Introducti<strong>on</strong><br />
<strong>Council</strong> <strong>Tax</strong> is charged <strong>on</strong> the basis that there are two adults aged 18 or<br />
over living in a property. If there are more than two adults resident, the bill<br />
is not increased. However, if there are less than two adults, a <str<strong>on</strong>g>discount</str<strong>on</strong>g> can<br />
be claimed.<br />
1. Sole Occupier Discount<br />
If there is <strong>on</strong>ly <strong>on</strong>e pers<strong>on</strong> living in a property, a 25% <str<strong>on</strong>g>discount</str<strong>on</strong>g> can be claimed.<br />
2. Are all the adults living in a property counted?<br />
No, we do not count some adults when working out how many adults live in<br />
a property. This means that even if there are two or more adults living in a<br />
property, you can still receive a <str<strong>on</strong>g>discount</str<strong>on</strong>g>.<br />
When looking at the number of adults resident in a property, certain people<br />
are not counted (see secti<strong>on</strong> 3 “Who is not counted?”). If people in a<br />
property are not counted, a 25% or even a 50% <str<strong>on</strong>g>discount</str<strong>on</strong>g> can be granted,<br />
even if more than <strong>on</strong>e pers<strong>on</strong> lives there. See examples below.<br />
Example 1:<br />
There are four adults living here. Emma is not counted as she is a student.<br />
Mark is not counted as he is an apprentice. There are still two adults<br />
counted so no <str<strong>on</strong>g>discount</str<strong>on</strong>g> applies.<br />
Example 2:<br />
Shar<strong>on</strong> T<strong>on</strong>y Mark Emma<br />
Dave Sarah John<br />
There are three adults living here. John is not counted, as he’s a Youth<br />

Training trainee. Sarah is not counted as she is a Student Nurse. One adult<br />
is counted, so a 25% <str<strong>on</strong>g>discount</str<strong>on</strong>g> will apply.<br />
Example 3:<br />
Liz<br />
Debbie<br />
There are two adults living here, Liz is not counted as she is severely<br />
mentally impaired. Debbie is not counted as she is her carer. N<strong>on</strong>e of the<br />
adults living at the property are counted, so a 50% <str<strong>on</strong>g>discount</str<strong>on</strong>g> will apply.<br />
3. Who is not counted?<br />
Carers<br />
You will not be counted if you live with, and care for a pers<strong>on</strong> with a<br />
disability who is receiving <strong>on</strong>e of certain allowances or disablement<br />
pensi<strong>on</strong>s. You must be providing care for at least 35 hours a week <strong>on</strong><br />
average. But you will be counted if you are caring for <strong>your</strong> husband, wife or<br />
civil partner (or partner with whom you live with as husband, wife or civil<br />
partner), or <strong>your</strong> child under 18 years old.<br />
People who are severely mentally impaired<br />
People who are severely mentally impaired are not counted. For council tax<br />
purposes, a pers<strong>on</strong> is regarded as severely mentally impaired if he or she<br />
has, for whatever reas<strong>on</strong>, severe impairment of intelligence and social<br />
functi<strong>on</strong>ing which appears <str<strong>on</strong>g>to</str<strong>on</strong>g> be permanent. This will usually include<br />
people with Alzheimer’s Disease or similar illnesses.<br />
In order not <str<strong>on</strong>g>to</str<strong>on</strong>g> be counted, a pers<strong>on</strong> will need a certificate from his or her<br />
doc<str<strong>on</strong>g>to</str<strong>on</strong>g>r <str<strong>on</strong>g>to</str<strong>on</strong>g> say that he or she is severely mentally impaired. The pers<strong>on</strong><br />
must also be entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>on</strong>e of a number of benefits including certain<br />
incapacity benefits, disability allowances, unemployment allowances or<br />
attendance allowances.<br />
Child Benefit<br />
You will also not be counted if you are at least 18 years old and some<strong>on</strong>e is<br />
receiving child benefit for you, or would be if you were not in local<br />
authority care.<br />

If you are under 20 and left school after 30 April, you will not be counted<br />
until 1 November of the same year. (You may c<strong>on</strong>tinue <str<strong>on</strong>g>to</str<strong>on</strong>g> get a <str<strong>on</strong>g>discount</str<strong>on</strong>g> as<br />
a student if you go <strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> further educati<strong>on</strong>).<br />
Apprentices<br />
You will not be counted if you are an apprentice employed <str<strong>on</strong>g>to</str<strong>on</strong>g> learn a job,<br />
and, as part of that learning, are undertaking training leading <str<strong>on</strong>g>to</str<strong>on</strong>g> a<br />
qualificati<strong>on</strong> recognised by the Nati<strong>on</strong>al <strong>Council</strong> for Vocati<strong>on</strong>al<br />
Qualificati<strong>on</strong>s. You must be paid no more than £195 per week (before tax).<br />
Youth Training trainees<br />
You will not be counted if you are under 25 and are receiving training which<br />
is funded by the Learning and Skills <strong>Council</strong> for England in line with an<br />
individual training plan under the Youth Training Scheme, such as TCT,<br />
Opti<strong>on</strong>s, Future and Next Step.<br />
Students<br />
You will not be counted if you are a student (or an overseas student) <strong>on</strong> a<br />
full-time or qualifying course of educati<strong>on</strong>.<br />
You are a student if you are:<br />
• attending a university or college course which lasts for at least an<br />
academic year, takes at least 24 weeks a year and involves at least 21<br />
hours of study per week during term-time; or<br />
• Under the age of 20 years and remain in further educati<strong>on</strong>. The course<br />
must last for at least 3 m<strong>on</strong>ths during which the student is required <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
study for more than 12 hours per week. Corresp<strong>on</strong>dence courses,<br />
evening classes, or courses taken in c<strong>on</strong>necti<strong>on</strong> with a pers<strong>on</strong>'s job,<br />
such as <strong>on</strong> day-release are not included<br />
• Student nurses studying academic courses at university or who are <strong>on</strong><br />
Project 2000 courses, are classed as students for council tax purposes<br />
• Foreign language assistants registered with the Central Bureau for<br />
Educati<strong>on</strong>al Visits and Exchanges are also treated as students.<br />
You will not be counted if you are the spouse or dependant of a student, are<br />
not a British Citizen, and are prevented by the terms of <strong>your</strong> permissi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
be in the UK either from taking paid employment or from <str<strong>on</strong>g>claiming</str<strong>on</strong>g> benefits.<br />

