on</strong>g>by</str<strong>on</strong>g> mudlift<str<strong>on</strong>g>in</str<strong>on</strong>g>g for brick mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g or sand m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g) to ensure public safety and mitigate erosi<strong>on</strong>. It is<br />

str<strong>on</strong>gly recommended that desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g of <strong>lake</strong>s should be taken-up <strong>on</strong>ly when absolutely necessary and where<br />

it is established bey<strong>on</strong>d any reas<strong>on</strong>able doubt that the <strong>lake</strong> bed has been silted-up. Even <str<strong>on</strong>g>in</str<strong>on</strong>g> such <str<strong>on</strong>g>in</str<strong>on</strong>g>stances,<br />

m<str<strong>on</strong>g>in</str<strong>on</strong>g>imal desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g should be taken-up so that it <str<strong>on</strong>g>in</str<strong>on</strong>g>volves m<str<strong>on</strong>g>in</str<strong>on</strong>g>imal costs, such as <str<strong>on</strong>g>in</str<strong>on</strong>g> transportati<strong>on</strong> of desilted<br />

mud. Desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g should be d<strong>on</strong>e carefully without alter<str<strong>on</strong>g>in</str<strong>on</strong>g>g the natural structure and slope of the <strong>lake</strong> bed from<br />

foreshore and the high water mark al<strong>on</strong>g the sides and towards the ma<str<strong>on</strong>g>in</str<strong>on</strong>g> bund.<br />

18. Overflow wiers: Overflow wiers of all <strong>lake</strong>s need to be immediately strengthened and restored. Lack of<br />

ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance of such critical features of a <strong>lake</strong> is result<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> loss of water and thus the <strong>lake</strong> itself. Proper<br />

st<strong>on</strong>e pitch<str<strong>on</strong>g>in</str<strong>on</strong>g>g must be the basis for rehabilitat<str<strong>on</strong>g>in</str<strong>on</strong>g>g the wiers as they have a l<strong>on</strong>ger life than c<strong>on</strong>crete wiers.<br />

19. Survey and management of Raja Kaluves: The flow of Raja Kaluves must be surveyed, identified and mapped<br />

for each and every <strong>lake</strong> both upstream and downstream. The typical spread of a Raja Kaluve from the po<str<strong>on</strong>g>in</str<strong>on</strong>g>t of<br />

discharge at the overflow wier to the next receiv<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong> must be identified. The Raja Kaluves must be<br />

surveyed and their areas demarcated <str<strong>on</strong>g>in</str<strong>on</strong>g> a manner similar to that of the spatial spread of the <strong>lake</strong>. Wherever<br />

feasible, the Raja Kaluve encroachments must be removed and the canals restored.<br />

20. Management of Raja Kaluves: No encroachment, sewage <str<strong>on</strong>g>in</str<strong>on</strong>g>flow or garbage dump<str<strong>on</strong>g>in</str<strong>on</strong>g>g must be allowed <str<strong>on</strong>g>in</str<strong>on</strong>g>to<br />

Raja Kaluves. In additi<strong>on</strong>, appropriate silt and waste trapp<str<strong>on</strong>g>in</str<strong>on</strong>g>g structures may be set up at regular distances of<br />

the Raja Kaluve. Protecti<strong>on</strong> of these canals are critical as they lifel<str<strong>on</strong>g>in</str<strong>on</strong>g>es for the survival of <strong>lake</strong>s and harbour<br />

immense potential for biodiversity c<strong>on</strong>servati<strong>on</strong>, recreati<strong>on</strong>, and graz<str<strong>on</strong>g>in</str<strong>on</strong>g>g and farm<str<strong>on</strong>g>in</str<strong>on</strong>g>g, <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g urban<br />

community gardens. With imag<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> and <str<strong>on</strong>g>in</str<strong>on</strong>g>novati<strong>on</strong>, Raja Kaluves can easily become the space for build<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

ecologically committed communities <str<strong>on</strong>g>in</str<strong>on</strong>g> urban areas. The Raja Kaluves that are not encroached, or partially<br />

destroyed, must be protected from further encroachment and destructi<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> live fenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g as though they were<br />

tree wedges <str<strong>on</strong>g>in</str<strong>on</strong>g>terl<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s. A list of species that may be planted al<strong>on</strong>g Raja Kaluves is annexed at<br />

Annexure F.<br />

21. Preventi<strong>on</strong> of sewage <str<strong>on</strong>g>in</str<strong>on</strong>g>flow <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>: 1 Sewage treated to sec<strong>on</strong>dary treatment standards must <strong>on</strong>ly be<br />

allowed <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong> bodies. No raw sewage or trade effluents must be allowed <str<strong>on</strong>g>in</str<strong>on</strong>g>to <strong>lake</strong>s bodies. Violators<br />

must be severely penalised and crim<str<strong>on</strong>g>in</str<strong>on</strong>g>al proceed<str<strong>on</strong>g>in</str<strong>on</strong>g>gs <str<strong>on</strong>g>in</str<strong>on</strong>g>itiated per appropriate law. Wherever possible,<br />

treated sewage must be made to flow through dense reed beds and/or c<strong>on</strong>structed wetlands, designed <str<strong>on</strong>g>in</str<strong>on</strong>g> a<br />

manner that is both aesthetic, ecologically viable and also low ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance. These reed beds/c<strong>on</strong>structed<br />

wetlands aid <str<strong>on</strong>g>in</str<strong>on</strong>g> clean<str<strong>on</strong>g>in</str<strong>on</strong>g>g up/filter<str<strong>on</strong>g>in</str<strong>on</strong>g>g the waters, improve local micro-climatic c<strong>on</strong>diti<strong>on</strong>s, <str<strong>on</strong>g>in</str<strong>on</strong>g>crease ground<br />

water recharge between the <strong>lake</strong> bodies. In the extreme situati<strong>on</strong> where there is not any space for locati<strong>on</strong> of<br />

STPs, they must <strong>on</strong>ly be located close to the foreshore, carefully limit<str<strong>on</strong>g>in</str<strong>on</strong>g>g space needed <str<strong>on</strong>g>by</str<strong>on</strong>g> engag<str<strong>on</strong>g>in</str<strong>on</strong>g>g extremely<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>telligently designs. Where the watershed is un-disturbed, the run-off may be directly allowed to flow <str<strong>on</strong>g>in</str<strong>on</strong>g>to<br />

the <strong>lake</strong>s. Where watershed is heavily built up or disturbed, the run-off must be directed to the sewage<br />

treatment plants and <strong>on</strong>ly then should the treated water allowed to flow <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>. This will mitigate the<br />

extent of polluti<strong>on</strong> of water due to run-off over polluted soil.<br />

