11. Does This <str<strong>on</strong>g>Class</str<strong>on</strong>g> Acti<strong>on</strong> Settlement Affect Other World War II-era Claims, such as Claims<br />

Against Companies That Employed Slave Labor, Insurance Companies, and Other Banks?<br />

This <str<strong>on</strong>g>Class</str<strong>on</strong>g> Acti<strong>on</strong> Settlement releases all Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g> <str<strong>on</strong>g>Member</str<strong>on</strong>g> Claims but <strong>on</strong>ly ins<strong>of</strong>ar as<br />

those Claims c<strong>on</strong>cern the Releasees. This <str<strong>on</strong>g>Class</str<strong>on</strong>g> Acti<strong>on</strong> Settlement does not address any other Holocaust<br />

or World War II-related claims relating <str<strong>on</strong>g>to</str<strong>on</strong>g> n<strong>on</strong>-Swiss and/or n<strong>on</strong>-Swiss-affiliated banks or other<br />

companies, including claims against n<strong>on</strong>-Swiss and n<strong>on</strong>-Swiss-affiliated banks, insurance companies, and<br />

manufacturers that employed Slave Labor or otherwise assisted in the Nazi Regime's war effort. The<br />

Settlement Agreement precisely defines the scope <strong>of</strong> the release.<br />

12. How Did the Lawyers and <str<strong>on</strong>g>Class</str<strong>on</strong>g> Representatives Determine the Settlement Amount?<br />

After World War II, Jewish organizati<strong>on</strong>s began working <str<strong>on</strong>g>to</str<strong>on</strong>g> secure restituti<strong>on</strong> <strong>of</strong>, and<br />

compensati<strong>on</strong> for, Jewish property throughout Europe and in Switzerland. In 1995, when the specific<br />

issue <strong>of</strong> dormant Swiss bank accounts c<strong>on</strong>taining unclaimed assets <strong>of</strong> Holocaust victims c<str<strong>on</strong>g>am</str<strong>on</strong>g>e under<br />

public scrutiny, the WJRO reinitiated formal discussi<strong>on</strong> with the Swiss regarding restituti<strong>on</strong> issues. Such<br />

negotiati<strong>on</strong>s led <str<strong>on</strong>g>to</str<strong>on</strong>g>, <str<strong>on</strong>g>am</str<strong>on</strong>g><strong>on</strong>g other things, the creati<strong>on</strong> <strong>of</strong> the Independent Committee <strong>of</strong> Eminent Pers<strong>on</strong>s<br />

(“ICEP”) and the Independent Commissi<strong>on</strong> <strong>of</strong> Experts (“ICE”). The ICEP, chaired by Paul A. Volcker,<br />

was established in May, 1996 by the Swiss Bankers’ Associati<strong>on</strong>, the World Jewish C<strong>on</strong>gress, and other<br />

Jewish organizati<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>duct an independent audit <strong>of</strong> Settling Defendants and Other Swiss Banks <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

identify accounts from the World War II era that could possibly bel<strong>on</strong>g <str<strong>on</strong>g>to</str<strong>on</strong>g> Victims <strong>of</strong> Nazi Persecuti<strong>on</strong>.<br />

The ICE, in turn, is an independent group <strong>of</strong> internati<strong>on</strong>ally recognized his<str<strong>on</strong>g>to</str<strong>on</strong>g>rians, chaired by Jean Francois<br />

Bergier, which the Swiss C<strong>on</strong>federati<strong>on</strong> established in 1996 <str<strong>on</strong>g>to</str<strong>on</strong>g> ex<str<strong>on</strong>g>am</str<strong>on</strong>g>ine Switzerland’s relati<strong>on</strong>ship with<br />

Nazi Germany.<br />

The litigati<strong>on</strong> was commenced by plaintiffs in 1996. Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g> Counsel, the WJRO, and<br />

others, including the World Council <strong>of</strong> Orthodox Jewish Communities, investigated the claims and the<br />

underlying events and transacti<strong>on</strong>s alleged in the Complaints, including: (1) reviewing thousands <strong>of</strong> pages<br />

<strong>of</strong> documents obtained from public informati<strong>on</strong> sources and through other, informal means;<br />

