Call to Order and Pledge of Allegiance<br />
At 8:05 PM, the regular public meeting of the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong><br />
<strong>Central</strong> <strong>School</strong> <strong>District</strong> Board of Education was called to order by Mr. Fucito.<br />
Approval of Agenda<br />
At 8:08, a motion was made by Ms. Wild and seconded by Mr. Ericson to accept the agenda as<br />
revised (Staff/Student Recognitions was moved to before Statements from Residents). The motion<br />
passed by a vote of 6-0.<br />
Student/Staff Recognitions<br />
Dr. Copel congratulated the Girls’ Lacrosse team for winning the State Championship for the third<br />
year in a row.<br />
Dr. Copel announced the High <strong>School</strong> was awarded a grant from Allstate for safe driving.<br />
Dr. Copel reported the Middle <strong>School</strong> Pride Club was written up in Newsday.<br />
Dr. Copel introduced Daria Capone, the Life Skills teacher. Ms. Capone introduced her students:<br />
Michael Antonoff, Jesse Wickey, Tara Sanders, Marisa Kurlowicz, Jonathan Webber, Amanda Morrow,<br />
and Eric Gunderson. Ms. Capone also introduced the Teacher Assistants in the class: Jackie Sessa,<br />
Sandy Pederson, Denise Kohart, Michelle Collyer, Jerry Flynn, Patricia Burgess, and Cecelia Tilley.<br />

Ms. Capone reported accomplishments and achievements of the class. Ms. Capone acknowledged<br />
and thanked her students for the daily tasks they assist with in the High <strong>School</strong> and <strong>District</strong> Office.<br />
Dr. Copel introduced Dr. Linda Anthony, Principal of the Middle <strong>School</strong>, who recognized the<br />
Technology Club for the design and creation of an outdoor sign for the Middle <strong>School</strong>. Dr. Anthony<br />
introduced Mr. Idaspe, the Technology Club advisor, who in turn introduced the students: John<br />
Staufer, Tyler Scholl, Mariah Brengel, James Kuczewski, Tyler Nevone, Cal Strack, Thomas Fox, and<br />
Kyle Schmitt. Mr. Idaspe praised his students for their hard work and genuine eagerness to learn.<br />
Dr. Copel introduced Mr. Don Hanft, the <strong>Wading</strong> <strong>River</strong> Elementary <strong>School</strong> music teacher, who is<br />
retiring this year. Dr. Copel presented Mr. Hanft with a gift and thanked Mr. Hanft for his many<br />
years of service.<br />
IV<br />
Statements from Residents<br />
Ms. Theresa McLaughlin reported being distressed over resolution #0809-212 (McGuire’s All Brands<br />
Hearing Aids and Audiology Bid Award Renewal Contract). Ms. McLaughlin reported she was<br />
dissatisfied with the physical appearance of the vendor’s building, reported a smell of mold, and was<br />
unhappy with the audiology testing itself. Mr. Fucito and Dr. Copel advised the resolution would be<br />
withdrawn and the <strong>District</strong> will investigate Ms. McLaughlin’s complaints.<br />
Ms. Alisa Mc Morris submitted to the <strong>District</strong> Clerk copies of letters from local officials in reference to<br />
a petition she submitted to Albany on June 5, 2009 to request reform of the State Aid formula<br />
(especially the combined wealth ratio) and request the <strong>District</strong>’s prior years' state aid payment be<br />
restored. Ms. Mc Morris briefly described Assemblyman Marc Alessi’s legal argument to the State<br />
that they are in violation of the 2009 Federal Economic Recovery Act because they have not kept<br />
State Aid (including prior years' state aid) the same as last year, leaving our <strong>District</strong> with a $3.8m<br />
shortfall. Ms. Mc Morris reported she has received several responses back from federal and state<br />
agencies and is encouraged that they are taking the <strong>District</strong>’s financial situation seriously and are<br />
looking into matters.<br />
Mr. Anthony De Louise advised the Board of Education that today he filed a lawsuit and a temporary<br />
restraining order against the <strong>District</strong> in an attempt to stop the Board of Education from<br />
implementing the contingency budget. The purpose of him filing this lawsuit and restraining order is<br />
to bring attention to the community and local officials “to the plight” of the <strong>District</strong>. Mr. De Louise<br />
was not satisfied with the way the decision to go on contingency budget was made. Mr. De Louise<br />
feels that none of the recommendations presented by the community have been considered by the<br />
Board (i.e. negotiate with bargaining unions, contact Senator LaValle, Financial Review Committee<br />
(FRC) recommendations, etc.). Dr. Copel responded by thanking Mr. De Louise for showing interest<br />
in and becoming involved in the <strong>District</strong>’s financial situation. Dr. Copel welcomed his ideas for<br />
budget development which will begin in January. As for the recommendations not being acted on,<br />
Dr. Copel advised that numerous contacts has been made with the bargaining units and Senator<br />
LaValle; and reminded Mr. De Louise that the FRC supported the proposed budget increase, however<br />
differed in the Board’s decision not to borrow against prior years' state aid.<br />
V<br />
Old Business<br />
a. Response to Residents’ Petitions<br />
Mr. Fucito read a statement in reference to the two (2) petitions submitted at the June 2, 2009<br />
Board meeting. Ms. Vanessa Sheehan, the <strong>District</strong>’s Legal Counsel, explained the role of the<br />
Board of Education involving a petition – if a petition does not specifically request a referendum<br />
at a Special <strong>District</strong> Meeting, the Board of Education is not required to take action. The power to<br />
adopt/not adopt a contingency budget is solely the responsibility of the Board of Education, as<br />
well as borrowing/not borrowing money.<br />
b. Policies<br />
* Policy #3160 - <strong>School</strong> <strong>District</strong> Standards and Guidelines for Web Page Publishing<br />
The Board reviewed this policy, discussion followed. This constituted the first reading of Policy<br />
#3160.<br />
* Rescind old policies<br />