22. Bifurcati<strong>on</strong> of m<strong>on</strong>so<strong>on</strong> runoff channels from sewage channels: Historically, all the <strong>lake</strong>s received water<br />

dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g m<strong>on</strong>so<strong>on</strong> due to surface runoff from the surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g catchment areas. Unfortunately, at a number of<br />

<strong>lake</strong>s, the surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g catchment areas have been extensively encroached and built-up, thus curtail<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

natural gradient <str<strong>on</strong>g>in</str<strong>on</strong>g>flow of water <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>. Tak<str<strong>on</strong>g>in</str<strong>on</strong>g>g this <str<strong>on</strong>g>in</str<strong>on</strong>g>to c<strong>on</strong>siderati<strong>on</strong>, it is proposed to ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> storm<br />

water-dra<str<strong>on</strong>g>in</str<strong>on</strong>g>s separately and not to mix the storm water (or run-off water) with sewage. Such waters may be<br />

allowed <str<strong>on</strong>g>in</str<strong>on</strong>g>to <strong>lake</strong>s <strong>on</strong>ly after due wetland filter<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>by</str<strong>on</strong>g> pass<str<strong>on</strong>g>in</str<strong>on</strong>g>g it through a dense reed-beds; these are low or<br />

no ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance approaches that also provide habitats for a variety of flora and fauna.<br />

Comments <strong>on</strong> current Lake Development Model:<br />

23. Mov<str<strong>on</strong>g>in</str<strong>on</strong>g>g away from Civil Eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer's model for <strong>lake</strong> rehabilitati<strong>on</strong>: The present <strong>lake</strong> development model<br />

be<str<strong>on</strong>g>in</str<strong>on</strong>g>g adopted <str<strong>on</strong>g>by</str<strong>on</strong>g> LDA, BDA, BBMP is a civil eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer<str<strong>on</strong>g>in</str<strong>on</strong>g>g design that does not take <str<strong>on</strong>g>in</str<strong>on</strong>g>to c<strong>on</strong>siderati<strong>on</strong> the <strong>lake</strong><br />

structure, ecology and the biodiversity they support. The model is aimed at maximum desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g , and<br />

utilizati<strong>on</strong> of the desilted mud <str<strong>on</strong>g>in</str<strong>on</strong>g> situ, essentially to curtail costs <str<strong>on</strong>g>in</str<strong>on</strong>g>volved <str<strong>on</strong>g>in</str<strong>on</strong>g> transport<str<strong>on</strong>g>in</str<strong>on</strong>g>g and dump<str<strong>on</strong>g>in</str<strong>on</strong>g>g mud<br />

elsewhere. This forces the agencies to resort to unnecessary c<strong>on</strong>structi<strong>on</strong>s with<str<strong>on</strong>g>in</str<strong>on</strong>g> the <strong>lake</strong> area, such as<br />

r<str<strong>on</strong>g>in</str<strong>on</strong>g>ged-elevated-wide jogg<str<strong>on</strong>g>in</str<strong>on</strong>g>g tracks. Often enough, bird islands are developed even when they serve no<br />

ecological role due to the small size of the <strong>lake</strong>. Such desilt<str<strong>on</strong>g>in</str<strong>on</strong>g>g and rehabilitati<strong>on</strong> practices c<strong>on</strong>tribute to the<br />

gradual or rapid destructi<strong>on</strong> of the natural structure of the <strong>lake</strong>. All south Asian (human built) <strong>lake</strong>s are based<br />

<strong>on</strong> the practice of ensur<str<strong>on</strong>g>in</str<strong>on</strong>g>g that there are c<strong>on</strong>centric z<strong>on</strong>es of vary<str<strong>on</strong>g>in</str<strong>on</strong>g>g water depths with the deepest z<strong>on</strong>e<br />

close to the bund and decreas<str<strong>on</strong>g>in</str<strong>on</strong>g>g water depths towards the foreshore. The current design model<br />

un<str<strong>on</strong>g>in</str<strong>on</strong>g>telligently deepens the <strong>lake</strong>s, often c<strong>on</strong>tribut<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the collecti<strong>on</strong> of polluted waters result<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> extensive<br />

polluti<strong>on</strong> of ground water aquifers, besides caus<str<strong>on</strong>g>in</str<strong>on</strong>g>g a variety of public health problems. Also, while<br />

c<strong>on</strong>sider<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s for development or restorati<strong>on</strong>, each <strong>lake</strong> should be c<strong>on</strong>sidered as a unique case and an<br />

universal development model should not be formulated or adopted.<br />

24. Revers<str<strong>on</strong>g>in</str<strong>on</strong>g>g privatisati<strong>on</strong> of <strong>lake</strong>s: In accordance with the directi<strong>on</strong>s of the H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

Jagpal S<str<strong>on</strong>g>in</str<strong>on</strong>g>gh case, the Karnataka Government must aband<strong>on</strong> all plans for the privatisati<strong>on</strong> of <strong>lake</strong><br />

management and other comm<strong>on</strong>s. All agreements currently entered <str<strong>on</strong>g>in</str<strong>on</strong>g>to must be annulled and a compliance<br />

eport must be filed <str<strong>on</strong>g>by</str<strong>on</strong>g> the Chief Secretary of the State before the May 2011 deadl<str<strong>on</strong>g>in</str<strong>on</strong>g>e proposed <str<strong>on</strong>g>by</str<strong>on</strong>g> the<br />

H<strong>on</strong>'ble Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g>.<br />

25. On Island Design: Islands are used <str<strong>on</strong>g>by</str<strong>on</strong>g> birds and other biota for rest<str<strong>on</strong>g>in</str<strong>on</strong>g>g roost<str<strong>on</strong>g>in</str<strong>on</strong>g>g and nest<str<strong>on</strong>g>in</str<strong>on</strong>g>g. For this, islands<br />

needs to be well away from human activity and should be located at sufficient distance from the ma<str<strong>on</strong>g>in</str<strong>on</strong>g>-bund<br />

and water-edge <str<strong>on</strong>g>in</str<strong>on</strong>g> such a manner that the surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g water provides sufficient <str<strong>on</strong>g>in</str<strong>on</strong>g>sulati<strong>on</strong> from ground<br />

predators and human activity. Tree plant<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> the islands must be based <strong>on</strong> careful selecti<strong>on</strong> and based <strong>on</strong> a<br />

clear understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g of bird use of islands as seen, for example, at Ranganathittu Bird Sanctuary. The design<br />

of islands and choice of trees for plantati<strong>on</strong> is given <str<strong>on</strong>g>in</str<strong>on</strong>g> Annexure G.<br />

