The <strong>County</strong> <strong>of</strong> Kaua'i Office <strong>of</strong> the Prosecuting Attorney announces the following indictments<br />

from the <strong>September</strong> <strong>and</strong> <strong>October</strong> <strong>2011</strong> Gr<strong>and</strong> <strong>Jury</strong> Sessions:<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a three count indictment against Hapaki<br />

Mainaaupo, alleging that on <strong>September</strong> 3, <strong>2011</strong>, Mainaaupo committed<br />

the <strong>of</strong>fenses <strong>of</strong> Harassment, Assault in the Third Degree, <strong>and</strong><br />

Terroristic Threatening in the First Degree a by harassing <strong>and</strong> causing<br />

bodily injury to one individual, <strong>and</strong> threatening a public servant with<br />

the intent to terrorize. Mainaaupo’s case is set for jury trial on<br />

February 21, 2012.<br />

Hapaki Mainaauopo<br />

Stanley Chock<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a seven count indictment against Stanley<br />

Chock, alleging that on August 13, <strong>2011</strong>, Chock committed the<br />

<strong>of</strong>fenses <strong>of</strong> two counts <strong>of</strong> Promoting a Dangerous Drug in the Third<br />

Degree, two counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia, Place to<br />

Keep Ammunition, Prohibited Possession <strong>of</strong> Firearms, <strong>and</strong> Prohibited<br />

Possession <strong>of</strong> Butterfly Knives by possessing methamphetamine, drug<br />

paraphernalia, ammunition, a firearm, <strong>and</strong> a butterfly knife. Chock’s<br />

Case is set for jury trial on February 13, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a six count indictment against Timothy<br />

Conwill, alleging that on August 13, <strong>2011</strong>, Conwill committed the<br />

<strong>of</strong>fenses <strong>of</strong> two counts <strong>of</strong> Promoting a Dangerous Drug in the Third<br />

Degree, two counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia, Place to<br />

Keep Ammunition, <strong>and</strong> Prohibited Possession <strong>of</strong> a Firearm by<br />

possessing methamphetamine, drug paraphernalia, ammunition, <strong>and</strong> a<br />

firearm. Conwill’s case is set for jury trial on February 13, 2012.<br />

Timothy Conwill


The Gr<strong>and</strong> <strong>Jury</strong> returned a four count indictment against Linda<br />

Dannog, alleging that on August 13, <strong>2011</strong>, Dannog committed the<br />

<strong>of</strong>fenses <strong>of</strong> two counts <strong>of</strong> Promoting a Dangerous Drug in the Third<br />

Degree <strong>and</strong> two counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia by<br />

possessing methamphetamine <strong>and</strong> drug paraphernalia. Dannog’s case<br />

is set for jury trial on February 13, 2012.<br />

Linda Dannog<br />

John L. Krause<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a five count indictment against John L.<br />

Krause, alleging that on July 21, <strong>2011</strong>, Krause committed the <strong>of</strong>fenses<br />

<strong>of</strong> Robbery in the Second Degree, Attempted Theft in the Second<br />

Degree, Attempted Assault in the Third Degree, Assault in the Third<br />

Degree, <strong>and</strong> Theft in the Fourth Degree by threatening the use <strong>of</strong> force<br />

while engaged in a theft, causing bodily injury to one person <strong>and</strong><br />

attempting to cause bodily injury to another. Krause’s case is set for<br />

jury trial on January 17, 2012.<br />

Rick Trinque<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a four count indictment against<br />

Rick Trinque <strong>and</strong> Miles Martinez, alleging that on March 19, 2009,<br />

Trinque <strong>and</strong> Martinez each committed the <strong>of</strong>fenses <strong>of</strong> Commercial<br />

Promotion <strong>of</strong> Marijuana in the First Degree <strong>and</strong> Unlawful use <strong>of</strong> Drug<br />

Paraphernalia by possessing, cultivating, or having under their control<br />

100 or more marijuana plants <strong>and</strong> possessing drug paraphernalia. Both<br />

Trinque <strong>and</strong> Martinez’s cases are set for jury trial on February 13,<br />

2012.<br />

Miles Martinez


Andrew Hall<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a six count indictment against<br />

Andrew Hall <strong>and</strong> Bronson Balino, alleging that on <strong>September</strong> 10,<br />

<strong>2011</strong>, Hall <strong>and</strong> Balino each committed the <strong>of</strong>fenses <strong>of</strong> Promoting a<br />

