weather has been a blessing<br />

to you all. I have been<br />

hearing a lot about the upcoming<br />

legislation on the<br />

Fire Sprinkler Initiative. As<br />

with anything that gets involved<br />

in the political process,<br />

there are actually opponents<br />

to this common<br />

sense issue. <strong>The</strong> fact that<br />

roughly 84% of all civilian fire<br />

deaths resulted from home<br />

structure fires and that the<br />

risk of dying in a home fire<br />

is decreased by about 80%<br />

when sprinklers are present<br />

is self explanatory.<br />

<strong>The</strong> plumbing industry is<br />

in the process of educating<br />

both our contractors and the<br />

general public on this issue.<br />

Our trade associations and<br />

our inspectors are offering<br />

information and training to<br />

bring light to the initiative.<br />

weather, but overall the day<br />

went smoothly. Everyone<br />

was in great spirits. After a<br />

challenging round of golf attendees<br />

were treated to a<br />

cook-out catered by the staff<br />

of Pine Island Country Club.<br />

Dear fellow Contractor.<br />

If I had to guess, I would<br />

say that you are like many<br />

these days… reeling from<br />

the economic challenges<br />

that face us and our businesses.<br />

Whether you are a<br />

one truck operation or have<br />

several hundred employees,<br />

we all face similar circumstances<br />

such as having<br />

a shortage in job opportunities.<br />

Even when given a<br />

chance to price work it<br />

seems that the entire HVAC<br />

or <strong>Plumbing</strong> industry is pricing<br />

the same job with the<br />

successful bidder coming in<br />

well below cost. Competition<br />

is fierce because we all<br />

have expenses that need to<br />

be met to survive.<br />

This event is held every<br />

year to raise funds for the<br />

MCASC Scholarship Fund<br />

which was established to<br />

raise money for young people<br />

pursuing a career in the mechanical<br />

contracting industry.<br />

MCASC received 12 applications<br />

for the 2009-2010 academic<br />

year who were<br />

awarded scholarships totaling<br />

$22,000.<br />

<strong>The</strong> golf tournament had<br />

several winning teams. <strong>The</strong>y<br />

were: 1 st place team; Edward<br />

Gibbs, Dennis Anonie, Randy<br />

Jones, and Shawn<br />

Holcombe, 2 nd place team;<br />

Bob Jacques, Jimmy Champion,<br />

Chris Kirkland, and Jim<br />

Maguire and 3 rd place team;<br />

Gary Kirkland, Harvey<br />

Kirkland, Craig Kirkland, and<br />

Jamie Roberts. All winners received<br />

a trophy.<br />

tournament held on Lake<br />

better I could have steered<br />

us from many of the mistakes<br />

we fell into. All this to<br />

say, I am a little wiser now.<br />

Recently I heard a really<br />

good analogy from a friend.<br />

He said that “Fools never<br />

learn from their mistakes.<br />

<strong>The</strong>y just keep making the<br />

same ones over and over.<br />

Smart people learn from<br />

their mistakes and tend to<br />

make only new ones. Truly<br />

wise people learn from other<br />

people’s mistakes and avoid<br />

we have certainly felt the<br />

effects of this market downturn,<br />

we are more prepared<br />

than at any other time in the<br />

being wiser. You see, I had<br />

pretty much floundered<br />

through years of learning to<br />

be a business owner and<br />

doing things on my own.<br />

Well, we all know the definition<br />

of insanity… “Doing the<br />

You guessed it,<br />

other contractors that had<br />

already been there and<br />

done that.<br />

<strong>The</strong>re is a wealth of information<br />

and experience<br />

that you can glean from<br />

your peers. I know that<br />

many view your competitor<br />

as the enemy but I would<br />

rather compete with<br />

likeminded, educated business<br />

