September and October 2011 Grand Jury Indictments
The County of Kaua'i Office of the Prosecuting Attorney announces the following indictments
from the September and October 2011 Grand Jury Sessions:
The Grand Jury returned a three count indictment against Hapaki
Mainaaupo, alleging that on September 3, 2011, Mainaaupo committed
the offenses of Harassment, Assault in the Third Degree, and
Terroristic Threatening in the First Degree a by harassing and causing
bodily injury to one individual, and threatening a public servant with
the intent to terrorize. Mainaaupo’s case is set for jury trial on
February 21, 2012.

Stanley Chock
The Grand Jury returned a seven count indictment against Stanley
Chock, alleging that on August 13, 2011, Chock committed the
offenses of two counts of Promoting a Dangerous Drug in the Third
Degree, two counts of Unlawful Use of Drug Paraphernalia, Place to
Keep Ammunition, Prohibited Possession of Firearms, and Prohibited
Possession of Butterfly Knives by possessing methamphetamine, drug
paraphernalia, ammunition, a firearm, and a butterfly knife. Chock’s
Case is set for jury trial on February 13, 2012.
The Grand Jury returned a six count indictment against Timothy
Conwill, alleging that on August 13, 2011, Conwill committed the
offenses of two counts of Promoting a Dangerous Drug in the Third
Degree, two counts of Unlawful Use of Drug Paraphernalia, Place to
Keep Ammunition, and Prohibited Possession of a Firearm by
possessing methamphetamine, drug paraphernalia, ammunition, and a
firearm. Conwill’s case is set for jury trial on February 13, 2012.

The Grand Jury returned a four count indictment against Linda
Dannog, alleging that on August 13, 2011, Dannog committed the
offenses of two counts of Promoting a Dangerous Drug in the Third
Degree and two counts of Unlawful Use of Drug Paraphernalia by
possessing methamphetamine and drug paraphernalia. Dannog’s case
is set for jury trial on February 13, 2012.

John L. Krause
The Grand Jury returned a five count indictment against John L.
Krause, alleging that on July 21, 2011, Krause committed the offenses
of Robbery in the Second Degree, Attempted Theft in the Second
Degree, Attempted Assault in the Third Degree, Assault in the Third
Degree, and Theft in the Fourth Degree by threatening the use of force
while engaged in a theft, causing bodily injury to one person and
attempting to cause bodily injury to another. Krause’s case is set for
jury trial on January 17, 2012.
Rick Trinque
The Grand Jury returned a four count indictment against
Rick Trinque and Miles Martinez, alleging that on March 19, 2009,
Trinque and Martinez each committed the offenses of Commercial
Promotion of Marijuana in the First Degree and Unlawful use of Drug
Paraphernalia by possessing, cultivating, or having under their control
100 or more marijuana plants and possessing drug paraphernalia. Both
Trinque and Martinez’s cases are set for jury trial on February 13,
2012.

Andrew Hall
The Grand Jury returned a six count indictment against
Andrew Hall and Bronson Balino, alleging that on September 10,
2011, Hall and Balino each committed the offenses of Promoting a
Dangerous Drug in the Third Degree, Methamphetamine Trafficking
in the Second Degree, and Unlawful Use of Drug Paraphernalia by
possessing and distributing methamphetamine, and possessing drug
paraphernalia. Hall’s and Balino’s cases are set for jury trial on
January 23, 2012.

