INTRODUCTION<br />

The <strong>National</strong> <strong>University</strong> <strong>of</strong> <strong>Singapore</strong> (NUS) was formally established in 1980 with the merger <strong>of</strong><br />

the <strong>University</strong> <strong>of</strong> <strong>Singapore</strong> and the Nanyang <strong>University</strong>. Its history can, however, be traced back<br />

to 1905, when <strong>Singapore</strong>’s first centre <strong>of</strong> higher education, the King Edward VII College <strong>of</strong> Medicine,<br />

was established. The NUS is a comprehensive university <strong>of</strong>fering a wide range <strong>of</strong> undergraduate<br />

and graduate studies, and has more than 30,000 students. NUS has maintained its position in the<br />

top quartile <strong>of</strong> the world’s best 100 universities in a global ranking by The Times <strong>of</strong> London in<br />

2005.<br />

The NUS <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong> is one <strong>of</strong> the finest law schools in the world, and is widely regarded as<br />

Asia’s leading law school. Staffed by an outstanding permanent faculty with law degrees from<br />

more than a dozen jurisdictions, the law school is an institution dedicated to building a community<br />

and an environment in which faculty and students can discuss and reflect on the fundamental<br />

legal issues that affect societies in today’s globalised world. The <strong>Faculty</strong> is also the only law<br />

school in <strong>Singapore</strong> and is responsible for producing the majority <strong>of</strong> entrants to the legal pr<strong>of</strong>ession.<br />

The LLB law degree is a four-year one, where students study a mixture <strong>of</strong> core and optional law<br />

subjects as well as some non-law options. A limited number <strong>of</strong> students who already have a first<br />

degree in another discipline are also admitted each year, and they complete their LLB degree<br />

in three years. <strong>Law</strong> graduates who wish to practice law have to go on to do a practical Bar course<br />

and serve a period <strong>of</strong> pupillage.<br />

The <strong>Law</strong> <strong>Faculty</strong> has attained an impressive reputation in mooting and debating, and it is the only<br />

law school in the world to have won the Philip C Jessup International <strong>Law</strong> Moot Court Competition<br />

four times.<br />

The <strong>Faculty</strong> has produced prominent judges, lawyers and legal academics. Its graduates have also<br />

become successful in diverse fields ranging from the civil service, diplomacy and politics, to<br />

drama, dance and publishing.<br />

In addition to the LLB programme, a range <strong>of</strong> postgraduate qualifications by coursework and<br />

research are also available. Apart from the general LLM coursework programme, there are also<br />

specialist LLM coursework programmes in the areas <strong>of</strong> Corporate & Financial Services <strong>Law</strong>;<br />

Intellectual Property & Technology <strong>Law</strong>; International & Comparative <strong>Law</strong>; Chinese <strong>Law</strong>; and<br />

International Business <strong>Law</strong> which is the first overseas degree programme <strong>of</strong>fered by the <strong>Faculty</strong><br />

<strong>of</strong> <strong>Law</strong> where students enrolled in the one-year programme spend the first nine weeks at NUS<br />

and the rest <strong>of</strong> the time in Shanghai, China. In February 2006, the NUS <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong> and New<br />

York <strong>University</strong> School <strong>of</strong> <strong>Law</strong> signed a Memorandum <strong>of</strong> Understanding to <strong>of</strong>fer a dual LLM degree<br />

programme which will commence in May 2007 in NUS. The postgraduate population is a cosmopolitan<br />

one, with students from Asia, Europe, North and South America, Africa and Oceania.<br />

The <strong>Faculty</strong> produces two journals, the <strong>Singapore</strong> Journal <strong>of</strong> Legal Studies and the <strong>Singapore</strong> Year<br />

Book <strong>of</strong> International <strong>Law</strong>, the latter formerly known as the <strong>Singapore</strong> Journal <strong>of</strong> International<br />

and Comparative <strong>Law</strong>. The <strong>Faculty</strong> has two centres, the Asia-Pacific Centre for Environmental<br />

<strong>Law</strong> (APCEL) and the Centre for Commercial <strong>Law</strong> Studies (CCLS), and also hosts the Asian <strong>Law</strong><br />

Institute (ASLI) which was established in March 2003 by a group <strong>of</strong> leading law schools in Asia.<br />

ASIA-PACIFIC CENTRE FOR ENVIRONMENTAL LAW (APCEL)<br />

Established in February 1996 by the <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong>, <strong>National</strong> <strong>University</strong> <strong>of</strong> <strong>Singapore</strong>, at the initiative<br />

<strong>of</strong> the <strong>Faculty</strong> and the World Conservation Union - Commission on Environmental <strong>Law</strong> (IUCN-CEL), and<br />

in collaboration with the United Nations Environment Programme (UNEP), APCEL was launched on 1<br />

July <strong>of</strong> the same year. The initiative was in response to the call in Agenda 21 to build capacity in<br />

environmental law and to promote awareness <strong>of</strong> environmental issues. APCEL has established itself<br />

as a centre <strong>of</strong> excellence in the region for capacity-building in environmental law, and is highly<br />

regarded worldwide.<br />

The objectives <strong>of</strong> APCEL are:<br />

• To serve as a regional training centre for the teaching <strong>of</strong> environmental law;<br />

• To organise conferences, seminars and other programmes on environmental issues;<br />

