Litigati<strong>on</strong>, Master Docket No. CV-96-4849 (E.D.N.Y.); Markovicova, et al. v. Swiss Bank Corporati<strong>on</strong>,<br />

et al., Case No. C98-02924 (N.D. Cal.); and Rosenberg, et al. v. Swiss Nati<strong>on</strong>al Bank, Civil Acti<strong>on</strong> No.<br />

1:98 CV 01647 (District <strong>of</strong> Columbia), except counsel for the WJRO.<br />

At the “Fairness Hearing” (described below), all <strong>of</strong> the Court-appointed Plaintiffs’ Counsel will<br />

apply <str<strong>on</strong>g>to</str<strong>on</strong>g> the Court <str<strong>on</strong>g>to</str<strong>on</strong>g> be reimbursed for their costs, in an <str<strong>on</strong>g>am</str<strong>on</strong>g>ount not <str<strong>on</strong>g>to</str<strong>on</strong>g> exceed approximately 0.2% <strong>of</strong> the<br />

Settlement Fund, or $2.5 (U.S.) milli<strong>on</strong>. The majority <strong>of</strong> Plaintiffs’ Counsel will not apply for an award <strong>of</strong><br />

fees. Certain Plaintiffs’ Counsel will apply <str<strong>on</strong>g>to</str<strong>on</strong>g> the Court for an award <strong>of</strong> fees up <str<strong>on</strong>g>to</str<strong>on</strong>g> a <str<strong>on</strong>g>to</str<strong>on</strong>g>tal <str<strong>on</strong>g>am</str<strong>on</strong>g>ount <strong>of</strong> 1.8%<br />

<strong>of</strong> the Settlement Fund, or $22.5 (U.S.) milli<strong>on</strong>. The Court has the discreti<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> award a lower <str<strong>on</strong>g>am</str<strong>on</strong>g>ount,<br />

after c<strong>on</strong>sidering the fee applicati<strong>on</strong>s made by those Plaintiffs’ Counsel who will apply for fees.<br />

Counsel for the WJRO, who are working pro b<strong>on</strong>o, will not seek reimbursement for its costs,<br />

and will not apply for an award <strong>of</strong> fees.<br />

18. What Do I Do If I Want <str<strong>on</strong>g>to</str<strong>on</strong>g> Exclude Myself From the Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g>es?<br />

If <str<strong>on</strong>g>you</str<strong>on</strong>g> do not wish <str<strong>on</strong>g>to</str<strong>on</strong>g> be included in the <str<strong>on</strong>g>Class</str<strong>on</strong>g> and <str<strong>on</strong>g>you</str<strong>on</strong>g> do not wish <str<strong>on</strong>g>to</str<strong>on</strong>g> participate in the proposed<br />

Settlement, <str<strong>on</strong>g>you</str<strong>on</strong>g> must individually and pers<strong>on</strong>ally request <str<strong>on</strong>g>to</str<strong>on</strong>g> be excluded in <str<strong>on</strong>g>writing</str<strong>on</strong>g> by Oc<str<strong>on</strong>g>to</str<strong>on</strong>g>ber 22, 1999.<br />

To request exclusi<strong>on</strong> <str<strong>on</strong>g>you</str<strong>on</strong>g> must write a letter that states (1) the n<str<strong>on</strong>g>am</str<strong>on</strong>g>e <strong>of</strong> this Litigati<strong>on</strong> (Swiss Banks); (2)<br />

<str<strong>on</strong>g>you</str<strong>on</strong>g>r n<str<strong>on</strong>g>am</str<strong>on</strong>g>e; (3) <str<strong>on</strong>g>you</str<strong>on</strong>g>r address; (4) and that <str<strong>on</strong>g>you</str<strong>on</strong>g> do not want <str<strong>on</strong>g>to</str<strong>on</strong>g> participate in the Settlement. The exclusi<strong>on</strong><br />

request must be pers<strong>on</strong>ally signed by <str<strong>on</strong>g>you</str<strong>on</strong>g> and mailed <str<strong>on</strong>g>to</str<strong>on</strong>g> the address listed in Secti<strong>on</strong> 22, below.<br />

No request for exclusi<strong>on</strong> will be c<strong>on</strong>sidered valid<br />

unless all the informati<strong>on</strong> described above is included<br />

and the request is postmarked by Oc<str<strong>on</strong>g>to</str<strong>on</strong>g>ber 22, 1999.<br />