Dangerous Drug in the Third Degree, Methamphetamine Trafficking<br />

in the Second Degree, <strong>and</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia by<br />

possessing <strong>and</strong> distributing methamphetamine, <strong>and</strong> possessing drug<br />

paraphernalia. Hall’s <strong>and</strong> Balino’s cases are set for jury trial on<br />

January 23, 2012.<br />

Terrance Ceria<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned an eleven count indictment against<br />

Terrance Ceria, alleging that on July 26, <strong>2011</strong>, Ceria committed the<br />

<strong>of</strong>fenses <strong>of</strong> Methamphetamine Trafficking in the Second Degree,<br />

Promoting a Dangerous Drug in the Third Degree, Promoting a<br />

Harmful Drug in the Fourth Degree, two counts <strong>of</strong> Unlawful Use <strong>of</strong><br />

Drug Paraphernalia, Carrying or Possessing a Loaded Firearm on a<br />

Public Highway, Place to Keep Loaded Firearms, Place to Keep<br />

Unloaded Firearms, Place to Keep Pistol or Revolver, Possession <strong>of</strong> a<br />

Firearm with Intent to Facilitate the Commission <strong>of</strong> a Felony Drug<br />

Offense, <strong>and</strong> Place to Keep Ammunition by distributing<br />

methamphetamine while unlawfully possessing a firearm, possessing<br />

methamphetamine, hydrocodone, drug paraphernalia, loaded firearms,<br />

unloaded firearms, <strong>and</strong> ammunition. Ceria’s case is set for jury trial on<br />

March 12, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against<br />

Kaili Ragudo, alleging that on July 26, <strong>2011</strong>, Ragudo committed the<br />

<strong>of</strong>fenses <strong>of</strong> Promoting a Dangerous Drug in the Third Degree <strong>and</strong><br />

Unlawful Use <strong>of</strong> Drug Paraphernalia by possessing methamphetamine<br />

<strong>and</strong> drug paraphernalia. Ragudo’s case is set for jury trial on March<br />

12, 2012.<br />

Bronson Balino<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a seventeen count indictment against<br />

Bronson Balino <strong>and</strong> Michael N. Montapert, alleging that on August 5,<br />

<strong>2011</strong>, Balino <strong>and</strong> Montapert each committed the <strong>of</strong>fenses <strong>of</strong><br />

Methamphetamine Trafficking in the Second Degree, Promoting a<br />

Dangerous Drug in the Second Degree, two counts <strong>of</strong> Promoting a<br />

Dangerous Drug in the Third Degree, Promoting a Harmful Drug in<br />

the Second Degree, <strong>and</strong> two counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug<br />

Paraphernalia, by possessing <strong>and</strong> distributing methamphetamine, <strong>and</strong><br />

by possessing cocaine, oxycodone, hydrocodone, <strong>and</strong> drug<br />

paraphernalia. Balino was also indicted for one count <strong>of</strong> Promoting a<br />

Detrimental Drug in the Third Degree for possessing marijuana.<br />

Balino’s case is set for Arraignment <strong>and</strong> Plea on November 22, <strong>2011</strong>.<br />

Montapert’s case is set for jury trial on March 12, 2012.<br />

Michael N. Montapert<br />

Ken Yamahiro<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned an eight count indictment against<br />

Ken Yamahiro <strong>and</strong> Eric W. M. Rivera, alleging that on August 26,<br />

<strong>2011</strong>, Yamahiro <strong>and</strong> Rivera each committed the <strong>of</strong>fenses <strong>of</strong><br />

Methamphetamine Trafficking in the Second Degree, Promoting a<br />

Dangerous Drug in the Second Degree, <strong>and</strong> Unlawful Use <strong>of</strong> Drug<br />

Paraphernalia by distributing methamphetamine <strong>and</strong> possessing<br />

methamphetamine <strong>and</strong> drug paraphernalia. Rivera was also indicted<br />

for one count <strong>of</strong> Promoting a Dangerous Drug in the Third Degree <strong>and</strong><br />

another count <strong>of</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia for possessing<br />

methamphetamine <strong>and</strong> drug paraphernalia. Yamahiro’s <strong>and</strong> Rivera’s<br />

cases are set for jury trial on March 5, 2012.<br />

Eric Rivera


The Gr<strong>and</strong> <strong>Jury</strong> returned an eighteen count indictment against<br />