• To serve as a regional centre for research, including multi-disciplinary research on<br />

international, regional and national environmental law and policy;<br />

• To establish and develop a collection <strong>of</strong> materials on environmental law and policy,<br />

and maintain an electronic database;<br />

• To promote the exchange <strong>of</strong> information on international, regional and national<br />

environmental law and policy;<br />

• To publish studies, reports and course materials on international, regional and national<br />

environmental law and policy;<br />

• To cooperate and collaborate with law schools, institutes, centres and such other<br />

organisations to further its objectives; and<br />

• To undertake such other programmes and activities as the Executive Committee<br />

may determine from time to time.<br />

To further its objectives, an MOU was signed with IUCN on Capacity-Building for Environmental Legal<br />

Education in the Asia and Pacific Region and on Environmental <strong>Law</strong> Information System. APCEL has<br />

also signed MOUs with the Center for Environmental Legal Studies <strong>of</strong> the School <strong>of</strong> <strong>Law</strong> <strong>of</strong> Pace<br />

<strong>University</strong>, and with Macquarie <strong>University</strong>’s Centre for Environmental <strong>Law</strong>, (MU-CEL) both <strong>of</strong> which<br />

relate to Cooperation in Teaching and Research in the Field <strong>of</strong> Environmental <strong>Law</strong>. It has also signed<br />

a three-party MOU with MU-CEL and World Wide Fund for Nature-India.<br />

Since its establishment, it has organised numerous activities on its own as well as in collaboration with<br />

other international and local organisations such as the Asian Development Bank (ADB), IUCN-CEL,<br />

UNEP, International Maritime Organisation (IMO), United Nations Development Program (UNDP), Mekong<br />

Region <strong>Law</strong> Center, United Nations <strong>University</strong> (UNU), United States-Asia Environmental Partnership<br />

(US-AEP), Center for Environmental Legal Studies <strong>of</strong> Pace <strong>University</strong>, Southeast Asian Program on<br />

Ocean <strong>Law</strong> Policy and Management (SEAPOL), Regional Institute <strong>of</strong> Environmental Technology (RIET),<br />

<strong>Singapore</strong> Ministry <strong>of</strong> the Environment (ENV), Maritime and Port Authority <strong>of</strong> <strong>Singapore</strong> (MPA), <strong>Singapore</strong><br />

Ministry <strong>of</strong> Foreign Affairs (MFA) and the Institute <strong>of</strong> Policy Studies (IPS) and the United Nations Institute<br />

for Training and Research (UNITAR). These activities include conferences, seminars, forums, workshops<br />

and training courses on various topics such as trade and the environment, marine pollution, environmental<br />

legislation on sustainable development, and teaching environmental law at university level in the Asia-<br />

Pacific region.<br />

CENTRES<br />

CAPACITY BUILDING<br />

APCEL has continued to take a leadership role and has been recognized worldwide as a premier<br />

environmental law centre. In 2005, three <strong>of</strong> its members, KL Koh, LH Lye and Simon SC Tay, were<br />

invited to teach in leading universities in Australia, Mexico and the United States <strong>of</strong> America. The<br />

courses were in Comparative Environmental <strong>Law</strong>, Asia-Pacific Environmental <strong>Law</strong>, WTO and Sustainable<br />

Development, International Environmental <strong>Law</strong> with focus on ASEAN, and Critical Issues in Environmental<br />

<strong>Law</strong> in South East Asia.<br />

APCEL has continued to organise seminars for the <strong>Singapore</strong> Ministry <strong>of</strong> Foreign Affairs for senior<br />

<strong>of</strong>ficials in developing countries. In 2005, APCEL organised a 5-day seminar on Urban and Industrial<br />

Environmental Management (19-25 April 2005). The purpose was to build capacity in urban and industrial<br />

environmental management. The main objective was to enable administrators and managers <strong>of</strong> urban<br />

and industrial environmental management from developing countries to learn and exchange skills and<br />

techniques in urban and industrial management. This was the eighth in a series <strong>of</strong> such courses. The<br />

participants were senior administrators from 15 countries: China, Indonesia, Jordon, Macedonia, Malta,<br />

Mauritius, Mexico, Romania, Samoa, Saudi Arabia, Serbia and Montenegro, Syria, Thailand and Timor-<br />

Leste. This was a multidisciplinary course and the following APCEL members conducted some <strong>of</strong> the<br />

seminars: Pr<strong>of</strong> KL Koh, Assoc Pr<strong>of</strong> LH Lye, Assoc Pr<strong>of</strong> P Lakshmikanth, Assoc Pr<strong>of</strong> R Beckman and Assoc<br />

Pr<strong>of</strong> V Ramraj. Pr<strong>of</strong> KL Koh was the course co-ordinator.<br />

At the invitation <strong>of</strong> the Ministry <strong>of</strong> Environment and Water Resources (MEWR) and the <strong>Singapore</strong><br />

Environment Institute (SEI), APCEL conducted a 2-day course on “Understanding Environmental <strong>Law</strong>s:<br />

The <strong>Singapore</strong> and International Perspectives”, 21-22 July 2005. This is a continuation <strong>of</strong> a series <strong>of</strong><br />

capacity building courses which started from 1997. Pr<strong>of</strong> KL Koh, Assoc Pr<strong>of</strong> LH Lye, Assoc Pr<strong>of</strong> KJ Tan<br />

and Asst Pr<strong>of</strong> LT Lim conducted this course.<br />

In August 2005, the School <strong>of</strong> Design and Environment, NUS organized the Environmental Management<br />

