office held by the alleged borrowers, i.e. Members of the Batasang Pambansa. In Chavez<br />
v. PCGG, 115 it was the recovery of the ill-gotten Marcos wealth and the proposed<br />
compromise agreement relating t<strong>here</strong>to. In Chavez v. PEA-Amari, 116 it was a large-scale<br />
government contract involving the alienation of reclaimed lands in violation of the<br />
Constitution.<br />
The JPEPA is clearly a matter of public concern and interest on a scope that is<br />
comparable to – and even far greater than - the matters in the cases mentioned above.<br />
As discussed previously, the JPEPA is an important and historic international<br />
trade agreement that stands to affect virtually all of the country’s domestic and<br />
international trade. The JPEPA covers practically all tariff lines in the Tariff and Customs<br />
Code, and will thus have a tremendous impact on the country’s manufacturing and<br />
agricultural sectors, particularly affecting job security, employment, and production<br />
capacity in these sectors. The JPEPA’s provisions on trade in services and the movement<br />
of natural persons will likewise impact on the <strong>Philippine</strong> services sector, particularly with<br />
respect to in<strong>for</strong>mation technology and health care, and may have ramifications on the<br />
<strong>Philippine</strong> public health system. The JPEPA will also dictate who will be authorized to do<br />
business in the <strong>Philippine</strong>s and under what conditions, and may effectively re-write<br />
existing laws and Constitutional provisions pertaining to investment and nationality<br />
requirements. The JPEPA may likewise entail changes in <strong>Philippine</strong> policy and legislation<br />
with respect to the areas of competition policy, intellectual property, government<br />
procurement, cooperation, and improvement of the business environment.<br />
Moreover, the fact that the JPEPA will be a “first” <strong>for</strong> the <strong>Philippine</strong>s in many<br />
respects makes it a precedent-setting case that will set the stage <strong>for</strong> all future trade<br />
engagements of the country. If not negotiated properly, the JPEPA may seriously impair<br />
existing trade commitments and even compromise negotiating positions that the<br />
<strong>Philippine</strong> may possibly take in the future.<br />