Ken Yamahiro, alleging that on August 26, <strong>2011</strong>, Yamahiro committed<br />

the <strong>of</strong>fenses <strong>of</strong> two counts <strong>of</strong> Methamphetamine Trafficking in the<br />

First Degree, seven counts <strong>of</strong> Promoting a Dangerous Drug in the<br />

Second Degree, <strong>and</strong> nine counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug<br />

Paraphernalia by possessing <strong>and</strong> distributing methamphetamine; <strong>and</strong><br />

possessing drug paraphernalia. Yamahiro’s case is set for jury trial on<br />

March 27, 2012.<br />

Ken Yamahiro<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a three count indictment against<br />

Eric W. M. Rivera, alleging that on August 26, <strong>2011</strong>, Rivera<br />

committed the <strong>of</strong>fenses <strong>of</strong> Promoting a Dangerous Drug in the Third<br />

Degree, Promoting a Detrimental Drug in the Third Degree <strong>and</strong><br />

Unlawful Use <strong>of</strong> Drug Paraphernalia by possessing methamphetamine,<br />

marijuana, <strong>and</strong> drug paraphernalia. Rivera’s case is set for jury trial on<br />

March 5, 2012.<br />

Eric Rivera<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Ramah Wong,<br />

alleging that on May 24, <strong>2011</strong>, Wong committed the <strong>of</strong>fenses <strong>of</strong><br />

Promoting a Dangerous Drug in the Third Degree <strong>and</strong> Unlawful Use <strong>of</strong><br />

Drug Paraphernalia by possessing methamphetamine <strong>and</strong> drug<br />

paraphernalia. A warrant was issued for Wong’s arrest <strong>and</strong> bail was<br />

set at $2,000.00.<br />

Ramah Wong<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Fred Rivera,<br />

alleging that on August 11, <strong>2011</strong>, Rivera committed the <strong>of</strong>fenses <strong>of</strong><br />

Promoting a Dangerous Drug in the Third Degree <strong>and</strong> Unlawful Use <strong>of</strong><br />

Drug Paraphernalia by possessing methamphetamine <strong>and</strong> drug<br />

paraphernalia. A warrant was issued for Rivera’s arrest <strong>and</strong> bail was<br />

set at $2,000.00.<br />

Fred Rivera


The Gr<strong>and</strong> <strong>Jury</strong> returned an eight count indictment against Shan Costa-<br />

Brum, alleging that on August 17, <strong>2011</strong>, Costa-Brum committed the<br />

<strong>of</strong>fenses <strong>of</strong> four counts <strong>of</strong> Promoting a Dangerous Drug in the Third<br />

Degree <strong>and</strong> four counts Unlawful Use <strong>of</strong> Drug Paraphernalia by<br />

possessing methamphetamine <strong>and</strong> drug paraphernalia. A warrant was<br />

issued for Costa-Brum’s arrest <strong>and</strong> bail was set at $8,000.00.<br />

Shan Costa-Brum<br />

Alvin Isobe<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a six count indictment against Alvin Isobe<br />

<strong>and</strong> Joseph K. Rapozo III, alleging that on <strong>September</strong> 26, <strong>2011</strong>, Isobe<br />

<strong>and</strong> Rapozo each committed the <strong>of</strong>fenses <strong>of</strong> Theft in the First Degree,<br />

Theft in the Second Degree, <strong>and</strong> Criminal Property Damage in the<br />

Second Degree by stealing <strong>and</strong> ATM machine <strong>and</strong> cash; <strong>and</strong> damaging<br />

the ATM machine. Isobe <strong>and</strong> Rapozo’s cases are set for jury trial on<br />

February 27, 2012.<br />

Joseph K. Rapozo III<br />

Norman R. Bukoski Jr.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a three count indictment against Norman R.<br />

Bukoski Jr., alleging that on January 19, 2010, Bukoski committed the<br />

<strong>of</strong>fenses <strong>of</strong> Negligent Homicide in the First Degree, Negligent<br />

Homicide in the Second Degree, <strong>and</strong> Negligent Injury in the First<br />

Degree by operating his vehicle in a negligent manner while under the<br />

influence <strong>of</strong> drugs or alcohol, thereby causing the death <strong>of</strong> Tomas<br />

Garcia Jr. <strong>and</strong> causing serious bodily injury to Aaron Marvin.<br />

Bukoski’s case is set for jury trial on March 19, 2012.


