NOTICE OF REJECTION OF UNEXPIRED NON-RESIDENTIAL REAL<br />

PROPERTY LEASES OF BENNIGAN'S STORE NUMBER 2331<br />

PLEASE BE ADVISED, in accordance with the Court's Order Approving Trustee's<br />

Emergency Motion to Reject Unexpired Leases of Non-Residential Real Property and to<br />

Establish Rejection Procedure [Docket No. 166] (the "Order"), 1 notice is hereby given to the<br />

landlord and subtenant of the Bennigan's store number 2331, at address 2372 Austins Parkway,<br />

Flint, MI 48507-1363 (the "Leased Premises") of the Trustee's proposed rejection of any and all<br />

of the Debtors' 2 lease and sublease pertaining to the Leased Premises (the "Leases"). The<br />

Trustee received an offer by LaBelle Management to reject the Leases in exchange for a cash<br />

payment of $35,000.00 (the "Offer"). The Leases are of no value to the estate and rejecting the<br />

Leases in exchange for the Offer is in the best interest of the Debtors' estates and creditors.<br />

Pursuant to the provisions of the Order, the Trustee's rejection of the Leases shall be<br />

effective as of the date of filing this Notice of Rejection with the Court, unless an objection to<br />

the Trustee's proposed rejection of the Leases is filed with the Court and served on counsel for<br />

the Trustee on or before five (5) business days after the filing date of this Notice of Rejection.<br />

This Notice of Rejection shall only apply to unexpired leases of non-residential real property to<br />

which one of the Debtors is a party.<br />

PLEASE BE FUR<strong>THE</strong>R ADVISED that the Trustee has abandoned the Debtors'<br />

interest, if any, in all personal property, including perishables, physically located at the Leased<br />

Premises. Pursuant to the Order, the automatic stay shall terminate as to any personal property<br />

of the Debtors located on or in the Leased Premises as of the effective date of rejection of the<br />

Leases to permit any party to exercise its rights under federal or state law as to such personal<br />

property.<br />