Terrance Ceria
The Grand Jury returned an eleven count indictment against
Terrance Ceria, alleging that on July 26, 2011, Ceria committed the
offenses of Methamphetamine Trafficking in the Second Degree,
Promoting a Dangerous Drug in the Third Degree, Promoting a
Harmful Drug in the Fourth Degree, two counts of Unlawful Use of
Drug Paraphernalia, Carrying or Possessing a Loaded Firearm on a
Public Highway, Place to Keep Loaded Firearms, Place to Keep
Unloaded Firearms, Place to Keep Pistol or Revolver, Possession of a
Firearm with Intent to Facilitate the Commission of a Felony Drug
Offense, and Place to Keep Ammunition by distributing
methamphetamine while unlawfully possessing a firearm, possessing
methamphetamine, hydrocodone, drug paraphernalia, loaded firearms,
unloaded firearms, and ammunition. Ceria’s case is set for jury trial on
March 12, 2012.
The Grand Jury returned a two count indictment against
Kaili Ragudo, alleging that on July 26, 2011, Ragudo committed the
offenses of Promoting a Dangerous Drug in the Third Degree and
Unlawful Use of Drug Paraphernalia by possessing methamphetamine
and drug paraphernalia. Ragudo’s case is set for jury trial on March
12, 2012.

Bronson Balino
The Grand Jury returned a seventeen count indictment against
Bronson Balino and Michael N. Montapert, alleging that on August 5,
2011, Balino and Montapert each committed the offenses of
Methamphetamine Trafficking in the Second Degree, Promoting a
Dangerous Drug in the Second Degree, two counts of Promoting a
Dangerous Drug in the Third Degree, Promoting a Harmful Drug in
the Second Degree, and two counts of Unlawful Use of Drug
Paraphernalia, by possessing and distributing methamphetamine, and
by possessing cocaine, oxycodone, hydrocodone, and drug
paraphernalia. Balino was also indicted for one count of Promoting a
Detrimental Drug in the Third Degree for possessing marijuana.
Balino’s case is set for Arraignment and Plea on November 22, 2011.
Montapert’s case is set for jury trial on March 12, 2012.

Ken Yamahiro
The Grand Jury returned an eight count indictment against
Ken Yamahiro and Eric W. M. Rivera, alleging that on August 26,
2011, Yamahiro and Rivera each committed the offenses of
Methamphetamine Trafficking in the Second Degree, Promoting a
Dangerous Drug in the Second Degree, and Unlawful Use of Drug
Paraphernalia by distributing methamphetamine and possessing
methamphetamine and drug paraphernalia. Rivera was also indicted
for one count of Promoting a Dangerous Drug in the Third Degree and
another count of Unlawful Use of Drug Paraphernalia for possessing
methamphetamine and drug paraphernalia. Yamahiro’s and Rivera’s
cases are set for jury trial on March 5, 2012.

The Grand Jury returned an eighteen count indictment against
Ken Yamahiro, alleging that on August 26, 2011, Yamahiro committed
the offenses of two counts of Methamphetamine Trafficking in the
First Degree, seven counts of Promoting a Dangerous Drug in the
Second Degree, and nine counts of Unlawful Use of Drug
Paraphernalia by possessing and distributing methamphetamine; and
possessing drug paraphernalia. Yamahiro’s case is set for jury trial on
March 27, 2012.

The Grand Jury returned a three count indictment against
Eric W. M. Rivera, alleging that on August 26, 2011, Rivera
committed the offenses of Promoting a Dangerous Drug in the Third
Degree, Promoting a Detrimental Drug in the Third Degree and
Unlawful Use of Drug Paraphernalia by possessing methamphetamine,
marijuana, and drug paraphernalia. Rivera’s case is set for jury trial on
March 5, 2012.

The Grand Jury returned a two count indictment against Ramah Wong,
alleging that on May 24, 2011, Wong committed the offenses of
Promoting a Dangerous Drug in the Third Degree and Unlawful Use of
Drug Paraphernalia by possessing methamphetamine and drug
paraphernalia. A warrant was issued for Wong’s arrest and bail was
set at $2,000.00.

The Grand Jury returned a two count indictment against Fred Rivera,
alleging that on August 11, 2011, Rivera committed the offenses of
Promoting a Dangerous Drug in the Third Degree and Unlawful Use of
Drug Paraphernalia by possessing methamphetamine and drug
paraphernalia. A warrant was issued for Rivera’s arrest and bail was
set at $2,000.00.

