INTRODUCTION
The National University of Singapore (NUS) was formally established in 1980 with the merger of
the University of Singapore and the Nanyang University. Its history can, however, be traced back
to 1905, when Singapore’s first centre of higher education, the King Edward VII College of Medicine,
was established. The NUS is a comprehensive university offering a wide range of undergraduate
and graduate studies, and has more than 30,000 students. NUS has maintained its position in the
top quartile of the world’s best 100 universities in a global ranking by The Times of London in
2005.
The NUS Faculty of Law is one of the finest law schools in the world, and is widely regarded as
Asia’s leading law school. Staffed by an outstanding permanent faculty with law degrees from
more than a dozen jurisdictions, the law school is an institution dedicated to building a community
and an environment in which faculty and students can discuss and reflect on the fundamental
legal issues that affect societies in today’s globalised world. The Faculty is also the only law
school in Singapore and is responsible for producing the majority of entrants to the legal profession.
The LLB law degree is a four-year one, where students study a mixture of core and optional law
subjects as well as some non-law options. A limited number of students who already have a first
degree in another discipline are also admitted each year, and they complete their LLB degree
in three years. Law graduates who wish to practice law have to go on to do a practical Bar course
and serve a period of pupillage.
The Law Faculty has attained an impressive reputation in mooting and debating, and it is the only
law school in the world to have won the Philip C Jessup International Law Moot Court Competition
four times.
The Faculty has produced prominent judges, lawyers and legal academics. Its graduates have also
become successful in diverse fields ranging from the civil service, diplomacy and politics, to
drama, dance and publishing.
In addition to the LLB programme, a range of postgraduate qualifications by coursework and
research are also available. Apart from the general LLM coursework programme, there are also
specialist LLM coursework programmes in the areas of Corporate & Financial Services Law;
Intellectual Property & Technology Law; International & Comparative Law; Chinese Law; and
International Business Law which is the first overseas degree programme offered by the Faculty
of Law where students enrolled in the one-year programme spend the first nine weeks at NUS
and the rest of the time in Shanghai, China. In February 2006, the NUS Faculty of Law and New
York University School of Law signed a Memorandum of Understanding to offer a dual LLM degree
programme which will commence in May 2007 in NUS. The postgraduate population is a cosmopolitan
one, with students from Asia, Europe, North and South America, Africa and Oceania.
The Faculty produces two journals, the Singapore Journal of Legal Studies and the Singapore Year
Book of International Law, the latter formerly known as the Singapore Journal of International
and Comparative Law. The Faculty has two centres, the Asia-Pacific Centre for Environmental
Law (APCEL) and the Centre for Commercial Law Studies (CCLS), and also hosts the Asian Law
Institute (ASLI) which was established in March 2003 by a group of leading law schools in Asia.
This research profile records Faculty works published, accepted or submitted for publication from
1 January to 31 December 2005.

ASIA-PACIFIC CENTRE FOR ENVIRONMENTAL LAW (APCEL)
Established in February 1996 by the Faculty of Law, National University of Singapore, at the initiative
of the Faculty and the World Conservation Union - Commission on Environmental Law (IUCN-CEL), and
in collaboration with the United Nations Environment Programme (UNEP), APCEL was launched on 1
July of the same year. The initiative was in response to the call in Agenda 21 to build capacity in
environmental law and to promote awareness of environmental issues. APCEL has established itself
as a centre of excellence in the region for capacity-building in environmental law, and is highly
regarded worldwide.
The objectives of APCEL are:
• To serve as a regional training centre for the teaching of environmental law;
• To organise conferences, seminars and other programmes on environmental issues;
• To serve as a regional centre for research, including multi-disciplinary research on
international, regional and national environmental law and policy;
• To establish and develop a collection of materials on environmental law and policy,
and maintain an electronic database;
• To promote the exchange of information on international, regional and national
environmental law and policy;
• To publish studies, reports and course materials on international, regional and national
environmental law and policy;
• To cooperate and collaborate with law schools, institutes, centres and such other
organisations to further its objectives; and
• To undertake such other programmes and activities as the Executive Committee
may determine from time to time.
