[Explanatory Note]<br />

The amended claim mentions “nitrogen-containing heterocyclic carboxylic acid (excluding<br />

nicotinic acid),” a partial change <strong>of</strong> the original claim, which explicitly excludes only the art disclosed as a<br />

prior art. Consequently, this example is included in the cases where the claim should be amended within the<br />

scope <strong>of</strong> the matters stated in the originally attached description, etc.<br />

A “disclaimer” approach should be adopted in the potential invention only when the filed invention<br />

is an art totally different from prior art in view <strong>of</strong> the technical idea <strong>and</strong> basically has an inventive step, but<br />

has an overlapped section with the prior art by chance.<br />