Executive Programme. Three APCEL members, Pr<strong>of</strong> KL Koh, Assoc Pr<strong>of</strong> LH Lye and Assoc Pr<strong>of</strong> Michael<br />

Ewing Chow conducted seminars on environmental law for a specially organised programme on<br />

Environmental Management for some thirty top <strong>of</strong>ficials from the MEWR, including the Permanent<br />

Secretary <strong>of</strong> MEWR, Mr Tan Yong Soon. The course was held at the SDE (School <strong>of</strong> Design and<br />

Environment), which hosts the MSc (Env Mgt) programme. The course was a great success and it was<br />

highly recommended by the participants, for other government agencies. The participants included<br />

the Permanent Secretary <strong>of</strong> the Ministry, directors and deputy directors, heads <strong>of</strong> department, chief<br />

executives from MEWR, NEA (<strong>National</strong> Environment Agency) and PUB (Public Utilities Board).<br />

CENTRES<br />

On 28 October 2005, eight <strong>Singapore</strong> organisations and institutions, including APCEL, entered into a<br />

Memorandum <strong>of</strong> Understanding (MOU) to formalise their commitment to jointly promote <strong>Singapore</strong>’s<br />

capacity-building efforts through environmentally-related training and technology transfer to the<br />

region and beyond, under the <strong>Singapore</strong> Environmental Training Programme (SETP). “No single<br />

organisation holds all the answers to the environmental issues that we face. While sharing knowledge<br />

with our counterparts in other countries is important, it is also important for us to share among<br />

ourselves so that we can have a more integrated understanding <strong>of</strong> the <strong>Singapore</strong>’s environmental<br />

experience and leverage on each other’s strengths and expertise. <strong>Singapore</strong> has learnt and benefited<br />

from the sound environmental practices <strong>of</strong> many countries. While we still have much to learn, we are<br />

now in a position to share our unique experiences with our neighbours and friends,” said Mr Lee Yuen<br />

Hee, CEO <strong>of</strong> the <strong>National</strong> Environment Agency, in his address at the MOU signing ceremony held at<br />

APCEL members have been represented in numerous conferences on critical environmental issues.<br />

They have attended conferences not only in <strong>Singapore</strong> but also in Australia, Belgium, Brazil, Cambodia,<br />

Hong Kong, Mexico, Japan and the United States <strong>of</strong> America (see listings by individual APCEL members<br />

RESEARCH<br />

APCEL members have been robust in their research activities and have engaged in many cutting-edge<br />

issues in environmental law (see listings by individual APCEL members, infra)<br />

OTHER ACTIVITIES<br />

i. Teaching the MSc (Env Mgt) & other NUS Programmes, 2005:<br />

- Teaching Environmental <strong>Law</strong> in the MSc (Env Mgt) Programme<br />

Apart from the teaching <strong>of</strong> law students in the <strong>Law</strong> <strong>Faculty</strong>, APCEL continues to play an active<br />

role in this graduate programme, now in its fifth year, hosted by the School <strong>of</strong> Design and the<br />

Environment. APCEL members teach in the compulsory core course, “Environmental <strong>Law</strong>”<br />

(LX5130), and Assoc Pr<strong>of</strong> LH Lye continues to chair the Programme Management Committee.<br />

Teaching staff involved are: Assoc Pr<strong>of</strong> R. Beckman, Asst Pr<strong>of</strong> Michael Ewing-Chow, Pr<strong>of</strong> KL Koh,<br />

Asst Pr<strong>of</strong> LT Lim, Assoc Pr<strong>of</strong> LH Lye, Asst Pr<strong>of</strong> Burton Ong and Assoc Pr<strong>of</strong> Alan KJ Tan.<br />

- Teaching Environmental <strong>Law</strong> for Non-<strong>Law</strong> Undergraduate Students<br />

APCEL continues to <strong>of</strong>fer an undergraduate course “Introduction to Environmental <strong>Law</strong> (LL 4040)”,<br />

targeted at BSc (Env Eng) students, but open to all non-law undergraduates.<br />

- M Med (Public Health Medicine) and M Med (Occupational Medicine), Medical <strong>Faculty</strong><br />

Assoc Pr<strong>of</strong> LH Lye continues to conduct a seminar on “Environmental Public Health <strong>Law</strong>s in<br />

<strong>Singapore</strong>” to graduate medical students.<br />

- M Sc (Biological Science)<br />

Assoc Pr<strong>of</strong> LH Lye continues to conduct a seminar on “Nature Conservation and the Preservation<br />

<strong>of</strong> Biological Diversity <strong>Law</strong>s” for students from the Science <strong>Faculty</strong>.<br />

ii. Other activities<br />

- Pr<strong>of</strong> KL Koh served as a member <strong>of</strong> the NEA (<strong>National</strong> Environmental Agency) Focus Group on<br />

Air and Climate Change. The Group made many recommendations and this is now contained in<br />

the Report <strong>of</strong> the Group.<br />

- Assoc Pr<strong>of</strong> LH Lye continues to serve as a member <strong>of</strong> the <strong>Singapore</strong> Green Plan Action Programme<br />

Committee for International Environmental Relations (APCIER) and is co-chair <strong>of</strong> its Environmental<br />

Training Programmes Sub-Committee. She is also a Committee member <strong>of</strong> the Ministry’s Inter-<br />

Agency Task Force for the <strong>Singapore</strong> Environmental Training Programme, led by the <strong>Singapore</strong><br />