To further its objectives, an MOU was signed with IUCN on Capacity-Building for Environmental Legal
Education in the Asia and Pacific Region and on Environmental Law Information System. APCEL has
also signed MOUs with the Center for Environmental Legal Studies of the School of Law of Pace
University, and with Macquarie University’s Centre for Environmental Law, (MU-CEL) both of which
relate to Cooperation in Teaching and Research in the Field of Environmental Law. It has also signed
a three-party MOU with MU-CEL and World Wide Fund for Nature-India.
Since its establishment, it has organised numerous activities on its own as well as in collaboration with
other international and local organisations such as the Asian Development Bank (ADB), IUCN-CEL,
UNEP, International Maritime Organisation (IMO), United Nations Development Program (UNDP), Mekong
Region Law Center, United Nations University (UNU), United States-Asia Environmental Partnership
(US-AEP), Center for Environmental Legal Studies of Pace University, Southeast Asian Program on
Ocean Law Policy and Management (SEAPOL), Regional Institute of Environmental Technology (RIET),
Singapore Ministry of the Environment (ENV), Maritime and Port Authority of Singapore (MPA), Singapore
Ministry of Foreign Affairs (MFA) and the Institute of Policy Studies (IPS) and the United Nations Institute
for Training and Research (UNITAR). These activities include conferences, seminars, forums, workshops
and training courses on various topics such as trade and the environment, marine pollution, environmental
legislation on sustainable development, and teaching environmental law at university level in the Asia-
Pacific region.
CAPACITY BUILDING
APCEL has continued to take a leadership role and has been recognized worldwide as a premier
environmental law centre. In 2005, three of its members, KL Koh, LH Lye and Simon SC Tay, were
invited to teach in leading universities in Australia, Mexico and the United States of America. The
courses were in Comparative Environmental Law, Asia-Pacific Environmental Law, WTO and Sustainable
Development, International Environmental Law with focus on ASEAN, and Critical Issues in Environmental
Law in South East Asia.
APCEL has continued to organise seminars for the Singapore Ministry of Foreign Affairs for senior
officials in developing countries. In 2005, APCEL organised a 5-day seminar on Urban and Industrial
Environmental Management (19-25 April 2005). The purpose was to build capacity in urban and industrial
environmental management. The main objective was to enable administrators and managers of urban
and industrial environmental management from developing countries to learn and exchange skills and
techniques in urban and industrial management. This was the eighth in a series of such courses. The
participants were senior administrators from 15 countries: China, Indonesia, Jordon, Macedonia, Malta,
Mauritius, Mexico, Romania, Samoa, Saudi Arabia, Serbia and Montenegro, Syria, Thailand and Timor-
Leste. This was a multidisciplinary course and the following APCEL members conducted some of the
seminars: Prof KL Koh, Assoc Prof LH Lye, Assoc Prof P Lakshmikanth, Assoc Prof R Beckman and Assoc
Prof V Ramraj. Prof KL Koh was the course co-ordinator.
At the invitation of the Ministry of Environment and Water Resources (MEWR) and the Singapore
Environment Institute (SEI), APCEL conducted a 2-day course on “Understanding Environmental Laws:
The Singapore and International Perspectives”, 21-22 July 2005. This is a continuation of a series of
capacity building courses which started from 1997. Prof KL Koh, Assoc Prof LH Lye, Assoc Prof KJ Tan
and Asst Prof LT Lim conducted this course.
