At a hearing on June 6, 2012, a<br />
Panel <strong>of</strong> the Discipline Committee<br />
found Ms. Virji guilty <strong>of</strong> pr<strong>of</strong>essional<br />
misconduct. The allegations <strong>of</strong><br />
pr<strong>of</strong>essional misconduct against Ms.<br />
Virji related to engaging in long-term<br />
unauthorized dispensing in the form<br />
<strong>of</strong> fraudulent prescriptions that she<br />
submitted for reimbursement but<br />
did not actually dispense, as well<br />
as engaging in other unauthorized<br />
dispensing practices, including<br />
dispensing drugs to self-prescribing<br />
physicians and their family members.<br />
The Panel imposed a penalty which<br />
included:<br />
• A reprimand;<br />
• Directing the Registrar to impose<br />
specified terms, conditions or<br />
limitations on the Member’s<br />
Certificate <strong>of</strong> Registration, and in<br />
particular:<br />
• that she complete successfully,<br />
at her own expense, within 12<br />
months <strong>of</strong> the date <strong>of</strong> the Order,<br />
the ProBE Program – Pr<strong>of</strong>essional/<br />
Problem Based Ethics, <strong>of</strong>fered<br />
by The Centre for Personalized<br />
Education for Physicians, or<br />
equivalent program acceptable to<br />
the <strong>College</strong><br />
• for a period <strong>of</strong> three years from the<br />
date <strong>of</strong> the Order, that she shall:<br />
o be prohibited from having any<br />
proprietary interest in a pharmacy<br />
<strong>of</strong> any kind;<br />
o be prohibited from acting as<br />
a Designated Manager in any<br />
pharmacy;<br />
o be prohibited from receiving any<br />
remuneration for her work as<br />
a pharmacist other than remuneration<br />
based only on hourly<br />
or weekly rates, and not on the<br />
basis <strong>of</strong> any incentive or bonus<br />
for prescription sales;<br />
o notify the <strong>College</strong> in writing <strong>of</strong><br />
any employment in a pharmacy;<br />
and<br />
o ensure that her employers<br />
confirm in writing to the <strong>College</strong><br />
that they have received and<br />
reviewed a copy <strong>of</strong> the Discipline<br />
Committee Panel’s decision in<br />
this matter and their Order, and<br />
confirming the nature <strong>of</strong> the<br />
Member’s remuneration.<br />
• A suspension <strong>of</strong> seven months,<br />
with one month <strong>of</strong> the suspension<br />
to be remitted on condition that<br />
the Member complete the remedial<br />
training;<br />
• Costs to the <strong>College</strong> in the amount<br />
<strong>of</strong> $7,500.<br />
Member: Marianne Songgadan, R.Ph.<br />
At a hearing on November 9, 2012,<br />
a Panel <strong>of</strong> the Discipline Committee<br />
found Ms. Songgadan guilty<br />
<strong>of</strong> pr<strong>of</strong>essional misconduct. The<br />
allegations <strong>of</strong> pr<strong>of</strong>essional misconduct<br />
against Ms. Songgadan related<br />
to unauthorized access, use and/or<br />
disclosure <strong>of</strong> health information.<br />
The Panel imposed a penalty which<br />
included:<br />
• A reprimand;<br />
• Directing the Registrar to impose<br />
specified terms, conditions or<br />