Environment Institute.<br />

- Assoc Pr<strong>of</strong> LH Lye continues to be a member <strong>of</strong> the <strong>Singapore</strong> Environment Council’s Committee<br />

on the <strong>Singapore</strong> Environmental Achievement Award.<br />

CENTRES<br />

- Assoc Pr<strong>of</strong> LH Lye continues to be a member <strong>of</strong> the Panel <strong>of</strong> Judges for the ACCA (Association<br />

<strong>of</strong> Chartered and Certified Accountants) <strong>Singapore</strong> Environmental Reporting Awards.<br />

- At NUS, Assoc Pr<strong>of</strong> LH Lye continues to chair the Executive Committee <strong>of</strong> the multi-disciplinary<br />

programme, the MSc (Env Mgt), hosted by the School <strong>of</strong> Design and the Environment. The<br />

programme is into its fifth year. Assoc Pr<strong>of</strong> LH Lye is also Vice-Chair <strong>of</strong> the Campus Green<br />

Committee, and heads its Environmental Education Sub-Group.<br />

- She continues to be Consultant-Trainer to the Regional Institute <strong>of</strong> Environmental Technology<br />

for its courses on Environmental, Health and Safety <strong>Law</strong>s.<br />

- Assoc Pr<strong>of</strong> LH Lye was visiting Associate Pr<strong>of</strong>essor at the Yale School <strong>of</strong> Forestry & Environmental<br />

Studies during the Spring Semester 2005, where she taught a course on Comparative Environmental<br />

<strong>Law</strong>. She also taught an intensive course on Asia-Pacific Environmental <strong>Law</strong> at the <strong>Faculty</strong> <strong>of</strong><br />

<strong>Law</strong>, <strong>University</strong> <strong>of</strong> Sydney in October 2005.<br />

- Assoc Pr<strong>of</strong> Simon Tay continues to be the Executive Director <strong>of</strong> the <strong>National</strong> Environmental Agency.<br />

- Pr<strong>of</strong> KL Koh was visiting Pr<strong>of</strong>essor at the Universidad Metropolitana de Mexico where she<br />

conducted a course on Critical Issues <strong>of</strong> Environmental <strong>Law</strong> in Southeast Asia. She was also<br />

visiting Pr<strong>of</strong>essor at the William S Richardson School <strong>of</strong> <strong>Law</strong>, <strong>University</strong> <strong>of</strong> Hawaii from November<br />

to December 2005, where she conducted an intensive course on International Environmental<br />

<strong>Law</strong>: Focus on ASEAN.<br />

PENNA LAKSHMIKANTH AND SIMON SC TAY<br />

APCEL would like to record its thanks to the above two past members for their valuable contributions.<br />

VISITORS<br />

There were two distinguished visitors in 2005.<br />

i. Pr<strong>of</strong> Gus Speth, Dean <strong>of</strong> the Yale School <strong>of</strong> Forestry and Environmental Studies.<br />

Pr<strong>of</strong> Speth was Lee Kuan Yew Distinguished Visitor to NUS in January 2005. Dean Speth met the<br />

Dean <strong>of</strong> the <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong> and also members <strong>of</strong> APCEL, and gave three distinguished public lectures,<br />

at NUS, NTU and the <strong>Singapore</strong> Environment Council. Pr<strong>of</strong> Speth commented that “APCEL is carrying<br />

out essential work - very important and very impressive”.<br />

ii. Pr<strong>of</strong> Philippe Sands, QC, <strong>University</strong> College London and Director, Centre for International Courts<br />

and Tribunals at <strong>University</strong> College London.<br />

CENTRES<br />

Pr<strong>of</strong> Sands played a leading role in the negotiation <strong>of</strong> the Climate Change Convention. Pr<strong>of</strong> Sands<br />

was in <strong>Singapore</strong> to promote his book, <strong>Law</strong>less World: America and the Making and Breaking <strong>of</strong><br />

Global Rules (Penguin. Allen: 2005). APCEL jointly organised with the <strong>Singapore</strong> Environment<br />

Institute a talk by Pr<strong>of</strong> Sands on the Kyoto Protocol, held on 24 June 2005.<br />

CENTRE FOR COMMERCIAL LAW STUDIES (CCLS)<br />

Since its inauguration on 17 January 1998, the Centre for Commercial <strong>Law</strong> Studies continually builds<br />

on the <strong>Faculty</strong>’s extensive experience to <strong>of</strong>fer practical and valuable comparative and regional<br />

commercial law research and dialogue to practitioners, legislators and businessmen.<br />

EVENTS ORGANISED IN 2005<br />

LUNCHTIME SEMINAR ON AUSTRALIAN-CHINA DTA<br />

On 9 March, CCLS organised a seminar which presented the findings <strong>of</strong> a paper to be published by the<br />

International Bureau <strong>of</strong> Fiscal Documentation in their April Bulletin. It dealt with differences in the<br />

taxpayer definitions employed in the Income Tax <strong>Law</strong>s <strong>of</strong> Australia and China and how these operate<br />

in the context <strong>of</strong> the Double Tax Agreement. The impact <strong>of</strong> the differences in creating tax arbitrage<br />

opportunities and incongruent tax outcomes were investigated. The findings are relevant to <strong>Singapore</strong><br />

and any other jurisdiction that adopts standard international income tax definitions such as Australia.<br />

ASIA EXCISE TAXATION CONFERENCE<br />

To establish CCLS as a focal point for comparative and regional commercial law research and dialogue<br />

which would be <strong>of</strong> practical value to key government tax policy makers, legislators and businessmen,<br />

the 1st Asia Excise Taxation Conference was organised by the Centre for Commercial <strong>Law</strong>, Maastricht<br />