In August 2005, the School of Design and Environment, NUS organized the Environmental Management
Executive Programme. Three APCEL members, Prof KL Koh, Assoc Prof LH Lye and Assoc Prof Michael
Ewing Chow conducted seminars on environmental law for a specially organised programme on
Environmental Management for some thirty top officials from the MEWR, including the Permanent
Secretary of MEWR, Mr Tan Yong Soon. The course was held at the SDE (School of Design and
Environment), which hosts the MSc (Env Mgt) programme. The course was a great success and it was
highly recommended by the participants, for other government agencies. The participants included
the Permanent Secretary of the Ministry, directors and deputy directors, heads of department, chief
executives from MEWR, NEA (National Environment Agency) and PUB (Public Utilities Board).
CENTRES
On 28 October 2005, eight Singapore organisations and institutions, including APCEL, entered into a
Memorandum of Understanding (MOU) to formalise their commitment to jointly promote Singapore’s
capacity-building efforts through environmentally-related training and technology transfer to the
region and beyond, under the Singapore Environmental Training Programme (SETP). “No single
organisation holds all the answers to the environmental issues that we face. While sharing knowledge
with our counterparts in other countries is important, it is also important for us to share among
ourselves so that we can have a more integrated understanding of the Singapore’s environmental
experience and leverage on each other’s strengths and expertise. Singapore has learnt and benefited
from the sound environmental practices of many countries. While we still have much to learn, we are
now in a position to share our unique experiences with our neighbours and friends,” said Mr Lee Yuen
Hee, CEO of the National Environment Agency, in his address at the MOU signing ceremony held at
the Singapore Environment Institute.
CENTRE FOR COMMERCIAL LAW STUDIES (CCLS)
Since its inauguration on 17 January 1998, the Centre for Commercial Law Studies continually builds
on the Faculty’s extensive experience to offer practical and valuable comparative and regional
commercial law research and dialogue to practitioners, legislators and businessmen.
EVENTS ORGANISED IN 2005
LUNCHTIME SEMINAR ON AUSTRALIAN-CHINA DTA
On 9 March, CCLS organised a seminar which presented the findings of a paper to be published by the
International Bureau of Fiscal Documentation in their April Bulletin. It dealt with differences in the
taxpayer definitions employed in the Income Tax Laws of Australia and China and how these operate
in the context of the Double Tax Agreement. The impact of the differences in creating tax arbitrage
opportunities and incongruent tax outcomes were investigated. The findings are relevant to Singapore
and any other jurisdiction that adopts standard international income tax definitions such as Australia.
ASIA EXCISE TAXATION CONFERENCE
To establish CCLS as a focal point for comparative and regional commercial law research and dialogue
which would be of practical value to key government tax policy makers, legislators and businessmen,
the 1st Asia Excise Taxation Conference was organised by the Centre for Commercial Law, Maastricht
University of The Netherlands and the International Tax and Investment Center (ITIC) of Washington,
DC on 2-4 March 2005 at the Grand Plaza Parkroyal Hotel.
The aim of the conference was to engage scholars, policy makers and other stakeholders in an open
debate on excise tax policy and administration in Asia. The honorable Mr Teo Eng Cheong, Director-
General of Singapore Customs addressed the conference as the Guest of Honour. The Conference
brought together leading public finance scholars from Asia, Europe, North America and Australia to
discuss these timely issues with senior Government officials charged with the responsibility for excise
tax policy and administration in their countries. Representatives from Asia-based academic institutes,
experts from the IMF and World Bank and the various industries also participated at the Conference.
The Conference also included the presentation of the just published Oxford University Press book,
“Theory and Practice of Excise Taxation: Smoking, Drinking, Gambling, Polluting and Driving”, edited
by Professor Sijbren Cnossen, who also served as the Conference Co-Chairman. Specifically commissioned
papers on excise taxes affecting alcohol, tobacco, and petroleum products were presented and these
issues were discussed from an Asian perspective.
The proceedings of this conference, the third in the series, will be published as a book by end 2005.
The conference co-chairman, Assoc Prof Stephen Phua will serve as the editor.
