THE <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> FRAMEWORK AGREEMENT<br />

ON ACCESS TO BIOLOGICAL AND GENETIC RESOURCES<br />

The Member States of the Associati<strong>on</strong> of South East Asian Nati<strong>on</strong>s (<str<strong>on</strong>g>ASEAN</str<strong>on</strong>g>) :<br />

CONSCIOUS of the fact that the Member States of the Associati<strong>on</strong> of South East Asian<br />

Nati<strong>on</strong>s possess ecosystems c<strong>on</strong>sidered as am<strong>on</strong>g the most diverse in the world in<br />

which the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> have a comm<strong>on</strong> interest;<br />

REALIZING the value of biological and genetic resources in the development of<br />

products, compounds and substances that have medicinal, industrial, agricultural and<br />

related applicati<strong>on</strong>s;<br />

RECOGNIZING that access <strong>to</strong> biological and genetic resources are currently<br />

unregulated, thus the urgent need <strong>to</strong> protect <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> interests in these biological and<br />

genetic resources from biopiracy;<br />

NOTING the provisi<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Biological Diversity <strong>on</strong> the sovereignty of<br />

States over their genetic resources and the need <strong>to</strong> promote the c<strong>on</strong>servati<strong>on</strong> and<br />

sustainable use of these resources as well as the fair and equitable sharing of benefits<br />

arising from its utilizati<strong>on</strong>;<br />

RECALLING the numerous decisi<strong>on</strong>s of the C<strong>on</strong>ference of the Parties of the<br />

C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Biological Diversity promoting and encouraging regi<strong>on</strong>al approaches <strong>to</strong><br />

access and benefit-sharing arrangements;<br />

RESPECTING the sovereignty of each Member State over their biological and genetic<br />

resources;<br />

AWARE of the fundamental principle that the prior informed c<strong>on</strong>sent of the Member<br />

State and its indigenous peoples and local communities embodying traditi<strong>on</strong>al lifestyles<br />

would have <strong>to</strong> be secured before access can take place;<br />

ACKNOWLEDGING the need <strong>to</strong> ensure the uniformity and c<strong>on</strong>sistency of access<br />

regulati<strong>on</strong>s in the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> regi<strong>on</strong> by setting minimum requirements for nati<strong>on</strong>al<br />

implementati<strong>on</strong> and maximize opportunities for the c<strong>on</strong>servati<strong>on</strong> and sustainable use of<br />

biological and genetic resources.<br />

Have agreed as follows :<br />

Article 1 - Declarati<strong>on</strong> of Principles<br />

The Associati<strong>on</strong> of South East Asian Nati<strong>on</strong>s (<str<strong>on</strong>g>ASEAN</str<strong>on</strong>g>) adheres <strong>to</strong> the following<br />

principles with regards <strong>to</strong> access <strong>to</strong> biological and genetic resources:<br />

a) That the Member States have sovereignty over biological and genetic resources<br />

within their terri<strong>to</strong>ries in accordance with the provisi<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong><br />

Biological Diversity;<br />

b) That the Member States shall recognize, respect, preserve and maintain the<br />

knowledge, innovati<strong>on</strong>s and practices of indigenous peoples and local<br />

communities embodying traditi<strong>on</strong>al lifestyles <strong>to</strong> their natural resources, including<br />

genetic resources;<br />

c) That the Member States shall ensure the c<strong>on</strong>servati<strong>on</strong> and sustainable utilizati<strong>on</strong><br />

of the biological diversity in the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> regi<strong>on</strong>;<br />

d) That the Member States shall ensure fair and equitable sharing of benefits<br />

arising from the utilizati<strong>on</strong> of biological and genetic resources at the community,<br />

nati<strong>on</strong>al and regi<strong>on</strong>al levels;<br />

e) That the Member States regard biological and genetic resources as a sacred<br />

heritage for all humankind and reject the applicati<strong>on</strong> of the patent system<br />

there<strong>on</strong>; and<br />

f) That the Member States recognize the importance of ensuring that food security<br />

in the regi<strong>on</strong> is enhanced and recognize the importance of the exchange and<br />

utilizati<strong>on</strong> of food crop germplasm already widely dispersed and utilized.<br />