The Grand Jury returned an eight count indictment against Shan Costa-
Brum, alleging that on August 17, 2011, Costa-Brum committed the
offenses of four counts of Promoting a Dangerous Drug in the Third
Degree and four counts Unlawful Use of Drug Paraphernalia by
possessing methamphetamine and drug paraphernalia. A warrant was
issued for Costa-Brum’s arrest and bail was set at $8,000.00.

Alvin Isobe
The Grand Jury returned a six count indictment against Alvin Isobe
and Joseph K. Rapozo III, alleging that on September 26, 2011, Isobe
and Rapozo each committed the offenses of Theft in the First Degree,
Theft in the Second Degree, and Criminal Property Damage in the
Second Degree by stealing and ATM machine and cash; and damaging
the ATM machine. Isobe and Rapozo’s cases are set for jury trial on
February 27, 2012.

Norman R. Bukoski Jr.
The Grand Jury returned a three count indictment against Norman R.
Bukoski Jr., alleging that on January 19, 2010, Bukoski committed the
offenses of Negligent Homicide in the First Degree, Negligent
Homicide in the Second Degree, and Negligent Injury in the First
Degree by operating his vehicle in a negligent manner while under the
influence of drugs or alcohol, thereby causing the death of Tomas
Garcia Jr. and causing serious bodily injury to Aaron Marvin.
Bukoski’s case is set for jury trial on March 19, 2012.

The Grand Jury returned a two count indictment against Brendan A.
Duarte, alleging that on May 31, 2011, Duarte committed the offenses
of Promoting a Dangerous Drug in the Third Degree and Unlawful Use
of Drug Paraphernalia by possessing methamphetamine and drug
paraphernalia. A warrant was issued for Duarte’s arrest and bail was
set at $20,000.00.

The Grand Jury returned a nine count indictment against Henry N.
Rabot, Shawn Aviguetero, and Alfredo Ascuncion, alleging that on
May 31, 2011: Rabot committed the offenses of two counts of Place to
Keep Unloaded Firearms other than Pistols or Revolvers by unlawfully
possessing two firearms; Aviguetero committed the offenses of Place
to Keep Unloaded Firearms other than Pistols or Revolvers, Place to
Keep Ammunition, and Permit to Acquire Firearm by unlawfully
possessing a firearm, and ammunition, and acquiring the firearm
without a proper permit; Ascuncion committed the offenses of Place to
Keep Unloaded Firearms other than Pistols or Revolvers, Place to
Keep Ammunition, and two counts of Felon in Possession of Firearms
by unlawfully possessing firearms and ammunition as a convicted
felon . Rabot’s, Aviguetero’s, and Ascuncion’s cases are set for jury
trial on March 19, 2012.

The Grand Jury returned a ten count indictment against David Borges,
alleging that: on October 8, 2011, Borges committed the offenses of
Robbery in the Second Degree, Assault in the Third Degree, and
Unauthorized Entry into a Motor Vehicle in the First Degree by using
force against a person to commit a theft, causing bodily injury to
another, and unlawfully entering a motor vehicle: on October 9, 2011,
Borges committed the offense of Assault in the Second Degree by
causing bodily injury to another with a dangerous instrument; on
October 12, 2011, Borges committed the offenses of Reckless Driving,
Accidents Involving Damage to Vehicle or Property, Promotion of a
Dangerous Drug in the Third Degree, Unlawful Use of Drug
Paraphernalia, and Prohibitions Related to Butterfly Knives by driving
recklessly, failing to stop after an accident involving property damage,
and possessing methamphetamine, drug paraphernalia, and a butterfly
knife. Borges’s case is set for jury trial on February 27, 2012.
The Grand Jury returned a two count indictment against Donald
Kagawa, alleging that on December 17, 2010, Kagawa committed the
offenses of Terroristic Threatening in the First Degree and Criminal
Trespass onto Public Parks and Recreational Grounds by threatening to
cause bodily injury to a public servant and remaining unlawfully in a
public park or recreational ground after a law enforcement officer
requested that he leave. Kagawa’s case is set for jury trial on March
19, 2012.
The Grand Jury returned an eight count indictment against Shan Costa-
Brum and Jasmine Duque, alleging that on June 3, 2011, Costa-Brum
committed the offenses two counts of Promoting a Dangerous Drug in
the Third Degree, two counts of Unlawful Use of Drug Paraphernalia,
Tampering with Physical Evidence, and Failure to Possess Insurance
Identification Card by possessing methamphetamine and drug
paraphernalia, tampering with a glass pipe, and failing to possess a
motor vehicle insurance card. The Grand jury also indicted Jasmine
Duque, alleging that on June 3, 2011, Duque committed the offenses of
Promoting a Dangerous Drug in the Third Degree and Unlawful Use of
Drug Paraphernalia by possessing methamphetamine and drug
paraphernalia. Warrants were issued for Costa-Brum’s and Duque’s
arrest. Bail was set at $4,100.00 for Costa-Brum and $2,000 for
Duque.

