has found a deterrent effect to <strong>the</strong> <strong>death</strong> <strong>penalty</strong>, but <strong>the</strong>se studies have been heavily<br />

criticized or are very recent and have not been appropriately scrutinized. Some<br />

studies have found an increase in <strong>the</strong> homicide rate after an execution (called <strong>the</strong><br />

"brutalization effect"). These studies are also not agreed with by <strong>the</strong> majority <strong>of</strong><br />

social scientists.<br />

Issue 6. Whe<strong>the</strong>r states that have <strong>the</strong> <strong>death</strong> <strong>penalty</strong> treat murder victims’ families who<br />

oppose <strong>the</strong> <strong>death</strong> <strong>penalty</strong> <strong>the</strong> same as murder victims’ families who favor <strong>the</strong> <strong>death</strong> <strong>penalty</strong>.<br />

The Committee has found no evidence <strong>of</strong> discriminatory treatment in Kansas<br />

<strong>of</strong> murder victims’ families who oppose <strong>the</strong> <strong>death</strong> <strong>penalty</strong>. In <strong>the</strong> courtroom at a<br />

capital trial, victims’ families who support and who oppose <strong>the</strong> <strong>death</strong> <strong>penalty</strong> are<br />

generally treated equally in states that have <strong>the</strong> <strong>death</strong> <strong>penalty</strong>. Outside <strong>the</strong> courtroom,<br />

in states o<strong>the</strong>r than Kansas, victims’ families who are opponents <strong>of</strong> <strong>the</strong> <strong>death</strong> <strong>penalty</strong><br />

appear to have been denied equal information and assistance in <strong>the</strong> capital trial<br />

process.<br />