<strong>University</strong> <strong>of</strong> The Netherlands and the International Tax and Investment Center (ITIC) <strong>of</strong> Washington,<br />

DC on 2-4 March 2005 at the Grand Plaza Parkroyal Hotel.<br />

The aim <strong>of</strong> the conference was to engage scholars, policy makers and other stakeholders in an open<br />

debate on excise tax policy and administration in Asia. The honorable Mr Teo Eng Cheong, Director-<br />

General <strong>of</strong> <strong>Singapore</strong> Customs addressed the conference as the Guest <strong>of</strong> Honour. The Conference<br />

brought together leading public finance scholars from Asia, Europe, North America and Australia to<br />

discuss these timely issues with senior Government <strong>of</strong>ficials charged with the responsibility for excise<br />

tax policy and administration in their countries. Representatives from Asia-based academic institutes,<br />

experts from the IMF and World Bank and the various industries also participated at the Conference.<br />

The Conference also included the presentation <strong>of</strong> the just published Oxford <strong>University</strong> Press book,<br />

“Theory and Practice <strong>of</strong> Excise Taxation: Smoking, Drinking, Gambling, Polluting and Driving”, edited<br />

by Pr<strong>of</strong>essor Sijbren Cnossen, who also served as the Conference Co-Chairman. Specifically commissioned<br />

papers on excise taxes affecting alcohol, tobacco, and petroleum products were presented and these<br />

issues were discussed from an Asian perspective.<br />

The proceedings <strong>of</strong> this conference, the third in the series, will be published as a book by end 2005.<br />

The conference co-chairman, Assoc Pr<strong>of</strong> Stephen Phua will serve as the editor.<br />

DELEGATION OF JAPANESE PROFESSORS<br />

On 27 July 2005, Assoc Pr<strong>of</strong> Hans Tjio and Asst Pr<strong>of</strong> Michael Ewing-Chow met with Pr<strong>of</strong> Massahiro<br />

Maeda <strong>of</strong> Kyoto <strong>University</strong>, Pr<strong>of</strong> Hiroshi Sano <strong>of</strong> Okayama <strong>University</strong> and Assoc Pr<strong>of</strong> Yasushi Ito <strong>of</strong><br />

Doshiya <strong>University</strong> to update them on changes to company law in <strong>Singapore</strong>. The delegation <strong>of</strong> Japanese<br />

Pr<strong>of</strong>essors was conducting research in the field <strong>of</strong> international corporate law under the auspices <strong>of</strong><br />

the Research and Training Institute <strong>of</strong> the Ministry <strong>of</strong> Justice, Japan and International Civil and<br />

Commercial <strong>Law</strong> Centre, Japan.<br />

OTHER AREAS OF DEVELOPMENT WITHIN CCLS INCLUDE THE FOLLOWING:<br />

i. Research Project - “Admiralty <strong>Law</strong>”, by Mr Toh Kian Sing<br />

Mr Toh Kian Sing is currently working on this research project with CCLS. The research findings will<br />

be published as the 2nd edition <strong>of</strong> his book on Admiralty <strong>Law</strong>.<br />

ii. LLM (Corporate and Financial Services <strong>Law</strong>) programme<br />

The CCLS has agreed to take on an advisory role to the Graduate Division. It would assist in the<br />

curriculum development and content review, and recommend experts to enhance the delivery <strong>of</strong><br />

the programme objectives. To that end, CCLS has created a new subgroup on Training headed by<br />

Emeritus Pr<strong>of</strong> Peter Ellinger as the Programme Director. Being a former Director <strong>of</strong> CCLS and an<br />

eminent member in his field, EP Ellinger provides the requisite credibility to the specialised<br />

programme and will build up the necessary capacity for its long term contributions to the <strong>Faculty</strong><br />

<strong>of</strong> <strong>Law</strong> and NUS.<br />

The LLM (Corporate & Financial Services <strong>Law</strong>) includes electives in banking (domestic and<br />

international), company law and corporate finance, financial services and securities, and taxation.<br />

This specialisation will enable students to acquire the theoretical base and practical expertise in<br />

these subjects. CCLS aims to attract applicants from all over the world to enroll for the academic<br />

year beginning 2003.<br />

Amongst the new courses that have been introduced for the programme are: Business & Finance<br />

for <strong>Law</strong>yers, Comparative Corporate Governance, Comparative Takeover Regulation, International<br />

Corporate Finance, International Trusts and Topics in Financial <strong>Law</strong>. Recent visitors that have<br />

taught in the programme include Pr<strong>of</strong>s Ge<strong>of</strong>frey Morse (Birmingham) and Paul Ali (Melbourne).<br />

iii. Undergraduate Double Degree programmes<br />

Members <strong>of</strong> the CCLS have also been actively involved in planning and implementing the two new<br />

undergraduate double honours degree programmes in Economics and <strong>Law</strong> and Business Administration<br />

and <strong>Law</strong>.<br />

SINGAPORE JOURNAL OF LEGAL STUDIES<br />

The journal is in its 47th year <strong>of</strong> publication from its inception as the Malaya <strong>Law</strong> Review in 1959. It<br />

continues to publish quality peer reviewed pieces discussing legal issues <strong>of</strong> particular relevance to<br />