Joycelynn Kanahele
The Grand Jury returned a four count indictment against Nolan
Kawika Keola-Kaleimamahu, alleging that on September 26, 2011,
Keola-Kaleimamahu committed the offenses of Obstructing
Government Operations, Resisting Arrest, and two counts of Assault
Against a Law Enforcement Officer in the Second Degree by using
force against a law enforcement officer to hinder government
operations, resisting arrest, and causing bodily injury to two police
officers. A warrant was issued for Keola-Kaleimamahu’s arrest and
bail was set at $6,250.00.
The Grand Jury returned a four count indictment against Joycelynn
Kanahele, alleging that on August 13, 2011, Kanahele committed the
offenses of Burglary in the First Degree, Unauthorized Entry into a
Dwelling, Abuse of Family or Household Members, and Criminal
Property Damage in the Fourth Degree by unlawfully entering a
residence with the intent to commit a crime, abusing a family or
household member, and damaging the property of another. Kanahele’s
case is set for jury trial on February 27, 2012.
The Grand Jury returned a one count indictment against Jonie Ragasa,
alleging that on March 31, 2011, Ragasa committed the offenses of
Criminal Property Damage in the Second Degree by damaging the
property of another exceeding $1,500.00. A bench warrant was issued
for Ragasa, who is ordered to be released on recognizance when the
warrant is served.

The Grand Jury returned a three count indictment against Timothy
Conwill, alleging that on December 10, 2009, Conwill committed the
offenses of Methamphetamine Trafficking in the Second Degree,
Promoting a Dangerous Drug in the Third Degree, and Unlawful Use
of Drug Paraphernalia by distributing and possessing
methamphetamine, and possessing drug paraphernalia. Conwill’s case
is set for jury trial on March 19, 2012.

The Grand Jury returned a two count indictment against Joel Acoba
Jose, alleging that on September 12, 2011, Jose committed the offenses
of two counts of Sexual Assault in the Third Degree by having sexual
contact with two persons under fourteen years old. Jose’s case is set
for jury trial on March 5, 2012.

The Grand Jury returned a two count indictment against Samiuela
Moala, alleging that on October 24, 2011, Moala committed the
offenses of Arson in the First Degree and Reckless Endangering in the
First Degree by setting a fire that placed another person or persons in
danger of death or bodily injury. Moala’s case is set for jury trial on
March 5, 2012.

The Grand Jury returned a twelve count indictment against Robin
Servantes, Tricia Rosa, Joseph K. Rapozo III, and Shauday Ragudo,
alleging that on July 30, 2011, Servantes, Rosa, Rapozo, and Ragudo
each committed the offenses of Promoting a Dangerous Drug in the
Third Degree, Promoting a Detrimental Drug in the Third Degree, and
Unlawful Use of Drug Paraphernalia by possessing methamphetamine,
marijuana, and drug paraphernalia. Warrants were issued for
Servantes, Rosa, Rapozo, and Ragudo with bail set at $5,000.00 each.
