EXPERT REPORT OF SARI LOCKER<br />

On July 13, 2012, Complainants Standard Innovation (US) Corp. and Standard<br />

Innovation Corporation (collectively, “SIC”) filed a motion to strike untimely invalidity opinions<br />

and references from the Supplemental Expert Report of Sari Locker (“July 9 Report”). (Motion<br />

Docket <strong>No</strong>. 823-044.) On July 30, 2012, respondents LELO Inc., Leloi AB, LELO, PHE Inc.<br />

d/b/a Adam & Eve, Nalpac Enterprises, Ltd. d/b/a/ Nalpac, Ltc., E.T.C., Inc. d/b/a Eldorado<br />

Trading Company, Inc., Williams Trading Co., Inc., Honey’s Place, Inc. and Lover’s Lane & Co<br />

(collectively, “Opposing Respondents”) filed a response opposing the motion} On July 30,<br />

2012, the Commission Investigative Staff (“Staff”) filed a response in support of the motion.<br />

At the end of May 2012, respondents LELO Inc., LELOi AB, and Lelo Shanghai Trading<br />

introduced a new version of their Tiani product, the Tiani 2. The partiesmoved for and were<br />

granted leave to supplement their expert reports—limited to infringement and non-infringement<br />

issuesraised by the Tiani 2. (See Motion Docket <strong>No</strong>. 823-033, granted by email on June 22,<br />

2012.) A<br />

SIC argues Dr. Locker’s July 9 Report violates the scope of the leave granted, going<br />

beyond Tiani 2 infringement issues, and presenting new or revised invalidity opinions and<br />

references. SIC requests that paragraphs 4, <strong>35</strong>-47, 58-61, and 64-119 of and “Attachments” 17,<br />

18,19, 31, 33, 36, 38, 39, 40, 41, 42, 45, 49, 50, 51, 54, 55, 56, 61, 62, 63, 70, 73, 74, 75, 76, and<br />

78 to the July 9 Report be stricken.<br />

The Opposing Respondents argue that SIC’s experts did not limit their supplemental<br />

expert reports to whether the Tiani 2 infringed the claims of the ’605 patent. The Opposing<br />

Respondents contend SIC’s experts gave extensive claim construction opinions and opinions<br />

related to domestic industry. The Opposing Respondents argue Dr. Locker’s challenged<br />

opinions respond directly to opinions given by SIC’s experts and are proper rebuttal testimony. 2<br />

The Staff contends, contrary to SIC’s assertions, that most of the challenged paragraphs<br />

do not relate to invalidity. The Staff asserts the majority of the supplemental opinions in Dr.<br />

Locker’s supplemental report relate to new opinions regarding SIC’s experts’ claim construction<br />

opinions. The Staff argues that Dr. Locker’s response to these opinions is untimely as they<br />

should have been presented in her first rebuttal report. The Staff notes the supplemental expert<br />

reports Werestrictly limited to infringement and argues the portions of Dr. Locker’s July 9 report<br />

that go beyond infringement of the Tiani 2 should be stricken.<br />

The Opposing Respondents do not assert that the challenged opinions address<br />

infringement of the Tiani 2. The Opposing Respondents have not sought leave to otherwise<br />

supplement their expert reports. The challenged opinions are stricken because they are beyond<br />

the permissible scope of the supplemental expert report.<br />

Accordingly, Motion Docket <strong>No</strong>. 823-O44 is GRANTED. Paragraphs 4, <strong>35</strong>-38, 40-43,<br />

59-61, and 64-68, 72-107, and 119 ofDr. Locker’s July 9, 2012 report, including the<br />

Attachments cited therein, are stricken<br />
