SPOTLIGHT<br />
governs the duties of state agencies regard<strong>in</strong>g designation<br />
of groundwater management areas and critical areas, and<br />
Chapter 36 (Groundwater Conservation <strong>Districts</strong>), which<br />
consolidates the provisions of the Water Code govern<strong>in</strong>g<br />
groundwater districts. 3 5<br />
ffGroundwater Management Areas<br />
Chapter 35 (Groundwater Studies), Water Code,<br />
authorizes the creation of groundwater management<br />
areas, consistent with the objectives of Section 59,<br />
Article XVI, <strong>Texas</strong> Constitution, <strong>in</strong> order to provide for<br />
the conservation, preservation, protection, recharg<strong>in</strong>g,<br />
and prevention of waste of the groundwater and of<br />
groundwater reservoirs or their subdivisions and to<br />
control subsidence caused by withdrawal of water from<br />
those groundwater reservoirs or their subdivisions. The<br />
statute directs the <strong>Texas</strong> Water Development Board<br />
(TWDB), <strong>in</strong> cooperation with TCEQ, to designate<br />
groundwater management areas not later than September<br />
1, 2003. TWDB is directed by the chapter to consider the<br />
boundaries of a subdivision of a groundwater reservoir<br />
or aquifer and the boundaries of political subdivisions or<br />
exist<strong>in</strong>g groundwater conservation districts <strong>in</strong> determ<strong>in</strong><strong>in</strong>g<br />
groundwater management areas. In December 2002,<br />
TWDB designated 16 groundwater management areas<br />
cover<strong>in</strong>g the entire state. Only one of these areas does<br />
not <strong>in</strong>clude any groundwater conservation districts.<br />
Chapter 35 <strong>in</strong>cludes provisions to designate priority<br />
groundwater management areas and address those<br />
areas of the state that are experienc<strong>in</strong>g or are expected<br />
to experience with<strong>in</strong> 25 years critical groundwater<br />
problems. The statute establishes procedures through<br />
which TCEQ may designate priority groundwater<br />
<strong>Special</strong> <strong>Purpose</strong> <strong>Districts</strong><br />
management areas and stipulates that the designation of<br />
such an area must recommend that the area be covered<br />
by a district that has the authority to regulate the spac<strong>in</strong>g<br />
of water wells, the production from water wells, or both.<br />
This must be accomplished either through the creation<br />
of one or more new districts, the addition of the land<br />
<strong>in</strong> the groundwater management area to one or more<br />
exist<strong>in</strong>g districts, or a comb<strong>in</strong>ation of these approaches.<br />
Landowners <strong>in</strong> a priority management area may create<br />
one or more districts or have the area annexed to a<br />
district that adjo<strong>in</strong>s the area. If a recommendation to<br />
add a priority management area to an exist<strong>in</strong>g district is<br />
made and accepted by the board of the exist<strong>in</strong>g district,<br />
an election on the issue is held with<strong>in</strong> the priority<br />
groundwater management area.<br />
ffGroundwater Conservation <strong>Districts</strong><br />
Chapter 36 (Groundwater Conservation <strong>Districts</strong>),<br />
Water Code, provides for the creation of groundwater<br />
conservation districts <strong>in</strong> order to address the conservation,<br />
preservation, protection, recharg<strong>in</strong>g, and prevention of<br />
waste of groundwater and of groundwater reservoirs or<br />
their subdivisions and to control subsidence caused by<br />
withdrawal of water from those groundwater reservoirs<br />
or their subdivisions.<br />
Accord<strong>in</strong>g to Chapter 36, a groundwater conservation<br />
district may be created under and subject to Section 59,<br />
Article XVI, <strong>Texas</strong> Constitution. A district may <strong>in</strong>clude<br />
all or part of one or more counties, cities, districts, or<br />
other political subdivisions, but may not <strong>in</strong>clude territory<br />
located <strong>in</strong> more than one county except upon approval<br />

which stipulates that Sections 49.052, 49.216, and 49.301 through 49.308,<br />
Water Code, do not apply to districts governed by Chapter 52. However,<br />
the provisions of Chapter 49 (Provisions Applicable to All <strong>Districts</strong>),<br />
Water Code, already do not apply to most districts governed by Chapter<br />
36, Water Code, the statute created to replace Chapter 52. Therefore, <strong>in</strong><br />
most cases, Section 52.005(c) has no substantive legal effect.<br />
Chapter 49 does, however, apply to a district governed by Chapter<br />
36 if a special law creat<strong>in</strong>g the district or amend<strong>in</strong>g the law that created<br />
the district stipulates that Chapter 49 applies. Therefore, there may be<br />
circumstances <strong>in</strong> which a groundwater conservation district, due to special<br />
or local laws, may be governed jo<strong>in</strong>tly by Chapters 36 and 49. Under<br />
such a circumstance, the exclusionary provision of Section 52.005(c) may<br />
apply. However, the attorney general has never expressed an op<strong>in</strong>ion on<br />
this issue and it is uncerta<strong>in</strong> whether Section 52.005(c) would <strong>in</strong>deed have<br />
any substantive effect <strong>in</strong> this event.<br />