<strong>Singapore</strong> law, as well as issues <strong>of</strong> general interest to Asia, the common law world, and comparative<br />

law scholars generally. This year, the journal published the public address <strong>of</strong> the inaugural Yong Shook<br />

SINGAPORE YEAR BOOK OF INTERNATIONAL LAW<br />

The aim <strong>of</strong> Volume IX <strong>of</strong> the <strong>Singapore</strong> Year Book <strong>of</strong> International <strong>Law</strong> continued to be the publication<br />

<strong>of</strong> timely and significant pieces <strong>of</strong> international law scholarship from within and outside the Asian<br />

region. Our outlook is international despite a specially felt responsibility to foster and promote Asian,<br />

Southeast Asian and <strong>Singapore</strong> scholarship in the field. In that regard, the Year Book continues to<br />

seek, review and accept writings from some <strong>of</strong> the best scholars the world over for our Articles, Notes<br />

and ASEAN Features sections.<br />

JOURNALS<br />

This year, we also put aside a new section for notable speeches given in the field which came to our<br />

attention in the previous year. We also expanded the Regular Features section to include coverage<br />

<strong>of</strong> two new features - “Private International <strong>Law</strong> in the Malaysia Courts”, and “Recent Developments<br />

in <strong>Singapore</strong> on International Commercial Arbitration”. The first is intended to complement our regular<br />

feature on “Private International <strong>Law</strong> in the <strong>Singapore</strong> Courts” and the second is intended to increase<br />

the scope, coverage and usefulness <strong>of</strong> the Year Book. The overriding aim <strong>of</strong> the Regular Features<br />

section continues to be that <strong>of</strong> keeping our readers informed about developments in <strong>Singapore</strong> state<br />

practice in the public international law field, and about private international law and international<br />

commercial arbitration decisions in the <strong>Singapore</strong> courts. Beyond our special interest in <strong>Singapore</strong>,<br />

and also Malaysia, we continued to invite scholars worldwide to submit their work for inclusion in our<br />

ASEAN Features section. Our aim is for that section to become the leading forum for the very best<br />

writings on ASEAN and the sub-region. Our book reviews section continues to accept a relatively small<br />

number <strong>of</strong> reviews <strong>of</strong> a substantive nature each year. Selected articles were again pre-published on<br />

our website and they continue to be made available on our website following hard copy publication.<br />

SYBIL continues to receive requests from various bodies for permission to reproduce our articles either<br />

in hard copy form or on various websites. These range from scholarly bodies such as the British Institute<br />

<strong>of</strong> International & Comparative <strong>Law</strong> to NGOs and others and we believe this testifies to the timeliness,<br />

importance and relevance <strong>of</strong> the kind <strong>of</strong> work we publish.<br />

In addition, two certificate courses were run: the Graduate Certificate in Intellectual Property <strong>Law</strong><br />

course (jointly conducted with the Intellectual Property Academy) and the Graduate Certificate in<br />

International Arbitration course. On 23 July 2005, a joint certificate-conferring ceremony was held<br />

for these two courses. 2005 also saw the continued administration <strong>of</strong> the auditing program, which<br />

allows legal practitioners to participate as observers in some <strong>of</strong> the faculty’s elective subjects. The<br />

New York Bar Review course, jointly run with the leading American provider <strong>of</strong> such courses (Barbri),<br />

was re-<strong>of</strong>fered.<br />

THE ASIAN LAW INSTITUTE (ASLI)<br />

The Asian <strong>Law</strong> Institute (ASLI) was established in March 2003 by a group <strong>of</strong> leading law schools in Asia.<br />

Its goal is to facilitate academic exchanges as well as research and teaching collaboration among<br />

colleagues from the thirteen founding institutions.<br />

The establishment <strong>of</strong> ASLI stems from the recognition that the diversity <strong>of</strong> legal traditions in Asia<br />

creates an imperative for Asian legal scholars to foster greater engagement with each other through<br />

collaborative research and teaching.<br />

The acronym “ASLI”, which means “indigenous” in the Malay and Indonesian languages, represents<br />

the commitment <strong>of</strong> the founding institutions to establish a truly home-grown law institute in Asia.<br />

The founding institutions <strong>of</strong> ASLI are:<br />

The Board <strong>of</strong> Governors, which maps out ASLI’s goals and activities, is chaired by Pr<strong>of</strong> Hikmahanto<br />

Juwana <strong>of</strong> the <strong>University</strong> <strong>of</strong> Indonesia. The Deputy Chairperson is Pr<strong>of</strong> Nik Ahmad Kamal Nik Mahmod<br />

<strong>of</strong> the International Islamic <strong>University</strong> Malaysia. Pr<strong>of</strong> He Qinhua <strong>of</strong> the East China <strong>University</strong> <strong>of</strong> Politics<br />

and <strong>Law</strong> is the immediate past Chairperson <strong>of</strong> the Board <strong>of</strong> Governors. The Director <strong>of</strong> ASLI is Assoc<br />

Pr<strong>of</strong> Gary F Bell and the two Deputy Directors are Assoc Pr<strong>of</strong>s Alan Tan Khee Jin and Margaret A<br />

Fordham.<br />

ASLI is not technically an NUS institute or research centre but it is physically situated at the <strong>Faculty</strong><br />

<strong>of</strong> <strong>Law</strong> <strong>of</strong> the <strong>National</strong> <strong>University</strong> <strong>of</strong> <strong>Singapore</strong> (NUS) which provides administrative and financial<br />

support for its activities. The <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong> has invested time and efforts to ensure that there can<br />

be research collaborations between Asian scholars. We are therefore pleased to report on the research<br />

activities <strong>of</strong> ASLI during its third year <strong>of</strong> existence.<br />

