ORDER NO. 35:
GRANTING COMPLAINANTS’ MOTION TO STRIKE NEWLY
ADDEDUNTIMELY INVALIDITY AND OTHER OPINIONS FROM
RESPONDENTS’ JULY 9, 2012 SUPPLEMENTAL REBUTTAL
EXPERT REPORT OF SARI LOCKER
(August 8, 2012)
On July 13, 2012, Complainants Standard Innovation (US) Corp. and Standard
Innovation Corporation (collectively, “SIC”) filed a motion to strike untimely invalidity opinions
and references from the Supplemental Expert Report of Sari Locker (“July 9 Report”). (Motion
Docket No. 823-044.) On July 30, 2012, respondents LELO Inc., Leloi AB, LELO, PHE Inc.
d/b/a Adam & Eve, Nalpac Enterprises, Ltd. d/b/a/ Nalpac, Ltc., E.T.C., Inc. d/b/a Eldorado
Trading Company, Inc., Williams Trading Co., Inc., Honey’s Place, Inc. and Lover’s Lane & Co
(collectively, “Opposing Respondents”) filed a response opposing the motion} On July 30,
2012, the Commission Investigative Staff (“Staff”) filed a response in support of the motion.
At the end of May 2012, respondents LELO Inc., LELOi AB, and Lelo Shanghai Trading
introduced a new version of their Tiani product, the Tiani 2. The partiesmoved for and were
granted leave to supplement their expert reports—limited to infringement and non-infringement
1On July 24, 2012, I granted Motion Docket No. 823-O48—Unopposed Motion of
Manufacturer/Importer and Distributor Respondents and Lover's Lane & Co. to Extend the
Deadline to File a Response to Complainants’ Motion to Strike Newly Added Untimely
Invalidity and Other Opinions From Respondents‘ July 9, 2012 Supplemental Rebuttal Expert
Report of Sari Locker—and extended the deadline to file a response to July 30, 2012.
issuesraised by the Tiani 2. (See Motion Docket No. 823-033, granted by email on June 22,
2012.) A
SIC argues Dr. Locker’s July 9 Report violates the scope of the leave granted, going
beyond Tiani 2 infringement issues, and presenting new or revised invalidity opinions and
references. SIC requests that paragraphs 4, 35-47, 58-61, and 64-119 of and “Attachments” 17,
18,19, 31, 33, 36, 38, 39, 40, 41, 42, 45, 49, 50, 51, 54, 55, 56, 61, 62, 63, 70, 73, 74, 75, 76, and
78 to the July 9 Report be stricken.
The Opposing Respondents argue that SIC’s experts did not limit their supplemental
expert reports to whether the Tiani 2 infringed the claims of the ’605 patent. The Opposing
Respondents contend SIC’s experts gave extensive claim construction opinions and opinions
related to domestic industry. The Opposing Respondents argue Dr. Locker’s challenged
opinions respond directly to opinions given by SIC’s experts and are proper rebuttal testimony. 2
The Staff contends, contrary to SIC’s assertions, that most of the challenged paragraphs
do not relate to invalidity. The Staff asserts the majority of the supplemental opinions in Dr.
Locker’s supplemental report relate to new opinions regarding SIC’s experts’ claim construction
opinions. The Staff argues that Dr. Locker’s response to these opinions is untimely as they
should have been presented in her first rebuttal report. The Staff notes the supplemental expert
V
reports Werestrictly limited to infringement and argues the portions of Dr. Locker’s July 9 report
that go beyond infringement of the Tiani 2 should be stricken.
The Opposing Respondents do not assert that the challenged opinions address
infringement of the Tiani 2. The Opposing Respondents have not sought leave to otherwise
2The Opposing Respondents state they withdraw paragraphs 39, 44-47, 58, and 69-71, 108-118
of Dr. Locker’s Supplemental Report.
supplement their expert reports. The challenged opinions are stricken because they are beyond
the permissible scope of the supplemental expert report.
Accordingly, Motion Docket No. 823-O44 is GRANTED. Paragraphs 4, 35-38, 40-43,
59-61, and 64-68, 72-107, and 119 ofDr. Locker’s July 9, 2012 report, including the
Attachments cited therein, are stricken