26. Walkways above <str<strong>on</strong>g>High</str<strong>on</strong>g> <strong>Water</strong> Mark <str<strong>on</strong>g>in</str<strong>on</strong>g>stead of Jogg<str<strong>on</strong>g>in</str<strong>on</strong>g>g Tracks: Instead of r<str<strong>on</strong>g>in</str<strong>on</strong>g>ged elevated jogg<str<strong>on</strong>g>in</str<strong>on</strong>g>g tracks, a<br />

packed-mud/ cobble-st<strong>on</strong>e ground-level walkway can be developed with a width not exceed<str<strong>on</strong>g>in</str<strong>on</strong>g>g 3 m (three<br />

meters). This can be established all around the <strong>lake</strong> perimeter bey<strong>on</strong>d the high-water mark or close to the<br />

perimeter fence. Such ground-level walkways will not obstruct the <str<strong>on</strong>g>in</str<strong>on</strong>g>flow of run-off water from the<br />

surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g catchment area, wherever it is still exists.<br />

27. Plant<str<strong>on</strong>g>in</str<strong>on</strong>g>g of tank area with trees and bushes above high water mark: In the open <strong>lake</strong> area that spreads<br />

above the high-water mark and the perimeter fence, select trees and bushes that are beneficial to birds,<br />

butterflies and other biota can be planted. List of such trees is listed <str<strong>on</strong>g>in</str<strong>on</strong>g> Annexure H.<br />

28. Lakes are not spaces for commercial amusement parks: As per the laws govern<str<strong>on</strong>g>in</str<strong>on</strong>g>g the wise use of wetlands,<br />

the <strong>lake</strong>s should not be turned <str<strong>on</strong>g>in</str<strong>on</strong>g>to amusement parks, public parks and water sport complexes, particularly<br />

for commercial ga<str<strong>on</strong>g>in</str<strong>on</strong>g>. Not <strong>on</strong>ly do such practices cause severe disturbance to the local biota/biodiversity, but<br />

also limit the possibility of recharg<str<strong>on</strong>g>in</str<strong>on</strong>g>g of ground water aquifers. Given the dire water scarcity situati<strong>on</strong>, no<br />

effort should be spared to rehabilitate <strong>lake</strong>s as water-bodies. If such public recreati<strong>on</strong>al facilities are required,<br />

space may be acquired adjo<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s, especially <str<strong>on</strong>g>in</str<strong>on</strong>g> moist atchkat areas, for the development of such parks.<br />

29. C<strong>on</strong>structi<strong>on</strong> of Kalyanis: Kalyanis should be c<strong>on</strong>structed near <strong>lake</strong>s, wherever necessary, to facilitate<br />

c<strong>on</strong>trolled immersi<strong>on</strong> of Ganesha idols. This way, the immersi<strong>on</strong> of Ganesha idols, or any other such festival<br />

idols, directly with<str<strong>on</strong>g>in</str<strong>on</strong>g> the <strong>lake</strong> can be prevented. The c<strong>on</strong>tam<str<strong>on</strong>g>in</str<strong>on</strong>g>ated waters of the Kalyanis should not be<br />

discharged without treatement <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong> waters to prevent <str<strong>on</strong>g>in</str<strong>on</strong>g>crease <str<strong>on</strong>g>in</str<strong>on</strong>g> turbidity, heavy metal pois<strong>on</strong><str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

(from pa<str<strong>on</strong>g>in</str<strong>on</strong>g>ts) and eutrophicati<strong>on</strong> of <strong>lake</strong>s. Kalyanis must <strong>on</strong>ly be developed outside the water-spread area of<br />

the <strong>lake</strong>.<br />

Prospective plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g to protect <strong>lake</strong>s and build water and ecological security:<br />

30. Cauti<strong>on</strong> to be exercised to protect <strong>lake</strong> systems when develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g new neighbourhoods, <str<strong>on</strong>g>in</str<strong>on</strong>g>frastructure<br />

projects and <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrial areas: As <strong>lake</strong>s provide several critical ecosystem services, such as act<str<strong>on</strong>g>in</str<strong>on</strong>g>g as lung<br />

spaces, groundwater recharge units and flood c<strong>on</strong>trol units, besides ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>siderable biodiversity,<br />

wherever and whenever there is a need to develop new residential or <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrial layouts or <str<strong>on</strong>g>in</str<strong>on</strong>g>frastructure<br />

projects, or expand exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong>es, care should be taken to ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> the sanctity and <str<strong>on</strong>g>in</str<strong>on</strong>g>tegrity of <strong>lake</strong>s, its<br />

immediate surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g areas and the accompany<str<strong>on</strong>g>in</str<strong>on</strong>g>g Raja Kaluves. At the plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g stages itself the c<strong>on</strong>cerned<br />

agencies must <str<strong>on</strong>g>in</str<strong>on</strong>g>tegrate these protective features to demarcate the <strong>lake</strong> area and the Raja Kaluves and thus<br />

protect them. Similarly, storm water dra<str<strong>on</strong>g>in</str<strong>on</strong>g>s should be planned <str<strong>on</strong>g>by</str<strong>on</strong>g> l<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g roadside water run off channels such<br />

that the dra<str<strong>on</strong>g>in</str<strong>on</strong>g>s would empty <strong>on</strong>ly pure m<strong>on</strong>so<strong>on</strong> run off <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>. No sewage or <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrial effluents<br />

should at all be let <str<strong>on</strong>g>in</str<strong>on</strong>g>to these storm water dra<str<strong>on</strong>g>in</str<strong>on</strong>g>s, and <str<strong>on</strong>g>in</str<strong>on</strong>g> any case they must be discharged after appropriate<br />

treatment <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with the <strong>Water</strong> (Preventi<strong>on</strong> and C<strong>on</strong>trol of Polluti<strong>on</strong>) Act, 1974 and the Wetland<br />

Rules, 2010. If the plan <str<strong>on</strong>g>in</str<strong>on</strong>g>cludes discharge of such domestic and trade effluents <str<strong>on</strong>g>in</str<strong>on</strong>g>to <strong>lake</strong>s, appropriate plans<br />

should be made at the plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g stages itself, and their strict implementati<strong>on</strong> ensured, to accommodate the<br />

transfer of post-treated waters through a network of separate underground canals <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>s. The<br />

c<strong>on</strong>cerned agencies, corporati<strong>on</strong>s, apartments, neighbourhoods, authorities, etc. should be strictly penalized<br />

if raw sewage or trade effluents are discharged directly <str<strong>on</strong>g>in</str<strong>on</strong>g>to the <strong>lake</strong>s without c<strong>on</strong>form<str<strong>on</strong>g>in</str<strong>on</strong>g>g to these standards<br />

and norms. The provisi<strong>on</strong>s of the Karnataka Town and Country Plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g Act, 1961, <str<strong>on</strong>g>in</str<strong>on</strong>g> particular those<br />

provisi<strong>on</strong>s that provide for public c<strong>on</strong>sultati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g and implementati<strong>on</strong> of town and country plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

schemes and projects, must be fully c<strong>on</strong>formed with as directed <str<strong>on</strong>g>by</str<strong>on</strong>g> this H<strong>on</strong>'ble <str<strong>on</strong>g>High</str<strong>on</strong>g> <str<strong>on</strong>g>Court</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> Envir<strong>on</strong>ment<br />

