“adverse effects of environmental damage” be used instead. This<br />

can still be interpreted to include more than environmental damage<br />

itself.<br />

The call for States to cooperate in a “more determined manner” to<br />

develop further international law on this subject was the PrepCom<br />

Chairman’s text.<br />

The increasing realisation that environmental planning is an essential<br />

component in the formulation of development policies <strong>and</strong> in project<br />

planning has resulted in various laws <strong>and</strong> st<strong>and</strong>ards at the domestic<br />

level. Imposing liability on offenders who pollute the environment<br />

<strong>and</strong> ensuring compensation for victims of environmental damage are<br />

also critical aspects in the management of natural resources <strong>and</strong> the<br />

environment. The “polluter pays” approach incorporated in Principle<br />

16 is a small step forward. In this respect, questions relating to locus<br />

st<strong>and</strong>i (st<strong>and</strong>ing to take legal action), burden of proof, limitation<br />

periods <strong>and</strong> effective remedies have to be fundamentally reviewed<br />

to ensure that victims of environmental damage can have effective<br />

remedies <strong>and</strong> redress.<br />

At the same time, the transboundary nature of almost all environmental<br />

problems also dem<strong>and</strong>s that regional <strong>and</strong> international rules <strong>and</strong><br />

st<strong>and</strong>ards be evolved which can effectively <strong>and</strong> equitably apportion<br />

responsibility among states. However, there is little sign of progress<br />

in this area.<br />

Principle 14<br />

States should effectively cooperate to discourage or prevent<br />

the relocation <strong>and</strong> transfer to other States of any activities <strong>and</strong><br />

substances that cause severe environmental degradation or are<br />

found to be harmful to human health.<br />
