Regulation R194-07: Proposed On-Site Sewage Disposal System
Dear Ms. Corp:
Attached is a permanent regulation referenced above that was adopted by
the State Environmental Commission (SEC) on June 17, 2008. Also
attached is the filing statement required by NRS 233B.066 and the SEC
form for filing administrative regulations with the Secretary of State.
Special Note: The State Environmental Commission adopted the regulation
with one insignificant non-substantive change. The language change was
made to Sec 57 (d) on page 23 as noted below;
(d) A public or community sewerage system, which includes in its
jurisdiction the property where the proposed on-site sewage disposal
system is located, is available [at the property line of the proposed
system], except that a letter of approval or permit may be granted by
the Division or other administrative agency if the public or community
sewerage system approves, in writing, the construction or operation of
the proposed on-site sewage disposal system.
The language in this section was excluded to allow local jurisdictions
flexibility in determining when on-site sewage disposal systems are
allowed in conjunction with public or community sewerage systems.
More information about this regulation such as workshop notices and
related background information is available on the SEC website at:
