10. ENVELOPE-II (Commercial Offer): The Commercial Offer must be given in a sealed envelope. Interested bidders are allowed to quote Price must be filled in completely, without any errors, erasures or alterations on company/manifacture/agencies letter head in “Annexure-H Price Schedule”. Tenderer should quote all-inclusive Price i.e. inclusive of Supply, Installation and Warranty, taxes and duties etc. Commercial Envelopes should be put and sealed in a single envelope marked as "Commercial Envelope" 11. Erasures or Alterations and Signing of Tender Offers The original copy of the Tender Offer shall be signed by the Tenderer or a person duly authorized in writing. Such authorization shall be indicated by power-of-attorney accompanying the tender offer. All pages of the Tender Offer, except for un amended printed literature, shall be initialed by the person signing the Tender Offer. This will be in two different envelopes. 12. Fixed Price The Commercial Offer shall be on a fixed price basis, inclusive of all taxes. No price variation should be asked for relating to increase. 13. Late Tender Offers Any tender offer received by the purchaser after the deadline prescribed for submission of the same, pursuant to the clause above, will not be entertained. 14. Modification and Withdrawal of Offers The Tenderer may modify or withdraw his offer after its submission, provided that written notice of the modification or withdrawal is received by the Purchaser prior to the closing date and time prescribed for submission of offers. No offer can be modified by the Tenderer, subsequent to the closing date and time for submission of offers. 15. Purchaser's Right to : The Purchaser reserves the right to accept or reject any tender or all tenders offer, at any time prior to award of contract, without thereby incurring any liability. 18. No commitment to accept lowest or any tender The Purchaser shall be under no obligation to accept the lowest or any other offer received in response to this tender notice and shall be entitled to reject any or all offers, including those received late, or incomplete, without assigning any reason therefore. The Purchaser reserves the right to make any changes in the terms and conditions of Purchase. The Purchaser will not be obliged to meet and have discussions with any Tenderer, and / or to give a hearing on their representations. 19. Corrupt or fraudulent Practices The Purchaser requires that the Tenderers under this tender observe the highest standards of ethics during the procurement and execution of such contracts. a) “corrupt practice” means the offering, giving, receiving or soliciting of any thing of value to influence the action of the public official in the procurement process or in contract execution; and b) Tenderers themselves or their representative seen this office after submitting the tender and before the result of it will be construed as an effort for corrupt practice. c) Any document favoring Tenderer seen in the concern file which has not been submitted officially and following the procedure, both the Tenderer and the public official will be considered to be indulged in to the corrupt practice and fraudulence. d) In the event of corrupt practice and fraudulence in addition to penal action as per the terms and conditions of the contract as well as legal action shall be initiated against the concerned. . 20. Signing of Contract The successful Tenderer shall sign the agreement Annexure-F (DRAFT CONTRACT FORM) within seven days from the date of the issue of the Letter. T his office reserves the right to grant an extension on satisfaction of the circumstances and reasons given. On failure of execution of the agreement by the successful Tenderer, E.M.D. furnished will be forfeited. TERMS AND CONDITIONS OF CONTRACT 1. The EMD / Bid Security may be forfeited: a) If a Tenderer withdraws its tender during the period of bid or b) In case of a successful Tenderer, fails: i) to execute the agreement / contract within 7 days from the date of the issue of the Letter. ii.) to submit Security Deposit as specified in the terms and conditions 2. Performance Bank Guarantee : The performance guarantee of Rs. 2 5 , 0 0 0 / - valid for One years after the date of Installation and Commissioning in the format specified in Performance Security Form (Annexure-G) provided in the tender document. The proceeds of the performance guarantee shall be payable to the purchaser as compensation for any loss / penalties / liquidated damages resulting from the vendor's failure to complete its obligations under the contract. The performance guarantee will be discharged and returned to the following the date of completion of the vendor's performance obligations, including any warranty obligations under the Contract. 3. Quality of Goods The equipment must conform to the highest quality and standard. Vendor should guarantee that the items delivered are brand new. Vendor should guarantee that the software supplied to the Indentor is licensed and legally obtained. All hardware and software must be supplied with their original and complete printed documentation. All the required quantity of an item in schedule of requirement must be of the same brand and same model number. Part numbers also must be same for all pieces of an item. The Vendor should not substitute any internal components or subsystems of equipment by similar items from a different manufacturer. 4. Inspection The Vendor will have to submit in detail Quality Control Procedures and standards adopted in the manufacturing process. Pre-dispatch inspection will be carried out by DIO NIC Aurangabad. The Collector & Chairman reserves the right to decide the method and intensity of the sampling to be adopted. Only on the satisfaction after tests, will be accepted.
