regarding <strong>the</strong> regulati<strong>on</strong> of pharmacies<br />

may be avoided. Accordingly,<br />

enabling provisi<strong>on</strong>s respecting remote<br />

dispensing are being written<br />

in<strong>to</strong> <strong>the</strong>se c<strong>on</strong>solidated regula<strong>to</strong>ry<br />

amendments <strong>to</strong> <strong>the</strong> DPRA (Drug<br />

and Pharmacies Regulati<strong>on</strong> Act).<br />

It is <strong>the</strong> College’s intent <strong>to</strong> introduce<br />

<strong>the</strong>se as a complete package<br />

<strong>to</strong> <strong>the</strong> government. In additi<strong>on</strong>,<br />

stakeholder c<strong>on</strong>sultati<strong>on</strong>s and interprofessi<strong>on</strong>al<br />

health college meetings<br />

have begun <strong>on</strong> <strong>the</strong> enhanced<br />

scope of practice. <strong>Focus</strong> groups of<br />

fr<strong>on</strong>t-line practiti<strong>on</strong>ers will also be<br />

c<strong>on</strong>ducted around <strong>the</strong> province <strong>to</strong><br />

inform <strong>the</strong> drafting of regulati<strong>on</strong>s<br />

regarding scope.<br />

By-law amendments<br />

Ratified<br />

Following circulati<strong>on</strong> of a new general<br />

operating by-law, which amends<br />

various secti<strong>on</strong>s of <strong>the</strong> current bylaw<br />

<strong>to</strong> incorporate changes <strong>to</strong> <strong>the</strong><br />

electi<strong>on</strong>s procedures, integrati<strong>on</strong> of<br />

technician members and o<strong>the</strong>r miscellaneous<br />

matters <strong>to</strong> bring it in line<br />

with current procedures and reflect<br />

best practices, <strong>the</strong> by-law was also<br />

fur<strong>the</strong>r re-examined internally by<br />

legal counsel <strong>to</strong> determine how <strong>to</strong><br />

address implementati<strong>on</strong> in <strong>the</strong> event<br />

that proclamati<strong>on</strong> of <strong>the</strong> registrati<strong>on</strong><br />

regulati<strong>on</strong> and <str<strong>on</strong>g>Pharmacy</str<strong>on</strong>g> Act<br />

changes enabling registrati<strong>on</strong> of<br />

pharmacy technicians was not received<br />

in time for electi<strong>on</strong>s. To that<br />

end, changes were proposed <strong>to</strong> several<br />

secti<strong>on</strong>s <strong>to</strong> enable <strong>the</strong> by-law<br />

<strong>to</strong> come in<strong>to</strong> force with provisi<strong>on</strong>s<br />

for electi<strong>on</strong> of technicians <strong>to</strong> take<br />

place up<strong>on</strong> passage of <strong>the</strong> regula<strong>to</strong>ry<br />

and legislative changes, should <strong>the</strong>se<br />

occur later.<br />

Council ratified <strong>the</strong> by-laws<br />

which became effective immediately.<br />

Council Ratifies proposed<br />

amendments <strong>to</strong> <strong>the</strong> Drug<br />

and Pharmacies Regulati<strong>on</strong><br />

Act<br />

Subsequent <strong>to</strong> Council’s c<strong>on</strong>siderati<strong>on</strong><br />

and preliminary approval in<br />

December 2009 of proposed<br />

amendments <strong>to</strong> <strong>the</strong> Drug and Pharmacies<br />

Regulati<strong>on</strong> Act (DPRA) <strong>to</strong><br />

c<strong>on</strong>solidate Regulati<strong>on</strong>s 551/90<br />

and 297/96 and <strong>to</strong> amend certain<br />

porti<strong>on</strong>s of <strong>the</strong> Regulati<strong>on</strong>s, <strong>the</strong><br />

c<strong>on</strong>solidated versi<strong>on</strong> of <strong>the</strong> Regulati<strong>on</strong>s,<br />