Article 2 - Objectives<br />

The <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall have the following objectives :<br />

a) To ensure the c<strong>on</strong>servati<strong>on</strong> and sustainable use of biological and genetic<br />

resources and equitable sharing of benefits arising from access <strong>to</strong> those<br />

resources, c<strong>on</strong>sistent with the principle of prior informed c<strong>on</strong>sent;<br />

b) To accord recogniti<strong>on</strong> and protecti<strong>on</strong> <strong>to</strong> traditi<strong>on</strong>al knowledge of indigenous<br />

peoples and local communities, and <strong>to</strong> facilitate fair and equitable sharing of<br />

benefits with the said communities where traditi<strong>on</strong>al knowledge is utilized;<br />

c) To ensure that the peoples of <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> derive maximum and fairly shared benefits<br />

from the development and uses of biological and genetic resources within their<br />

terri<strong>to</strong>ries;<br />

d) To promote cooperati<strong>on</strong> am<strong>on</strong>g <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States in the utilizati<strong>on</strong> of, and<br />

providing access <strong>to</strong> biological and genetic resources and encourage the sharing<br />

of resources;<br />

e) To ensure that access regulati<strong>on</strong>s within the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> regi<strong>on</strong> are uniform and<br />

c<strong>on</strong>sistent in accordance with identified minimum requirements as set out in this<br />

<str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

f) To set minimum standards in regulating access <strong>to</strong> biological and genetic<br />

resources and strengthen nati<strong>on</strong>al initiatives <strong>to</strong>wards this objective; and<br />

g) To promote technology transfer and capacity building at the regi<strong>on</strong>al, nati<strong>on</strong>al<br />

and community levels.<br />

h) To establish effective and participa<strong>to</strong>ry measures for the grant of prior informed<br />

c<strong>on</strong>sent up <strong>to</strong> the local level taking in<strong>to</strong> account nati<strong>on</strong>al perspectives and<br />

priorities.<br />

Article 3 - Definiti<strong>on</strong> of Terms<br />

Under this <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, the following terms shall mean:<br />

<strong>Access</strong> <strong>to</strong> Biological and Genetic Resources -- the acquisiti<strong>on</strong> and use of biological and genetic resources<br />

as well as the derivatives thereof or, as applicable, intangible comp<strong>on</strong>ents, for purposes of research,<br />

bioprospecting, c<strong>on</strong>servati<strong>on</strong>, industrial applicati<strong>on</strong> or commercial use, am<strong>on</strong>g others.<br />

Biological and Genetic Resources -- includes genetic materials , <strong>org</strong>anisms and parts<br />

thereof, populati<strong>on</strong>, or any other biotic comp<strong>on</strong>ent of ecosystems with actual or potential<br />

use or value for humanity.<br />

Bioprospecting – the search for wild species with genes that produce better crops and<br />

medicines, or the explorati<strong>on</strong> of biodiversity for commercially valuable genetic and<br />

biological resources.<br />

Resource Providers – shall include federal, state governments, local authorities, land<br />

owners, land users, indigenous and local communities.<br />

Indigenous Peoples and Local Communities – shall be defined according <strong>to</strong> ILO 169<br />

with the following elements : identity, Terri<strong>to</strong>ry, culture, traditi<strong>on</strong> and knowledge<br />

Traditi<strong>on</strong>al Knowledge – knowledge, innovati<strong>on</strong>s and practices of indigenous and local<br />

communities relating <strong>to</strong> the use, properties, values and processes of any biological and<br />

genetic resource or any part thereof.<br />

Derivatives -- something extracted from biological and genetic resources such as blood,<br />

oils, resins, genes, seeds, spores, pollen and the like as well as the products derived<br />

from, patterned <strong>on</strong>, or incorporating manipulated compounds and/or genes.<br />