Support Group and ors. vs. Bangalore Metro Rail Corporati<strong>on</strong> Ltd. (PIL: WP No. 13241/2009).<br />

31. Designati<strong>on</strong> of <strong>lake</strong>s as bird sanctuaries (with no boat<str<strong>on</strong>g>in</str<strong>on</strong>g>g and commercial fish<str<strong>on</strong>g>in</str<strong>on</strong>g>g): Historically, the <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

Karnataka have supported immense aquatic biodiversity <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g birds and other biota. Lakes that have a<br />

past history of support<str<strong>on</strong>g>in</str<strong>on</strong>g>g high bird diversity <str<strong>on</strong>g>in</str<strong>on</strong>g> terms of species richness and their numbers should be<br />

identified <str<strong>on</strong>g>in</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong> with competent pers<strong>on</strong>nel/birdwatchers and declared as bird sanctuaries. An <str<strong>on</strong>g>in</str<strong>on</strong>g> situ<br />

development and management plan should be drawn-up <str<strong>on</strong>g>by</str<strong>on</strong>g> treat<str<strong>on</strong>g>in</str<strong>on</strong>g>g each <strong>lake</strong> as a unique case. Such <strong>lake</strong>s<br />

should be identified as unique bird habitats, should be kept free of all disturbances like boat<str<strong>on</strong>g>in</str<strong>on</strong>g>g and other<br />

water-sports, commercial fish<str<strong>on</strong>g>in</str<strong>on</strong>g>g, poach<str<strong>on</strong>g>in</str<strong>on</strong>g>g, etc, and notified for protecti<strong>on</strong> as per the Wetland Rules, 2010.<br />

Regular watch and ward should be put <str<strong>on</strong>g>in</str<strong>on</strong>g> place <str<strong>on</strong>g>by</str<strong>on</strong>g> the Forest Department dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the breed<str<strong>on</strong>g>in</str<strong>on</strong>g>g and bird<br />

migrati<strong>on</strong> seas<strong>on</strong>s, <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>vok<str<strong>on</strong>g>in</str<strong>on</strong>g>g provisi<strong>on</strong>s of the Wildlife (Protecti<strong>on</strong> and C<strong>on</strong>servati<strong>on</strong>) Act, 1972, Forest<br />

32. Local Rights to be recognised for wise use of wetlands: In any effort to protect and rehabilitate <strong>lake</strong>s, the<br />

local traditi<strong>on</strong>al and customary rights must be fully recognised per law, and special effort taken to protect<br />

those whose livelihoods depend <strong>on</strong> <strong>lake</strong>s. Any management plan should <str<strong>on</strong>g>in</str<strong>on</strong>g>corporate the possibility of<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>volv<str<strong>on</strong>g>in</str<strong>on</strong>g>g such communities <str<strong>on</strong>g>in</str<strong>on</strong>g> the management and protecti<strong>on</strong> of <strong>lake</strong>s. Examples <str<strong>on</strong>g>in</str<strong>on</strong>g>clude those who<br />

undertake subsistence fish<str<strong>on</strong>g>in</str<strong>on</strong>g>g, washer communities, those harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g aquatic plants, cattle grazers, vegetable<br />

growers, etc.<br />

33. Lakes as educati<strong>on</strong>al spaces: While <strong>lake</strong>s have served as cultural and livelihood spaces from time<br />

immemorial, an emerg<str<strong>on</strong>g>in</str<strong>on</strong>g>g dimensi<strong>on</strong> of these water-bodies is as critical educati<strong>on</strong>al spaces. While no effort<br />

must be spared to revive the social practice of <strong>lake</strong>s as cultural and livelihood spaces, special <str<strong>on</strong>g>in</str<strong>on</strong>g>itiatives must<br />

be undertaken to appreciate <strong>lake</strong>s as spaces for experiential and creative educati<strong>on</strong>. Students from all schools<br />

and colleges must be <str<strong>on</strong>g>in</str<strong>on</strong>g>volved <str<strong>on</strong>g>in</str<strong>on</strong>g> some aspects of <strong>lake</strong> management as part of their educati<strong>on</strong>al experience. In<br />

additi<strong>on</strong>, special educati<strong>on</strong>al programmes ought to be developed to encourage a wholistic and deeper<br />

understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the roles that <strong>lake</strong>s play <str<strong>on</strong>g>in</str<strong>on</strong>g> provid<str<strong>on</strong>g>in</str<strong>on</strong>g>g as ecological security and also as social, cultural and<br />

livelihood support spaces. Such educative efforts must not <strong>on</strong>ly be limited to students, but should also<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>clude local communities.<br />

34. Involvement of Local Governments <str<strong>on</strong>g>in</str<strong>on</strong>g> Lake protecti<strong>on</strong> and management: The Panchayat Raj and Nagarpalika<br />

Acts clearly mandate the fundamental <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement of elected local governments <str<strong>on</strong>g>in</str<strong>on</strong>g> all aspects relat<str<strong>on</strong>g>in</str<strong>on</strong>g>g to<br />

plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g and utilisati<strong>on</strong> of natural resources and envir<strong>on</strong>mental c<strong>on</strong>servati<strong>on</strong>, <str<strong>on</strong>g>by</str<strong>on</strong>g> way of formulati<strong>on</strong> of<br />

District Management Plans. Unfortunately, Karnataka is am<strong>on</strong>gst those States which has not c<strong>on</strong>stituted<br />

District or Metropolitan (as applicable) Plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g Committees, as mandated <str<strong>on</strong>g>by</str<strong>on</strong>g> these Acts. Appropriate<br />

directi<strong>on</strong>s may be issued to the State to comply with these c<strong>on</strong>stituti<strong>on</strong>al mandate. Any plans for <strong>lake</strong><br />

rehabilitati<strong>on</strong> must form a fundamental basis for preparati<strong>on</strong> of District Management Plan. The notificati<strong>on</strong><br />

of <strong>lake</strong>s as ecologically sensitive areas and as Ramsar sites must beg<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g such items <str<strong>on</strong>g>in</str<strong>on</strong>g> the District<br />

Management Plans, as envisaged <str<strong>on</strong>g>in</str<strong>on</strong>g> the Rio Declarati<strong>on</strong>.<br />

35. Involvement of local communities <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>lake</strong> protecti<strong>on</strong> and management: The Panchayat Raj and Nagarpalika<br />

