Similarly analyzed, <str<strong>on</strong>g>the</str<strong>on</strong>g> positi<strong>on</strong> at <str<strong>on</strong>g>the</str<strong>on</strong>g> COURT STAGE is as follows:<br />

Performance<br />

• The low number of charges being referred <str<strong>on</strong>g>to</str<strong>on</strong>g> court (relative <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> number of crimes reported), is fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

compounded by <str<strong>on</strong>g>the</str<strong>on</strong>g> many charges/cases being withdrawn/struck off <str<strong>on</strong>g>the</str<strong>on</strong>g> roll after being introduced in court<br />

• The number of finalised cases (i.e. those guilty + not guilty + admissi<strong>on</strong> of guilt + diversi<strong>on</strong> + ADR + plea<br />

bargain) is low measured against <str<strong>on</strong>g>the</str<strong>on</strong>g> number of cases enrolled (which comprise cases carried over from<br />

previous years + new cases MINUS cases removed from <str<strong>on</strong>g>the</str<strong>on</strong>g> roll (withdrawn + struck off <str<strong>on</strong>g>the</str<strong>on</strong>g> roll + warrants +<br />

transfers)<br />

• Number of property crime finalised by <str<strong>on</strong>g>the</str<strong>on</strong>g> courts is very low, whilst c<strong>on</strong>tact crime is higher but not by much<br />

• 35% backlogs (cases l<strong>on</strong>ger than 9 m<strong>on</strong>ths <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> roll) in regi<strong>on</strong>al courts<br />

• ±48000 ATD’s are kept in our detenti<strong>on</strong> facilities<br />

• Low court hours (less than 3h30 pd per RC)/ Low number of finalised cases per court (7pm per RC in 06/07 –<br />

now (07/08) decreased <str<strong>on</strong>g>to</str<strong>on</strong>g> 6pm per RC)<br />

Capacity<br />

• Number of courts HC/RC/DC (judges <strong>and</strong> magistrates)<br />

• Numbers of Prosecu<str<strong>on</strong>g>to</str<strong>on</strong>g>rs (move <str<strong>on</strong>g>to</str<strong>on</strong>g>wards 2 per court, but 24% in 06/07 now (07/08)17% vacancies) vs unequal<br />

number of LAB legal staff (less than <strong>on</strong>e per court)<br />

C<strong>on</strong>clusi<strong>on</strong><br />

• The bot<str<strong>on</strong>g>to</str<strong>on</strong>g>m line is that an unacceptably low number of reported crime translates in<str<strong>on</strong>g>to</str<strong>on</strong>g> cases actually reaching<br />

our courts <strong>and</strong> of those cases that are referred <str<strong>on</strong>g>to</str<strong>on</strong>g> court, a large number are removed from <str<strong>on</strong>g>the</str<strong>on</strong>g> court roll <strong>and</strong><br />

<strong>on</strong>ly a small number of cases are placed before a judicial officer <strong>and</strong> finalised through <str<strong>on</strong>g>the</str<strong>on</strong>g> courts in any given<br />

year. So if efficiency <strong>and</strong> capacity do not improve <str<strong>on</strong>g>the</str<strong>on</strong>g> number of cases appearing before a judicial officer will<br />

c<strong>on</strong>tinue decreasing, <str<strong>on</strong>g>the</str<strong>on</strong>g> number of cases finalised will decrease, court hours will fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r shrink, cycle times<br />

will even become l<strong>on</strong>ger, <strong>and</strong> ultimately <str<strong>on</strong>g>the</str<strong>on</strong>g> Backlogs will increase even fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r.<br />