THE ASLI FELLOWSHIP PROGRAMME<br />

Every year, each member institution <strong>of</strong> ASLI sends one faculty member to ASLI as a Visiting Fellow<br />

for one to three months. While at NUS, the ASLI Fellows conduct collaborative research on legal issues<br />

<strong>of</strong> interest to their respective countries and to Asia in general. In addition, they may help with the<br />

teaching <strong>of</strong> some comparative law aspects <strong>of</strong> courses <strong>of</strong>fered at the NUS <strong>Faculty</strong> <strong>of</strong> <strong>Law</strong>. In particular,<br />

they have the opportunity <strong>of</strong> sharing the experiences <strong>of</strong> their respective countries in dealing with<br />

relevant legal issues and challenges. In this way, the member institutions <strong>of</strong> ASLI hope to cultivate<br />

greater interest, collaboration and comparative scholarship in common legal issues facing the nations<br />

<strong>of</strong> Asia.<br />

Arising out <strong>of</strong> their collaboration, the ASLI Fellows also prepare papers for presentation at the annual<br />

ASLI conference to be hosted by a member institution on a rotating basis in April or May the following<br />

calendar year. Members <strong>of</strong> ASLI also do their best to facilitate student as well as faculty exchanges<br />

among themselves.<br />

At this point, the ASLI Fellowship programme is open only to faculty members from the founding<br />

institutions. ASLI is looking into having more member institutions in the future and also the possibility<br />

<strong>of</strong> allowing individuals not associated with any member institution to participate in its programmes<br />

and activities.<br />

In the academic year 2003-2004, seven scholars from the ASLI participating institutions came to<br />

represent their institution as an ASLI Fellow. In the academic year 2004-5, we had a total <strong>of</strong> ten<br />

scholars. In the academic year 2005-6, we had four Fellows in the first semester and six Fellows in<br />

the second semester.<br />

ANNUAL ASLI CONFERENCE<br />

ASLI organises annual academic conferences hosted by its member institutions on a rotating basis.<br />

These conferences examine contemporary legal issues <strong>of</strong> interest to Asian countries and gather scholars<br />

and experts from the member institutions as well as from Asia and beyond.<br />

A suitable theme <strong>of</strong> relevance to Asia is decided for each annual conference by ASLI’s Board <strong>of</strong><br />

Governors. For the inaugural conference held on 27th and 28th May 2004 hosted by the <strong>Faculty</strong> <strong>of</strong><br />

<strong>Law</strong>, <strong>National</strong> <strong>University</strong> <strong>of</strong> <strong>Singapore</strong>, the theme was The Role <strong>of</strong> <strong>Law</strong> in a Developing Asia. The<br />

second conference was hosted by Chulalongkorn <strong>University</strong> in Bangkok on 26th and 27th May 2005 and<br />

carried the theme Asia and the Challenges <strong>of</strong> <strong>Law</strong>: From Globalisation to Regionalisation? Being one<br />

<strong>of</strong> the anchor activities <strong>of</strong> ASLI, the conference provided a platform for scholars to share on the legal<br />

developments <strong>of</strong> relevance to Asia.<br />

The second conference saw a total <strong>of</strong> 185 participants from 24 countries and close to 70 law schools<br />

and research institutes from Asia, Europe, North America and Australasia. In all, 12 panel titles that<br />

included Environmental Protection, Human Rights and Social Impact, Operationalising WTO System<br />

in the Region, International Business <strong>Law</strong> and Practice, Challenges <strong>of</strong> International <strong>Law</strong>, The FTA<br />

Effect, Bankruptcy <strong>Law</strong> and Post 1997 Scenario, Competition and Consumer Protection, Corporate<br />

Governance, Intellectual Property IT/E Commerce and the <strong>Law</strong>, Commercial <strong>Law</strong> and Building Inter-<br />

State Taxation Regime and Overcoming Transnational Crime provided a wide scope <strong>of</strong> discussions.<br />

There were also 3 Open Forums to accommodate interests in other legal issues. A total <strong>of</strong> 110 papers<br />

were presented.<br />

For the first time, an afternoon networking session was set up after the plenary session ended on the<br />

second day, in response to some participants’ feedback at the inaugural conference to allow further<br />

discussions on partnerships for exchange programmes and ideas. It also gave rise to an opportunity<br />

for non-ASLI members and non-Asian institutions to mingle with the ASLI members to promote<br />

understanding and cooperation.<br />

At the ASLI Board <strong>of</strong> Governors’ meeting, held a day before the conference, the Governors agreed<br />

to convene the next conference in Shanghai. To be hosted by the East China <strong>University</strong> <strong>of</strong> Politics and<br />

<strong>Law</strong> (ECUPL), the conference is scheduled for 25th and 26th May 2006 and bears the theme The<br />

Development <strong>of</strong> <strong>Law</strong> in Asia: Convergence versus Divergence?<br />

The ECUPL and ASLI welcome legal scholars to attend and present papers at its annual conference,<br />

both from ASLI founding institutions as well as other institutions within and outside Asia. The conference<br />

is open to all whether or not they present a paper and provides excellent opportunities for scholars<br />

in Asian law to meet and exchange ideas and to form closer working and personal relationships.<br />

