3.5 Personal belongings left at the Accommodation are at the <strong>Tenant's</strong> own risk. Although<br />

the <strong>Tenant's</strong> personal belongings (up to a maximum value <strong>of</strong> £4000 in total) are<br />

insured under the Block Halls Insurance Policy, that insurance is subject to conditions,<br />

exclusions, limitations <strong>and</strong> excesses <strong>of</strong> the policy. <strong>To</strong>p up insurance cover is available<br />

direct from the insurance provider, <strong>and</strong> further details are available at<br />

www.ncl.ac.uk/accommodation/current/rent/insurance<br />

3.6 The L<strong>and</strong>lord is not liable to repair any damage caused by the Tenant unless the cost<br />

is met by the Tenant or by the insurance (any excess on the policy being <strong>pay</strong>able by<br />

the Tenant). This clause shall not apply where the L<strong>and</strong>lord has an overriding<br />

statutory obligation to effect repairs to make the Accommodation secure<br />

3.7 Your obligations extend to your visitors <strong>and</strong> you must ensure that your visitors behave<br />

in a manner consistent with these <strong>Terms</strong> <strong>and</strong> <strong>Conditions</strong><br />

3.8 The L<strong>and</strong>lord reserve the right to exclude any visitor from the Accommodation where<br />

the L<strong>and</strong>lord has reasonable grounds to believe that their exclusion is necessary for<br />

the safety or wellbeing <strong>of</strong> other <strong>Tenant's</strong>, their visitors or the L<strong>and</strong>lord's employees<br />

3.9 This <strong>Contract</strong> falls within the definition set out in paragraph Eight <strong>of</strong> Schedule One <strong>of</strong><br />

the Housing Act 1988<br />

3.10 This <strong>Contract</strong> is not intended to award any benefit to anyone who is not party to it<br />

3.11 If the Tenant is <strong>of</strong>fered a twin study-bedroom at the beginning <strong>of</strong> the <strong>Contract</strong> the<br />

Tenant will be charged a reduced rent for the time the Tenant occupies the studybedroom<br />

with another Tenant. Should the Tenant occupy the study-bedroom as sole<br />

occupant or be moved to a single study-bedroom at anytime during the period <strong>of</strong><br />

<strong>Contract</strong>, the Tenant will be charged the st<strong>and</strong>ard daily rate <strong>of</strong> the relevant room.<br />

Overnight visitors are not allowed<br />

3.12 Undergraduate Student's Only: Should the Tenant wish to cancel the Silver level<br />

membership for the Sports Centre the following terms apply:<br />

i. Cancel before 14 October 2013 to receive a full refund,<br />

ii. Cancel before 13 January 2014 to receive a refund <strong>of</strong> years two <strong>and</strong> three only,<br />

iii. Cancel after 13 January 2014 no refund is applicable.<br />

3.13 If, due to a disability, the L<strong>and</strong>lord provides Accommodation for a <strong>Tenant's</strong> personal<br />

carer, the Tenant will be responsible for ensuring <strong>pay</strong>ment <strong>of</strong> the additional<br />

Accommodation Charges for this study-bedroom <strong>and</strong> the <strong>Tenant's</strong> contractual<br />

obligations extend to the carer who must behave in a manner consistent with these<br />

terms <strong>and</strong> conditions<br />

4. Termination <strong>of</strong> <strong>Contract</strong><br />

4.1 The Tenant agrees that the Accommodation is let to them as a consequence <strong>of</strong> their<br />

attendance at Newcastle University <strong>and</strong> it is agreed that they will be bound to give up<br />

the <strong>Contract</strong> when they cease to be a registered student <strong>of</strong> the University. In the event<br />

that the Tenant withdraws from University during the <strong>Contract</strong>, they will be bound to the<br />

<strong>Contract</strong> until the end date <strong>of</strong> the term in which they withdraw, unless a suitable<br />

replacement (a 'successor') can be found. The Tenant is responsible for finding a<br />

suitable replacement, but the L<strong>and</strong>lord will assist in this process. If another Tenant (a
