General Terms and Conditions of Trade of ÖBB-Personenverkehr AG <strong>for</strong> the ÖBB<br />

BUSINESScard<br />

1. The BUSINESScard (called "card" hereinafter) is a payment card issued by ÖBB-Personenverkehr AG (called "ÖBB" hereinafter). The card<br />

entitles the customer to obtain reduced or regular tickets and reservations under the terms stated in these Terms and Conditions and the ÖBB's<br />

fare policies. The customer must purchase the minimum quantity established in the PT/ÖBB Personentarif ÖBB. The card is valid <strong>for</strong> three years.<br />

If the customer does not meet the minimum quantity established in the fare policies, ÖBB may terminate the card contract and refrain from issuing<br />

a card to the customer <strong>for</strong> the subsequent years. When ÖBB accepts the card contract, the customer receives the requested number of cards as<br />

long as he or she fulfils all requirements in these Terms and Conditions and the ÖBB's fare policies regarding the acquisition and use of the card.<br />

The card includes the desired (company) identification, the card number, and the expiration date and is transferable as a rule. Giving the card to<br />

third parties who are not the customer's employees is prohibited. By accepting and using this card, the card holder acknowledges these Terms<br />

and Conditions. Every card issued remains the property of the ÖBB. The ÖBB is not obligated to accept a card application. Card issue is free <strong>for</strong><br />

the client <strong>for</strong> a card quantity of up to 20 units; the client will be charged a sum of € 4.00 (incl. VAT) <strong>for</strong> each additional card in the first monthly bill<br />

after card receipt.<br />

2. The card holder must take care of his or her card and is liable <strong>for</strong> any misuse. If the card is lost or stolen, the card holder must notify ÖBB<br />

immediately by telephone, fax, or email. The loss or theft must also be reported to the nearest police station. When ÖBB receives the report of the<br />

lost or stolen card, ÖBB will block and invalidate the card. From this point on the card holder is freed from all other liability. If the card reported lost<br />

is found again, it must be sent back to ÖBB immediately.<br />

3. The card is valid <strong>for</strong> three years and expires at the end of the expiration date engraved on the card. Using an expired, invalid, blocked, or<br />

terminated card is prohibited. The card holder must ensure that expired, invalid, blocked, or terminated cards cannot be re-used and destroy the<br />

card. The card holder is generally liable <strong>for</strong> misuse of the card. The card holder may terminate the open-ended use contract with one month's<br />

notice at any time in writing and with simultaneous return of the card(s). The termination goes into effect upon receipt of the termination letter and<br />

the card(s) at ÖBB; services claimed from ÖBB be<strong>for</strong>e receipt of the card or termination letter will still be charged. When returning the card, the<br />

card holder should first make the card unusable by cutting it up in order to prevent misuse.<br />

4. The ÖBB is entitled to terminate the use contract with one month's notice without stating reasons. The ÖBB is entitled to terminate the contract <strong>for</strong><br />

cause with immediate effect. Cause particularly includes a breach of these Terms and Conditions, misuse of the card, failure to pay the bill on<br />

time, lack of adequate balance in the card holder's account, or the opening of insolvency or judicial composition proceedings <strong>for</strong> the card holder's<br />

assets.<br />

5. Any use of an expired, invalid (blocked), or terminated card is prohibited.<br />

6. Billing/payment: the card holder acknowledges the correctness of the amount of the monthly bill if he or she has not objected in writing within 30<br />

days of issue. Written objection does not release the card holder from the obligation to pay the bill on time. The card holder may only use the card<br />

as long as he or she is in a position to pay the monthly bills on time. The card holder agrees to transfer the amount of the monthly bill to the given<br />

bank connection within 30 days of the billing date.<br />

7. The card holder may choose between the following payment methods:<br />

a) Payment of the total outstanding amount via the payment <strong>for</strong>m included with the bill be<strong>for</strong>e the deadline stated on the bill. This payment<br />

method is generally considered agreed.<br />

b) Payment of the total outstanding amount via collection from the card holder's giro account be<strong>for</strong>e the deadline stated on the bill. In this case,<br />

the card holder must ensure that the giro account referred to the ÖBB has a sufficient balance when collection is completed.<br />

8. The card holder must immediately report any change of bank connection or address/email address to the ÖBB in writing. Writing statements from<br />

the ÖBB are considered received if they are sent to the card holder's last known address/email address.<br />

9. Amendments of these Terms and Conditions, especially of the expenses, costs, and fees to be charged and the default interest rate or<br />

amendment of the reduced rate <strong>for</strong> fare prices will be reported to the card holder in writing. All changes go into effect 14 days after issue and are<br />

considered approved if the card holder does not either return the card or terminate the card contract in writing within this period. If the contract is<br />

not terminated, the card holder commissions the ÖBB to issue a new card be<strong>for</strong>e the old card's expiration date and to send it to the last known<br />

address.<br />

10. If the use contract is not terminated, the card holder commissions the ÖBB to issue a new card be<strong>for</strong>e the old card's expiration date and to send it<br />

to the last known address.<br />

11. The valid version of the Fare and Transportation Regulations of the ÖBB is binding in addition to these Terms and Conditions; the Fare and<br />

Transportation Regulations also include the reduced rate <strong>for</strong> fares. The Fare and Transportation Regulations can be accessed at the ÖBB<br />

Personenkassen or online at www.oebb.at.<br />

12. The card holder grants their permission to receive advertising and in<strong>for</strong>mational material regarding offers, transportation service products of ÖBB,<br />

and advantages of the BUSINESScard from ÖBB Personenverkehr AG.<br />

13. Austrian law has sole application. The place of per<strong>for</strong>mance is Vienna. The place of jurisdiction is the competent court in Vienna I.
