c) To ensure that the peoples of <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> derive maximum and fairly shared benefits<br />

from the development and uses of biological and genetic resources within their<br />

terri<strong>to</strong>ries;<br />

d) To promote cooperati<strong>on</strong> am<strong>on</strong>g <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> Member States in the utilizati<strong>on</strong> of, and<br />

providing access <strong>to</strong> biological and genetic resources and encourage the sharing<br />

of resources;<br />

e) To ensure that access regulati<strong>on</strong>s within the <str<strong>on</strong>g>ASEAN</str<strong>on</strong>g> regi<strong>on</strong> are uniform and<br />

c<strong>on</strong>sistent in accordance with identified minimum requirements as set out in this<br />

<str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

f) To set minimum standards in regulating access <strong>to</strong> biological and genetic<br />

resources and strengthen nati<strong>on</strong>al initiatives <strong>to</strong>wards this objective; and<br />

g) To promote technology transfer and capacity building at the regi<strong>on</strong>al, nati<strong>on</strong>al<br />

and community levels.<br />

h) To establish effective and participa<strong>to</strong>ry measures for the grant of prior informed<br />

c<strong>on</strong>sent up <strong>to</strong> the local level taking in<strong>to</strong> account nati<strong>on</strong>al perspectives and<br />

priorities.<br />

Article 3 - Definiti<strong>on</strong> of Terms<br />

Under this <str<strong>on</strong>g>Framework</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, the following terms shall mean:<br />

<strong>Access</strong> <strong>to</strong> Biological and Genetic Resources -- the acquisiti<strong>on</strong> and use of biological and genetic resources<br />

as well as the derivatives thereof or, as applicable, intangible comp<strong>on</strong>ents, for purposes of research,<br />

bioprospecting, c<strong>on</strong>servati<strong>on</strong>, industrial applicati<strong>on</strong> or commercial use, am<strong>on</strong>g others.<br />

Biological and Genetic Resources -- includes genetic materials , <strong>org</strong>anisms and parts<br />

thereof, populati<strong>on</strong>, or any other biotic comp<strong>on</strong>ent of ecosystems with actual or potential<br />

use or value for humanity.<br />

Bioprospecting – the search for wild species with genes that produce better crops and<br />

medicines, or the explorati<strong>on</strong> of biodiversity for commercially valuable genetic and<br />

biological resources.<br />

Resource Providers – shall include federal, state governments, local authorities, land<br />

owners, land users, indigenous and local communities.<br />

Indigenous Peoples and Local Communities – shall be defined according <strong>to</strong> ILO 169<br />

with the following elements : identity, Terri<strong>to</strong>ry, culture, traditi<strong>on</strong> and knowledge<br />