ASLI SYMPOSIUM - REFLECTIONS ON LEGAL EDUCATION<br />

IN ASIA<br />

Building on the success <strong>of</strong> its conference series, ASLI launched a complementary symposium series on<br />

10th and 11th November 2005 for smaller groups <strong>of</strong> scholars to gather and discuss specific topics in<br />

greater depth and detail.<br />

The inaugural ASLI Symposium was jointly organised by member institutions International Islamic<br />

<strong>University</strong> Malaysia (IIUM) and <strong>National</strong> <strong>University</strong> <strong>of</strong> <strong>Singapore</strong> (NUS). NUS hosted the event, which<br />

brought together more than 40 scholars from 18 institutions to consider topics under the theme <strong>of</strong><br />

Reflections on Legal Education in Asia. It was particularly gratifying to welcome participants from as<br />

far away as America and England to this two-day gathering. The symposium included two country<br />

survey panels that surveyed the state <strong>of</strong> legal educations in specific countries in Asia as well as two<br />

panels that discussed the challenges <strong>of</strong> teaching certain subjects in Asia.<br />

With the relatively intimate symposium setting and the richness <strong>of</strong> the issues raised, discussions were<br />

frank and challenging. Asian law schools faced many common issues and challenges: finding the right<br />

balance between academic and pr<strong>of</strong>essional learning objectives, between law and non-law subjects;<br />

considering whether law education should be a graduate endeavour rather an undergraduate degree;<br />

funding and autonomy. At the same time, the symposium gave participants a valuable opportunity<br />

to learn about different developments in other jurisdictions. Judging from the animated discussions<br />

that continued into tea breaks and meals, most participants would welcome the prospect <strong>of</strong> more ALSI<br />

symposia on topics <strong>of</strong> common interest. Some <strong>of</strong> the symposium papers may be published in the<br />

inaugural issue <strong>of</strong> the Asian Journal <strong>of</strong> Comparative <strong>Law</strong>.<br />

ASIAN JOURNAL OF COMPARATIVE LAW<br />

When Asian scholars want to publish their research on Asian law in English, they usually have to turn<br />

to law journals published outside <strong>of</strong> Asia. Whether they be general journals, comparative law journals<br />

or journals about Asia, most <strong>of</strong> their audience is outside <strong>of</strong> Asia.<br />

At its first meeting, the Board <strong>of</strong> Governors discussed the possibility <strong>of</strong> an ASLI journal. The NUS has<br />

pursued this and it was decided that the <strong>Singapore</strong> Journal <strong>of</strong> International and Comparative <strong>Law</strong><br />

would split its mission and the comparative law aspect would now be continued in an Asian law journal.<br />

Hence, the Editorial Board <strong>of</strong> the journal – Asian Journal <strong>of</strong> Comparative <strong>Law</strong>, comprising members<br />

from the founding institutions, has been set up under the auspices <strong>of</strong> ASLI. It is currently in the process<br />

<strong>of</strong> putting together the inaugural volume in time for the ASLI conference in Shanghai in May 2006. The<br />

Journal aims to maintain the highest academic standards, and all papers will undergo an independent<br />

peer-review process before publication. Besides a print format, an electronic format will be published<br />

by the Berkeley Electronic Press (“BEPRESS”), an online publisher set up by academics from the law<br />

and business schools and the department <strong>of</strong> economics <strong>of</strong> the <strong>University</strong> <strong>of</strong> California, Berkerley.<br />

BEPRESS will host the Journal free <strong>of</strong> charge.<br />

The study <strong>of</strong> victims <strong>of</strong> crime is a relatively new field. It was only in the last thirty years or so that<br />

attention has been focused on the relevance <strong>of</strong> victims in the criminal justice process and their needs.<br />

In many jurisdictions, this has led to compensation schemes for victims <strong>of</strong> crime, assistance schemes<br />

for victims <strong>of</strong> crime to recover from their ordeal, and guidelines to the police and courts as to how<br />

they should treat victims <strong>of</strong> crime to prevent a “second victimisation” to name a few.<br />

RESEARCH PROJECTS<br />

Although there have been developments in <strong>Singapore</strong> in the last ten years or so to address the needs<br />

<strong>of</strong> victims <strong>of</strong> crime, large numbers <strong>of</strong> victims such as the elderly and victims <strong>of</strong> property <strong>of</strong>fences may<br />

not be adequately assisted in having their needs met and guided through the legal process. The state<br />

<strong>of</strong> victim services in <strong>Singapore</strong> is not well developed or well co-ordinated. Therefore, there is much<br />

to be learnt from other jurisdictions, particularly those from around the region, on how victim needs<br />

are met, their recovery enhanced, and justice secured.<br />

This project aims to bring together leading academics and social service providers to assess the support<br />

given to victims <strong>of</strong> crime in the Asian region. In doing so, policy makers and field workers in <strong>Singapore</strong><br />

can be made more aware <strong>of</strong> the themes and developments in other parts <strong>of</strong> the world relating to<br />

victim services, as well as opportunity given to showcase the successful efforts in <strong>Singapore</strong> in this<br />

respect.<br />

A collection <strong>of</strong> essays stemming from the papers delivered at the symposium is planned to be published<br />

which will document and analyse the support available to victims <strong>of</strong> crime in the Asian Region. This<br />

will also be the first time that such victim services in <strong>Singapore</strong> will be identified and analysed, which<br />

is an essential prerequisite for future co-ordination and networking to develop an integrated system<br />

<strong>of</strong> victim services.<br />
