MINUTES OF MEETING<br />

BOARD OF COUNTY COMMISSIONERS OF SARPY COUNTY, NEBRASKA<br />

June 3, 1997<br />

A <strong>meeting</strong> <strong>of</strong> the Board <strong>of</strong> <strong>County</strong> Commissioners <strong>of</strong> <strong>Sarpy</strong> <strong>County</strong>, Nebraska was convened in open and public session at 4:00<br />

P.M. on June 3, 1997 at the Courthouse in Papillion, Nebraska. Present: Thomas O’Hara, Tim Gay, Bart Bonn, Don Knott<br />

Sr., Tim Schram, Board Administrator Mark Wayne and Debra J. Houghtaling, <strong>County</strong> Clerk.<br />

Notice <strong>of</strong> the <strong>meeting</strong> was given in advance thereto by publication in the Bellevue Leader on May 28, 1997, a copy <strong>of</strong> the Pro<strong>of</strong><br />

<strong>of</strong> Publication is on file in the <strong>County</strong> Clerk's <strong>of</strong>fice. Notice <strong>of</strong> the <strong>meeting</strong> was simultaneously given to all members <strong>of</strong> the<br />

Board <strong>of</strong> <strong>County</strong> Commissioners <strong>of</strong> <strong>Sarpy</strong> <strong>County</strong>, Nebraska. Availability <strong>of</strong> the agenda was communicated in the published<br />

notice and in the notice to members <strong>of</strong> the Board <strong>of</strong> <strong>County</strong> Commissioners <strong>of</strong> this <strong>meeting</strong>. All proceedings were taken while<br />

the convened <strong>meeting</strong> was open to the attendance <strong>of</strong> the public.<br />

Commissioners' comments were recorded.<br />

Commissioner Bonn requested that item # 4 (Approve claims) be removed from the Consent Agenda and placed on the<br />

Regular Agenda.<br />

Knott moved, seconded by O’Hara, to approve the Consent Agenda as amended with the removal <strong>of</strong> item #4 . Ayes: O’Hara,<br />

Gay, Knott, Bonn & Schram. Nays: None.<br />

CONSENT AGENDA:<br />

Knott moved, seconded by O’Hara, to approve the minutes <strong>of</strong> the May 27, 1997 <strong>meeting</strong> as submitted. Ayes: O’Hara, Gay,<br />

Knott, Bonn & Schram. Nays: None.<br />

Resolved by Knott, seconded by O’Hara, to authorize the Chairman to sign an Amendment to the Agreement with Omaha-<br />

Council Bluffs Metropolitan Area Planning Agency , Contract No. 524-200, for the administration <strong>of</strong> the NDED Community<br />

Development Block Grant No. 93-DW-026, Public Work Flood Recovery Program, extending the completion date to July 31,<br />

1997. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

REGULAR AGENDA:<br />

Bonn moved, seconded by Knott, to approve the claims as submitted by Debra J. Houghtaling, <strong>Sarpy</strong> <strong>County</strong> Clerk, and<br />

authorize the <strong>County</strong> Clerk to issue warrants for said claims except hold Claim No. 97-08296 to Husker Steel in the amount <strong>of</strong><br />

$8,856 to determine if informal bids are needed. A complete listing <strong>of</strong> claims is on file in the <strong>of</strong>fice <strong>of</strong> the <strong>County</strong> Clerk. Ayes:<br />

O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

A discussion was held concerning 54th Street construction across Timmerman Farms to connect with Schram Road or Maass<br />

Road.<br />

Gay moved, seconded by Knott, to sit as a Board <strong>of</strong> Equalization. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Knott moved, seconded by Gay, to approve the applications for 1997 Tax Exemption on Real and Personal Property by<br />

Qualifying Organizations (Form 451) for 1) Trinity Evangelical Lutheran Church, 2) Papillion Gun Club, Inc. 3) Millard Star<br />

Soccer Assoc. Commissioner Knott withdrew his motion.<br />

O’Hara moved, seconded by Gay, to approve the application <strong>of</strong> Trinity Evangelical Lutheran Church for 1997 Tax Exemption<br />

on Real and Personal Property by Qualifying Organization (Form 451) on property described as Tax Lots 34B & 35A, 27-14-12,<br />

<strong>Sarpy</strong> <strong>County</strong>, NE., as recommended by the <strong>County</strong> Assessor. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Knott moved, seconded by Gay, to approve a 75% reduction <strong>of</strong> the tax due based on the application <strong>of</strong> Papillion Gun Club,<br />

Inc. for 1997 Tax Exemption on Real and Personal Property by Qualifying Organization (Form 451) on property described as<br />

Tax Lots 18B & 19B, 27-13-12, <strong>Sarpy</strong> <strong>County</strong>, NE. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Gay moved, seconded by Knott, to approve the application <strong>of</strong> Millard Star Soccer Assoc. for 1997 Tax Exemption on Real and<br />

Personal Property by Qualifying Organization (Form 451) on property described as Pt. Tax Lot 2C, 15-14-11, <strong>Sarpy</strong> <strong>County</strong>, NE.<br />

(14.43 ac), as recommended by the <strong>County</strong> Assessor. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.