If <str<strong>on</strong>g>you</str<strong>on</strong>g> validly request exclusi<strong>on</strong> from the <str<strong>on</strong>g>Class</str<strong>on</strong>g>: (a) <str<strong>on</strong>g>you</str<strong>on</strong>g> will be excluded from the <str<strong>on</strong>g>Class</str<strong>on</strong>g>;<br />

(b) YOU WILL NOT BE ELIGIBLE TO SHARE IN THE PROCEEDS OF THE SETTLEMENT;<br />

(c) <str<strong>on</strong>g>you</str<strong>on</strong>g> will not be bound by any judgment entered in the Litigati<strong>on</strong>; and (d) <str<strong>on</strong>g>you</str<strong>on</strong>g> will not be precluded from<br />

otherwise prosecuting an individual claim, if timely, against the Settling Defendants based <strong>on</strong> the matters<br />

complained <strong>of</strong> in the Litigati<strong>on</strong>.<br />

19. What Happens Next?<br />

A Fairness Hearing will be held <strong>on</strong> November 29, 1999 at 10:00 A.M. EST before the H<strong>on</strong>.<br />

Edward R. Korman at the United States District Courthouse, United States District Court, Eastern<br />

District <strong>of</strong> New York, 225 Cadman Plaza East, Brooklyn, NY 11201 (the "Fairness Hearing"). At that<br />

time, the Court will determine (1) whether the proposed Settlement c<strong>on</strong>sisting <strong>of</strong> a principal sum <strong>of</strong> $1.25<br />

billi<strong>on</strong>, plus accrued interest, is fair, reas<strong>on</strong>able, adequate, and in the best interest <strong>of</strong> the <str<strong>on</strong>g>Class</str<strong>on</strong>g>; (2)<br />

whether <str<strong>on</strong>g>Class</str<strong>on</strong>g> Counsel's request for at<str<strong>on</strong>g>to</str<strong>on</strong>g>rneys' fees, expenses and costs <strong>of</strong> notice and administrati<strong>on</strong><br />

should be approved; and (3) whether the Litigati<strong>on</strong> should be dismissed with prejudice. The Court may<br />

adjourn or c<strong>on</strong>tinue the Fairness Hearing without further notice <str<strong>on</strong>g>to</str<strong>on</strong>g> the <str<strong>on</strong>g>Class</str<strong>on</strong>g>. You do not need <str<strong>on</strong>g>to</str<strong>on</strong>g> attend<br />

the hearing in order <str<strong>on</strong>g>to</str<strong>on</strong>g> participate in or comment up<strong>on</strong> the Settlement, or <str<strong>on</strong>g>to</str<strong>on</strong>g> exclude <str<strong>on</strong>g>you</str<strong>on</strong>g>rself from the<br />

Settlement <str<strong>on</strong>g>Class</str<strong>on</strong>g>.<br />

Any <str<strong>on</strong>g>Class</str<strong>on</strong>g> member who has not requested exclusi<strong>on</strong> may (but need not) appear at the Fairness<br />

Hearing in pers<strong>on</strong> or through Counsel <str<strong>on</strong>g>to</str<strong>on</strong>g> address why the proposed Settlement should or should not be<br />

approved, and <str<strong>on</strong>g>to</str<strong>on</strong>g> comment <strong>on</strong> or object <str<strong>on</strong>g>to</str<strong>on</strong>g> the applicati<strong>on</strong> <strong>of</strong> <str<strong>on</strong>g>Class</str<strong>on</strong>g> Counsel for at<str<strong>on</strong>g>to</str<strong>on</strong>g>rneys' fees, costs, and<br />

expenses; provided, however, that no such pers<strong>on</strong> shall be heard unless his or her objecti<strong>on</strong> or oppositi<strong>on</strong><br />

is made in <str<strong>on</strong>g>writing</str<strong>on</strong>g> and is filed, <str<strong>on</strong>g>to</str<strong>on</strong>g>gether with copies <strong>of</strong> all other papers and briefs <str<strong>on</strong>g>to</str<strong>on</strong>g> be presented by him or<br />

her <str<strong>on</strong>g>to</str<strong>on</strong>g> the Court at the Fairness Hearing, no later than Oc<str<strong>on</strong>g>to</str<strong>on</strong>g>ber 22, 1999, and mailed <str<strong>on</strong>g>to</str<strong>on</strong>g> the address listed<br />