(2) interviewing hundreds <strong>of</strong> <str<strong>on</strong>g>Class</str<strong>on</strong>g> <str<strong>on</strong>g>Member</str<strong>on</strong>g>s; (3) c<strong>on</strong>sulting with experts; (4) researching and analyzing<br />

applicable law with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the <str<strong>on</strong>g>Class</str<strong>on</strong>g> claims and the Defendants' defenses; (5) reviewing and analyzing<br />

the report produced by ICE; and (6) reviewing and analyzing the reports prepared under the auspices <strong>of</strong><br />

Stuart Eizenstat, United States Undersecretary <strong>of</strong> Commerce for Internati<strong>on</strong>al Trade, and by Willi<str<strong>on</strong>g>am</str<strong>on</strong>g> Z.<br />

Slany, an his<str<strong>on</strong>g>to</str<strong>on</strong>g>rian for the United States Department <strong>of</strong> State, with the participati<strong>on</strong> <strong>of</strong> various federal<br />

government agencies and the United States Holocaust Museum. Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g> Counsel, the WJRO,<br />

and the World Council <strong>of</strong> Orthodox Jewish Communities c<strong>on</strong>ferred with survivors and survivor<br />

representatives, and participated in Court-supervised settlement discussi<strong>on</strong>s, mediated in part by United<br />

States Under Secretary <strong>of</strong> State Stuart Eizenstat. The Settlement is the result <strong>of</strong> more than a year <strong>of</strong><br />

arms-length negotiati<strong>on</strong>s.<br />

You should evaluate the terms <strong>of</strong> the Settlement, and the risks and costs <strong>of</strong> c<strong>on</strong>tinued litigati<strong>on</strong>,<br />

and decide for <str<strong>on</strong>g>you</str<strong>on</strong>g>rself whether <str<strong>on</strong>g>you</str<strong>on</strong>g> think the Settlement is fair and reas<strong>on</strong>able, and whether <str<strong>on</strong>g>you</str<strong>on</strong>g> wish <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

remain a member <strong>of</strong> the Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g>.<br />

13. What Do I Have <str<strong>on</strong>g>to</str<strong>on</strong>g> Do Now If I Want <str<strong>on</strong>g>to</str<strong>on</strong>g> Participate in the Settlement?<br />

If <str<strong>on</strong>g>you</str<strong>on</strong>g> are a member <strong>of</strong> <strong>on</strong>e or more <strong>of</strong> the Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g>es, and <str<strong>on</strong>g>you</str<strong>on</strong>g> wish <str<strong>on</strong>g>to</str<strong>on</strong>g> participate in the<br />

Settlement, then <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure <str<strong>on</strong>g>you</str<strong>on</strong>g> receive notice <strong>of</strong> the Plan <strong>of</strong> Allocati<strong>on</strong> and claims filing process, <str<strong>on</strong>g>you</str<strong>on</strong>g> must<br />

either (a) mail a written request <str<strong>on</strong>g>to</str<strong>on</strong>g> receive such notice <str<strong>on</strong>g>to</str<strong>on</strong>g> the address listed in resp<strong>on</strong>se <str<strong>on</strong>g>to</str<strong>on</strong>g> Questi<strong>on</strong> 22<br />

below, or (b) complete and return the attached Initial Questi<strong>on</strong>naire. The Initial Questi<strong>on</strong>naire will not be<br />

utilized for purposes <strong>of</strong> determining distributi<strong>on</strong> <str<strong>on</strong>g>am</str<strong>on</strong>g>ounts until after a Plan <strong>of</strong> Allocati<strong>on</strong> is adopted by the<br />

Court. By filling out the Initial Questi<strong>on</strong>naire, accordingly, <str<strong>on</strong>g>you</str<strong>on</strong>g> are not necessarily entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> any funds,<br />

unless and until such an entitlement is established by the Plan <strong>of</strong> Allocati<strong>on</strong> adopted by the Court. You<br />

will au<str<strong>on</strong>g>to</str<strong>on</strong>g>matically receive written notice <strong>of</strong> the terms <strong>of</strong> the Plan <strong>of</strong> Allocati<strong>on</strong> if <str<strong>on</strong>g>you</str<strong>on</strong>g> submit an Initial<br />

Questi<strong>on</strong>naire that includes <str<strong>on</strong>g>you</str<strong>on</strong>g>r correct address for mailing.<br />