Acts clearly require the <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement of local communities <str<strong>on</strong>g>in</str<strong>on</strong>g> management and utilisati<strong>on</strong> of natural resources<br />

through the Gram Sabhas and Ward Committees, as applicable. An extensive effort is needed to ensure that<br />

these c<strong>on</strong>stituti<strong>on</strong>ally mandated and representative local community engagement bodies are facilitated to<br />

undertake activities relat<str<strong>on</strong>g>in</str<strong>on</strong>g>g to <strong>lake</strong> protecti<strong>on</strong>, rehabilitati<strong>on</strong>, management and c<strong>on</strong>servati<strong>on</strong>.<br />

36. M<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g of Lake water quality: By a special programme, all <strong>lake</strong> waters must be m<strong>on</strong>itored at least twice a<br />

year aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st polluti<strong>on</strong> parameters and the results made available <strong>on</strong>l<str<strong>on</strong>g>in</str<strong>on</strong>g>e. Such taskx may be undertaken <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

extend<str<strong>on</strong>g>in</str<strong>on</strong>g>g the laboratory facilities of Dept. of M<str<strong>on</strong>g>in</str<strong>on</strong>g>es and Geology (which m<strong>on</strong>itors wells) and Karnataka State<br />

Polluti<strong>on</strong> C<strong>on</strong>trol Board (which has the mandate to m<strong>on</strong>itor quality of all waters). This effort is immediately<br />

required and undertaken <strong>on</strong> a war foot<str<strong>on</strong>g>in</str<strong>on</strong>g>g. Critically polluted water bodies must be clearly and publicly<br />

notified so that no fish or other sources of food (Eg. Vegetables) may be c<strong>on</strong>sumed from these water bodies<br />

as a public health measure.<br />

37. Appropriate model for ecologically sensitive and humane <strong>lake</strong> development: Envir<strong>on</strong>ment Support Group<br />

with assistance from a student of Architecture from BMS College of Eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer<str<strong>on</strong>g>in</str<strong>on</strong>g>g, Bangalore, has developed a<br />

model for a humane and ecologically sensitive rehabilitati<strong>on</strong> of Venkatappa Kere (also known as Setty Kere or<br />

Subramanyapura Kere), <str<strong>on</strong>g>in</str<strong>on</strong>g> Uttarhalli Hobli, Bangalore south. This <strong>lake</strong> is heavily encroached <str<strong>on</strong>g>by</str<strong>on</strong>g> poor and<br />

wealthier communities, and <strong>on</strong>ly recently has been seriously c<strong>on</strong>tam<str<strong>on</strong>g>in</str<strong>on</strong>g>ated <str<strong>on</strong>g>by</str<strong>on</strong>g> the effluent discharge from<br />

massive apartments of Mantri Tranquil and Gokulam Apartments (of ISKCON) off Kanakapura Road. This <strong>lake</strong><br />

can still be comprehensively rehabilitated <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g with its Raja Kaluve, which is largely <str<strong>on</strong>g>in</str<strong>on</strong>g>tact. The comm<strong>on</strong><br />

lands (Gomala lands, graz<str<strong>on</strong>g>in</str<strong>on</strong>g>g pastures) have been illegally encroached <str<strong>on</strong>g>by</str<strong>on</strong>g> large land-holders and builders. A<br />

detailed proposal to recover the encroached lands, rehabilitate poor communities humanely, and restore the<br />

<strong>lake</strong> to its prist<str<strong>on</strong>g>in</str<strong>on</strong>g>e state <str<strong>on</strong>g>in</str<strong>on</strong>g> an ecologically wise way is proposed, and the same is enclosed as Annexure J<br />

(series). Also enclosed is a report of the workshop organised <str<strong>on</strong>g>by</str<strong>on</strong>g> Envir<strong>on</strong>ment Support Group and Karnataka<br />

State Council for Science and Technology <strong>on</strong> “Urban Lakes as Ecological, Cultural and Public Spaces”, annexed<br />

The keynote address for the workshop was<br />

delivered <str<strong>on</strong>g>by</str<strong>on</strong>g> H<strong>on</strong>'ble Lokayukta of Karnataka Justice<br />

Santosh Hegde. He addressed the overall <strong>lake</strong><br />

situati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore and then <strong>on</strong> more specific<br />

issues of governance that worsen c<strong>on</strong>diti<strong>on</strong>s for<br />

<strong>lake</strong>s. He spoke of the undulat<str<strong>on</strong>g>in</str<strong>on</strong>g>g topography of<br />

Bangalore, lend<str<strong>on</strong>g>in</str<strong>on</strong>g>g itself to the huge system of<br />

manmade <strong>lake</strong> cha<str<strong>on</strong>g>in</str<strong>on</strong>g>s that was <str<strong>on</strong>g>in</str<strong>on</strong>g> place until relatively recently. He went <strong>on</strong> to expla<str<strong>on</strong>g>in</str<strong>on</strong>g> that<br />

build<str<strong>on</strong>g>in</str<strong>on</strong>g>g up<strong>on</strong> and encroach<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> <strong>lake</strong>s leads to problems of flood<str<strong>on</strong>g>in</str<strong>on</strong>g>g, s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce problems of<br />

overflow were previously handled <str<strong>on</strong>g>by</str<strong>on</strong>g> water flow<str<strong>on</strong>g>in</str<strong>on</strong>g>g from the upper <strong>lake</strong>s of a <strong>lake</strong> series to<br />

those further down. He spoke of other problems fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s, such as polluti<strong>on</strong> from sewage<br />

and heavy metal c<strong>on</strong>tam<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong>.<br />

Justice Hegde attributed the problems fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g Bangalore’s <strong>lake</strong>s to the negligent attitudes of<br />

short-sighted politicians and an unc<strong>on</strong>cerned bureaucracy. He claimed that faulty governance<br />

and overcrowd<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the city bey<strong>on</strong>d its <str<strong>on</strong>g>in</str<strong>on</strong>g>frastructural capacities were both to blame for the<br />

death of the city’s <strong>lake</strong>s. The <strong>on</strong>ly hope he saw was <str<strong>on</strong>g>in</str<strong>on</strong>g> people organis<str<strong>on</strong>g>in</str<strong>on</strong>g>g themselves to<br />

questi<strong>on</strong> the absolute collapse of the governance systems and engag<str<strong>on</strong>g>in</str<strong>on</strong>g>g with each and every<br />

public acti<strong>on</strong>, demand<str<strong>on</strong>g>in</str<strong>on</strong>g>g transparency, expos<str<strong>on</strong>g>in</str<strong>on</strong>g>g corrupti<strong>on</strong> and ensur<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong>ly that<br />

development would take place that truly benefits the people. He spoke with alarm that less<br />

than 15% of public expenditure truly meets public objectives and cited the recent CAG report<br />