Article 4 - Scope and Coverage<br />

The <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall cover all biological and genetic resources including<br />

the traditi<strong>on</strong>al knowledge associated therein. However, access <strong>to</strong> biological and genetic<br />

resources shall not au<strong>to</strong>matically mean access <strong>to</strong> the traditi<strong>on</strong>al knowledge associated<br />

with the resource. <strong>Access</strong> <strong>to</strong> such traditi<strong>on</strong>al knowledge shall be explicitly indicated in<br />

the applicati<strong>on</strong> for access.<br />

The <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States shall c<strong>on</strong>sider ex-situ materials originating from the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g><br />

regi<strong>on</strong> collected prior <strong>to</strong> the adopti<strong>on</strong> of the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Biological Diversity as held<br />

in trust for the benefit of humankind where the applicati<strong>on</strong> of intellectual property rights<br />

shall not be allowed.<br />

The <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States shall not allow the patenting of plants, animals,<br />

micro<strong>org</strong>anisms or any parts thereof, and traditi<strong>on</strong>al and indigenous knowledge.<br />

The <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall not allow the prospecting as well as the applicati<strong>on</strong> of<br />

intellectual property rights <strong>on</strong> genetic materials of human origin. Furthermore, the<br />

Member States str<strong>on</strong>gly urge the establishment of a multilateral process <strong>to</strong> effectively<br />

regulate the access, use, and commercializati<strong>on</strong> of human genetic materials.<br />

The <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall not apply <strong>to</strong> the traditi<strong>on</strong>al uses of biological and<br />

genetic resources by indigenous and local communities in accordance with their<br />

cus<strong>to</strong>mary practices and traditi<strong>on</strong>s. All other individuals, agencies and instituti<strong>on</strong>s shall<br />

comply with the access regulati<strong>on</strong>s that may be established by the Member States.<br />

Article 5 - <strong>Access</strong> Instrument<br />

The nature of the access instrument shall be determined by each Member State based<br />

<strong>on</strong> their respective nati<strong>on</strong>al policies and legislati<strong>on</strong> in accordance with the minimum<br />

terms and c<strong>on</strong>diti<strong>on</strong>s laid down by this <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 6 - Implementati<strong>on</strong> of the <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g><br />

The implementati<strong>on</strong> of the <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall be effected by an entity <strong>to</strong> be<br />

identified from existing <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> bodies that may fulfill a clearing house functi<strong>on</strong> <strong>to</strong> attain<br />

the objectives of this <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>. Whenever it becomes necessary, the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member<br />

States shall make a decisi<strong>on</strong> <strong>on</strong> whether a separate body within the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> may be<br />

created <strong>to</strong> attain the objectives of the <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

There shall be established an interim clearing house mechanism the functi<strong>on</strong>s of which<br />

may be initially performed by the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Regi<strong>on</strong>al Centre For Biodiversity C<strong>on</strong>servati<strong>on</strong><br />

(ARCBC) until such time when a permanent body shall have been designated by the<br />

<str<strong>on</strong>g>ASEAN</str<strong>on</strong>g>. To this end, the ARCBC shall establish and maintain a database <strong>on</strong> the status<br />

of biological and genetic resources, as well as access agreements and applicati<strong>on</strong>s.<br />

Article 7 – Regi<strong>on</strong>al Clearing House Mechanism<br />

The regi<strong>on</strong>al clearing house mechanism shall be resp<strong>on</strong>sible for:<br />

a) Providing relevant informati<strong>on</strong> <strong>to</strong> resource users and the competent nati<strong>on</strong>al<br />

authorities. Provided that some informati<strong>on</strong> received by the clearing house<br />

mechanism may not be shared <strong>to</strong> parties other than the resource providers and<br />

shall be subject <strong>to</strong> appropriate security precauti<strong>on</strong>s;<br />

b) Serving as an informati<strong>on</strong> node <strong>to</strong> which Member States that allowed access <strong>to</strong><br />

genetic resources shall report such access and <strong>to</strong> disseminate such informati<strong>on</strong><br />