OTHER AREAS OF DEVELOPMENT WITHIN CCLS INCLUDE THE FOLLOWING:
i. Research Project - “Admiralty Law”, by Mr Toh Kian Sing
Mr Toh Kian Sing is currently working on this research project with CCLS. The research findings will
be published as the 2nd edition of his book on Admiralty Law.
ii. LLM (Corporate and Financial Services Law) programme
The CCLS has agreed to take on an advisory role to the Graduate Division. It would assist in the
curriculum development and content review, and recommend experts to enhance the delivery of
the programme objectives. To that end, CCLS has created a new subgroup on Training headed by
Emeritus Prof Peter Ellinger as the Programme Director. Being a former Director of CCLS and an
eminent member in his field, EP Ellinger provides the requisite credibility to the specialised
programme and will build up the necessary capacity for its long term contributions to the Faculty
of Law and NUS.
The LLM (Corporate & Financial Services Law) includes electives in banking (domestic and
international), company law and corporate finance, financial services and securities, and taxation.
This specialisation will enable students to acquire the theoretical base and practical expertise in
these subjects. CCLS aims to attract applicants from all over the world to enroll for the academic
year beginning 2003.
Amongst the new courses that have been introduced for the programme are: Business & Finance
for Lawyers, Comparative Corporate Governance, Comparative Takeover Regulation, International
Corporate Finance, International Trusts and Topics in Financial Law. Recent visitors that have
taught in the programme include Profs Geoffrey Morse (Birmingham) and Paul Ali (Melbourne).
iii. Undergraduate Double Degree programmes
SINGAPORE JOURNAL OF LEGAL STUDIES
The journal is in its 47th year of publication from its inception as the Malaya Law Review in 1959. It
continues to publish quality peer reviewed pieces discussing legal issues of particular relevance to
Singapore law, as well as issues of general interest to Asia, the common law world, and comparative
law scholars generally. This year, the journal published the public address of the inaugural Yong Shook
Lin Visiting Professor David Vaver in “Unconventional and Well-Known Trade Marks” [2005] SingJLS
1. Articles published in the journal continued to be found useful and cited by the Singapore courts.
In 2005, citations included Lee Eng Beng, “The Avoidance Provisions of the Bankruptcy Act 1995 and
Their Application to Companies” [1995] SingJLS 597, Debbie Ong, “Making No Custody Order: Re G
(Guardianship of an Infant)” [2003] SingJLS 583 and “Parents and Custody Orders - A New Approach”
[1999] SingJLS 205, Victor V Ramraj, “Murder Without an Intention to Kill” [2000] SingJLS 560, Daniel
Seng, “Another Clog on the Construction of Contracts? The Parol Evidence Rule and the Use of Extrinsic
Evidence” [1997] SingJLS 457, David Vaver, “Unconventional and Well-Known Trade Marks” [2005]
SingJLS 1, and TM Yeo, “Unilateral Mistake in Contract: Five Degrees of Fusion of Common Law and
Equity” [2004] SingJLS 227. In the same year, the Australian High Court also took notice of A
Kumaralingam, “The Sunrise Crane - Shedding New Light or Casting Old Shadows on Duty of Care?”
[2004] SingJLS 551. Apart from its paper circulation, the journal is also available electronically through
Lawnet, Westlaw, Heinonline, Proquest and SSRN. The Wilson Index to Legal Periodicals and Scholar
Google are linked to the SSRN database.
SINGAPORE YEAR BOOK OF INTERNATIONAL LAW
The aim of Volume IX of the Singapore Year Book of International Law continued to be the publication
of timely and significant pieces of international law scholarship from within and outside the Asian
region. Our outlook is international despite a specially felt responsibility to foster and promote Asian,
Southeast Asian and Singapore scholarship in the field. In that regard, the Year Book continues to
seek, review and accept writings from some of the best scholars the world over for our Articles, Notes
and ASEAN Features sections.
