Introduction<br />

The Scottish Government issued a Public Consultation 1 into the eligible intervention<br />

area for investment <strong>of</strong> public funds into broadband infrastructure on 1 st October<br />

2012. The period <strong>of</strong> consultation closed on 28 th November 2012. A Public<br />

Consultation Report 2 was published on 3 rd January 2013, extending the period <strong>of</strong><br />

consultation to 11 th January 2013.<br />

In January 2012, the Scottish Government published <strong>Scotland</strong>’s Digital Future –<br />

<strong>Infrastructure</strong> <strong>Action</strong> <strong>Plan</strong> 3 that set out how the Government will deliver its strategic<br />

targets up to 2020. <strong>Scotland</strong>’s Digital Future – <strong>Infrastructure</strong> <strong>Action</strong> <strong>Plan</strong> – <strong>Step</strong><br />

<strong>Change</strong> <strong>2015</strong> – Procurement <strong>Plan</strong> 4 , published in May 2012, set out how the Scottish<br />

Government will procure the first step towards the 2020 targets. The procurement is<br />

split into two gap funded public sector interventions in the market – one in the<br />

Highlands and Islands and the other in the rest <strong>of</strong> <strong>Scotland</strong>.<br />

This Public Consultation is relevant to the “rest <strong>of</strong> <strong>Scotland</strong>” procurement.<br />

Purpose <strong>of</strong> this State Aid Public Consultation Report<br />

Under the European Commission’s State Aid guidelines, public sector intervention in<br />

broadband infrastructure investment is limited to those areas where there is no<br />

current or planned (within the next 3 years) commercial deployments, to avoid<br />

distorting what might otherwise be/become a competitive market.<br />

The Scottish Government carried out an Open Market Review <strong>of</strong> all current and<br />

planned infrastructure within the scope area in July 2012. The submitted data<br />

allowed us to produce a draft intervention area for the Public Consultation.<br />

The Public Consultation is now complete and this revised report sets out the<br />

responses to both the initial and extended periods <strong>of</strong> consultation and the actions<br />

that the Scottish Government has taken as a direct result <strong>of</strong> those responses.<br />

A total <strong>of</strong> nineteen responses were submitted, thirteen during the initial consultation<br />

period and a further six were submitted during the extended consultation period.<br />

Four responses asked to be treated in the strictest confidence. The table below<br />

Revised Mapping Methodology<br />

As a result <strong>of</strong> the Public Consultation, the Scottish Government has revised its<br />

mapping methodology in order to maximise the number <strong>of</strong> white postcode areas<br />

against both Basic Broadband and Next Generation. This is to minimise the number<br />

<strong>of</strong> white premises out <strong>of</strong> scope <strong>of</strong> the procurement.<br />

The mapping is displayed using the European Commission’s geographic market<br />

definitions for broadband areas, which are classed as Basic Broadband Black, Grey<br />

or White areas and Next Generation Broadband Black, Grey or White areas. Both<br />

maps are presented by postcode area.<br />

Figure 1 shows the current and planned (3 years) provision <strong>of</strong> basic broadband<br />

(speeds in excess <strong>of</strong> 2Mbps) in the rest <strong>of</strong> <strong>Scotland</strong> while Figure 2 shows the current<br />

and planned provision <strong>of</strong> next generation broadband (speeds <strong>of</strong> at least 24Mbps).<br />

For the Basic Broadband map (figure 1), each postcode is turned Grey if greater<br />

than 90% <strong>of</strong> delivery points have access to connection speeds in excess <strong>of</strong> 2Mbps<br />

from any single provider. Postcodes are displayed as Black if greater than 90% <strong>of</strong><br />

delivery points have access to connection speeds in excess <strong>of</strong> 2Mbps from more<br />

than one provider. All other postcodes are displayed White.<br />

For the Next Generation Broadband map (figure 2), each postcode is turned Grey if<br />

greater than 90% <strong>of</strong> delivery points have access to connection speeds in excess <strong>of</strong><br />

24Mbps from any single provider. Postcodes are displayed as Black if greater than<br />

90% <strong>of</strong> delivery points have access to connection speeds in excess <strong>of</strong> 24Mbps from<br />

more than one provider. All other postcodes are displayed White.<br />

In areas where there is more than one supplier, the Scottish Government has<br />

assumed maximum overlap <strong>of</strong> coverage e.g. if supplier A covers 50% <strong>of</strong> premises<br />

and supplier B covers 70% <strong>of</strong> premises, the assumption is that 70% <strong>of</strong> premises are<br />

covered and therefore the postcode is displayed as white. This methodology allows<br />

us to maximise white postcode areas thereby minimising white premises out <strong>of</strong><br />

scope. At the detailed survey stage <strong>of</strong> the implementation, the supplier will be<br />

expected to confirm actual coverage.<br />

Both maps are shown including a 10km “buffer” zone around the procurement area.<br />

While the <strong>Rest</strong> <strong>of</strong> <strong>Scotland</strong> procurement is intended to address broadband coverage<br />

within its geographic scope, it is recognised that some areas within scope will be<br />

served by infrastructure outwith the procurement boundary.<br />

The Scottish Government is working with neighbouring regions to ensure that the<br />

optimum solution for tackling areas <strong>of</strong> coverage that span the borders is achieved.<br />

The three projects are:<br />

Using the criteria illustrated above, the total eligible premises for intervention are as<br />

follows:<br />

• Basic Broadband 38,565 in 9,021 postcode areas.<br />

• Next Generation Broadband 690,614 in 56,034 postcode areas.<br />

In the reference postcode dataset used by the Scottish Government (provided by<br />

National Records <strong>of</strong> <strong>Scotland</strong>), total delivery points do not in all cases equal the sum<br />

<strong>of</strong> total residential and non-residential delivery points. This is due to the estimation <strong>of</strong><br />

multiple households served by a single delivery point in the Royal Mail postcode<br />

address file. Where this arises, it is recognised that the number <strong>of</strong> households<br />

The Scottish Government used the information in this report to define the<br />

Intervention Area in order to submit an application for State Approval to invest public<br />

funds into the deployment <strong>of</strong> broadband infrastructure within the <strong>Rest</strong> <strong>of</strong> <strong>Scotland</strong><br />

area.<br />

Following approval, the Scottish Government issued an Invitation to Tender for the<br />

provision <strong>of</strong> broadband infrastructure with an expectation to award a contract in the<br />

first half <strong>of</strong> 2013.<br />