which exposed that Rs. 51,000 crores of <str<strong>on</strong>g>in</str<strong>on</strong>g>vestment <str<strong>on</strong>g>in</str<strong>on</strong>g> programmes like NREGA were<br />

unaccounted. In that sense he w<strong>on</strong>dered if the the thousands of crores that the Government<br />

proposed to be <str<strong>on</strong>g>in</str<strong>on</strong>g>vested <str<strong>on</strong>g>in</str<strong>on</strong>g> rehabiltat<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s should be perceived as benefit<str<strong>on</strong>g>in</str<strong>on</strong>g>g the public to<br />

the extent of 15%? Justice Hegde also answered many questi<strong>on</strong>s from the audience and<br />

encouraged people to <str<strong>on</strong>g>in</str<strong>on</strong>g>tervene at the very <str<strong>on</strong>g>in</str<strong>on</strong>g>cepti<strong>on</strong> of a problem and not to presume it is not<br />

their problem at all.<br />

Speak<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> "A Historical Anthropology of Tank Irrigati<strong>on</strong> Technology <str<strong>on</strong>g>in</str<strong>on</strong>g> South <strong>India</strong>" Dr. Esha<br />

Shah of the University of Suxxex <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigated the history of tanks <str<strong>on</strong>g>in</str<strong>on</strong>g> Karnataka, study<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

particular the folklore and s<strong>on</strong>gs that grew up around tanks. She disputed the comm<strong>on</strong><br />

assumpti<strong>on</strong> that <str<strong>on</strong>g>in</str<strong>on</strong>g> pre-col<strong>on</strong>ial times tanks were collectively c<strong>on</strong>structed and ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g>ed <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

communities, attribut<str<strong>on</strong>g>in</str<strong>on</strong>g>g that assumpti<strong>on</strong> to a tendency to glorify and romanticise history.<br />

Esha Shah discussed the system through which tanks were c<strong>on</strong>structed, where temples would<br />

provide resources (d<strong>on</strong>ated <str<strong>on</strong>g>by</str<strong>on</strong>g> the elite of the community) and lower caste communities<br />

provided labour, often under cruel coerci<strong>on</strong>. She spoke of folk tales passed <strong>on</strong> through the<br />

communities which support the latter theory, <str<strong>on</strong>g>in</str<strong>on</strong>g> which their people were through various<br />

means tricked and cursed <str<strong>on</strong>g>in</str<strong>on</strong>g>to poverty and tank build<str<strong>on</strong>g>in</str<strong>on</strong>g>g. She also spoke of the complex<br />

mythology that would grow up around tanks, with s<strong>on</strong>gs and shr<str<strong>on</strong>g>in</str<strong>on</strong>g>es created for women who<br />

were periodically sacrificed to make a tank provide water dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g droughts.<br />

She also spoke of how tanks were not <str<strong>on</strong>g>in</str<strong>on</strong>g>itially built with a view towards envir<strong>on</strong>mental<br />

susta<str<strong>on</strong>g>in</str<strong>on</strong>g>ability. Of the over 35,000 tanks <str<strong>on</strong>g>in</str<strong>on</strong>g> Karnataka, merely 300 were built dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the British<br />

period and most of the rest dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the reign of the Vijayanagar Empire. The basic objective<br />

was to expand agriculture, particularly paddy cultivati<strong>on</strong>, to places with water scarcity.<br />

She c<strong>on</strong>cluded <str<strong>on</strong>g>by</str<strong>on</strong>g> say<str<strong>on</strong>g>in</str<strong>on</strong>g>g that history does not hold the key to the problems of the present.<br />

Our history did not have the democratic structure of present day society, and thus its often<br />

brutal soluti<strong>on</strong>s to problems could not be replicated <str<strong>on</strong>g>in</str<strong>on</strong>g> society today. She said that we need<br />

alternative ways to imag<str<strong>on</strong>g>in</str<strong>on</strong>g>e the future keep<str<strong>on</strong>g>in</str<strong>on</strong>g>g well our memories from the past as a rem<str<strong>on</strong>g>in</str<strong>on</strong>g>der<br />

of what to avoid.<br />

Dr. S. Subramanya of the University of Agricultural Sciences spoke of the structure and<br />

ecological diversity of tanks, as well as strategies for their effective management. He expla<str<strong>on</strong>g>in</str<strong>on</strong>g>ed<br />

that all tanks are man made, built so that the deepest z<strong>on</strong>e lies closest to the bund, after<br />

which the water grows progressively shallower. They are also traditi<strong>on</strong>ally seas<strong>on</strong>al <str<strong>on</strong>g>in</str<strong>on</strong>g> nature,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>undated dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the m<strong>on</strong>so<strong>on</strong> and then dry <str<strong>on</strong>g>by</str<strong>on</strong>g> summer through a comb<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> of evaporati<strong>on</strong><br />

and dra<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g of water for irrigati<strong>on</strong>. Both these factors, that of its structure and seas<strong>on</strong>ality, are<br />

needed to ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> its ecological health.<br />

The different z<strong>on</strong>es of the tank support different types of wildlife, with deep water support<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

birds such as ducks and pelicans and shallow water support<str<strong>on</strong>g>in</str<strong>on</strong>g>g birds such as sandpipers and<br />

stilts. The tank supports many other types of wildlife as well, from plankt<strong>on</strong> to beetles, frogs<br />

and snakes. The health of the tank can be judged <str<strong>on</strong>g>by</str<strong>on</strong>g> the presence of certa<str<strong>on</strong>g>in</str<strong>on</strong>g> sensitive<br />

organisms. For <str<strong>on</strong>g>in</str<strong>on</strong>g>stance, <str<strong>on</strong>g>in</str<strong>on</strong>g> the presence of excess sewage giant water bugs cannot survive. He<br />

spoke of problems fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore, from the loss of the catchement area, to sewage<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>flow, to disturbance from fish<str<strong>on</strong>g>in</str<strong>on</strong>g>g and poor redesign.<br />