The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Brendan A.<br />

Duarte, alleging that on May 31, <strong>2011</strong>, Duarte committed the <strong>of</strong>fenses<br />

<strong>of</strong> Promoting a Dangerous Drug in the Third Degree <strong>and</strong> Unlawful Use<br />

<strong>of</strong> Drug Paraphernalia by possessing methamphetamine <strong>and</strong> drug<br />

paraphernalia. A warrant was issued for Duarte’s arrest <strong>and</strong> bail was<br />

set at $20,000.00.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a nine count indictment against Henry N.<br />

Rabot, Shawn Aviguetero, <strong>and</strong> Alfredo Ascuncion, alleging that on<br />

May 31, <strong>2011</strong>: Rabot committed the <strong>of</strong>fenses <strong>of</strong> two counts <strong>of</strong> Place to<br />

Keep Unloaded Firearms other than Pistols or Revolvers by unlawfully<br />

possessing two firearms; Aviguetero committed the <strong>of</strong>fenses <strong>of</strong> Place<br />

to Keep Unloaded Firearms other than Pistols or Revolvers, Place to<br />

Keep Ammunition, <strong>and</strong> Permit to Acquire Firearm by unlawfully<br />

possessing a firearm, <strong>and</strong> ammunition, <strong>and</strong> acquiring the firearm<br />

without a proper permit; Ascuncion committed the <strong>of</strong>fenses <strong>of</strong> Place to<br />

Keep Unloaded Firearms other than Pistols or Revolvers, Place to<br />

Keep Ammunition, <strong>and</strong> two counts <strong>of</strong> Felon in Possession <strong>of</strong> Firearms<br />

by unlawfully possessing firearms <strong>and</strong> ammunition as a convicted<br />

felon . Rabot’s, Aviguetero’s, <strong>and</strong> Ascuncion’s cases are set for jury<br />

trial on March 19, 2012.<br />

Robbery in the Second Degree, Assault in the Third Degree, <strong>and</strong><br />

Unauthorized Entry into a Motor Vehicle in the First Degree by using<br />

force against a person to commit a theft, causing bodily injury to<br />

another, <strong>and</strong> unlawfully entering a motor vehicle: on <strong>October</strong> 9, <strong>2011</strong>,<br />

Borges committed the <strong>of</strong>fense <strong>of</strong> Assault in the Second Degree by<br />

causing bodily injury to another with a dangerous instrument; on<br />

<strong>October</strong> 12, <strong>2011</strong>, Borges committed the <strong>of</strong>fenses <strong>of</strong> Reckless Driving,<br />

Accidents Involving Damage to Vehicle or Property, Promotion <strong>of</strong> a<br />

Dangerous Drug in the Third Degree, Unlawful Use <strong>of</strong> Drug<br />

Paraphernalia, <strong>and</strong> Prohibitions Related to Butterfly Knives by driving<br />

recklessly, failing to stop after an accident involving property damage,<br />

<strong>and</strong> possessing methamphetamine, drug paraphernalia, <strong>and</strong> a butterfly<br />

knife. Borges’s case is set for jury trial on February 27, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Donald<br />

Kagawa, alleging that on December 17, 2010, Kagawa committed the<br />

<strong>of</strong>fenses <strong>of</strong> Terroristic Threatening in the First Degree <strong>and</strong> Criminal<br />

Trespass onto Public Parks <strong>and</strong> Recreational Grounds by threatening to<br />

cause bodily injury to a public servant <strong>and</strong> remaining unlawfully in a<br />

public park or recreational ground after a law enforcement <strong>of</strong>ficer<br />

requested that he leave. Kagawa’s case is set for jury trial on March<br />

19, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned an eight count indictment against Shan Costa-<br />

Brum <strong>and</strong> Jasmine Duque, alleging that on June 3, <strong>2011</strong>, Costa-Brum<br />

committed the <strong>of</strong>fenses two counts <strong>of</strong> Promoting a Dangerous Drug in<br />

the Third Degree, two counts <strong>of</strong> Unlawful Use <strong>of</strong> Drug Paraphernalia,<br />

Tampering with Physical Evidence, <strong>and</strong> Failure to Possess Insurance<br />

Identification Card by possessing methamphetamine <strong>and</strong> drug<br />

paraphernalia, tampering with a glass pipe, <strong>and</strong> failing to possess a<br />

motor vehicle insurance card. The Gr<strong>and</strong> jury also indicted Jasmine<br />

Duque, alleging that on June 3, <strong>2011</strong>, Duque committed the <strong>of</strong>fenses <strong>of</strong><br />