JOURNALS
This year, we also put aside a new section for notable speeches given in the field which came to our
attention in the previous year. We also expanded the Regular Features section to include coverage
of two new features - “Private International Law in the Malaysia Courts”, and “Recent Developments
in Singapore on International Commercial Arbitration”. The first is intended to complement our regular
feature on “Private International Law in the Singapore Courts” and the second is intended to increase
the scope, coverage and usefulness of the Year Book. The overriding aim of the Regular Features
section continues to be that of keeping our readers informed about developments in Singapore state
practice in the public international law field, and about private international law and international
commercial arbitration decisions in the Singapore courts. Beyond our special interest in Singapore,
and also Malaysia, we continued to invite scholars worldwide to submit their work for inclusion in our
ASEAN Features section. Our aim is for that section to become the leading forum for the very best
writings on ASEAN and the sub-region. Our book reviews section continues to accept a relatively small
number of reviews of a substantive nature each year. Selected articles were again pre-published on
our website and they continue to be made available on our website following hard copy publication.
SYBIL continues to receive requests from various bodies for permission to reproduce our articles either
in hard copy form or on various websites. These range from scholarly bodies such as the British Institute
of International & Comparative Law to NGOs and others and we believe this testifies to the timeliness,
importance and relevance of the kind of work we publish.
THE ASIAN LAW INSTITUTE (ASLI)
The Asian Law Institute (ASLI) was established in March 2003 by a group of leading law schools in Asia.
Its goal is to facilitate academic exchanges as well as research and teaching collaboration among
colleagues from the thirteen founding institutions.
The establishment of ASLI stems from the recognition that the diversity of legal traditions in Asia
creates an imperative for Asian legal scholars to foster greater engagement with each other through
collaborative research and teaching.
The acronym “ASLI”, which means “indigenous” in the Malay and Indonesian languages, represents
the commitment of the founding institutions to establish a truly home-grown law institute in Asia.
The founding institutions of ASLI are:
• Faculty of Law, Chulalongkorn University (Bangkok, Thailand)
• East China University of Politics and Law (Shanghai, People’s Republic of China)
• Faculty of Law, University of Hong Kong (Hong Kong SAR, People’s Republic of China)
• Faculty of Law, University of Indonesia (Jakarta, Indonesia)
• Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia
(Kuala Lumpur, Malaysia)
• Faculty of Law, University of Malaya (Kuala Lumpur, Malaysia)
• Faculty of Law, Kyushu University (Fukuoka, Japan)
• National Law School of India University (Bangalore, India)
• Faculty of Law, National University of Singapore (Singapore)
• College of Law, National Taiwan University (Taipei, Chinese Taipei)
• Peking University Law School, Peking University (Beijing, People’s Republic of China)
• College of Law, University of the Philippines (Manila, the Philippines)
• College of Law, Seoul National University (Seoul, Republic of Korea)
The Board of Governors, which maps out ASLI’s goals and activities, is chaired by Prof Hikmahanto
Juwana of the University of Indonesia. The Deputy Chairperson is Prof Nik Ahmad Kamal Nik Mahmod
of the International Islamic University Malaysia. Prof He Qinhua of the East China University of Politics
and Law is the immediate past Chairperson of the Board of Governors. The Director of ASLI is Assoc
Prof Gary F Bell and the two Deputy Directors are Assoc Profs Alan Tan Khee Jin and Margaret A
Fordham.
ASLI is not technically an NUS institute or research centre but it is physically situated at the Faculty
of Law of the National University of Singapore (NUS) which provides administrative and financial
support for its activities. The Faculty of Law has invested time and efforts to ensure that there can
be research collaborations between Asian scholars. We are therefore pleased to report on the research
activities of ASLI during its third year of existence.