men than folks that<br />

often because of inexperience,<br />

fail and give our industry<br />

another black eye.<br />

We have found that<br />

through peer associations<br />

you can talk with other<br />

business owners and you<br />

would be surprised what<br />

they are willing to share to<br />

help you become better. I<br />

currently am involved in a<br />

peer group comprised of a<br />

number of Mechanical<br />

companies spread over the<br />

Southeast that all use the<br />

same Job Cost and Accounting<br />

software. We<br />

meet quarterly at one<br />

another’s shops and get a<br />

chance for other businesses<br />

to look at our organization<br />

and make suggestions.<br />

While there, we all<br />

meet to talk about each<br />

other’s business and share<br />

tools, reports and other<br />

things that might be working<br />

for us. I and my Vice<br />

President also are part of<br />

a Christian CEO Executive<br />

roundtable called C12. We<br />

meet monthly for a whole<br />

day doing nothing but<br />

working on being a better<br />

steward of the business we<br />

have been entrusted by<br />

God to run. <strong>The</strong> other<br />

CEOs around the table are<br />

essentially my “Board of<br />

Advisers” helping me<br />

make good sound decisions<br />

and coming up with<br />

creative ideas. We are part<br />

of several other associations<br />

and attend those<br />

regularly. One of the greatest<br />

opportunities that exist<br />

for us in the HVAC and<br />

<strong>Plumbing</strong> fields is the<br />

<strong>Plumbing</strong>, Heating and<br />

Cooling Contractors Association,<br />

(PHCC). PHCC has<br />

a National, State and local<br />

presence. Through this association<br />

you can take advantage<br />

of many benefits<br />

and tangible savings. I<br />

must say I am disappointed<br />

in that PHCC membership<br />

and participation has declined<br />

over the past few<br />

years, much because of<br />

the tremendous economic<br />

ride we have all enjoyed till<br />

now. If you had a pulse you<br />

could find work and most<br />

of the time have enough<br />

money left over to take your<br />

spouse out to eat at a nice<br />

restaurant and maybe<br />

even buy that boat or motorcycle<br />

you had always<br />

wanted. Why waste your<br />

time with an association? I<br />

think the answers are<br />

clear! To be prepared and<br />

equipped to deal with circumstances<br />

when they<br />

change.<br />

Friends, PHCC is a<br />

much needed part of our<br />

business. <strong>The</strong> work of our<br />

association has benefitted<br />

all of you through legislation<br />

that has fought against<br />

unfair trade practices.<br />

We have helped businesses<br />

by developing training<br />

materials, continuing<br />

education classes, project<br />

management training, discounts<br />

on trucks and<br />

equipment, insurance options.<br />

<strong>The</strong> list goes on and<br />

on. Without you as an active<br />

participating member,<br />

we are not what our potential<br />

could be. Right now our<br />

North Carolina State Association<br />

is retooling and we<br />

have some great things<br />

ahead! You need to be a<br />

part of protecting our industry<br />

and learning from<br />

others on how to be better.<br />

If you are a member of<br />

PHCC and have not been<br />

attending the monthly<br />

meetings please make it a<br />

priority to start attending. If<br />

you are not a member,<br />

what are you waiting on?<br />

Insanity? Join your National,<br />

State and Local<br />

PHCC. Attend the meetings.<br />

Go to some of the conventions<br />

and trade shows.<br />

Participate in some of the<br />

great training opportunities<br />

and be a better contractor<br />

By the time this article<br />

goes to print the Tennessee<br />

House of Representatives<br />