Because these policies are obsolete, it is recommended they be rescinded. All board members<br />
were in favor of rescinding these policies.<br />
* Adoption of 8000 series<br />
This constituted the second reading of the 8000 series – all board members were in favor to<br />
adopt all 8000 policies.<br />
* Code of Conduct<br />
The Board reviewed the revisions to the Code of Conduct – all board members were in favor of<br />
adopting the revisions.<br />
b. Food Service Program<br />
Mr. Singleton reported the State Education Dept. (SED) will not approve the existing contract<br />
with the current food vendor. Mr. Singleton recommended for the 2009-2010 school year the<br />
<strong>District</strong> hire a part time food manager through BOCES at a cost of $65,000. The lunch program<br />
is to be self sufficient so the $65,000 should be recouped by the sale of lunches / food items.<br />
This will give the <strong>District</strong> a year to explore options as to how to modify any program needed to<br />
meet State standards and the Wellness Program required by Federal and State regulations.<br />
Through BOCES, the <strong>District</strong> can use the existing kitchen in the High <strong>School</strong> with minor<br />
modifications. By approving a food service program, the <strong>District</strong> will then qualify for federal<br />
subsidies. Ms. Wild asked Mr. Singleton to explain the bid process last year for food service<br />
providers. Mr. Singleton reported that several large companies expressed interest in submitting<br />
a bid, but that none were actually submitted because there are no existing kitchen facilities in<br />
the buildings (except High <strong>School</strong>). All Board members were in favor of approval of this food<br />
service program through BOCES and to revise resolution #0809-199 to reflect the $65,000<br />
increase.<br />
c. Health and Safety Proposition<br />
Dr. Copel advised that since the proposition did not pass in June, the corrections needed at the<br />
Middle <strong>School</strong> have been re-prioritized. Dr. Copel reviewed the essential corrections that will be<br />
made in the near future: the exiting of three (3) wings, removal and/or relocation of lockers in<br />
the narrow hallways. Discussion followed of a re-vote for the $3m proposition in the fall and it<br />
was noted the decision has to be made by the end of July 2009.<br />
VI<br />
Reports and Reviews<br />
a. Superintendent’s Report<br />
Dr. Copel reported on a successful school year and thanked Board of Education and staff for<br />
their hard work throughout the year.<br />
b. Curriculum and Instruction / Technology Report<br />
Dr. McSweeney gave a Power Point presentation of this year’s curriculum and instruction as well<br />
as a brief Technology Report. Dr. McSweeney also gave a presentation on the “Word Study<br />
Program” (grades K-2 and 3-5) which included background, summary, and goals of the<br />
program. Several classroom teachers, reading teachers, and administrators gave input of the<br />
program. The Board unanimously approved the program for 2009-2010.<br />
c. Report on TAN’s and RAN’s<br />
Mr. Singleton gave a brief summary of the TAN’s and RAN’s the will be received shortly. Mr.<br />
Singleton highlighted the fact that Standard and Poor’s gave the <strong>District</strong> a high credit rating<br />
which allows the <strong>District</strong> the benefit of receiving a low interest rate.<br />
Mr. Singleton also gave an “Annual Report on Reserve for Tax Reduction”. Mr. Singleton<br />
reported that since the prior years' state aid payment was reduced from $10m to $7,567,424,<br />
there resulted a $3.8m shortfall. This $3.8m will have to be borrowed in 2009 in anticipation of<br />
prior years' state aid, payable in 2010-2011. Mr. Singleton reported the payment received this<br />
year of $7,567,424, plus interest of $10,754.77, will be used toward the payment of outstanding<br />
RAN’s of $11,400,000, payable on June 30, 2009.<br />
d. 2008-2009 End of Year Budget Report<br />
Mr. Singleton reported the <strong>District</strong> coming in under budget this year by approximately $2m in<br />
several areas, including: utilities, instruction, special education, transportation, and medical<br />
insurance. However, Mr. Singleton indicated that effective January 1, 2010, there will be an<br />

