What does the measure mean – A major responsibility <strong>of</strong> PGT Child <strong>and</strong> Youth Services is administering<br />

requests to spend some <strong>of</strong> their trust monies. Unlike a bank account, funds held in trust are subject to a<br />

What does the measure mean – The PGT is co-guardian with the Ministry <strong>of</strong> Children <strong>and</strong> Family<br />
Development (MCFD) for children in continuing care <strong>of</strong> the Province. Designated <strong>of</strong>ficials <strong>of</strong> MCFD are<br />
<strong>Guardian</strong>s <strong>of</strong> Person <strong>of</strong> children in continuing care <strong>and</strong> the PGT is the <strong>Guardian</strong> <strong>of</strong> Estate. As <strong>Guardian</strong><br />
<strong>of</strong> Estate, the PGT must identify outst<strong>and</strong>ing financial entitlements or legal claims <strong>and</strong> bring forward<br />
appropriate legal action. This includes claims for unliquidated damages such as personal injury arising<br />
from abuse, assault or motor vehicle accidents as well as for statutory benefits such as death <strong>of</strong> a parent.<br />
MCFD has implemented automated reporting to the PGT <strong>of</strong> incidents involving children in continuing<br />
care which has significantly increased the number <strong>of</strong> reports that must be reviewed to determine whether<br />
to commence civil legal proceedings on behalf <strong>of</strong> the child.<br />
Why is the measure important – This activity improves the well being <strong>of</strong> children <strong>and</strong> youth in continuing<br />
care <strong>of</strong> the Province by protecting their legal rights while also satisfying PGT legal obligations as fiduciary.<br />
What do the results mean – In <strong>2007</strong>/08, out <strong>of</strong> 633 critical incident reports, 622 (98%) were reviewed <strong>and</strong><br />
action was initiated by the PGT within 60 days <strong>of</strong> receipt <strong>of</strong> the report.<br />
The data – Data is from CASE (PGT case management system) <strong>and</strong> divisional spreadsheets. This is a<br />
new measure in <strong>2007</strong>/08 as these reports were previously included in a measure focused more broadly on<br />
identifying legal claims <strong>and</strong> entitlements <strong>of</strong> all child guardianship clients.<br />