<strong>to</strong> the other Member States;<br />

c) Providing technical and legal support <strong>to</strong> competent nati<strong>on</strong>al authorities;<br />

d) Reporting <strong>to</strong> the Standing Committee the status of implementati<strong>on</strong> of the<br />

<str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

e) M<strong>on</strong>i<strong>to</strong>ring the implementati<strong>on</strong> of nati<strong>on</strong>al access legislati<strong>on</strong>s;<br />

f) Adopting a system of warning other Member States <strong>on</strong> applicati<strong>on</strong>s that have<br />

been denied by a Member State including a disseminati<strong>on</strong> of the reas<strong>on</strong>s and<br />

circumstances for such a refusal or rejecti<strong>on</strong>;<br />

Article 8 – Competent Nati<strong>on</strong>al Authority<br />

The Member States shall have the obligati<strong>on</strong> <strong>to</strong> designate their respective competent<br />

nati<strong>on</strong>al authorities which shall be resp<strong>on</strong>sible for:<br />

a) Formulating and implementing the nati<strong>on</strong>al legislati<strong>on</strong>s <strong>on</strong> access;<br />

b) Establishing procedures for the granting of prior informed c<strong>on</strong>sent at the nati<strong>on</strong>al<br />

and local levels with the direct involvement of resource providers;<br />

c) Disseminating informati<strong>on</strong> <strong>on</strong> the access regulati<strong>on</strong>;<br />

d) Establishing links with the ARCBC in the interim period and with the regi<strong>on</strong>al<br />

clearing house mechanism <strong>on</strong>ce it has been established;<br />

e) Providing informati<strong>on</strong> <strong>to</strong> the regi<strong>on</strong>al clearing house mechanism which they view<br />

<strong>to</strong> be of regi<strong>on</strong>al importance<br />

A Standing Committee composed of competent nati<strong>on</strong>al authorities shall be established<br />

and shall be resp<strong>on</strong>sible for :<br />

a) Reviewing the <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

b) Assisting Member States in the establishment of competent nati<strong>on</strong>al authorities;<br />

c) Settling disputes between and am<strong>on</strong>g the Member States<br />

Article 9 – Settlement of Disputes<br />

In cases of dispute between Member States, between a Member State and<br />

communities, or between communities regarding access, such cases shall be settled<br />

am<strong>on</strong>g the c<strong>on</strong>cerned parties through dialogue. Dispute between a resource user and a<br />

Member-State shall be settled at the nati<strong>on</strong>al level following the provisi<strong>on</strong>s of the<br />

nati<strong>on</strong>al access regulati<strong>on</strong>. Disputes am<strong>on</strong>g Member-States shall be settled through an<br />

arbitrati<strong>on</strong> process in a manner similar <strong>to</strong> what has been laid down in applicable<br />

internati<strong>on</strong>al treaties.<br />

Article10 - Prior Informed C<strong>on</strong>sent and Participati<strong>on</strong> of Key Stakeholders<br />

The prior informed c<strong>on</strong>sent of the Member State providing the biological and genetic<br />

resources is necessary before access <strong>to</strong> genetic resources can take place. The<br />

competent nati<strong>on</strong>al authority designated by Member States shall establish legallybinding<br />

procedures for the determinati<strong>on</strong> of prior informed c<strong>on</strong>sent up <strong>to</strong> the local level.<br />