In the ensu<str<strong>on</strong>g>in</str<strong>on</strong>g>g discussi<strong>on</strong> the questi<strong>on</strong> was raised,<br />

of what role <strong>lake</strong>s have to play <str<strong>on</strong>g>in</str<strong>on</strong>g> today’s social<br />

c<strong>on</strong>text, so different from that under which they<br />

were built centuries ago. His resp<strong>on</strong>se was that<br />

<strong>lake</strong>s are good lung spaces for the city, and help<br />

recharge ground water. They c<strong>on</strong>trol floods and<br />

provide a habitat for wildlife, which <str<strong>on</strong>g>in</str<strong>on</strong>g> turn can be<br />

good for the educati<strong>on</strong> of children. Esha Shah<br />

added that at <strong>on</strong>e po<str<strong>on</strong>g>in</str<strong>on</strong>g>t it was horrendously proposed <str<strong>on</strong>g>by</str<strong>on</strong>g> a British designer that the pyramids<br />

should be dismantled <str<strong>on</strong>g>in</str<strong>on</strong>g> order to use their material to build the Aswan Dam <str<strong>on</strong>g>in</str<strong>on</strong>g> Egypt. What we<br />

are now do<str<strong>on</strong>g>in</str<strong>on</strong>g>g is no different, <str<strong>on</strong>g>by</str<strong>on</strong>g> widespread encrochment and purposive decay of tank<br />

systems. She str<strong>on</strong>gly argued taht <strong>lake</strong>s must be perceived as a part of our natural landscape<br />

and also as an accumulati<strong>on</strong> of our cultural memories. Their current use must therefore be<br />

guided <str<strong>on</strong>g>by</str<strong>on</strong>g> wise choices that suits our present times while protect<str<strong>on</strong>g>in</str<strong>on</strong>g>g the needs of the future.<br />

Dr. D. S. Rav<str<strong>on</strong>g>in</str<strong>on</strong>g>dran, IFS, who chaired the morn<str<strong>on</strong>g>in</str<strong>on</strong>g>g sessi<strong>on</strong> complimented the speakers for their<br />

excellent, provacative and thought provok<str<strong>on</strong>g>in</str<strong>on</strong>g>g presentati<strong>on</strong>s. Summaris<str<strong>on</strong>g>in</str<strong>on</strong>g>g this sessi<strong>on</strong> he<br />

advocated a c<strong>on</strong>centrated effort <str<strong>on</strong>g>in</str<strong>on</strong>g> sav<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong>s as public comm<strong>on</strong>s. He alerted that Bangalore<br />

has am<strong>on</strong>gst the lowest per capita open spaces and the denegerati<strong>on</strong> of the quality and access<br />

to public spaces has taken place <str<strong>on</strong>g>in</str<strong>on</strong>g> a little over a decade. While attribut<str<strong>on</strong>g>in</str<strong>on</strong>g>g such major lossess<br />

to poor plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g, he stated that the current spate of flood<str<strong>on</strong>g>in</str<strong>on</strong>g>g across the city was a result of<br />

callous encroachment of <strong>lake</strong>s and their <str<strong>on</strong>g>in</str<strong>on</strong>g>terc<strong>on</strong>nect<str<strong>on</strong>g>in</str<strong>on</strong>g>g canal systems. Unless a serious effort<br />

was made to redeem the situati<strong>on</strong>, and that not <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>vestment <str<strong>on</strong>g>in</str<strong>on</strong>g> unnecessary <str<strong>on</strong>g>in</str<strong>on</strong>g>frastructure,<br />

but through a wholistic, and ecologically and culturally sensitive community based<br />

management process, quality of life <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore is likely to worsen tremendously.<br />

In the afterno<strong>on</strong>, the first talk was <str<strong>on</strong>g>by</str<strong>on</strong>g> Sunil Dutt Yadav. He expla<str<strong>on</strong>g>in</str<strong>on</strong>g>ed the legal issues<br />

surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>lake</strong> privatisati<strong>on</strong>. Say<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the law represents the m<str<strong>on</strong>g>in</str<strong>on</strong>g>imal level of morality, he<br />

claimed that all development must occur strictly <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with the law. This is the<br />

m<str<strong>on</strong>g>in</str<strong>on</strong>g>imum the public expects of the Government. The state must be just as accountable to the<br />

law as <str<strong>on</strong>g>in</str<strong>on</strong>g>dividuals. It is <strong>on</strong>ly the active role of the public at large that will ensure that the state<br />

is accountable and there is simply no other way to prevent lawlessness. Moreover, we cannot<br />

just criticize illegal acts <str<strong>on</strong>g>in</str<strong>on</strong>g> privacy. In order to have any efficacy, we must br<str<strong>on</strong>g>in</str<strong>on</strong>g>g our protests to<br />

the streets.<br />

He expla<str<strong>on</strong>g>in</str<strong>on</strong>g>ed the legal case aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st <strong>lake</strong> privatisati<strong>on</strong>. Accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to Secti<strong>on</strong> 67 of the Karnataka<br />

Revenue Act <strong>lake</strong>s are the property of the state. In other words, it was not legal for the state<br />

to transfer sovereignty over <strong>lake</strong>s to the Lake Development Authority (LDA). The LDA set up as<br />

a n<strong>on</strong>-profit to work for the regenerati<strong>on</strong> of <strong>lake</strong>s cannot therefore use public m<strong>on</strong>ey <str<strong>on</strong>g>in</str<strong>on</strong>g> order<br />

to make a profit off <strong>lake</strong>s <str<strong>on</strong>g>by</str<strong>on</strong>g> trad<str<strong>on</strong>g>in</str<strong>on</strong>g>g them for ma<str<strong>on</strong>g>in</str<strong>on</strong>g>tenance through commercial leases with<br />

private enterprises. Further, accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the Public Trust Doctr<str<strong>on</strong>g>in</str<strong>on</strong>g>e that the Supreme <str<strong>on</strong>g>Court</str<strong>on</strong>g> has<br />

upheld <str<strong>on</strong>g>in</str<strong>on</strong>g> many cases, the public comm<strong>on</strong>s should be ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g>ed based <strong>on</strong> the pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple of<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>tergenerati<strong>on</strong>al equity. Posterity must have access to the public comm<strong>on</strong>s, and that means it<br />

must have access for free. Cit<str<strong>on</strong>g>in</str<strong>on</strong>g>g an example here, he said the very fact that a poor pers<strong>on</strong><br />

had to pay Rs. 2/- to use the toilet must be c<strong>on</strong>sidered an outrageous act of violati<strong>on</strong> of<br />

fundamental human rights. Toilets ought to be treated as public comm<strong>on</strong>s and the Government<br />

which <str<strong>on</strong>g>in</str<strong>on</strong>g>vests thousands of crores <str<strong>on</strong>g>in</str<strong>on</strong>g> various projects should not f<str<strong>on</strong>g>in</str<strong>on</strong>g>d it difficult to provide<br />

toilets for the poor. By a similar pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple, public comm<strong>on</strong>s should not be perceived as usable<br />

for <strong>on</strong>ly those with access to resources and it is the Government's obligatory functi<strong>on</strong> to ensure<br />

access to comm<strong>on</strong>s is open to all with reas<strong>on</strong>able restricti<strong>on</strong>s <strong>on</strong> use.<br />

Speak<str<strong>on</strong>g>in</str<strong>on</strong>g>g next, Mr. A. R. Shivakumar, Executive Secretary of the Karnataka State Council for<br />