will have either passed or<br />

failed to pass the Governors<br />

Energy Bill for 2009. This<br />

bill is the result of many<br />

months of meetings all<br />

across the state, meetings<br />

to learn how homes<br />

can be built that don’t use<br />

and loose so much energy.<br />

Truth is Tennessee<br />

homes are the worst in<br />

the southeast as far as<br />

cost to operate and energy<br />

loss. <strong>The</strong> Task<br />

Force that Governor<br />

Bredesen appointed listened<br />

to people and experts<br />

from all walks of life,<br />

architects, engineers,<br />

builders, science and energy<br />

experts and even I<br />

and a few more PHCC of<br />

Middle Tennessee members<br />

were able to speak<br />

and be heard.<br />

What could we do to<br />

make better homes in this<br />

state? <strong>The</strong> result was the<br />

Governors Energy Bill I<br />

spoke of, it would require<br />

new homes in the State of<br />

Tennessee to be inspected<br />

to the International<br />

Residential Code.<br />

Inspections currently are<br />

limited to larger communities<br />

around the state.<br />

In Wilson County<br />

for example, Lebanon<br />

has codes inspections<br />

and a building code to<br />

build too, but build outside<br />

the city limits only<br />

and only two inspections<br />

are required, electrical<br />

and septic tank.<br />

I have seen some of<br />

the worse plumbing systems<br />

ever installed in areas<br />

that have no plumbing<br />

inspections or building<br />

codes. I bet some of you<br />

have as well. No vents,<br />

no traps, no fall, dangerous<br />

gas water heater installations<br />

to name but a<br />

few. <strong>The</strong> Governors Energy<br />

Bill would address<br />

this and more.<br />

But, it is being opposed<br />

by the less government<br />

is better members<br />

of the Tennessee House<br />

of Representatives. <strong>The</strong>ir<br />

complaint, to much government,<br />

I can see their<br />

point, we are sometimes<br />

regulated to death on<br />

what seemingly is no of<br />

the governments business.<br />

But homes are not<br />

one of them. Professional<br />

plumbers know the code,<br />

professional plumbers<br />

understand the reason for<br />

codes, but unfortunately<br />

not all House members<br />

do.<br />

<strong>The</strong> Tennessee Senate<br />

passed it, the Home Builders<br />

even supported it, but it<br />

may die because of legislators<br />

not wanting their districts<br />

included in the bill.<br />

Homes would be inspected<br />

from beginning to finish,<br />

foundation to insulation,<br />

that’s what will make homes<br />

in Tennessee use less energy<br />

and be a safer home<br />

as well.<br />

Relying on a private<br />

home inspector is not a<br />

great option given the fact<br />

that they are very unregulated<br />

and many have never<br />

been involved in the building<br />

trades. Inspectors that can<br />

inspect foundations and<br />

structure might have limited<br />

knowledge of plumbing and<br />

HVAC systems.<br />

As you read this the answer<br />

will be known, but right<br />

now as I write this, it’s up in<br />

the air what will happen.<br />

Hopefully the House will realize<br />

that protecting the citizens<br />

of their districts is best<br />

accomplished through the<br />

tried and true method that<br />

has been the cornerstone of<br />

the mechanical trades for<br />

over a hundred years, building<br />

to a code and inspectors<br />

that are fair and know the<br />

code.<br />

Real protection from a<br />

substandard builder and or<br />

contractors happens before<br />

the sheetrock goes up not<br />

afterwards. <strong>The</strong> citizens of<br />

this state deserve more that<br />

what they have right now,<br />

minimum building codes<br />

and a good inspection<br />

system is the right thing<br />

to do.