Student nurses<br />
You will not be counted if you are a student nurse <strong>on</strong> a course leading <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
registrati<strong>on</strong> <strong>on</strong> any of Parts 1 <str<strong>on</strong>g>to</str<strong>on</strong>g> 6, or 8 of the nursing register. Only student<br />
nurses studying for their first inclusi<strong>on</strong> <strong>on</strong> the register are not counted.<br />
Nurses who are already <strong>on</strong> the register or are taking further courses are<br />
counted. Student nurses studying academic courses at university or who<br />
are <strong>on</strong> Project 2000 courses, are excluded from the definiti<strong>on</strong> as they are<br />
c<strong>on</strong>sidered as students.<br />
Resident hospital patients<br />
You will not be counted if you are a patient in a hospital which is <strong>your</strong> <strong>on</strong>ly or<br />
main home. If you are in hospital for a short time and you have a home<br />
elsewhere, you will carry <strong>on</strong> paying council tax at <strong>your</strong> home.<br />
People living in Residential Care Homes, Nursing Homes, Mental Nursing<br />
Homes and Hostels providing a high level care<br />
You will not be counted if you live, and are receiving care, in <strong>on</strong>e of these<br />
homes or hostels, as l<strong>on</strong>g as it’s <strong>your</strong> <strong>on</strong>ly or main home.<br />
People staying in certain hostels or night shelters<br />
A pers<strong>on</strong> whose main or <strong>on</strong>ly residence is in a property such as a short stay<br />
hostel or night shelter providing communal accommodati<strong>on</strong> for people who<br />
have no fixed abode and no settled way of life is not counted. These may<br />
include hostels run by the Salvati<strong>on</strong> Army or Church Army.<br />
People in Pris<strong>on</strong><br />
Pris<strong>on</strong>ers who are <strong>on</strong> remand or in pris<strong>on</strong> are not counted. However,<br />
people who are impris<strong>on</strong>ed for not paying a fine or their council tax or<br />
community charge are counted.<br />
Members of religious communities<br />
You will not be counted if you are a member of a religious community,<br />
provided that you depend <strong>on</strong> the community for <strong>your</strong> material needs and<br />
have no pers<strong>on</strong>al income or capital, for example m<strong>on</strong>ks and nuns etc<br />
Only members of religious communities whose main work is prayer,<br />
c<strong>on</strong>templati<strong>on</strong>, the relief of suffering, educati<strong>on</strong> or any combinati<strong>on</strong> of these<br />
are not counted.<br />

Foreign Diplomats<br />
This applies <str<strong>on</strong>g>to</str<strong>on</strong>g> any pers<strong>on</strong> who has diplomatic privileges and immunities.<br />

Dependants) of Internati<strong>on</strong>al Headquarters and Defence Organisati<strong>on</strong>s<br />

5. How do I apply?<br />
The pers<strong>on</strong> resp<strong>on</strong>sible for paying the <strong>Council</strong> <strong>Tax</strong> must apply in writing.<br />
Forms are available at all of the One S<str<strong>on</strong>g>to</str<strong>on</strong>g>p Shops, from our website or you<br />
can teleph<strong>on</strong>e our C<strong>on</strong>tact Centre and ask for a form.<br />
6. How l<strong>on</strong>g will the <str<strong>on</strong>g>discount</str<strong>on</strong>g> last?<br />
If a <str<strong>on</strong>g>discount</str<strong>on</strong>g> is granted, it will last as l<strong>on</strong>g as the qualifying c<strong>on</strong>diti<strong>on</strong>s are<br />
met. If <strong>your</strong> circumstances change you must c<strong>on</strong>tact us straight away.<br />
7. If I am unhappy with <strong>your</strong> decisi<strong>on</strong>, can I appeal?<br />
If <strong>your</strong> <str<strong>on</strong>g>discount</str<strong>on</strong>g> applicati<strong>on</strong> is refused you can appeal against our decisi<strong>on</strong>.<br />
Your appeal must be made in writing direct <str<strong>on</strong>g>to</str<strong>on</strong>g> us. You must give the<br />
reas<strong>on</strong>s for <strong>your</strong> appeal and provide any supporting evidence.<br />
We will look at our decisi<strong>on</strong> again and let you know if we are going <str<strong>on</strong>g>to</str<strong>on</strong>g> allow<br />
<strong>your</strong> appeal. If we decide not <str<strong>on</strong>g>to</str<strong>on</strong>g> allow <strong>your</strong> appeal, you have a right of<br />
further appeal <str<strong>on</strong>g>to</str<strong>on</strong>g> an independent tribunal.<br />