Science and Technology presented an engag<str<strong>on</strong>g>in</str<strong>on</strong>g>g presentati<strong>on</strong> <strong>on</strong> the massive public benefits of<br />

ra<str<strong>on</strong>g>in</str<strong>on</strong>g> water harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g. He spoke of the extreme water scarcity problems fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>India</strong> today, and<br />

how Bangalore specifically can combat its water problems through ra<str<strong>on</strong>g>in</str<strong>on</strong>g> water harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g. Past<br />

wisdom of harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g ra<str<strong>on</strong>g>in</str<strong>on</strong>g> through thousands of tanks and sourc<str<strong>on</strong>g>in</str<strong>on</strong>g>g its waters through milli<strong>on</strong>s<br />

of open wells, has now reduced us to a situati<strong>on</strong> that such social <str<strong>on</strong>g>in</str<strong>on</strong>g>telligence which is comm<strong>on</strong><br />

place is be<str<strong>on</strong>g>in</str<strong>on</strong>g>g ignored <str<strong>on</strong>g>by</str<strong>on</strong>g> the lure of expensive and <str<strong>on</strong>g>in</str<strong>on</strong>g>appropriate technological <str<strong>on</strong>g>in</str<strong>on</strong>g>terventi<strong>on</strong>s.<br />

He argued that the borewell was a significant reas<strong>on</strong> for the deliberate neglect of tank systems<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> rural and urban areas, and today despite drill<str<strong>on</strong>g>in</str<strong>on</strong>g>g hundreds of feet water could not be<br />

sourced.<br />

The soluti<strong>on</strong> for all this is fairly simple he argued. Simply <str<strong>on</strong>g>by</str<strong>on</strong>g> harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g ra<str<strong>on</strong>g>in</str<strong>on</strong>g> water that falls<br />

free <strong>on</strong> every<strong>on</strong>e's roof, and ensur<str<strong>on</strong>g>in</str<strong>on</strong>g>g its storage to <strong>on</strong>e's f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial capacity, and mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

overflow go<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>to the ground, was the best <str<strong>on</strong>g>in</str<strong>on</strong>g>surance of water we could build. He cited the<br />

unfortunate tragedy of our times that Bangalore is flooded and yet people have to buy dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

water, when we are all very excited about f<str<strong>on</strong>g>in</str<strong>on</strong>g>d<str<strong>on</strong>g>in</str<strong>on</strong>g>g some water <strong>on</strong> the mo<strong>on</strong>. Ra<str<strong>on</strong>g>in</str<strong>on</strong>g> water<br />

harvest<str<strong>on</strong>g>in</str<strong>on</strong>g>g is simple comm<strong>on</strong> sense practice of protect<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong>e's own liv<str<strong>on</strong>g>in</str<strong>on</strong>g>g comforts, and<br />

comes for free. This should become a popular movement and <strong>on</strong>e should not wait for<br />

government regulati<strong>on</strong>s or sheer necessity to force us <str<strong>on</strong>g>in</str<strong>on</strong>g>to adopt<str<strong>on</strong>g>in</str<strong>on</strong>g>g such simple ways of<br />

secur<str<strong>on</strong>g>in</str<strong>on</strong>g>g our water needs.<br />

of Public Lands <str<strong>on</strong>g>in</str<strong>on</strong>g> the Bangalore area, lamented the gross forms of corrupti<strong>on</strong> that have taken<br />

over our systems of governance. The public at large is as guilty as politicians, bureacrats and<br />

builders, as they encourage such dangerous practices with their silence and <str<strong>on</strong>g>in</str<strong>on</strong>g>difference. The<br />

need of the hour is public <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement <str<strong>on</strong>g>in</str<strong>on</strong>g> decisi<strong>on</strong> mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g and not public <str<strong>on</strong>g>in</str<strong>on</strong>g>difference.<br />

He shared many <str<strong>on</strong>g>in</str<strong>on</strong>g>stances of corrupti<strong>on</strong> that had led to loss of public comm<strong>on</strong>s. Cit<str<strong>on</strong>g>in</str<strong>on</strong>g>g a<br />

Revenue Department assessment, he said over 5,000 acres of public comm<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore<br />

was encroached based <strong>on</strong> bogus documentati<strong>on</strong>. No Government must be spared for such<br />

blatant aggressi<strong>on</strong> <strong>on</strong> public comm<strong>on</strong>s, as there was simply rhetorical commitment to enforce<br />

the rule of law, and no real acti<strong>on</strong> follows. On the matter of polluti<strong>on</strong> of <strong>lake</strong>s, he lamented<br />

that the Karnataka State Polluti<strong>on</strong> C<strong>on</strong>trol Board was very happy to issues hundreds of notices,<br />

but there is not <strong>on</strong>e <str<strong>on</strong>g>in</str<strong>on</strong>g>stance of c<strong>on</strong>victi<strong>on</strong> for the three decades the Board has functi<strong>on</strong>ed.<br />

Such failure of public agencies should not be easily forgiven <str<strong>on</strong>g>by</str<strong>on</strong>g> the people, as it is clearly<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>dicative of the gross corrupti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> the system.<br />

Cit<str<strong>on</strong>g>in</str<strong>on</strong>g>g Mahatma Gandhi, he encouraged people to develop a sense of justice based <strong>on</strong> the<br />

c<strong>on</strong>science with<str<strong>on</strong>g>in</str<strong>on</strong>g>, than merely the rule of law. As is evident, the rule of law is easily<br />

subverted, especially <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>fluential classes, <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g leaders <str<strong>on</strong>g>in</str<strong>on</strong>g> the government and the<br />

protectors of C<strong>on</strong>stituti<strong>on</strong>al rights. He w<strong>on</strong>dered if the voice of reas<strong>on</strong> and protecti<strong>on</strong> had itself<br />

turned <str<strong>on</strong>g>in</str<strong>on</strong>g>to a murderer of peoples rights? Almost all of the 50,000 acres of public lands<br />

encroached <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangalore was <str<strong>on</strong>g>by</str<strong>on</strong>g> the elite, the <str<strong>on</strong>g>in</str<strong>on</strong>g>fluential and the very c<strong>on</strong>nected powers <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

Government. Were <strong>lake</strong>s and other public comm<strong>on</strong>s marg<str<strong>on</strong>g>in</str<strong>on</strong>g>ally encroached <str<strong>on</strong>g>by</str<strong>on</strong>g> the poor out of<br />

sheer necessity, <strong>on</strong>e has to take a humanistic view and help them susta<str<strong>on</strong>g>in</str<strong>on</strong>g> their life and<br />

livelihoods. But today we are witness<str<strong>on</strong>g>in</str<strong>on</strong>g>g encroachment <str<strong>on</strong>g>by</str<strong>on</strong>g> greedy grabbers – people who have<br />

so much and feel they d<strong>on</strong>'t have enough. Only public oppositi<strong>on</strong> can end this menace of our<br />

society he argued.<br />