President’s Message<br />

Hello to all, I have just<br />

return from the region 3<br />

presidents meeting which<br />

was held in New Orleans,<br />

LA. <strong>The</strong> obvious and main<br />

concern of our society is the<br />

economic crisis we are currently<br />

enduring. Most of the<br />

chapters in our region have<br />

members that have lost<br />

their job which in turn directly<br />

affects the membership<br />

numbers. Fortunately, the<br />

Charlotte chapter has not<br />

had a loss of membership as<br />

of May 2009. This is not to<br />

say our chapter will not endure<br />

a loss of members and,<br />

in fact, the board is taking<br />

precautions in anticipation<br />

of such a loss.<br />

One such precaution is<br />

the Compassion Waiver of<br />

Society Dues application.<br />

Said application is for those<br />

that experience difficult financial<br />

issues due to, for<br />

example, job loss. This program<br />

would allow, with approval<br />

from national, a<br />

waiver of dues for a maximum<br />

of a three month increment,<br />

with a maximum<br />

amount of four waiver renewals<br />

permitted. Due to<br />

the crisis at hand, it is highly<br />

unlikely that an application<br />

would be denied. If you are<br />

after year and I don’t blame<br />

goal to encourage all members<br />

to consider a position<br />

great friend. It is comforting<br />

to know that Norman is now<br />

comfortable and starting on<br />

a new journey. We’ll all certainly<br />

Words can not express<br />

my sorrow and sadness of<br />

the news about Norman. As<br />

many of you know cancer<br />

and the treatments for it take<br />

a terrible toll on the body<br />

and emotionally on the family.<br />

Norman fought the fight<br />

for a long time and I know<br />

he is with his Lord in a better<br />

place. We should find<br />

peace in that and that he is<br />

no longer suffering. It is always<br />

hard to let go but he is<br />

now in the place he had prepared<br />

for all his life. I know<br />

that in the past Norman has<br />

ALWAYS been with us sitting<br />

right there, since his incident<br />

in Long Beach, and will be<br />

each time we meet. I will<br />

miss him very much.<br />

close friends threw our mutual<br />

interest in Racing-, and<br />

once told me that you<br />

should always be careful<br />

what you ask for. Not long<br />

after becoming a board<br />

member of North Carolina<br />

Wildlife Habitat Foundation,<br />

In the early 90’s I wrote Richard<br />

a letter stating that I<br />

had recently gotten on the<br />

board of NCWHF, and I<br />

thought he and the late<br />

GREAT Dale Earnhardt<br />

could help us raise funds<br />

and awareness for NCWHF,<br />

and that it would be a win win<br />

situation, because we could<br />

also help he and Dale become<br />

better Steward’s of<br />

the land, and therefore build<br />

on their fan base, while helping<br />

a cause they both loved.<br />

Richard called me, said he<br />

received my letter, thought<br />

it was a great idea, and we<br />

met and the next Charlotte<br />

race he put the North Carolina<br />

Wildlife Habitat Foundation<br />

logo on the hood of the<br />

# 3 car, and donated 10 %<br />

of the purse to NCWHF, and<br />

the rest is history. Six years<br />

later after becoming best<br />

friends, hunting and traveling<br />

together every year with<br />

our wives, Richard and I<br />

started working on the<br />

Childress Vineyards business<br />

plan, we both put in<br />

Vineyards, at our homes in<br />

2001, and eventually we formulated<br />

Childress Winery,<br />

which was completed late<br />

2003, in Davidson County,<br />

and it has become one of<br />

the top tourist attractions in<br />

the state, and is visited by<br />

over 300,000 people each<br />

year. Richard and I are business<br />

partners, but most importantly<br />

we are best<br />

friends, and every year we<br />

take one or two hunting or<br />

truly saddened to hear of his<br />

passing. I know he was with<br />

the Lord so I know they are<br />

now celebrating in Heaven<br />

for his homecoming. Our<br />

thoughts and prayers go out<br />

to Brenda, Cassie, Jon and<br />

their families for their loss<br />

Norm will be missed by<br />

many.<br />

A few months ago,<br />

Norman was able to make it<br />

to our monthly chapter<br />

meeting. Even though he<br />

fishing trips together, this<br />

year we are headed to Argentina,<br />

in July, to duck and dove<br />

hunt, we have hunted and<br />

fished all over North America,<br />

and I am the luckiest guy in<br />

the world, I get to be a business<br />

partner, go to races, and<br />

hunt and fish and travel with<br />

my hero. Richard Childress,<br />

one of the greatest true American<br />

hero’s. That goes to show<br />

you, do something good for<br />

others, and good things al-<br />

was in a wheelchair, several<br />

pounds lighter and in need<br />

of the assistance provided<br />

by his daughter Cassie, he<br />

was excited to be there and<br />

wanted to know everything<br />

that was going on with each<br />

of us and with the business<br />

of the Raleigh Chapter. For<br />

some reason, it didn’t feel<br />

like it was going to be the<br />

last time I would get to visit<br />

with him.<br />

Since becoming chapter<br />

president 4 years ago, I<br />

have always had the comfort<br />

of knowing Norman was<br />

there. Not only was he a<br />

founding member and active<br />

ways happen in return”.<br />

Christian have been married<br />

for 23 wonderful years and<br />

share two beautiful daughters.<br />