THE ASLI FELLOWSHIP PROGRAMME
Every year, each member institution of ASLI sends one faculty member to ASLI as a Visiting Fellow
for one to three months. While at NUS, the ASLI Fellows conduct collaborative research on legal issues
of interest to their respective countries and to Asia in general. In addition, they may help with the
teaching of some comparative law aspects of courses offered at the NUS Faculty of Law. In particular,
they have the opportunity of sharing the experiences of their respective countries in dealing with
relevant legal issues and challenges. In this way, the member institutions of ASLI hope to cultivate
greater interest, collaboration and comparative scholarship in common legal issues facing the nations
of Asia.
Arising out of their collaboration, the ASLI Fellows also prepare papers for presentation at the annual
ASLI conference to be hosted by a member institution on a rotating basis in April or May the following
calendar year. Members of ASLI also do their best to facilitate student as well as faculty exchanges
among themselves.
At this point, the ASLI Fellowship programme is open only to faculty members from the founding
institutions. ASLI is looking into having more member institutions in the future and also the possibility
of allowing individuals not associated with any member institution to participate in its programmes
and activities.
In the academic year 2003-2004, seven scholars from the ASLI participating institutions came to
represent their institution as an ASLI Fellow. In the academic year 2004-5, we had a total of ten
scholars. In the academic year 2005-6, we had four Fellows in the first semester and six Fellows in
the second semester.
THE ASIAN LAW INSTITUTE (ASLI)
The scholars for academic year 2005-6 are:
ANNUAL ASLI CONFERENCE
ASLI organises annual academic conferences hosted by its member institutions on a rotating basis.
These conferences examine contemporary legal issues of interest to Asian countries and gather scholars
and experts from the member institutions as well as from Asia and beyond.
A suitable theme of relevance to Asia is decided for each annual conference by ASLI’s Board of
Governors. For the inaugural conference held on 27th and 28th May 2004 hosted by the Faculty of
Law, National University of Singapore, the theme was The Role of Law in a Developing Asia. The
second conference was hosted by Chulalongkorn University in Bangkok on 26th and 27th May 2005 and
carried the theme Asia and the Challenges of Law: From Globalisation to Regionalisation? Being one
of the anchor activities of ASLI, the conference provided a platform for scholars to share on the legal
developments of relevance to Asia.
30
The second conference saw a total of 185 participants from 24 countries and close to 70 law schools
and research institutes from Asia, Europe, North America and Australasia. In all, 12 panel titles that
included Environmental Protection, Human Rights and Social Impact, Operationalising WTO System
in the Region, International Business Law and Practice, Challenges of International Law, The FTA
Effect, Bankruptcy Law and Post 1997 Scenario, Competition and Consumer Protection, Corporate
Governance, Intellectual Property IT/E Commerce and the Law, Commercial Law and Building Inter-
State Taxation Regime and Overcoming Transnational Crime provided a wide scope of discussions.
There were also 3 Open Forums to accommodate interests in other legal issues. A total of 110 papers
were presented.
For the first time, an afternoon networking session was set up after the plenary session ended on the
second day, in response to some participants’ feedback at the inaugural conference to allow further
discussions on partnerships for exchange programmes and ideas. It also gave rise to an opportunity
for non-ASLI members and non-Asian institutions to mingle with the ASLI members to promote
understanding and cooperation.
At the ASLI Board of Governors’ meeting, held a day before the conference, the Governors agreed
to convene the next conference in Shanghai. To be hosted by the East China University of Politics and
Law (ECUPL), the conference is scheduled for 25th and 26th May 2006 and bears the theme The
Development of Law in Asia: Convergence versus Divergence?
The ECUPL and ASLI welcome legal scholars to attend and present papers at its annual conference,
both from ASLI founding institutions as well as other institutions within and outside Asia. The conference
is open to all whether or not they present a paper and provides excellent opportunities for scholars
in Asian law to meet and exchange ideas and to form closer working and personal relationships.