The procedures leading <strong>to</strong> the grant of prior informed c<strong>on</strong>sent at the local level shall<br />

provide for the active involvement of indigenous peoples and local communities<br />

embodying traditi<strong>on</strong>al lifestyles. The prior informed c<strong>on</strong>sent process shall respect and<br />

comply with the cus<strong>to</strong>mary laws, practices and pro<strong>to</strong>cols of indigenous peoples and<br />

local communities and the disclosure of any informati<strong>on</strong> pertaining <strong>to</strong> the access shall<br />

be in a language understandable <strong>to</strong> the local communities.<br />

The Member States shall provide in their access regulati<strong>on</strong>s that each applicati<strong>on</strong> for<br />

prior informed c<strong>on</strong>sent shall be accompanied by a full disclosure of the following<br />

informati<strong>on</strong> :<br />

a) name of the researcher, collec<strong>to</strong>r or collabora<strong>to</strong>r;<br />

) specific area and locati<strong>on</strong> of the bioprospecting activity;<br />

c) the defined period when the collecti<strong>on</strong> activities will take place;<br />

d) the specific purposes, objectives, resources <strong>to</strong> be used, activities and<br />

methodologies, expected outputs and other related informati<strong>on</strong>;<br />

e) informati<strong>on</strong> <strong>on</strong> the local collabora<strong>to</strong>r;<br />

f) informati<strong>on</strong> <strong>on</strong> the potential envir<strong>on</strong>mental and ecological impact of the<br />

bioprospecting activity; and<br />

g) potential benefits <strong>to</strong> the country<br />

If a Member State decides <strong>to</strong> deny access <strong>to</strong> a particular applicati<strong>on</strong>, the regi<strong>on</strong>al<br />

clearing house mechanism shall disseminate the appropriate informati<strong>on</strong> <strong>to</strong> Member-<br />

States for their reference and appropriate acti<strong>on</strong>.<br />

Article 11 - Fair and Equitable Sharing of Benefits<br />

All resource providers, particularly indigenous peoples and local communities<br />

embodying traditi<strong>on</strong>al lifestyles, shall be actively included in the negotiati<strong>on</strong> of benefits<br />

<strong>on</strong> the basis of a full disclosure of potential benefits and risks arising from the use of the<br />

resource. Any benefit sharing arrangements that may be entered in<strong>to</strong> shall not<br />

negatively interfere with traditi<strong>on</strong>al knowledge systems and practices of indigenous<br />

peoples and local communities.<br />

The <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States shall recognize the indigenous peoples and local<br />

communities as the legitimate users and cus<strong>to</strong>dians of biological and genetic resources,<br />

and crea<strong>to</strong>rs of traditi<strong>on</strong>al knowledge. In this c<strong>on</strong>necti<strong>on</strong>, the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States<br />

shall establish legal processes <strong>to</strong> ensure fair and equitable sharing of benefits arising<br />

from the use of such knowledge and resources.<br />

The negotiati<strong>on</strong> of any benefit sharing arrangements that may come in the form of<br />

technology transfer, capacity building, m<strong>on</strong>etary and n<strong>on</strong>-m<strong>on</strong>etary benefits arising from<br />

the utilizati<strong>on</strong> of a Member State’s biological and genetic resources shall be left <strong>to</strong> its<br />

own initiative and discreti<strong>on</strong> based <strong>on</strong> a minimum set of requirements which shall<br />

include the following :<br />

a) The participati<strong>on</strong> of nati<strong>on</strong>als in research activities;<br />

) The sharing of research results, including all discoveries;<br />

c) A complete set of all voucher specimens left in nati<strong>on</strong>al instituti<strong>on</strong>s;<br />

d) <strong>Access</strong> by nati<strong>on</strong>als <strong>to</strong> all nati<strong>on</strong>al specimens deposited in internati<strong>on</strong>al ex situ<br />

collecti<strong>on</strong>s;<br />

e) The receipt by resource providers, without payment of a royalty, of all<br />

technologies developed from research <strong>on</strong> provided materials;<br />

f) Fees, royalties and financial benefits; and<br />

g) The d<strong>on</strong>ati<strong>on</strong> <strong>to</strong> nati<strong>on</strong>al instituti<strong>on</strong>s of equipment used as part of research.<br />

