WARRANTY<br />
FOR FIRST FIT APPLICATIONS<br />
(DOES NOT APPLY IN CALIFORNIA)<br />
<strong>Cummins</strong> Emission Solutions warrants its diesel particulate filter (“Product”) to be free of defects in<br />
materials and workmanship commencing on the sale by <strong>Cummins</strong> Emissions Solutions and expiring on the<br />
earliest of the following periods:<br />

The Product must be installed on the appropriate diesel engine. Installation must also be in accordance<br />
with all of <strong>Cummins</strong> Emission Solutions’ written instructions and applicable installation manuals as well as<br />
those of the engine manufacturer per the information provided on the engine’s datasheet. In the event any<br />
<strong>Cummins</strong> Emission Solutions Product is determined by <strong>Cummins</strong> Emission Solutions to be defective in<br />
material or workmanship prior to the expiration of the Warranty, <strong>Cummins</strong> Emission Solutions will repair,<br />
replace or, at <strong>Cummins</strong> Emission Solutions’ discretion, make a full refund of the Product’s original<br />
purchase price. Before expiration of the Warranty, owner must notify a <strong>Cummins</strong> Inc. distributor, dealer or<br />
other authorized repair location of any suspected warrantable failure and make the Product available for<br />
repair at such facility.<br />
LIMITATIONS:<br />
This Warranty on the Product does not cover damage or repair to the Product which is the result of:<br />
� Improper installation of the Product or installation incompatible with the vehicle or equipment<br />
application information as provided to <strong>Cummins</strong> Emission Solutions.

� Misuse (including but not limited to fuel system tampering), neglect, accident, improper maintenance,<br />
abuse, unauthorized modifications to the Product or engine, or continued operation of the engine after<br />
a suspected warrantable failure is known or should have been known to have occurred.<br />
� Engine oil consumption, including particulate matter generation beyond the guidelines as set by the<br />
engine manufacturer.<br />
� Installation on an engine other than as recommended by <strong>Cummins</strong> Emission Solutions or the engine<br />
manufacturer.<br />
� Where any substances present in the exhaust stream are outside of guidelines as set by the engine<br />
manufacturer.<br />
� Improper inspection, cleaning or any attempt to repair the Product by anyone other than authorized<br />
personnel.<br />
� .Act of God.<br />
� Use of lube oil blended with diesel fuel or any other fluids not approved by <strong>Cummins</strong> Emission<br />
Solutions.<br />
� Failure to follow engine manufacturer maintenance and operating procedures. Proper engine<br />
manufacturer maintenance and operating procedures are understood to be those procedures<br />
recommended by the engine manufacturer to ensure engine longevity and operation.<br />
� Use of fuel and/or oil additives not recommended or approved by the <strong>Cummins</strong> Emission Solutions or<br />
the engine manufacturer.<br />
� Use of fuels containing sulfur or other chemical elements beyond guidelines as set by the <strong>Cummins</strong><br />
Emission Solutions or engine manufacturer for the appropriate device and calibration for the specific<br />
engine. Sulfur levels must not exceed 0.005% (five one thousandths of one percent) by weight (50<br />
PPM).<br />
� Where the root cause of the damage is due to an engine malfunction.<br />
A new or approved rebuilt part used in the repair or replacement of a Product having a warrantable failure<br />
assumes the identity of the Product it replaced and is entitled to the remaining warranty coverage<br />
hereunder.<br />
This Warranty does not cover wear or wear out of the Product.<br />
Progressive engine damage due to the Product defect in material or workmanship is not covered under this<br />
Warranty.<br />
Each installation must have a <strong>Cummins</strong> Emission Solutions-approved emission control system monitoring<br />
device.<br />
OWNER RESPONSIBILITIES:<br />
Service and warranty coverage of a suspected defect in material or workmanship of a Product covered by<br />
this Warranty must be performed under the terms and conditions herein.<br />
Owner is responsible for non-Product repairs, “downtime” expenses, cargo damage, fines, all applicable<br />
taxes, business costs, and other losses resulting from a warrantable failure.<br />
To assist in validating a Warranty claim <strong>Cummins</strong> Emission Solutions or the engine, vehicle or equipment<br />
manufacturer or its representatives may, at its discretion, require:<br />

1. Physical inspection of the engine, vehicle and/or equipment using the Product.<br />
2. Information acquired by the manufacturer, dealer, purchaser and/or user relative to the Product’s<br />
application and use.<br />
3. <strong>Cummins</strong> Emission Solutions reserves the right to require return of the Product to <strong>Cummins</strong> Emission<br />
Solutions for coverage determination.<br />
4. If the Product failure is warrantable and the Product is either replaced or a refund is paid, ownership of<br />
the failed Product shall pass to <strong>Cummins</strong> Emission Solutions.<br />
WITH THE EXCEPTIONS OF THE WARRANTIES PROVIDED HEREIN, THIS WARRANTY<br />
IS THE SOLE WARRANTY CUMMINS EMISSION SOLUTIONS MAKES NO OTHER<br />
WARRANTIES, EXPRESS OR IMPLIED. CUMMINS EMISSION SOLUTIONS MAKES NO<br />
WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, DESIGN,<br />
CONDITION, PERFORMANCE OR ANY OTHER ASPECT OF THE PRODUCT, ITS<br />
MATERIAL OR WORKMANSHIP.<br />
IN NO EVENT SHALL CUMMINS EMISSION SOLUTIONS BE LIABLE FOR INCIDENTAL,<br />
CONSEQUENTIAL OR SPECIAL DAMAGES.<br />
This Warranty supercedes any and all other <strong>Cummins</strong> Emission Solutions Warranty Statements applicable<br />
to the Product, except with regard to Product sold or registered in <strong>California</strong>.<br />