estimated 9% increase in the health insurance expense which will cost the <strong>District</strong><br />
approximately, $500,000.<br />

#0809-195 Employee Benefit Accrued Liability Reserve Transfer:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
approves the transfer of $51,600 from the Employee Benefit Accrued Liability Reserve to the<br />
General Fund to cover the cost of the sick leave payout for retiring employees.<br />
#0809-196 Accepts Internal Auditor Report:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
hereby approves the Internal Audit Report on Personnel and Payroll Procedures as of June 9, 2009.<br />
#0809-197 SWRTA Memorandum of Agreement:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
approves the Memorandum of Agreement (MOA) between the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> Teachers<br />
Association (SWRTA) and the <strong>District</strong> for the Subject Leaders stipend compensation for the 2009-<br />
2010 school year.<br />
#0809-198 CSEA Memorandum of Agreement:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
approves a CSEA Memorandum of Agreement regarding 403(b) Plan for non-instructional<br />
employees. The President of the Board of Education is authorized to sign this contract.<br />
#0809-199 BOCES Shared Services Agreement: (REVISED)<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong> <strong>Wading</strong> <strong>River</strong> CSD hereby approves the<br />
BOCES Shared Services Agreement at an annual cost of $2,463,727.09 for the 2009-2010 school<br />
year. The Superintendent and Board President are authorized to execute said contract.<br />
#0809-200 CBIZ Valuation Group Contract:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
approves the contract with CBIZ Valuation Group, LLC (updates fixed asset inventory and accounts)<br />
for 2009-2010 school year at an annual cost of $975. The Superintendent is authorized to execute<br />
this contract.<br />
#0809-201 Summer Curriculum Writing Project:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
hereby accepts the Summer Curriculum Writing Project at a cost not to exceed $2,257.92 for the<br />
2009-2010 school year.<br />
#0809-202 Impartial Hearing Officers Appointments:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
hereby appoints the following Impartial Hearing Officers for three (3) special education students at<br />

#0809-203 Center Moriches Summer Tuition Contract:<br />

hereby approves a contract with Center Moriches <strong>School</strong> <strong>District</strong> for one (1) student for the summer<br />
(July 1 through August 14, 2009) at a total tuition cost of $5,463.46. The President of the Board of<br />
Education is authorized to execute said contract.<br />

RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong>,<br />
hereby approves a contract with Center Moriches <strong>School</strong> <strong>District</strong> for one (1) student for the 2009-<br />
2010 school year at a total tuition cost of $49,050.00. The President of the Board of Education is<br />
authorized to execute said contract.<br />
#0809-205 Miller Place UFSD Tuition Contract:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong>,<br />
hereby approves a contract with Miller Place UFSD for tuition for one (1) student to attend our<br />
<strong>District</strong> from April 13, 2009 through June 26, 2009 at an estimated tuition cost of $11,790.00. The<br />
President of the Board of Education is authorized to execute said contract.<br />
#0809-206 New York State Association for the Help of Retarded Children Tuition Contract:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong>,<br />
hereby approves a contract with New York State Association for the Help of Retarded Children<br />

