DRIVER AUTHORISATION -<br />

EFFECT OF A DRIVING HISTORY<br />

General<br />

Legislation exists in Queensland to improve the public passenger transport system. The Transport<br />

Operations (Passenger Transport) Act 1994 requires drivers <strong>of</strong> public passenger services to be<br />

authorised to provide services in Queensland.<br />

Separate information bulletins provide further information on the effect <strong>of</strong> a driver disqualifying<br />

<strong>of</strong>fence and <strong>Driver</strong> <strong>Authorisation</strong> requirements for the different categories <strong>of</strong> passenger transport<br />

services.<br />

What is a <strong>Driving</strong> <strong>History</strong>?<br />

A person's driving history is the record <strong>of</strong> important events that have affected their driver licence.<br />

The record notes particulars <strong>of</strong> the licence including applications, appointments, determinations,<br />

notifications, demands, directions, cancellations, suspensions, surrenders, authorisations,<br />

approvals, or orders issued, made or given under this state's Transport Operations (Road Use<br />

Management) Act 1995, and equivalent interstate and overseas law. These particulars are kept by<br />

Queensland Transport.<br />

Criteria to Amend, Suspend, Cancel or Refuse <strong>Driver</strong> <strong>Authorisation</strong><br />

The criteria for deciding how a driving history will impact on a <strong>Driver</strong> <strong>Authorisation</strong> relates to how it<br />

demonstrates a person's competence to drive a vehicle safely.<br />

Depending on a person's driving history, the Director-General, Queensland Transport may:<br />

• either refuse to grant <strong>Driver</strong> <strong>Authorisation</strong> to a person, or<br />

• amend, suspend, cancel or refuse to renew a <strong>Driver</strong> <strong>Authorisation</strong> already held by a<br />

driver <strong>of</strong> a public passenger vehicle.


The following criteria are to be followed when assessing the driver’s driving history in terms <strong>of</strong> the<br />

acceptability <strong>of</strong> drivers' policy:<br />

1. A driver <strong>of</strong> a public passenger vehicle must hold the appropriate type <strong>of</strong> licence <strong>of</strong> either:<br />

a) a current Australian open driver licence, including a good driving behaviour period after<br />

the accumulation <strong>of</strong> demerit points, or<br />

b) a restricted driver licence issued under section 87 <strong>of</strong> the Transport Operations (Road<br />

Use Management) Act 1995 - that is, following disqualification <strong>of</strong> a person for drink<br />

driving. Please note, the restricted licence must authorise the holder to drive a public<br />

passenger vehicle.<br />

2. If a person does not comply with point one above, the person’s application will be refused or<br />

the person’s <strong>Driver</strong> <strong>Authorisation</strong> will be cancelled for not complying with a standard. (A<br />

provisional licence issued under any other provision is unacceptable).<br />

3. A driver <strong>of</strong> a public passenger vehicle must have held the appropriate class <strong>of</strong> licence for at<br />

least three years (five years in the case <strong>of</strong> a motorcycle).<br />

4. If a person does not comply with point three above, the person must satisfactorily complete a<br />

practical competence test or the person's application is to be refused. (In the case <strong>of</strong> a<br />

motorcycle, the licence must have been held for at least three years).<br />

5. If a person has a provisional licence issued under section 25(2)(a)(ii) <strong>of</strong> the Transport<br />

Operations (Road Use Management - <strong>Driver</strong> Licensing) Regulation 1999 in terms <strong>of</strong> point<br />

1(a) above, or a Restricted Licence under point 1(b) above, <strong>Driver</strong> <strong>Authorisation</strong> is to be<br />

issued for a maximum <strong>of</strong> 12 months.<br />

6. Where a person has an Australian open licence in terms <strong>of</strong> 1(a) above and has 10 or more<br />

finalised demerit points, <strong>Driver</strong> <strong>Authorisation</strong> is to be issued for a maximum <strong>of</strong> 12 months.<br />

7. Where a person has a drink driving traffic history:<br />

a) If:<br />

(i) it is the person’s first drink driving <strong>of</strong>fence,<br />

(ii) blood alcohol content (BAC) level was under 0.15%,<br />

(iii) the <strong>of</strong>fence was not in a public passenger vehicle, and<br />

(iv) there is no prior suspension/cancellation <strong>of</strong> the driver licence within the two<br />

preceding years.<br />

a waiting period <strong>of</strong> one year, from the end <strong>of</strong> the period <strong>of</strong> suspension/cancellation <strong>of</strong> the<br />

driver’s licence is to apply. (The person will have to hold an Australian open licence at the<br />

time <strong>of</strong> application).<br />

b) In all other circumstances, that is:<br />

(i)<br />

(ii)<br />

(iii)<br />

(iv)<br />

it is the person’s second (or more) drink driving <strong>of</strong>fence,<br />

it is the person’s first drink driving <strong>of</strong>fence, but blood alcohol content (BAC) level<br />

was 0.15% or higher,<br />

the <strong>of</strong>fence was in a public passenger vehicle, or<br />

there has been a prior suspension/cancellation <strong>of</strong> the driver licence within the<br />

preceding two years.<br />

a waiting period <strong>of</strong> two years, from the end <strong>of</strong> the period <strong>of</strong> suspension/cancellation <strong>of</strong> the<br />

<strong>Driver</strong> Licence is to apply. (The person will have to hold an Australian open licence at the<br />

time <strong>of</strong> application).<br />

8. Where a person has been charged with driving under the influence <strong>of</strong> drugs, the <strong>of</strong>fence will<br />

attract the same waiting period as if they had a blood alcohol content <strong>of</strong> 0.15% or higher. A<br />

waiting period <strong>of</strong> 2 years applies to this <strong>of</strong>fence.<br />

9. Where the person’s driver licence has been cancelled by a court, other than under the<br />

demerit points system, the criteria for drink driving is to apply.<br />

Overall, the following factors will be taken into consideration:<br />

• the severity <strong>of</strong> <strong>of</strong>fences, and<br />

• whether <strong>of</strong>fences occurred in a public passenger vehicle, and<br />

• the frequency <strong>of</strong> <strong>of</strong>fences.<br />

Review <strong>of</strong>, and Appeals Against, a Decision<br />

Should applicants be dissatisfied with the decision on their application, they may request a review<br />

<strong>of</strong> the decision by the director-general. If the applicant is not satisfied with the outcome <strong>of</strong> the<br />

review, then the applicant may appeal to a court in an attempt to overturn the decision. (For more<br />
