DRIVER AUTHORISATION -
EFFECT OF A DRIVING HISTORY
General
Legislation exists in Queensland to improve the public passenger transport system. The Transport
Operations (Passenger Transport) Act 1994 requires drivers of public passenger services to be
authorised to provide services in Queensland.
Separate information bulletins provide further information on the effect of a driver disqualifying
offence and Driver Authorisation requirements for the different categories of passenger transport
services.
What is a Driving History?
A person's driving history is the record of important events that have affected their driver licence.
The record notes particulars of the licence including applications, appointments, determinations,
notifications, demands, directions, cancellations, suspensions, surrenders, authorisations,
approvals, or orders issued, made or given under this state's Transport Operations (Road Use
Management) Act 1995, and equivalent interstate and overseas law. These particulars are kept by
Queensland Transport.
Criteria to Amend, Suspend, Cancel or Refuse Driver Authorisation
The criteria for deciding how a driving history will impact on a Driver Authorisation relates to how it
demonstrates a person's competence to drive a vehicle safely.
Depending on a person's driving history, the Director-General, Queensland Transport may:
• either refuse to grant Driver Authorisation to a person, or
• amend, suspend, cancel or refuse to renew a Driver Authorisation already held by a
driver of a public passenger vehicle.
The following criteria are to be followed when assessing the driver’s driving history in terms of the
acceptability of drivers' policy:
1. A driver of a public passenger vehicle must hold the appropriate type of licence of either:
a) a current Australian open driver licence, including a good driving behaviour period after
the accumulation of demerit points, or
b) a restricted driver licence issued under section 87 of the Transport Operations (Road
Use Management) Act 1995 - that is, following disqualification of a person for drink
driving. Please note, the restricted licence must authorise the holder to drive a public
passenger vehicle.
2. If a person does not comply with point one above, the person’s application will be refused or
the person’s Driver Authorisation will be cancelled for not complying with a standard. (A
provisional licence issued under any other provision is unacceptable).
3. A driver of a public passenger vehicle must have held the appropriate class of licence for at
least three years (five years in the case of a motorcycle).
4. If a person does not comply with point three above, the person must satisfactorily complete a
practical competence test or the person's application is to be refused. (In the case of a
motorcycle, the licence must have been held for at least three years).
5. If a person has a provisional licence issued under section 25(2)(a)(ii) of the Transport
Operations (Road Use Management - Driver Licensing) Regulation 1999 in terms of point
1(a) above, or a Restricted Licence under point 1(b) above, Driver Authorisation is to be
issued for a maximum of 12 months.
6. Where a person has an Australian open licence in terms of 1(a) above and has 10 or more
finalised demerit points, Driver Authorisation is to be issued for a maximum of 12 months.
7. Where a person has a drink driving traffic history:
a) If:
(i) it is the person’s first drink driving offence,
(ii) blood alcohol content (BAC) level was under 0.15%,
(iii) the offence was not in a public passenger vehicle, and
(iv) there is no prior suspension/cancellation of the driver licence within the two
preceding years.
a waiting period of one year, from the end of the period of suspension/cancellation of the
driver’s licence is to apply. (The person will have to hold an Australian open licence at the
time of application).
b) In all other circumstances, that is:
(i)
(ii)
(iii)
(iv)
it is the person’s second (or more) drink driving offence,
it is the person’s first drink driving offence, but blood alcohol content (BAC) level
was 0.15% or higher,
the offence was in a public passenger vehicle, or
there has been a prior suspension/cancellation of the driver licence within the
preceding two years.
a waiting period of two years, from the end of the period of suspension/cancellation of the
Driver Licence is to apply. (The person will have to hold an Australian open licence at the
time of application).
Driver Authorisation - Effect of a Driving History Page 2 of 3
8. Where a person has been charged with driving under the influence of drugs, the offence will
attract the same waiting period as if they had a blood alcohol content of 0.15% or higher. A
waiting period of 2 years applies to this offence.
9. Where the person’s driver licence has been cancelled by a court, other than under the
demerit points system, the criteria for drink driving is to apply.
Overall, the following factors will be taken into consideration:
• the severity of offences, and
• whether offences occurred in a public passenger vehicle, and
• the frequency of offences.
Review of, and Appeals Against, a Decision
Should applicants be dissatisfied with the decision on their application, they may request a review
of the decision by the director-general. If the applicant is not satisfied with the outcome of the
review, then the applicant may appeal to a court in an attempt to overturn the decision. (For more
information please refer to the information bulletin - "Reviews and Appeals against Decisions").