via resolution #0809-013 for CAP-D Evaluations for the 2008-2009 school year provided for the<br />
annual renewal and/or extension of the contract and services for a period of two (2) years, and<br />
WHEREAS, the Director of Special Education has recommended that the services provided by<br />
continued,<br />
THEREFORE BE IT RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong><br />
<strong>School</strong> <strong>District</strong> approves the extension of the contract for CAP-D Evaluations for the 2009-2010<br />
school year by McGuire’s All Brands Hearing Aids and Audiology.<br />
#0809-213 North Shore Youth Council Contract:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
hereby approves a contract with North Shore Youth Council (provides assistance and counseling<br />
services for the <strong>District</strong>), effective July 1, 2009 through June 30, 20010, at an annual rate of<br />
$103,717. The President of the Board of Education is authorized to sign this contract.<br />
#0809-214 Allan Rotto Contract:<br />
RESOLVED, that the Board of Education of the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong><br />
hereby approves a contract between the <strong>District</strong> and Allan Rotto Consultants, Inc., on a contingency<br />
fee, for the purpose of auditing invoices received from the <strong>District</strong>’s four (4) telephone vendors to<br />
secure credits and/or refunds related to same. The President of the Board of Education is<br />
authorized to sign this contract.<br />
#0809-215 Joint Municipal Cooperative Bidding Program:<br />
WHEREAS, various educational and municipal corporations located within the State of New York<br />
desire to bid jointly for generally needed services and standardized supply and equipment items;<br />
and<br />
WHEREAS, the <strong>Shoreham</strong>-<strong>Wading</strong> <strong>River</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong>, an educational/municipal<br />
corporation (hereinafter the “Participant”) is desirous of selectively participating with other<br />
educational and/or municipal corporations in the State of New York in joint bidding in the areas<br />
mentioned above pursuant to General Municipal Law § 119-o and Education Law Section 1950; and<br />
WHEREAS, the Participant is a municipality within the meaning of General Municipal Law § 119-n<br />
and is eligible to participate in the Board of Cooperative Educational Services, First Supervisory<br />
<strong>District</strong> of Suffolk County (hereinafter Eastern Suffolk BOCES) Joint Municipal Cooperative Bidding<br />
Program (hereinafter the “Program”) in the areas mentioned above; and<br />
WHEREAS, the Participant acknowledges receipt of the Program description inclusive of Eastern<br />
Suffolk BOCES’ standard bid packet and the general conditions relating to said Program; and<br />
WHEREAS, with respect to all activities conducted by the Program, the Participant wishes to<br />
delegate to Eastern Suffolk BOCES the responsibility for drafting of bid specifications, advertising for<br />

ids, accepting and opening bids, tabulating bids, and recommending the awarding of the bids to<br />
the Participant.<br />
BE IT RESOLVED that the Participant hereby appoints Eastern Suffolk BOCES to represent it and to<br />

BE IT FURTHER RESOLVED that the Participant hereby authorizes Eastern Suffolk BOCES to place<br />
all legal advertisements for any required cooperative bidding in Newsday, which is designated as the<br />
official newspaper for the Program; and<br />
BE IT FURTHER RESOLVED that a Membership Committee consisting of one (1) representative<br />
from each Participant shall be formed. The Participant shall accordingly appoint one (1)<br />
representative to the Membership Committee. Said representative shall be provided with a list of<br />
bids. A meeting of the Membership Committee shall be held annually. Notice of the meeting shall<br />
be given to each representative at least five (5) days prior to such meeting; and<br />
BE IT FURTHER RESOLVED that this Agreement with the Participant shall be for a term of one (1)<br />
year as authorized by General Municipal Law §119-o.2.j.<br />
BE IT FURTHER RESOLVED that the Participant agrees to pay Eastern Suffolk BOCES an annual<br />

Discussion<br />
Mr. Fucito spoke on behalf of the Board of Education to thank those who have donated money or<br />
items to the <strong>District</strong> this year and past years, especially each school’s parent organization. Mr.<br />
Fucito announced this year’s total of PTA / PTO donations was estimated at $116,414. Mr. Fucito<br />
reminded residents this is money that should have been included in the budget.<br />
Mr. Fucito thanked Mr. Joe Singleton for this two (2) years of service as Interim Assistant<br />
Superintendent for Business. This will be Mr. Singleton’s final board meeting as Mr. James Christie<br />
begins as Assistant Superintendent for Business on July 1, 2009.<br />