<strong>to</strong>ge<strong>the</strong>r with a comparis<strong>on</strong><br />

chart, was circulated <strong>to</strong> members<br />

for comment.<br />

Following <strong>the</strong> review of received<br />

comments, some of which required<br />

simple clarificati<strong>on</strong> and o<strong>the</strong>rs which<br />

repeated past submissi<strong>on</strong>s, five additi<strong>on</strong>al<br />

amendments were made:<br />

- Replacing <strong>the</strong> definiti<strong>on</strong> of “electr<strong>on</strong>ic<br />

signature” with that in<br />

<strong>the</strong> Electr<strong>on</strong>ic Commerce Act:<br />

(i.e. “electr<strong>on</strong>ic informati<strong>on</strong> that a<br />

pers<strong>on</strong> creates or adopts in order<br />

<strong>to</strong> sign a document and that is in,<br />

attached <strong>to</strong> or associated with <strong>the</strong><br />

document”)<br />

- clarificati<strong>on</strong> that pseudoephedrine<br />

and ephedrine are drugs<br />

in Ontario. Although it was <strong>the</strong><br />

intenti<strong>on</strong> of both <strong>the</strong> College and<br />

<strong>the</strong> Ministry of Health and L<strong>on</strong>g-<br />

Term Care that <strong>the</strong>se substances<br />

remain drugs when <strong>the</strong> definiti<strong>on</strong><br />

of a drug was revised in 2007, both<br />

parties c<strong>on</strong>sider it important <strong>to</strong><br />

provide greater clarity since <strong>the</strong>se<br />

products are now also designated<br />

as natural health products. Provisi<strong>on</strong><br />

(f) of <strong>the</strong> definiti<strong>on</strong> of a drug<br />

will ensure that <strong>the</strong>y are sold in<br />

a manner which protects against<br />

diversi<strong>on</strong> and illicit use<br />

- A change in wording <strong>to</strong> <strong>the</strong> secti<strong>on</strong><br />

c<strong>on</strong>cerning <strong>the</strong> knowledge<br />

of <strong>the</strong> designated manager of <strong>the</strong><br />

specifics of any agreement where<br />

a pharmacy discloses n<strong>on</strong> patient<br />

identifiable informati<strong>on</strong> <strong>to</strong> a third<br />

party. A copy of such an agreement<br />

would not necessarily be<br />

required <strong>to</strong> be provided <strong>to</strong> <strong>the</strong><br />

designated manager, but <strong>the</strong>y must<br />

be made aware of its existence<br />

and be assured of <strong>the</strong> fact that no<br />

patient identifiable informati<strong>on</strong><br />

would be included<br />

- definiti<strong>on</strong> of “benefit” as it relates<br />

<strong>to</strong> c<strong>on</strong>flict of interest is clarified <strong>to</strong><br />

exclude those permitted by law<br />

- clarificati<strong>on</strong> of secti<strong>on</strong> 40.(2) <strong>to</strong><br />

include “all prescripti<strong>on</strong> records” for<br />

maintenance of records as opposed<br />

<strong>to</strong> “written” prescripti<strong>on</strong>s.<br />

U of T’s Satellite IPG Pilot<br />

receives approval<br />

Council approved <strong>the</strong> University of<br />

Tor<strong>on</strong><strong>to</strong>’s proposal for a <strong>on</strong>e-time<br />

pilot delivery of a satellite IPG Program<br />

in Egypt in spring 2010.<br />

The faculty at <strong>the</strong> University of<br />

Tor<strong>on</strong><strong>to</strong> has been c<strong>on</strong>sidering strategies<br />

<strong>to</strong> improve access <strong>to</strong> <strong>the</strong> IPG<br />

program both geographically and<br />

financially and this program is being<br />

offered as a <strong>on</strong>e time pilot, with<br />

pharmacyc<strong>on</strong>necti<strong>on</strong> • May/June 2010<br />
