China relating to <strong>the</strong> size <strong>of</strong> areas for exploration <strong>and</strong> relinquishment. At <strong>the</strong> 166th meeting, two Chinese scientists,<br />

Dr. Jiang Kaixi <strong>and</strong> Dr. He Gaowen, made presentations for <strong>the</strong> information <strong>of</strong> members <strong>of</strong> <strong>the</strong> Council on “Technical<br />

<strong>and</strong> economic evaluation <strong>of</strong> cobalt crust mining <strong>and</strong> processing” <strong>and</strong> “Determination <strong>of</strong> <strong>the</strong> size <strong>of</strong> areas for<br />

exploitation <strong>of</strong> <strong>and</strong> exploration for cobalt‐rich ferromanganese crusts”.<br />

7. The Council carried out a detailed reading <strong>of</strong> <strong>the</strong> entire text <strong>of</strong> <strong>the</strong> draft regulations. Agreement was<br />

reached on all regulations, with <strong>the</strong> exception <strong>of</strong> draft regulations 11, 12, 21 <strong>and</strong> 27. It was agreed to continue<br />

discussion <strong>of</strong> <strong>the</strong>se outst<strong>and</strong>ing issues at <strong>the</strong> next session in 2012 <strong>and</strong> that <strong>the</strong> adoption <strong>of</strong> <strong>the</strong> draft regulations<br />

would be <strong>the</strong> priority for <strong>the</strong> work <strong>of</strong> <strong>the</strong> Council. It was also noted that it would be necessary in due course to<br />

adopt a decision <strong>of</strong> <strong>the</strong> Council to deal with <strong>the</strong> possibility <strong>of</strong> overlapping claims, as had been done in <strong>the</strong> case <strong>of</strong><br />

polymetallic sulphides.<br />

VI.<br />

ADVISORY OPINION OF THE SEABED DISPUTES CHAMBER ON MATTERS RELATING TO<br />

THE RESPONSIBILITY AND LIABILITY OF SPONSORING STATES<br />

8. On 14 July, <strong>the</strong> Secretary‐General submitted to <strong>the</strong> Council a report on <strong>the</strong> advisory opinion <strong>of</strong> <strong>the</strong> Seabed<br />

Disputes Chamber, adopted on 1 February 2011 (ISBA/17/C/6‐ISBA/17/LTC/5). The Council took note with<br />

appreciation <strong>of</strong> <strong>the</strong> advisory opinion, <strong>and</strong> recommended that <strong>the</strong> Assembly also take note <strong>of</strong> <strong>the</strong> opinion during <strong>the</strong><br />

seventeenth session.<br />

VII.<br />

CONSIDERATION AND APPROVAL OF THE RECOMMENDATIONS OF THE LEGAL AND<br />

TECHNICAL COMMISSION RELATING TO THE APPROVAL OF TWO PLANS OF WORK FOR<br />

EXPLORATION FOR POLYMETALLIC NODULES<br />

A. Application submitted by Nauru Ocean Resources Inc.<br />

9. At its 167th <strong>and</strong> 168th meetings, on 19 July 2011, <strong>the</strong> Council considered <strong>the</strong> report <strong>and</strong><br />

recommendations <strong>of</strong> <strong>the</strong> Legal <strong>and</strong> Technical Commission relating to an application for <strong>the</strong> approval <strong>of</strong> a plan <strong>of</strong><br />

work for exploration for polymetallic nodules in reserved areas by Nauru Ocean Resources Inc. (NORI), sponsored<br />

by Nauru (ISBA/17/C/9). Following deliberations, <strong>the</strong> Council approved <strong>the</strong> plan <strong>of</strong> work <strong>and</strong> requested <strong>the</strong><br />

Secretary‐General to issue <strong>the</strong> plan <strong>of</strong> work for exploration for polymetallic nodules in <strong>the</strong> form <strong>of</strong> a contract<br />

between <strong>the</strong> Authority <strong>and</strong> NORI. The decision <strong>of</strong> <strong>the</strong> Council in this respect is contained in document<br />

ISBA/17/C/14.<br />

B. Application submitted by Tonga Offshore Mining Limited<br />

10. Also at its 167th <strong>and</strong> 168th meetings, <strong>the</strong> Council considered <strong>the</strong> report <strong>and</strong> recommendations <strong>of</strong> <strong>the</strong><br />

Legal <strong>and</strong> Technical Commission relating to an application for <strong>the</strong> approval <strong>of</strong> a plan <strong>of</strong> work for exploration for<br />

polymetallic nodules in reserved areas by Tonga Offshore Mining Limited (TOML), sponsored by Tonga<br />

(ISBA/17/C/10). Following deliberations, <strong>the</strong> Council approved <strong>the</strong> plan <strong>of</strong> work <strong>and</strong> requested <strong>the</strong> Secretary‐<br />

General to issue <strong>the</strong> plan <strong>of</strong> work for exploration for polymetallic nodules in <strong>the</strong> form <strong>of</strong> a contract between <strong>the</strong><br />

Authority <strong>and</strong> TOML. The delegations <strong>of</strong> Germany <strong>and</strong> <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s noted that paragraph 15 <strong>of</strong> <strong>the</strong><br />

Commission’s report left room for interpretation on <strong>the</strong> issue <strong>of</strong> sponsorship <strong>and</strong> effective control as it related to<br />

regulation 11 (2) <strong>of</strong> <strong>the</strong> Regulations on Prospecting <strong>and</strong> Exploration for Polymetallic Nodules in <strong>the</strong> Area. Germany<br />

stated its view that <strong>the</strong> issue required fur<strong>the</strong>r clarification <strong>and</strong> that, for such reason, it was unable to support <strong>the</strong><br />

decision to approve <strong>the</strong> plan <strong>of</strong> work for exploration <strong>of</strong> TOML. The decision <strong>of</strong> <strong>the</strong> Council with respect to <strong>the</strong><br />

application by TOML is contained in document ISBA/17/C/15.<br />