ASLI SYMPOSIUM - REFLECTIONS ON LEGAL EDUCATION
IN ASIA
Building on the success of its conference series, ASLI launched a complementary symposium series on
10th and 11th November 2005 for smaller groups of scholars to gather and discuss specific topics in
greater depth and detail.
The inaugural ASLI Symposium was jointly organised by member institutions International Islamic
University Malaysia (IIUM) and National University of Singapore (NUS). NUS hosted the event, which
brought together more than 40 scholars from 18 institutions to consider topics under the theme of
Reflections on Legal Education in Asia. It was particularly gratifying to welcome participants from as
far away as America and England to this two-day gathering. The symposium included two country
survey panels that surveyed the state of legal educations in specific countries in Asia as well as two
panels that discussed the challenges of teaching certain subjects in Asia.
With the relatively intimate symposium setting and the richness of the issues raised, discussions were
frank and challenging. Asian law schools faced many common issues and challenges: finding the right
balance between academic and professional learning objectives, between law and non-law subjects;
considering whether law education should be a graduate endeavour rather an undergraduate degree;
funding and autonomy. At the same time, the symposium gave participants a valuable opportunity
to learn about different developments in other jurisdictions. Judging from the animated discussions
that continued into tea breaks and meals, most participants would welcome the prospect of more ALSI
symposia on topics of common interest. Some of the symposium papers may be published in the
inaugural issue of the Asian Journal of Comparative Law.
THE ASIAN LAW INSTITUTE (ASLI)
ASIAN JOURNAL OF COMPARATIVE LAW
When Asian scholars want to publish their research on Asian law in English, they usually have to turn
to law journals published outside of Asia. Whether they be general journals, comparative law journals
or journals about Asia, most of their audience is outside of Asia.
At its first meeting, the Board of Governors discussed the possibility of an ASLI journal. The NUS has
pursued this and it was decided that the Singapore Journal of International and Comparative Law
would split its mission and the comparative law aspect would now be continued in an Asian law journal.
Hence, the Editorial Board of the journal – Asian Journal of Comparative Law, comprising members
from the founding institutions, has been set up under the auspices of ASLI. It is currently in the process
of putting together the inaugural volume in time for the ASLI conference in Shanghai in May 2006. The
Journal aims to maintain the highest academic standards, and all papers will undergo an independent
peer-review process before publication. Besides a print format, an electronic format will be published
by the Berkeley Electronic Press (“BEPRESS”), an online publisher set up by academics from the law
and business schools and the department of economics of the University of California, Berkerley.
BEPRESS will host the Journal free of charge.
The study of victims of crime is a relatively new field. It was only in the last thirty years or so that
attention has been focused on the relevance of victims in the criminal justice process and their needs.
In many jurisdictions, this has led to compensation schemes for victims of crime, assistance schemes
for victims of crime to recover from their ordeal, and guidelines to the police and courts as to how
they should treat victims of crime to prevent a “second victimisation” to name a few.
RESEARCH PROJECTS
75
Although there have been developments in Singapore in the last ten years or so to address the needs
of victims of crime, large numbers of victims such as the elderly and victims of property offences may
not be adequately assisted in having their needs met and guided through the legal process. The state
of victim services in Singapore is not well developed or well co-ordinated. Therefore, there is much
to be learnt from other jurisdictions, particularly those from around the region, on how victim needs
are met, their recovery enhanced, and justice secured.
This project aims to bring together leading academics and social service providers to assess the support
given to victims of crime in the Asian region. In doing so, policy makers and field workers in Singapore
can be made more aware of the themes and developments in other parts of the world relating to
victim services, as well as opportunity given to showcase the successful efforts in Singapore in this
respect.
A collection of essays stemming from the papers delivered at the symposium is planned to be published
which will document and analyse the support available to victims of crime in the Asian Region. This
will also be the first time that such victim services in Singapore will be identified and analysed, which
is an essential prerequisite for future co-ordination and networking to develop an integrated system
of victim services.
