social scientists have studied the effects of mandatory m<strong>in</strong>imums and the<br />

crack/powder disparity and have concluded that both have contributed to<br />

racial discrim<strong>in</strong>ation 227 and overcrowd<strong>in</strong>g <strong>in</strong> prisons. 228 Moreover,<br />

studies show harsh drug penalties fall well short of deterr<strong>in</strong>g crime and<br />

are largely counterproductive. 229<br />

Of course, these studies have been around for more than a decade,<br />

and the Commission presented much of this <strong>in</strong>formation to Congress<br />

when it issued its 1995, 1997, and 2002 reports. 230 In the past, much of<br />

this <strong>in</strong>formation was ignored by Congress, but there are reasons to<br />

believe Congress may now be listen<strong>in</strong>g. Dur<strong>in</strong>g the 2007-2008<br />

legislative session, six crack coca<strong>in</strong>e reform bills were <strong>in</strong>troduced. 231<br />

And while most of the proposed legislation appears to be at a standstill,<br />

crime policy is often politically driven and 2008 was a presidential<br />

election year. Perhaps a better <strong>in</strong>dicator of Congress’ will<strong>in</strong>gness to<br />

change is its handl<strong>in</strong>g of the dramatic rise of methamphetam<strong>in</strong>e, which<br />