For the guidance of the Member States, the <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall provide an<br />

Annex that will illustrate opti<strong>on</strong>s and guidelines for appropriate benefit-sharing<br />

arrangements particularly those that have been discussed and noted by any ad-hoc<br />

body or Experts Panel created by the C<strong>on</strong>ference of the Parties <strong>to</strong> the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong><br />

Biological Diversity for the purpose. Other opti<strong>on</strong>s for benefit-sharing shall be<br />

determined by the Member States at the nati<strong>on</strong>al level or whatever they may be able <strong>to</strong><br />

negotiate in every applicati<strong>on</strong> for access.<br />

The Member States shall provide for the renegotiati<strong>on</strong> of whatever benefit-sharing<br />

arrangements that may have been entered in<strong>to</strong> and this renegotiati<strong>on</strong> shall be d<strong>on</strong>e with<br />

the originally identified resource providers <strong>on</strong> the terms of benefit sharing during the<br />

development and when new uses are discovered for those biological and genetic<br />

resources that have been collected.<br />

Article 12 - Comm<strong>on</strong> Fund for Biodiversity C<strong>on</strong>servati<strong>on</strong><br />

There is hereby created, at the level of the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g>, a Comm<strong>on</strong> Fund specifically and<br />

<strong>on</strong>ly for biodiversity c<strong>on</strong>servati<strong>on</strong>. C<strong>on</strong>tributi<strong>on</strong>s <strong>to</strong> this Fund shall be sourced from a<br />

share in the revenues derived from any commercializati<strong>on</strong> of the use of comm<strong>on</strong> and<br />

shared resources am<strong>on</strong>g the Member States. The <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Working Group <strong>on</strong> Nature<br />

C<strong>on</strong>servati<strong>on</strong> and Biodiversity (AWGNCB) shall make the appropriate<br />

recommendati<strong>on</strong>s <strong>on</strong> the implementati<strong>on</strong> mechanisms for the said Fund.<br />

The Comm<strong>on</strong> Fund shall also be sourced from a porti<strong>on</strong> of whatever the Member States<br />

shall impose as the appropriate charges and fees <strong>on</strong> each access applicati<strong>on</strong> submitted<br />

<strong>to</strong> their respective competent nati<strong>on</strong>al authorities. Additi<strong>on</strong>al support <strong>to</strong> the Comm<strong>on</strong><br />

Fund shall also be derived from whatever benefit-sharing arrangements that may be<br />

negotiated by each Member State, <strong>on</strong> a case-<strong>to</strong>-case basis.<br />

Article 13 - Envir<strong>on</strong>mental and Social Impact and Biosafety C<strong>on</strong>cerns<br />

In view of its importance in realizing the objectives of biodiversity c<strong>on</strong>servati<strong>on</strong>, this<br />

<str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall c<strong>on</strong>form with any nati<strong>on</strong>al, regi<strong>on</strong>al and internati<strong>on</strong>al<br />

guidelines <strong>on</strong> biosafety without prejudice <strong>to</strong> a separate and distinct framework or<br />

pro<strong>to</strong>col <strong>on</strong> the issue that may be developed by the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Working Group <strong>on</strong> Nature<br />

C<strong>on</strong>servati<strong>on</strong> and Biodiversity (AWGNCB) taking in<strong>to</strong> account the work of other relevant<br />

<str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> bodies.<br />

This <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall also take in<strong>to</strong> c<strong>on</strong>siderati<strong>on</strong> the various envir<strong>on</strong>mental<br />

and social impacts of access <strong>to</strong> genetic resources in c<strong>on</strong>formity with nati<strong>on</strong>al, regi<strong>on</strong>al<br />

and internati<strong>on</strong>al guidelines.<br />
