EXECUTIVE SUMMARYJANUARY 2011 erage annual and frost freeze protection water use data to better correlate the relationships between pumpage and measured drawdown. Flow Meter Purchase and Installation. For permits existing as of the effective date of the rule, the District will provide for the flow meters on withdrawal points, inflow lines, catchment facilities, tailwater recovery or rainfall capture ponds and storage facilities. This provision applies to these structures in existence prior to the effective rule date that are not equipped with and not required by other District rules to have a flow meter. Automatic Meter Reading Device Purchase, Installation and Data Collection. For permits requiring automatic meter reading (AMR) devices under the proposed rule, the District will provide, install, replace, maintain and repair these AMR devices for each flow meter that is not already so equipped. The District shall include these devices in the District’s data collection and reporting service subscription at no cost to the permittee. Net Benefit. In the case where an applicant for New Quantities is constrained by impacts to the Minimum Aquifer Level Protection Zone, the applicant may choose to provide reasonable assurance by implementing one or more of the Net Benefit options in order to mitigate the predicted impacts. In order to provide a Net Benefit, the measures proposed by the applicant must offset the predicted negative impact of the proposed withdrawal and also provide an additional positive effect on the Minimum Aquifer Level Protection Zone equal to or exceeding 20% of the predicted negative impact. For example, if the predicted drawdown is 1.0 ft., the mitigation must offset the 1.0 ft. drawdown and provide another 0.2 ft. (i.e., 20% of 1.0 ft.) of positive effect so that the result is a net improvement of 0.2 ft. There are two forms of Net Benefit: Mitigation plus Recovery and Groundwater Replacement Credits. Assignment of Responsibility - Frost / Freeze Impacts. The method used by the District to assign permittees in the DPC WUCA the responsibility to investigate and resolve frost / freeze withdrawal-related well complaints is revised under the proposed rule. The intent is to improve fairness and more evenly distribute well complaints among permittees. 44324-000R4.docx Well Complaint Mitigation. The mitigation activity required by the permittee and the complainant under the proposed rule is, for the most part, the same as under current rule. One difference is that, under the proposed rule, if a complainant mitigates the well damage before the permittee investigates, then the permittee is required to reimburse the complainant for the actual expenditures not to exceed $1,500 unless the permittee can demonstrate that it is not responsible for all or part of the cost. EXECUTIVE SUMMARYJANUARY 2011 ES.2 Number of Individuals and Entities Required to Comply with the Proposed Rule Water Use Permittees and Applicants inside the DPC WUCA The Dover and Plant City area, located between the City of Tampa and the City of Lakeland in Florida, is a mix of agricultural, residential and industrial land uses. Dover is an unincorporated area of Hillsborough County and Plant City is an incorporated city. This area is well-known for its valuable strawberry production and hosts the Annual Strawberry Festival each year. The proposed rule addresses the impacts of ground water withdrawals for frost /freeze protection on ground water levels in the DPC WUCA. The individuals and entities required to comply with the proposed rule are limited to those who have or who will apply for a water use permit from the Southwest Florida Water Management District and who have water uses or requested water quantities that meet specific criteria. There are 660 water use permits in the DPC WUCA that are associated with groundwater withdrawals. Most of these permits, 88 percent, are for agricultural production including crop irrigation, tropical fish farms, and livestock watering. The remaining permits are for public supply, recreation / aesthetic, and industrial / commercial water uses. Most of the water use permits in the DPC WUCA are located in either the Northern Tampa Bay WUCA or the Southern WUCA. Water use permittees required to comply are those who have permitted ground water quantities for frost / freeze protection or who have uses that typically require frost / freeze protection or who have average daily permitted quantities greater than 100,000 gpd. Activities that typically require frost / freeze protection include strawberries, blueberries, nurseries, citrus groves, and tropical fish farms. There are 547 existing water use permittees who will be required to comply with the proposed rule. Most of these permittees, or 95 percent, use water for agricultural crop irrigation. The remaining permittees are tropical fish farms (7 permits), public supply (10 permits), industrial / commercial (6 permits) and recreation / aesthetic (4 permits). 44324-000R4.docx There are 113 existing water use permittees who will not be required to comply with the proposed rule. However, they will need to comply if they add or change crops or use types such that new water quantities for frost/freeze protection are requested. About 50 percent of these permittees use water for agricultural production. Most of the existing permittees who need to comply have permitted ground water withdrawals for frost / freeze quantities.