Gay moved, seconded by Knott, to return to regular session. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Bonn moved, seconded by Knott, to approve the following Flood Plain Permit, as approved by the Building Inspector: Carl C.<br />

Acuff, 3212 Annebelle Dr., Lot 31 Chris Lake, Platte River, 10' x 14' shed on concrete slab. Ayes: O’Hara, Gay, Knott, Bonn<br />

& Schram. Nays: None.<br />

Resolved by Knott, seconded by O’Hara, to approve and authorize the Chairman to sign a Change Order to the contract with<br />

U.S. Asphalt Company for Project No. C-77(97-9)A to add the asphalt paving <strong>of</strong> 23rd Street, between Childs Road and Virginia<br />

Street, and Virginia Street, between 23rd Street and 25th Street, additional cost $14,300. Ayes: O’Hara, Gay & Knott. Nays:<br />

Bonn & Schram.<br />

As advertised a public hearing was held regarding the application for a public works grant for an economic development project<br />

to assist in the expansion <strong>of</strong> the Werner Enterprises transportation operation at approximately I-80 and Hwy. 50. No public<br />

comments were <strong>of</strong>fered.<br />

Knott resolved , seconded by Bonn, that the Chairman is authorized and directed to proceed with formulation <strong>of</strong> any and all<br />

contracts, documents, or other memoranda between <strong>Sarpy</strong> <strong>County</strong> and the Nebraska Department <strong>of</strong> Economic Development so<br />

as to effect the acceptance <strong>of</strong> the Community Development Block Grant Application for Public Works Grant for the relocation<br />

and paving <strong>of</strong> Cornhusker Road in a configuration that will accommodate truck traffic and improvements to Hwy 50 access at<br />

Cornhusker Road and Prairie Corners Road associated with the Werner Enterprises expansion, CDBG funds requested<br />

$502,000. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Knott moved, seconded by O’Hara, to authorize application for a Comprehensive Communities Policing Grant (CCPG) entitled<br />

“Issues in Rural Communities” to provide for the implementation <strong>of</strong> a bicycle patrol program for the <strong>Sarpy</strong> <strong>County</strong> Sheriff’s<br />

Department, total amount requested $68,994.40. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />

Resolved by Bonn, seconded by O’Hara, to approve and authorize the Chairman to sign the Master Cooperative Agreement<br />

between the Papio-Missouri River Natural Resources District, <strong>Sarpy</strong> <strong>County</strong> Board <strong>of</strong> Commissioners, Nebraska Natural<br />

Resources Commission, Board <strong>of</strong> Regents University <strong>of</strong> Nebraska and Natural Resources Conservation Service <strong>of</strong> the United<br />

States Department <strong>of</strong> Agriculture for update <strong>of</strong> the soil survey <strong>of</strong> <strong>Sarpy</strong> <strong>County</strong>, Nebraska. Ayes: O’Hara, Gay, Knott, Bonn &<br />

Schram. Nays: None.<br />

Resolved as amended by Bonn, seconded by O’Hara, that pursuant to Neb. Rev. Stat. §39-1722, et seq. (Reissue 1993) that a<br />

portion <strong>of</strong> 232nd Street between Angus Road and Lincoln Road within the Equestrian Ridge Estates Subdivision located in<br />

<strong>Sarpy</strong> <strong>County</strong>, all as further described in legal description attached to said resolution, is hereby vacated subject to any existing<br />

easements and utility improvements; further that said vacation is conditioned upon the owner complying with the following<br />

conditions:<br />

1. If a gate is constructed across the vacated 232nd Street, any access code or changes to the<br />

access code be provided to the <strong>Sarpy</strong> <strong>County</strong> Sheriff’s Office, the <strong>Sarpy</strong> <strong>County</strong> E-911 Center,<br />

and the Gretna Volunteer Fire Department.<br />

2. The addresses <strong>of</strong> all homes constructed along 232nd Street be provided to the <strong>Sarpy</strong> <strong>County</strong><br />

Sheriff’s Office, the <strong>Sarpy</strong> <strong>County</strong> E-911 Center, and the Gretna Volunteer Fire Department.<br />

3. If a gate is constructed across the vacated 232nd Street, a bypass mechanism be installed to<br />

allow emergency access in the event <strong>of</strong> a mechanical or electrical failure.<br />

At 5:20 p.m. Knott moved, seconded by O’Hara , to adjourn until June 10, 1997 at 7:00 p.m. preceded by a liaison and<br />

administrative report <strong>meeting</strong> beginning at 5:30 p.m. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.<br />