Promoting a Dangerous Drug in the Third Degree <strong>and</strong> Unlawful Use <strong>of</strong><br />

Drug Paraphernalia by possessing methamphetamine <strong>and</strong> drug<br />

paraphernalia. Warrants were issued for Costa-Brum’s <strong>and</strong> Duque’s<br />

arrest. Bail was set at $4,100.00 for Costa-Brum <strong>and</strong> $2,000 for<br />

Duque.<br />

Joycelynn Kanahele<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a four count indictment against Nolan<br />

Kawika Keola-Kaleimamahu, alleging that on <strong>September</strong> 26, <strong>2011</strong>,<br />

Keola-Kaleimamahu committed the <strong>of</strong>fenses <strong>of</strong> Obstructing<br />

Government Operations, Resisting Arrest, <strong>and</strong> two counts <strong>of</strong> Assault<br />

Against a Law Enforcement Officer in the Second Degree by using<br />

force against a law enforcement <strong>of</strong>ficer to hinder government<br />

operations, resisting arrest, <strong>and</strong> causing bodily injury to two police<br />

<strong>of</strong>ficers. A warrant was issued for Keola-Kaleimamahu’s arrest <strong>and</strong><br />

bail was set at $6,250.00.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a four count indictment against Joycelynn<br />

Kanahele, alleging that on August 13, <strong>2011</strong>, Kanahele committed the<br />

<strong>of</strong>fenses <strong>of</strong> Burglary in the First Degree, Unauthorized Entry into a<br />

Dwelling, Abuse <strong>of</strong> Family or Household Members, <strong>and</strong> Criminal<br />

Property Damage in the Fourth Degree by unlawfully entering a<br />

residence with the intent to commit a crime, abusing a family or<br />

household member, <strong>and</strong> damaging the property <strong>of</strong> another. Kanahele’s<br />

case is set for jury trial on February 27, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a one count indictment against Jonie Ragasa,<br />

alleging that on March 31, <strong>2011</strong>, Ragasa committed the <strong>of</strong>fenses <strong>of</strong><br />

Criminal Property Damage in the Second Degree by damaging the<br />

property <strong>of</strong> another exceeding $1,500.00. A bench warrant was issued<br />

for Ragasa, who is ordered to be released on recognizance when the<br />

warrant is served.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a three count indictment against Timothy<br />

Conwill, alleging that on December 10, 2009, Conwill committed the<br />

<strong>of</strong>fenses <strong>of</strong> Methamphetamine Trafficking in the Second Degree,<br />

Promoting a Dangerous Drug in the Third Degree, <strong>and</strong> Unlawful Use<br />

<strong>of</strong> Drug Paraphernalia by distributing <strong>and</strong> possessing<br />

methamphetamine, <strong>and</strong> possessing drug paraphernalia. Conwill’s case<br />

is set for jury trial on March 19, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Joel Acoba<br />

Jose, alleging that on <strong>September</strong> 12, <strong>2011</strong>, Jose committed the <strong>of</strong>fenses<br />

<strong>of</strong> two counts <strong>of</strong> Sexual Assault in the Third Degree by having sexual<br />

contact with two persons under fourteen years old. Jose’s case is set<br />

for jury trial on March 5, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a two count indictment against Samiuela<br />

Moala, alleging that on <strong>October</strong> 24, <strong>2011</strong>, Moala committed the<br />

First Degree by setting a fire that placed another person or persons in<br />

danger <strong>of</strong> death or bodily injury. Moala’s case is set for jury trial on<br />

March 5, 2012.<br />

The Gr<strong>and</strong> <strong>Jury</strong> returned a twelve count indictment against Robin<br />

Servantes, Tricia Rosa, Joseph K. Rapozo III, <strong>and</strong> Shauday Ragudo,<br />

alleging that on July 30, <strong>2011</strong>, Servantes, Rosa, Rapozo, <strong>and</strong> Ragudo<br />

each committed the <strong>of</strong>fenses <strong>of</strong> Promoting a Dangerous Drug in the<br />

Third Degree, Promoting a Detrimental Drug in the Third Degree, <strong>and</strong><br />

Unlawful Use <strong>of</strong> Drug Paraphernalia by possessing methamphetamine,<br />

marijuana, <strong>and</strong> drug paraphernalia. Warrants were issued for<br />

Servantes, Rosa, Rapozo, <strong>and</strong> Ragudo with bail set at $5,000.00 each.<br />
